CIRCULAR

Regulations on investment in bus stops, parking areas, and locations, scale of rest stations, bus stops, and parking areas on expressways

On the basis of Pursuant to the proposal of the Director of the Vietnam Expressway Administration; June 27, 2024;

BASED ON THE DECREE NO. 56/2022/ND-CP dated August 24, 2022 of THE GOVERNMENT stipulating the functions, tasks, powers, and organizational structure of THE MINISTRY OF TRANSPORT;

The Minister of Transport issues this Circular detailing Clause 3 and Clause 4, Article 52 of the Road Law, including:

1. Considering and deciding on the investment in bus stops and parking areas on expressways;

Article 1. Scope of Regulation

2. Locations and scales of rest stations, bus stops, and parking areas on expressways.

This Circular applies to organizations and individuals related to decisions on investment in bus stops and parking areas and determination of locations and scales of rest stations, bus stops, and parking areas on expressways.

Article 3. Investment in bus stops and parking areas

Article 2. Applicability

1. During the preparation of feasibility study reports, based on service usage needs and project characteristics, the project preparation unit shall research and propose investment in bus stops and parking areas at the following locations:

a) Areas with natural scenery or scenic spots, historical and cultural relics for tourism development and promotion of local culture;

b) Areas with convenient access roads that do not obstruct visibility, suitable for the nature and conditions of the terrain, geology, and hydrology of the project, ensuring safety during operation.

2. The authority deciding on investment projects for public investment projects or approving projects for public-private partnership projects shall decide on investment in bus stops and parking areas based on the research and proposals of the project preparation unit under Clause 1 of this Article.

Article 4. Location and Scale of Bus Stops and Parking Areas

1. Bus stops and parking areas shall be constructed outside the safe zone of the road.

2. Bus stops and parking areas must have a minimum area of 500 square meters excluding access roads.

Article 5. Components of Facilities at Bus Stops and Parking Areas

1. Bus stops and parking areas include the following components:

a) Access roads;

b) Parking lot surface;

c) Information provision areas, tourist maps, or other audiovisual equipment serving to provide information to traffic participants or promote local tourism.

2. Design requirements for the components under Clause 1 of this Article are as follows:

a) Access roads must comply with national technical standards for branch roads on expressways;

b) The structure of the parking lot surface and information provision areas must be concrete pavement with a minimum thickness of 20 cm or asphalt pavement with a minimum thickness of 7 cm;

c) Traffic lanes within the parking lot must have traffic signs and markings; the turning radius must be at least 10 meters from the centerline of the road, ensuring safe movement of vehicles within the bus stop and parking area;

d) There must be appropriate drainage measures.

Article 6. Location and Scale of Rest Stations

1. Rest stations shall be constructed outside the safe zone of the road as stipulated in Point d, Clause 1, Article 39 of the Road Law.

2. During the preparation of feasibility study reports, the project preparation unit shall research and propose locations and scales of rest stations based on:

a) National technical standards for rest stations and expressways;

c) Investment forms and investment resource balancing capabilities;

d) Terrain, geological conditions, and project characteristics.

2. For rest stations whose locations and scales were approved and decided before the effective date of this Circular, they shall continue to be implemented according to the approved contents./.

d) Topographical, geological conditions and characteristics of the project works.

Article 7. Effective Date

1. This Circular shall take effect from January 1, 2025.

2. For rest stations that have been approved and had their locations and scales determined before this Circular takes effect, they shall continue to be implemented according to the approved contents./.
