JOINT CIRCULAR

Guidelines for implementing Decision No. 292-CT dated

November 17, 1988 of the Chairman of the Council of Ministers

Implementing Decision No. 292-CT dated November 17, 1988 of the Chairman of the Council of Ministers regarding the issuance of sales and service supply receipts (hereinafter referred to as payment receipts); the Ministry of Finance and the General Statistics Office hereby provide the following guidelines:

I.OBJECTS AND SCOPE OF PAYMENT RECEIPT ISSUANCE:

1. All state economic organizations, collective organizations, armed forces units, state agencies, people's organizations, and individual households engaged in production, business, and service activities must issue valid payment receipts whenever selling products, materials, goods, or providing services to customers or collecting money for the state budget in any form. Customers have the right to request valid payment receipts in all cases.

2. In the following cases, if the customer does not request it, the seller or service provider does not need to issue a payment receipt:

a. For the manufacturing sector:

- Individuals engaged in family economy directly bringing their own products to sell retail on the market to consumers.

- Small individual households producing products for direct retail sale on the market.

b. For the transportation sector:

Transportation services using simple means of transport such as bicycles, cyclos, ferries, etc., provided by individual households and individuals engaged in family economy.

c. For the service sector:

- Repair services that do not require warranty, refurbishment, or restoration of consumer products for individuals.

- Services related to daily life such as hair cutting, hair styling, laundry, dyeing, etc.

d. For the trade and catering sector:

- Activities of selling goods on the street, sidewalk, individual households selling tea, snacks.

- Direct retail sales of fresh goods to consumers.

e. Cases where the value of goods sold or services rendered is equivalent to or less than 10 kilograms of rice at local prices for each transaction.

The specific list of activities not requiring the issuance of payment receipts mentioned above shall be determined by the People's Committees of provinces, cities, and centrally-administered municipalities based on point 2 above and according to the actual situation in their respective areas.

Although the cases listed in point 2 above do not require the issuance of payment receipts, state-owned and collective economic units that maintain accounting records must still record and update sales figures and service provision to reflect the full results of their production and business activities in accordance with the national accounting and statistical regulations already issued.

II. AUTHORITY TO ISSUE, MANAGEMENT, AND USE OF PAYMENT RECEIPTS.

1. Valid payment receipts are those issued by the Ministry of Finance and the General Statistics Office or authorized by them.

In cases where industries, units, or economic entities print payment receipts for their own use, state-owned and collective units must follow the models prescribed in the current initial recording systems of the Ministry of Finance and the General Statistics Office; individual households should apply the model attached to this circular. Before use, they must register with the revenue collection agency or tax authority under the financial department directly managing them in accordance with the regulations of the Ministry of Finance. If other types of payment receipts different from the prescribed models are needed, the unit must register the model with the revenue collection agency or tax authority under the financial department.

Payment receipts that do not clearly indicate the elements required in the receipt or do not comply with the above provisions are invalid and will be handled according to the Accounting and Statistics Law.

2. Payment receipts include:

- Sales invoices of various types

- Combined stock withdrawal and transportation vouchers of various types,

- Direct shipment vouchers of various types,

- Receipts or payment vouchers of various types

- Payment tickets of various types.

Payment receipts of state-owned and cooperative production, business, and service units continue to use the existing receipts issued by the General Statistics Office or jointly issued by the General Statistics Office and the relevant industry management departments in the corresponding initial recording systems.

Payment receipts of production, business, and service conglomerates, private enterprises, small household businesses, and individual households, as well as receipts for state budget collections, are issued by the Ministry of Finance.

For "Fine Tickets" and "Penalty Receipts," which are used to impose administrative penalties for violations of the law, they are implemented according to Decision No. 275 TC/PC dated August 31, 1987 of the Ministry of Finance.

For types of tickets such as cultural, artistic, sports performance tickets, catering and service tickets, transportation fare tickets, bicycle parking tickets, etc., the Ministry authorizes relevant departments and entities to define the printing models, but these must be registered with the revenue collection agency or tax authority under the financial department and must contain the following basic information:

- Ticket number

- Collecting entity - date of collection

- Collection purpose

- Amount collected.

3. When delivering products, materials, or goods to customers or collecting money for the state budget, the seller or collector must issue a payment receipt according to the prescribed model and hand it over to the customer. The payment receipt must have a copy or stub.

The payment receipt must be clearly and fully filled out without erasing, overlapping writing, abbreviations, and must have all required signatures and stamps (if applicable). Payment receipts must be managed, preserved, and stored in accordance with the Accounting and Statistics Law.

III. REWARDS AND PENALTIES

Units and individuals who achieve good results and strictly comply with the system of issuing payment receipts will be rewarded. Organizations and individuals violating the provisions of this circular will be subject to penalties depending on the severity and nature of the violation.

The level and form of rewards and penalties are stipulated by the Ministry of Finance in a separate document.

IV. IMPLEMENTATION

1. This circular takes effect from January 1, 1989. All products, materials, and goods must be accompanied by a payment receipt as required when transported on the road, except for the cases specified in point 2, section I.

2. All units and individuals mentioned in point 1, section I must improve and strengthen accounting work to quickly and conveniently issue payment receipts without causing inconvenience or hindrance to production and circulation activities.

Accountants of all production, business, service, administrative, and public institution units shall only accept payment for valid vouchers in accordance with the provisions of this Circular.

Leaders at all levels and heads of institutions must direct and create favorable conditions for institutions and enforcement officers to strictly implement this Circular.

3. Local financial and statistical agencies shall organize guidance on business practices, supervise, and inspect implementation at all levels and sectors.

- Local financial revenue agencies shall coordinate with relevant functional sectors to guide and assist entities in establishing collection vouchers in compliance with the aforementioned regulations, strengthen inspection and control to strictly implement Decision No. 292-CT of the Council of Ministers. Inspection and control of voucher and bookkeeping records shall be conducted only at grassroots production, business, and service units or at transportation hubs, and shall not arbitrarily set up checkpoints along roads that obstruct traffic and impede production and circulation.

This Circular shall be widely disseminated through central and local information and propaganda channels.

In the course of implementation, if there are difficulties or obstacles, they should be promptly reported to the Ministry of Finance and the General Statistics Office for research and resolution.
