THE MINISTER OF TRANSPORTATION
Pursuant to the Maritime Code of Vietnam dated June 14, 2005;
WHEREAS, Decree No. 34/2003/NĐ-CP dated April 4, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
At the proposal of the Director of the Department of Science and Technology and the Director of the Vietnam Vehicle Inspection Agency,
DECISION:
Article 1. Attached to this Decision is the "Regulations on maritime safety equipment and marine pollution prevention devices installed on Vietnamese inland waterway vessels."
Article 2. This Decision takes effect from January 1, 2006. All previous regulations contrary to this Decision are hereby abolished.
Article 3. The Director of the Office, the Inspector General of the Ministry, Heads of Departments under the Ministry, the Director of the Vietnam Maritime Administration, Heads of agencies, organizations, and individuals related to this Decision shall be responsible for its implementation./.

Regulations on maritime safety equipment and marine pollution prevention devices installed on Vietnamese inland waterway vessels

PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
Article 1. These regulations stipulate maritime safety equipment and marine pollution prevention devices installed on Vietnamese inland waterway vessels (hereinafter referred to collectively as equipment).
Article 2. These regulations apply to agencies, organizations, and individuals involved in managing and operating vessels that fall into one of the following categories:
a) Vessels with a length of 20 meters or more;
b) Vessels with a total main engine power of 37 kW or more;
c) Passenger vessels, towing vessels, liquid cargo vessels, liquefied gas carriers, dangerous chemical cargo vessels, and other special-purpose vessels regardless of vessel length and total main engine power.
Article 2. Technical requirements and installation requirements for equipment
Clause 1. Technical requirements and installation requirements for equipment shall be implemented according to these regulations.
Clause 2. In cases not covered by these regulations, requirements must be met as specified in TCVN 6259-5:2003 - Fire Prevention, Detection, and Extinguishing Regulations, TCVN 6276:2003 - Marine Pollution Prevention System Regulations for Vessels, and TCVN 6278:2003 - Vessel Safety Equipment Regulations.
Article 3. Explanation of Terms
Terms used in these regulations shall be understood according to TCVN 6259-5:2003 - Fire Prevention, Detection, and Extinguishing Regulations, TCVN 6276:2003 - Marine Pollution Prevention System Regulations for Vessels, and TCVN 6278:2003 - Vessel Safety Equipment Regulations.
Chapter II
LIFE-SAVING EQUIPMENT
Article 4. Life-saving equipment requirements for cargo vessels
Cargo vessels must have the following life-saving equipment:
For cargo vessels less than 85 meters in length, except oil tankers, chemical tankers, and liquefied gas carriers, the following requirements must be met:
a) Vessels under 500 GT must be equipped with floating devices on each side of the vessel sufficient to carry all persons on board;
b) Vessels from 500 GT to less than 1600 GT must be equipped with life rafts on each side of the vessel sufficient to carry all persons on board;
c) Vessels 1600 GT or more, in addition to the requirements set forth in point b, Clause 1, Article 4, must also be equipped with at least one rescue boat on board.
Clause 2. For cargo vessels 85 meters or longer, except oil tankers, chemical tankers, and liquefied gas carriers, the following requirements must be met:
a) One or more lifeboats (which may be open boats) must be positioned on each side of the vessel sufficient to carry all persons on board, including at least one lifeboat meeting the requirements of a rescue boat on board;
b) One or more life rafts must be positioned on each side of the vessel sufficient to carry all persons on board. If life rafts are positioned on an open deck and can easily be moved to any side of the vessel, the number of life rafts on board must be sufficient to carry all persons on board.
Clause 3. The number of lifebuoys and requirements for lifebuoys must comply with the provisions in Section 2.4.2-1 and Section 2.2.2-1 Chapter 2 - TCVN 6278:2003 - Vessel Safety Equipment Regulations.
Clause 4. In addition to the life jackets required for each person on board, additional life jackets must be provided for those on duty and stored in the bridge, control room, or other manned stations.
Clause 5. A minimum of two-line throwing appliances with two launching points.
Clause 6. No requirement to provide swimming suits and anti-exposure suits.
Article 5. Requirements for lifesaving appliances on passenger ships
Passenger ships must have the following lifesaving appliances:
1. Lifesaving appliances for passenger ships under 300 GT must meet the following requirements:
a) For ships operating in restricted waters III, floating devices must be arranged on each side of the ship sufficient to carry 75% of the total number of people on board. When one floating device is lost or damaged, the remaining floating devices must still ensure carrying 100% of the total number of people on board;
b) For ships operating in restricted waters II, life rafts must be arranged on each side of the ship sufficient to carry 75% of the total number of people on board. When one life raft is lost or damaged, the remaining life rafts must still ensure carrying 100% of the total number of people on board;
c) For ships operating in restricted waters I, in addition to the provisions in point b Clause 1 of this Article, at least one rescue boat must be additionally equipped on board.
2. Lifesaving appliances for passenger ships from 300 GT to less than 500 GT must meet the following requirements:
a) For ships operating in restricted waters III, floating devices must be arranged according to the provisions in point a Clause 1 of this Article;
b) For ships operating in restricted waters I and II, in addition to arranging life rafts on each side of the ship sufficient to carry 75% of the total number of people on board, at least one rescue boat must be additionally equipped on board. When one life raft is lost or damaged, the remaining life rafts must still ensure carrying 100% of the total number of people on board.
3. Passenger ships of 500 GT or more must comply with the provisions in 2.3 and Table 2/1 Chapter 2 TCVN 6278:2003 - Safety Equipment Regulations for Seagoing Ships.
4. The number of circular lifebuoys and regulations for circular lifebuoys must comply with the provisions in Section 2.3.2-1 and Section 2.2.2-2 Chapter 2 TCVN 6278:2003 - Safety Equipment Regulations for Seagoing Ships.
5. In addition to the number of life jackets provided for each person on board, an additional 5% of life jackets and 10% of children's life jackets must be provided for the total number of people on board.
6. At least one two-end fire line launching appliance.
7. No requirement to equip swimming suits and anti-exposure suits.
Article 6. Requirements for ships carrying flammable liquid cargo, ships carrying liquefied gas tanks, and ships carrying dangerous chemical tanks.
1. Ships carrying flammable liquid cargo under 500 GT must be equipped according to the provisions in point a Clause 1, Clauses 3, 4, 5, and 6 of Article 4.
2. Ships carrying flammable liquid cargo of 500 GT or more, ships carrying liquefied gas tanks, and ships carrying dangerous chemical tanks must comply with the requirements specified in Section 2.4.1-1 (6), (7), (8) Chapter 2 - TCVN 6278:2003 - Vessel Safety Equipment Regulations.
Chapter III
FIRE PREVENTION, FIRE DETECTION AND FIRE FIGHTING
Article 7. Fire-resistant structure
1. For cargo ships under 1600 GT; ships carrying flammable liquid cargo under 500 GT; passenger ships under 300 GT: high-risk fire service rooms, areas adjacent to living quarters such as engine room compartments and control stations must be separated by watertight bulkheads, decks, and floors made of ship hull construction materials and if covered, must be covered with non-combustible materials.
2. Ships not specified in Clause 1 of this Article must comply with TCVN 6259-5:2003 - Fire Prevention, Detection, and Fighting Regulations.
Article 8. Engine room access doors
Engine room access doors must have a fire-resistant structure equivalent to that of the fire-resistant wall where the door is located. For engine room access doors of type A they must be self-closing and air-tight.
Article 9. Fire pumps
Fire pumps must be equipped according to the following provisions:
1. Ships under 150 GT must have at least one mechanically driven fire pump.
2. Ships from 150 GT to less than 1000 GT must have at least two mechanically driven fire pumps, including one independently driven mechanically driven fire pump.
3. Ships of 1000 GT or more must have at least three fire pumps, including one emergency fire pump and two main mechanically driven fire pumps, including one independently driven mechanically driven fire pump. For ships under 2000 GT, a portable emergency fire pump may be used.
Article 10. Fire nozzles, fire hoses, and fire outlets
Fire nozzles, fire hoses, and fire outlets on ships must be arranged according to the following provisions:
1. Fire nozzles
a) Standard fire nozzles are those with diameters of 12mm, 16mm, 19mm, or close to these diameters. If necessary, fire nozzles with larger diameters may be used.
b) For living quarters and service rooms, fire nozzles with a diameter of 12mm must be used.
c) For engine rooms, fire nozzles must have both mist and jet spray functions.
2. Fire hoses
a) Fire hoses for firefighting must have lengths from 10m to 15m for engine rooms and from 10m to 20m for other compartments and open decks.
b) Ships must be equipped with fire hoses for firefighting as prescribed in Section 10.2.3 - TCVN 6259-5:2003 - Fire Prevention and Extinguishing Regulations, but there is no requirement to equip reserve fire hoses.
3. Fire outlets
a) The number and location of fire outlets must ensure that at least one water jet from a fire outlet connected to a fire hose can reach all parts of the ship.
b) Fire outlets must be located near the entrances and exits of compartments that they are responsible for protecting.
Article 11. Portable fire extinguishers
1. Types of portable fire extinguishers are specified in Chapter 24 - TCVN 6259-5:2003 - Fire Prevention, Detection, and Extinguishing Regulations.
2. The number and arrangement of portable fire extinguishers must comply with the requirements stipulated in Section 10.3.2 - TCVN 6259-5:2003 - Fire Prevention, Detection, and Extinguishing Regulations, but there is no requirement to equip reserve fire extinguisher charges.
Article 12. Firefighting equipment in engine rooms
Engine rooms containing internal combustion engines and fuel oil equipment must be equipped with firefighting systems as follows: A phải được trang bị hệ thống chữa cháy theo quy định sau đây nếu含有内燃机和燃烧装置的设备:
1. Ships under 500 GT.
a) One foam fire extinguisher with a minimum capacity of 45 liters or equivalent;
b) Portable fire extinguishers must be provided so that no point within the engine room is more than 10m away from a portable fire extinguisher, however, the minimum number required for each engine room is two;
c) One set of water fire nozzles, hoses, and outlets in an engine room.
2. Ships from 500 GT to less than 1000 GT, in addition to meeting the requirements stipulated in Clause 1 of this Article, engine rooms must also be equipped with at least one additional set of water fire nozzles, hoses, and outlets.
3. Ships of 1000 GT or more, in addition to meeting the requirements stipulated in Clause 2 of this Article, engine rooms must be equipped with one of the fixed firefighting systems prescribed in Section 10.4.1 - TCVN 6259-5:2003 - Fire Prevention, Detection, and Extinguishing Regulations.
Article 13. Fire control diagrams
1. The language used in fire control diagrams must be Vietnamese.
2. Number of fire control diagrams
a) Ships under 1000 GT must be equipped with one fire control diagram hung on each deck to guide officers and crew members on board.
b) Ships of 1000 GT or more must be equipped with one fire control diagram hung on each deck to guide crew members on board and two sets of fire control diagrams kept in weatherproof boxes marked and placed permanently outside the living area to assist firefighters coming from shore to the ship.
Article 14. Escape breathing apparatus
There is no requirement to equip escape breathing apparatus.
Article 15. Equipment for firefighters
Equipment for firefighters is prescribed as follows:
1. Cargo ships under 500 GT, passenger ships under 300 GT, do not require firefighter equipment sets.
2. Cargo ships of 500 GT or more, passenger ships of 300 GT or more, must be equipped with a minimum of two firefighter equipment sets.
Article 16. Requirements for fire-fighting equipment, fire detection, and firefighting for passenger vessels
Passenger vessels with a gross tonnage of 100 GT or more, in addition to complying with the provisions from Article 7 to Article 15, must also satisfy the following requirements:
1. Fire pumps
a) Passenger vessels with a gross tonnage under 300 GT must be equipped with at least two manually operated fire pumps, one of which must be independently driven.
b) Passenger vessels with a gross tonnage of 300 GT or more must have at least three fire pumps, including one emergency fire pump and two main manually operated fire pumps, one of which must be independently driven.
2. Portable fire extinguishers
Living areas must be equipped with portable fire extinguishers such that no point within the living area is more than 15 meters away from a portable fire extinguisher, however, each deck must have at least two portable fire extinguishers.
Article 17. Fixed fire detection and alarm systems
1. Cargo vessels with a gross tonnage of 1000 GT or more and passenger vessels with a gross tonnage of 300 GT or more must be equipped with fixed fire detection and alarm systems in accordance with the provisions set out in Chapter 7 - TCVN 6259-5:2003 - Fire Prevention, Detection, and Extinguishing Regulations.
2. Cargo vessels with a gross tonnage under 1000 GT and passenger vessels with a gross tonnage under 300 GT must be equipped with manual fire alarm systems. Manual fire alarm devices must be installed at entrances and exits of living areas, control stations, and corridors. Manual fire alarm devices must always be accessible in each deck's corridor so that no location in the corridor is more than 20 meters away from a fire alarm device.
3. There is no requirement to install automatic fire alarm systems.
Article 18. Requirements for fire prevention, fire detection, and firefighting equipment for vessels carrying flammable liquid cargo, liquefied gas carriers, and dangerous chemical tankers
The fire prevention, fire detection, and firefighting equipment of the vessel must meet the requirements specified in TCVN 62569-5:2003 - Fire Prevention, Detection, and Extinguishing Regulations.
Chapter IV
WIRELESS EQUIPMENT AND NAVIGATION EQUIPMENT
Article 19. Equipment standards

Chapter V
FIRE PREVENTION EQUIPMENT FOR MARINE ENVIRONMENT PROTECTION
OF THE VESSEL
Article 20. Oil Pollution Prevention Equipment from Engine Rooms
Ships shall be equipped with oil filtering systems as follows:
1. Cargo ships and passenger ships under 1000 GT, and oil tankers under 400 GT are not required to be equipped with oil filtering systems.
2. Cargo ships and passenger ships from 1000 GT to less than 10000 GT, and oil tankers from 400 GT to less than 10000 GT must be equipped with oil filtering systems ensuring that any oil-water mixture passing through the system contains no more than 15 parts per million of oil.
3. Ships of 10000 GT and above must be equipped with oil filtering systems as stipulated in Clause 2 of this Article, and such oil filtering equipment must have light and sound signals and automatically shut off when the oil content in the effluent exceeds 15 parts per million./.
