THE MINISTER OF PUBLIC SECURITY

Based on the Ordinance on the Protection of State Secrets dated December 28, 2000;

Based on the Decree No. 37/1998/NĐ-CP dated June 9, 1998 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

Pursuant to the Decree No. 33/2002/NĐ-CP dated March 28, 2002 of the Government detailing the implementation of the Ordinance on Protection of State Secrets;

After reaching consensus with the Minister of Commerce,

Pursuant to …;

Article 1. The list of state secrets of Confidential level in the commerce sector includes information within the following scope:

1. Projects on trade policies of the Ministry of Commerce submitted to the Government.

2. Data on total supply and demand for key goods of the State regarding assets and commodity reserves of the commerce sector that have not been published.

3. Plans and measures for managing imports and exports, ensuring balance between supply and demand, and stabilizing the social market that have not been published.

4. Summary reports and current status reports on domestic markets, trade between Vietnam and foreign countries, and activities of representative offices of foreign economic organizations in Vietnam that have not been published.

5. Survey and research data on commercial activities in each region, each country, and each business partner of Vietnam abroad, and information collected from abroad serving economic and trade purposes that have not been published or are yet to be published.

6. Comprehensive price indices and guidance plans for pricing and price adjustments that have not been published.

7. Orders of authorized agencies, plans, and schemes for inspecting serious violations of laws in commercial activities that have not been published.

8. Information and documents about organizations and individuals (including foreigners) suspected of smuggling, purchasing counterfeit goods, or seriously violating management policies and laws in the market, which are under surveillance and investigation.

9. Types of encryption keys used in the application of information technology in the commerce sector. Code names and signals used in communication and directing work in the inspection and supervision of the market.

10. Inventions, patents, scientific research projects, useful solutions, and trade secrets in the commerce sector with significant value in science and technology that have not been published.

11. Complaint letters and inspection files of cases under investigation, verification, or concluded but not yet published.

12. Organizational plans, personnel transfers, arrangements, and cadre planning schemes of the Ministry of Commerce that have not been published or are yet to be published.

Article 2. This Decision shall take effect fifteen days after its publication in the Official Gazette. Competent agencies of the Ministry of Commerce and the Ministry of Public Security are responsible for supervising the implementation of this Decision.

Article 3. Ministries; ministerial-level agencies; government-affiliated agencies; People's Committees of provinces and centrally-administered cities are responsible for implementing this Decision.
