Decision No. 59/2004/QĐ-BNV on approving the amended Statutes of the Vietnam Table Tennis Federation

DECISION

Approves the amended Statutes of the Vietnam Tennis Federation.

THE MINISTER OF THE MINISTRY OF HOME AFFAIRS

Based on Decree No. 102/SL-L004 dated May 20, 1957 on the right to establish Associations;

Pursuant to the Government Decree No. 45/2003/NĐ-CP dated May 9, 2003 on the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

Pursuant to the Government Decree No. 88/2003/NĐ-CP dated July 30, 2003 on the organization, operation, and management of associations;

Considering the proposal of the President of the Vietnam Tennis Federation and the Director of the Department of Non-Governmental Organizations;

DECISION:

Article 1. Approves the amended Statutes of the Vietnam Tennis Federation adopted at the Fourth Term General Assembly held on May 15, 2004.

Article 2. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.

Article 3. The President of the Vietnam Tennis Federation and the Director of the Department of Non-Governmental Organizations shall be responsible for implementing this Decision.

STATUTES OF THE VIETNAM TENNIS FEDERATION(Amended)

PART I

Name of the Association:

Article 1. Name: "Vietnam Tennis Federation" abbreviated as "VTF".

International trade name: VIETNAM TENNIS FEDERATION (abbreviated as VTF).

Article 2. The Vietnam Tennis Federation is a voluntary social organization of officials, coaches, athletes, referees, enthusiasts of tennis, and supporters of tennis activities. It is part of the Vietnamese Olympic Movement, a member of the Asian Tennis Federation (ATF) and the International Tennis Federation (ITF), established pursuant to Decision No. 142-CT dated May 27, 1989 of the Council of Ministers (now the Government) and subject to state management by the Sports Management Committee.

Article 3. The Vietnam Tennis Federation operates with the purpose of promoting, organizing, and guiding the public to participate in training and competition to enhance health, physical fitness, and performance, thereby contributing to the gradual development of the Vietnamese tennis movement to catch up with regional and international standards. To strengthen relations and integration with countries in the region and around the world.

Article 4. The Vietnam Tennis Federation has legal personality, its own seal (both embossed and printed) and a separate account at the Vietnam Bank. It is the sole representative of the country in international sports organizations.

The Vietnam Tennis Federation has its own emblem registered with the national copyright protection agency. Its headquarters is located in Hanoi.

Chapter II

TASKS AND CONTENT OF ACTIVITIES

Article 5. The Vietnam Tennis Federation has the following main tasks:

5.1. Promote education among the public and members of the Federation about the State's policies and directions for the development of the sports industry, the Statutes of the Vietnam Tennis Federation, the Olympic Charter, and the rules of operation of the International Tennis Federation and the Asian Tennis Federation, with the spirit of sports for health and happiness for all people.

5.2. Encourage and assist in organizing and developing tennis organizations at local levels and in various sectors to build and develop tennis widely at all levels and among all groups, paying special attention to young people and children.

5.3. Coordinate with relevant state agencies to perfect the competition system from grassroots to national level. Manage domestic and international competitions. Issue uniformly nationwide regulations on competition and related rules for tennis.

5.4. Propose to the state management agency (Sports Management Committee) regarding: Selection of athletes for the national team, improvement of the training and talent development system for tennis from children to the national team, training and development policies for referees, coaches, and athletes, awarding or demoting athletes, coaches, and referees based on their performance, construction of facilities, equipment, and training and competition gear.

5.5. Develop and implement plans for international cooperation in tennis according to assigned tasks.

5.6. Mobilize resources to contribute to the investment in building technical infrastructure and equipment for tennis. Formulate appropriate plans to attract domestic and foreign sponsorships. Organize economic activities in accordance with the law to generate funds for the Federation.

5.7. Pay attention to and protect the legitimate rights and interests of member organizations and members within the Federation.

5.8. Study and propose the gradual establishment of semi-professional and professional tennis in Vietnam.

Chapter III

ORGANIZATIONAL MEMBERS AND ASSOCIATES

Article 6. Organizations of the Provincial Tennis Federation under the Central Government, clubs that recognize and comply with the regulations of the Federation, pay annual membership fees, and participate in activities may be recognized as official members of the Vietnam Tennis Federation.

Article 7. Vietnamese citizens who agree with the regulations, voluntarily apply for membership, pay annual membership fees, and participate in activities of a member organization of the Federation may be recognized as members of the Vietnam Tennis Federation.

In special cases, individuals who have made significant contributions to the tennis movement in Vietnam may be considered by the Executive Board for recognition as honorary members.

Article 8. The procedure for joining the Vietnam Tennis Federation includes:

Application form for joining the Federation (according to the model).

Other necessary documents (as specified in the application form).

Paying the prescribed fee.

The recognition of a member organization shall be decided by the Executive Board of the Federation at regular or extraordinary meetings.

Article 9. Obligations and rights of member organizations and members

9.1. Obligations:

Strictly comply with the regulations, resolutions, rules, and other provisions of the Federation.

Actively participate in all activities of the Federation. Contribute effectively to the development and improvement of the level of tennis in Vietnam. Pay annual membership fees as prescribed.

Regularly report to the Vietnam Tennis Federation.

9.2. Rights:

Have the right to vote and run for election to leadership bodies at various levels of the Federation.

Participate in discussions and proposals on policies and activity plans of the Federation.

Be rewarded when achieving outstanding results.

Be provided with favorable conditions for learning, training, and competing in tennis.

Be given priority in using facilities and equipment for training and competition of the Federation.

Have the right to request withdrawal from the Federation.

Honorary members may attend meetings of organizations they previously participated in as advisors, without participating in voting and decision-making.

Article 10. Withdrawal from the Federation

If wishing to withdraw from the Vietnam Tennis Federation, member organizations and members must submit an application to the Executive Board of the Federation for consideration and decision in writing.

Before withdrawing from the Federation, member organizations and members must hand over their responsibilities for work, financial assets, and facilities to replacement organizations or individuals.

Chapter IV

PRINCIPLES OF OPERATION AND ORGANIZATION

Article 11. Principles of Operation

The Vietnam Tennis Federation operates on the principle of voluntary democracy, consultation, and majority decision-making. Leadership bodies of the Federation are elected at each level's congress through secret ballot.

The Federation operates on the principle of voluntarism and self-management within the framework of the law, the Federation's regulations, and current state regulations.

Article 12. Organization of the Federation

12.1. Vietnam Tennis Federation

12.2. Provincial Tennis Federations under the Central Government.

12.3. Tennis Clubs

The establishment of Provincial Tennis Federations under the Central Government is decided by the People's Committee of the province or city under the Central Government according to the law.

Article 13. Provincial Tennis Federations under the Central Government elect an Executive Board at their congress; their term of operation follows the term of the Vietnam Tennis Federation. The Executive Board elects a Standing Board including: Chairman, Vice Chairmen, General Secretary to manage the Federation's affairs.

Provincial Tennis Federations under the Central Government, as members of the Vietnam Tennis Federation, must implement the resolutions of the National Congress of the Federation and the annual program of activities of the Executive Board of the Vietnam Tennis Federation.

Article 14. National Congress

The National Congress is the highest authority of the Federation, organized once every five years by the Executive Board to convene the congress: in case two-thirds of the official members request, the Executive Board shall convene an extraordinary congress. The number of delegates attending the congress is determined by the Executive Board. The congress must have at least half of the convened delegates to be valid.

Tasks of the Vietnam Table Tennis Federation Congress:

14.1. Approve the term report on operations and finances of the Federation from the previous term.

14.2. Decide on the direction, tasks, and activity plans for the upcoming term of the Federation.

14.3. Amend or supplement the charter (if necessary).

14.4. Elect the Executive Board of the Federation.

14.5. Approve resolutions, review and decide on major economic and financial issues.

Article 15. The Executive Board of the Federation is elected by the Congress, serving as the leadership body between two Congress terms. The number of members in the Executive Board is decided by the Vietnam Table Tennis Federation Congress. During the term, based on the development needs of members, the Executive Board may be supplemented or replaced but not exceeding one-third of the total number of the Executive Board. The supplementation or removal of Executive Board members must be proposed at regular or extraordinary meetings of the Executive Board and approved by secret ballot.

In the event that an Executive Board member fails to attend two consecutive annual regular meetings without a legitimate reason, they will be automatically removed from the Executive Board.

The Executive Board of the Vietnam Table Tennis Federation has duties and powers:

15.1. Elect the Standing Committee of the Federation including: President, Vice Presidents, General Secretary, Deputy General Secretaries, Head of the Inspection Board, Standing Committee Members, and appoint heads of functional boards of the Federation.

15.2. Develop plans and direct the implementation of Congress resolutions. Fulfill the tasks stipulated in Article 5.

15.3. Convene and organize annual regular meetings of the Executive Board. In case two-thirds of the Executive Board members request, an extraordinary meeting shall be convened.

15.4. Support the development of table tennis movements and build grassroots competition systems.

15.5. Coordinate with state management agencies for physical culture and sports to organize and direct domestic and international competitions in Vietnam.

15.6. Decide on the Federation's financial plan.

15.7. Set membership fees and annual dues.

15.8. Seek solutions to attract domestic and foreign funding sources.

15.9. Decide on rewards and disciplinary actions for member organizations and members.

Article 16. The Standing Committee of the Federation

The Standing Committee is elected by the Executive Board through a secret ballot election principle. The Standing Committee meets once every six months. Extraordinary meetings can be convened upon the request of the Federation President.

Midway through the Congress term, a confidence vote is held for the Standing Committee, and personnel changes may be made if necessary to improve the Standing Committee's performance.

Article 17. Duties and Powers of the Federation's Standing Committee:

17.1. Manage routine work to implement Congress resolutions and resolutions of regular and extraordinary meetings of the Executive Board.

17.2. Prepare content and organize regular and extraordinary meetings of the Executive Board.

17.3. Decide on urgent matters of the Federation.

17.4. Based on Congress resolutions of the Executive Board, formulate short-term and long-term work programs.

Article 18. President, Vice Presidents, General Secretary, and Head of the Inspection Board:

18.1. The President of the Federation has the powers and duties:

To represent the Federation before the law.

To organize the implementation of resolutions of the Congress, the Representative Meeting, and decisions of the Executive Committee and the Standing Committee.

To convene and chair meetings of the Executive Committee of the Federation.

To appoint personnel for the Office, the Federation, and other organizations established by the Federation.

To be responsible to the Executive Committee and all members regarding the activities of the Federation.

18.2. The Vice Presidents assist the President, assigned specific issues by the President, and authorized to manage the work of the Executive Committee in the absence of the President.

18.3. The General Secretary directly manages all activities of the Federation's Office, prepares content for sessions of the Executive Committee and the Standing Committee, regularly reports to the Standing Committee and the Executive Committee on the activities of the Federation, compiles annual reports and term reports of the Central Executive Committee of the Federation, manages assets and finances of the Federation, and is responsible to the Executive Committee and the law for the activities of the Federation's Office.

The Deputy General Secretary assists the General Secretary (if necessary).

18.4. The Inspection Board:

a) The Head of the Federation's Inspection Board is elected from among the members of the Executive Committee by the Executive Committee. The number of Inspection Board members is decided by the Executive Committee.

b) The Federation's Inspection Board assists the Standing Committee in inspecting compliance with the Charter of the Federation, the implementation of resolutions of the Congress and the Executive Committee of the Federation, as well as policies of the Standing Committee.

c) The Inspection Board inspects members' activities to commend and reward them, and at the same time identifies violations of the law when signs appear to promptly correct them.

d) Inspects economic and financial activities of the Federation and its affiliated organizations, examines and resolves complaints.

Article 19. Organizational Structure of the Vietnam Table Tennis Federation:

19.1. The Federation's Office is a specialized administrative organization of the Federation, a permanent body assisting the Standing Committee and the Executive Committee in managing daily operations.

19.2. Functional Boards: Training and Research Board, Development and Competition Organization Board, Fundraising and Finance Board, Inspection Board, and Publicity and International Cooperation Board.

Chapter V

FINANCE AND ASSETS

Article 20. All assets and finances of the Federation are managed uniformly according to current regulations of the State, specific provisions of the Federation's Executive Committee are reported publicly at meetings.

The Standing Committee and the Head of the Fundraising and Finance Board of the Federation are primarily responsible for revenues, expenditures, and settlements.

Article 21. Sources of Financial Revenue of the Federation:

21.1. Membership fees and annual dues of member organizations and members.

21.2. Money and materials donated by members within and outside the Federation.

21.3. Financial support from state management agencies for sports.

21.4. Income from economic activities, services, production, competitions, selling broadcasting rights, selling books and newspapers, marketing, and advertising in accordance with the law.

21.5. Sponsorship funds from economic and social organizations and individuals both domestically and internationally.

21.6. Money and equipment support from international sports organizations.

Article 22. Main expenditures of the Federation:

22.1. Administrative expenses for the office's operations.

22.2. Activities of the congress and the Executive Board.

22.3. Professional development allowances.

22.4. Competition organization and awards.

22.5. Construction and maintenance of technical infrastructure.

22.6. Production and service capital provision.

22.7. Propaganda and education work.

22.8. Salary, allowances, remuneration, insurance, and hardship assistance.

22.9. International activities.

22.10. Other expenditures.

Chapter VI

REWARD AND DISCIPLINE

Article 23. Member organizations and members of the Vietnam Table Tennis Federation who achieve outstanding results in their work shall be commended by the Federation. In special cases, the Federation may propose commendation to the Sports Committee and the State.

Article 24. Member organizations and members of the Vietnam Table Tennis Federation who violate the charter and regulations, thereby damaging the Federation's reputation and honor, shall be subject to disciplinary action depending on the severity of the violation.

Article 25. If member organizations and members violate state laws, they must bear penalties according to the provisions of the law.

Chapter VII

IMPLEMENTING PROVISIONS

Article 26. All member organizations and members of the Vietnam Table Tennis Federation are responsible for strictly implementing the provisions of this charter.

Article 27. Only the National Congress has the right to amend or supplement the charter.

Article 28. This charter consists of seven chapters and twenty-eight articles, which were adopted at the fourth National Congress on May 15, 2004.

The charter only becomes effective upon approval by the competent state authority.
