CIRCULAR

Issuing the maritime port waters area under the jurisdiction of Thua Thien Hue province and the management area of Thua Thien Hue Maritime Port Office

Pursuant to the Vietnam Maritime Code on November 25, 2015;

Pursuant to Decree No. 12/2017/NĐ-CP dated February 10, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

1. Amending Clause 2 Article 2 as follows:

At the proposal of the Director of the Legal Department and the Director General of the Vietnam Maritime Administration;

The Minister of Transport issues this Circular to announce the maritime port waters area under the jurisdiction of Thua Thien Hue province and the management area of Thua Thien Hue Maritime Port Office.

Article 1. Announcing the maritime port waters area under the jurisdiction of Thua Thien Hue province

The maritime port waters area of Thua Thien Hue province includes:

1. The maritime port waters area of Thua Thien Hue at Thuong An region.

2. The maritime port waters area of Thua Thien Hue at Cham May region.

Article 2. Scope of the maritime port waters area under the jurisdiction of Thua Thien Hue province

1. The scope of the maritime port waters area of Thua Thien Hue at Thuong An region is determined according to the highest tidal level as follows:

a) The boundary towards the sea is limited by straight lines connecting points TA1, TA2, TA3, and TA4 with the following coordinates:

TA1: 16°35’12”N, 107°35’58”E;

TA2: 16°37’30”N, 107°36’07”E;

TA3: 16°37’08”N, 107°39’41”E;

TA4: 16°33’58”N, 107°38’28”E.

b) The boundary towards the mainland runs from point TA4 along the coastline northward and along the shore of Tam Giang Lagoon to point TA5 with coordinates: 16°33’27”N, 107°38’39”E; from point TA5 connected by a straight line to point TA6 with coordinates: 16°33’15”N, 107°38’32”E; from point TA6 running along the shore of Tam Giang Lagoon northward to point TA7 with coordinates: 16°33’12”N, 107°38’22”E; from point TA7 connected by a straight line to point TA8 with coordinates: 16°34’01”N, 107°37’08”E; from point TA8 running along the coastline northward to point TA1.

2. The scope of the maritime port waters area of Thua Thien Hue at Cham May region is determined according to the highest tidal level as follows:

a) The boundary towards the sea is limited by straight lines connecting points CM1, CM2, CM3, and CM4 with the following coordinates:

CM1: 16°20’40”N, 107°57’00”E (West Cham May Cape);

CM2: 16°22’38”N, 107°57’51”E;

CM3: 16°22’38”N, 108°01’54”E;

CM4: 16°20’42”N, 108°01’06”E (East Cham May Cape).

b) The boundary towards the mainland runs from point CM1 along the coast of Cham May Bay southward to point CM4.

4. The boundaries of the maritime port waters area specified in this Circular are determined on Chart Nos. VN50019, VN50020 produced by the Northern Marine Safety Assurance Corporation and published by the Ministry of Transport. The coordinates of the points specified in this Circular are based on the VN-2000 Coordinate System and are converted to the WGS-84 Coordinate System in the Appendix attached to this Circular.

The Director of the Vietnam Maritime Administration shall organize the announcement of pilot reception areas, quarantine zones, anchorage areas, cargo transfer zones, and storm shelters for vessels entering and leaving the Thai Binh seaport, Nam Dinh seaport, and other related water areas as prescribed.

The Director of the Vietnam Maritime Administration shall organize the announcement of pilot reception and delivery areas, quarantine zones, anchorage areas, cargo transfer areas, and storm shelters for vessels entering and leaving the Thua Thien Hue maritime ports and other water areas and zones as prescribed.

Article 4. Responsibilities of the Thua Thien Hue Maritime Port Office

1. Implementing the tasks and powers stipulated in the Vietnam Maritime Code and related regulatory legal documents for maritime activities in the maritime port waters area and maritime zones under the jurisdiction of Thua Thien Hue province.

2. Based on actual conditions regarding weather, waves, draft, vessel load capacity, and cargo characteristics, designate specific locations for vessels to receive and deliver pilots, undergo quarantine, anchor, transfer cargo, and seek shelter from storms within the prescribed waters, ensuring maritime safety, maritime security, maritime labor safety, and environmental pollution prevention.

Article 5. State management responsibilities for maritime affairs in the sea area under the jurisdiction of Thua Thien Hue Province

Outside the water areas specified in Article 2 of this Circular, the Thua Thien Hue Maritime Branch shall be responsible for state management of maritime safety, maritime security, and prevention of environmental pollution in the sea area under the jurisdiction of Thua Thien Hue Province.

Article 6. Effectiveness

This Circular takes effect from February 1, 2019. The Decision No. 40/2007/QD-BGTVT dated August 28, 2007 of the Minister of Transport promulgating the water areas of coastal ports under the jurisdiction of Thua Thien Hue Province and the management area of the Thua Thien Hue Maritime Branch is hereby abolished.

Article 7. Implementation Organization

The Director of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments, the Directors of the Vietnam Maritime Administration, the Directors of the Vietnam Inland Waterways Administration, the Director of the Thua Thien Hue Department of Transport, the Director of the Thua Thien Hue Maritime Branch, and the Heads of relevant agencies, organizations, and individuals are responsible for implementing this Circular./.
