List of State Secrets

of Top Secret and Very Top Secret Levels for the Finance Sector

Based on the Law on the Organization of the Government dated December 25, 2001;

Pursuant to the Ordinance on Protecting State Secrets dated December 28, 2000;

Pursuant to the Decree No. 33/2002/NĐ-CP dated March 28, 2002 of the Government detailing the implementation of the Ordinance on Protection of State Secrets;

Pursuant to the proposal of the Minister of Finance and the Minister of Public Security;

The Prime Minister issues this Decision on the list of State Secrets of Top Secret and Very Top Secret levels for the Finance Sector.

Article 1. The list of State Secrets of Top Secret level for the Finance Sector includes documents and data within the following scope:

1. Documents and data submitted to the Politburo, the Secretariat, the National Assembly, the Standing Committee of the National Assembly, the Government, and the Prime Minister for reporting or requesting guidance on policies for drafting the state budget for national defense, security, foreign affairs, and state reserves.

2. Documents and data on personnel strength, specialized assets serving national defense, security, and foreign affairs; detailed figures on the state budget allocation and settlement for national defense, national security, and foreign affairs.

3. Special important directives and instructions of the Party and the State on financial matters that have not been or will not be disclosed.

4. Information on the national financial reserve (gold, silver, precious stones, rare metals, foreign currency) that has not been or will not be disclosed.

5. Guidance opinions of Party and State leaders on special budgets for national defense (national defense strategy), national security, and foreign affairs.

6. Budget plans of the state being submitted to competent authorities in cases of significant overall and structural changes in the budget.

7. Reports and other documents using information and materials classified as Top Secret from other agencies and organizations.

Article 2. The list of State Secrets of Very Top Secret level for the finance sector includes documents and data within the following scope:

1. Documents and data on foreign loans and aid to Vietnam in the field of national security and defense that have not been or will not be disclosed.

2. Long-term plans for national reserves, absolute figures on stockpiles of various types of state reserves.

3. Network systems, secret facilities; files and documents related to secret networks and facilities; data on technical surveillance equipment of customs authorities.

4. Information on the export and import of weapons and equipment aimed at protecting interests, sovereignty, and national security.

5. News, documents, and plans for exchanges and coordination between securities market management and supervision agencies with relevant sectors significantly affecting securities market activities and economic and social operations or related to international commitments requiring confidentiality that have not been or will not be disclosed.

6. Reports and other documents using information and materials classified as Very Top Secret from other agencies and organizations.

Article 3. Effectiveness

This Decision takes effect from November 30, 2013, and replaces Decision No. 124/2009/QD-TTg dated October 19, 2009, of the Prime Minister on the list of State Secrets of Top Secret and Very Top Secret levels for the Finance Sector.

Article 4. Responsibility for Implementation

1. The Minister of Finance and the Minister of Public Security shall be responsible for guiding and supervising the implementation of this Decision.

2. Ministers, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairmen of People's Committees of provinces and centrally governed cities shall be responsible for implementing this Decision./.
