Based on the Road Traffic Law dated 13 months 11 BASED ON THE CIVIL SERVANT LAW ON JANUARY 1,

Chapter I

GENERAL PROVISIONS

Article 1.perioda) Clause 1 Article 15 regarding accountability;

This Circular provides for the establishment and operation of Motor Vehicle Inspection Centers.

Article 2. Applicability

This Circular applies to organizations and individuals related to the establishment of Motor Vehicle Inspection Centers and the inspection of the safety and environmental protection of motor vehicles.

Article 3. DefinitionsPlan for handling assets after the expiration of the joint venture and association period language

In this Circular, the following terms are understood as follows:

1. Motor Vehicle Inspection Center (hereinafter referred to as the Center) is a unit providing services for the inspection of the safety and environmental protection of motor vehicles in circulation.

2. Inspection of the safety and environmental protection of motor vehicles (hereinafter referred to as inspection) is the periodic examination and evaluation of the safety and environmental conditions of motor vehicles to certify that motor vehicles meet the conditions to participate in traffic.

Inspection stamp is the form of certificates, inspection labels, and vehicle record sheets uniformly issued and managed by the Vietnam Motor Vehicle Inspection Center.

 

Chapter II

PROVISIONS ON THE ESTABLISHMENT

OF MOTOR VEHICLE INSPECTION CENTERS

Article 4. Conditions for establishing the Center

Organizations and individuals may register to establish the Center if they satisfy the following conditions:

a) The Center is consistent with the Master Plan of the System of Motor Vehicle Inspection Centers approved by the Minister of Transport;

b) Ensuring all conditions required for Motor Vehicle Inspection Centers as stipulated by the Ministry of Transport;

c) Receiving approval from the People's Committee of the province or centrally governed city regarding the location for constructing the Center.

Article 5. Documents for registering the establishment of the Center

The documents for registering the establishment of the Center include:

1. A registration document for establishing the Center.

2. An approval document from the People's Committee of the province or centrally governed city regarding the location for constructing the Center.

3. A project for establishing the Center, which clearly demonstrates the capacity in land, capital, human resources, inspection equipment, information, fire prevention and fighting, environmental impact, and operating time.

Article 6. Procedures and formalities for registering the establishment of the Center

1. Organizations and individuals wishing to register to establish the Center shall submit one set of documents as prescribed in Article 5 of this Circular directly or through postal service to the Vietnam Motor Vehicle Inspection Center.

2. The Vietnam Motor Vehicle Inspection Center will accept the documents and review them; in case additional documents are needed, the Vietnam Motor Vehicle Inspection Center must notify in writing within two working days from the date of receipt of the documents the contents that need to be supplemented to the organization or individual.

Within a period not exceeding seven working days from the date of receiving complete documents as prescribed, the Vietnam Motor Vehicle Inspection Center will review, compare with regulations, and notify the result in writing whether the requirements are met or not. In case the requirements are not met, the reasons must be specified.

3. If the documents meet the requirements, the Vietnam Motor Vehicle Inspection Center will conduct an on-site inspection of the location, floor area, and road access in the construction area of the Center. The inspection will be completed within ten working days from the date of notification that the documents meet the requirements.

4. Within a period not exceeding ten working days from the date of inspection, the Vietnam Motor Vehicle Inspection Center must notify in writing the approval (if the inspection results meet the requirements) or disapproval (if the inspection results do not meet the requirements). The disapproval notice must specify the reasons for the organization or individual to rectify. The approval notice will expire six months from the date of signature if the organization or individual does not commence investment in constructing the Center.

Article 7. Issuance of the Certificate for Vehicle Inspection Activities.i

1. After completing the establishment of technical facilities, organizations and individuals shall submit one set of application documents for the issuance of the Certificate for Vehicle Inspection Activities, which shall include:

a) An application form for inspection and issuance of the Certificate for Vehicle Inspection Activities according to the model specified in Appendix I of this Circular;

b) A list of job titles at the Inspection Center and relevant certificates and diplomas (certified copies);

c) A list of inspection equipment, testing tools, information devices, data transmission equipment, and other equipment as prescribed in Circular No. 11/2009/TT-BGTVT dated June 24, 2009 of the Minister of Transport on conditions for motor vehicle inspection centers;

d) The completed floor plan of the Inspection Center (photocopies);

đ) Business registration certificate for enterprises or establishment decision for public institutions (certified copies or photocopies with original documents for verification);

"2. Implementation procedures:"

a) Organizations and individuals shall submit one set of application documents for the issuance of the Certificate for Vehicle Inspection Activities to the Vietnam Motor Vehicle Inspection Agency.

b) The Vietnam Motor Vehicle Inspection Agency shall accept the application and review it; in cases where additional information is required, the Agency must notify the organization or individual in writing within two working days from the date of receipt of the application about the necessary supplements.

Within ten working days from the date of receiving a complete application as stipulated, the Vietnam Motor Vehicle Inspection Agency shall review and compare with regulations, and notify the organization or individual in writing of the result as either pass or fail. In case of failure, the reasons must be clearly stated and the completion of the application is required.

c) If the application meets the requirements, the Vietnam Motor Vehicle Inspection Agency shall notify the organization or individual of the actual inspection time at the construction site of the Center. The inspection period shall be within ten working days from the date of notification that the application has been accepted.

d) The Vietnam Motor Vehicle Inspection Agency shall conduct the inspection at the notified time. The results of the inspection and evaluation shall be recorded in the Summary Report of Initial/Annual Inspection and Evaluation Results according to the model specified in Appendix II of this Circular, and the Certificate for Vehicle Inspection Activities according to the model specified in Appendix III of this Circular shall be issued to the Center within ten working days from the end of the successful inspection. If the inspection does not meet the requirements, the Agency shall notify the organization or individual in writing within five working days to rectify and re-inspect.

3. Implementation method: Organizations and individuals may submit applications and collect results directly at the office of the Vietnam Motor Vehicle Inspection Agency or through postal services.

4. Annually, the Vietnam Motor Vehicle Inspection Agency shall conduct inspections and evaluations of the maintenance of operational conditions of the Center as prescribed. The inspection and evaluation procedures are as follows:

a) The Center shall submit reports on the maintenance of operational conditions according to the contents specified in Sections 1, 2, 3, 4, 5, and 7 of Appendix II of this Circular via postal service or directly to the Vietnam Motor Vehicle Inspection Agency at least thirty days before the expiration of the Certificate for Vehicle Inspection Activities.

b) The Vietnam Motor Vehicle Inspection Agency shall accept the report, notify the time, and organize inspections and evaluations of the maintenance of operational conditions of the Center. The inspection and evaluation must be completed ten days prior to the expiration of the Certificate for Vehicle Inspection Activities.

c) The results of the inspection and evaluation shall be recorded in the Summary Report of Initial/Annual Inspection and Evaluation Results according to the model specified in Appendix II of this Circular and shall be notified to the Center within five days from the end of the inspection and evaluation.

d) If the results meet the requirements, the Vietnam Motor Vehicle Inspection Agency shall issue the Certificate for Vehicle Inspection Activities according to the model specified in Appendix III of this Circular within ten working days from the end of the successful inspection. If the results do not meet the requirements, the organization or enterprise must rectify the non-compliant items so that the Vietnam Motor Vehicle Inspection Agency can organize another inspection and evaluation.

5. The validity period of the Certificate for Vehicle Inspection Activities issued to the Center is one year.

Chapter III

VEHICLE INSPECTION ACTIVITY

Article 8. Responsibilities of the Center in inspection activities

1. Conducting inspections of motor vehicles, acceptance of motor vehicle modifications, checking specialized equipment installed on motor vehicles, and inspecting dedicated motorcycles to issue Safety Technical and Environmental Protection Certificates, the Head of the Inspection Unit and the person directly conducting the inspection shall be responsible under the law for the results of the inspection.

2. Inspecting, maintaining, repairing, and ensuring the accuracy of inspection equipment between inspection periods according to regulations.

3. Publicly posting at the waiting room for inspection procedures the contents: process, regulations, fees, inspection time on the day, and hotline number.

4. Announcing publicly the suspension and duration of suspension or cessation of inspection at the Center's headquarters.

5. Preparing records when encountering objective incidents that require suspending inspection operations for more than one working day and reporting to the Vietnam Vehicle Registration Agency, the Department of Transport at the local level.

6. Participating in appraising accidents related to the technical safety of motor vehicles upon request from competent authorities, determining causes, and recommending preventive measures.

7. Implementing other technical consulting services as prescribed; implementing scientific research topics and participating in other related activities upon request from state management agencies.

8. Adhering to supervision, inspection, and monitoring by competent authorities.

9. Within the latest 18 months from the date of receiving the Certificate of Operation for Motor Vehicle Inspection, must have a certificate applying the ISO 9001 quality management system.

Article 9. Rights of the Center

1. Collecting and using fees and charges as prescribed.

2. Refusing to conduct inspections when motor vehicles do not meet specified conditions.

3. Revoking Safety Technical and Environmental Protection Certificates and Inspection Stamps according to regulations.

4. Requesting law enforcement agencies to handle acts obstructing the Center’s activities.

Article 10. Prohibited Behaviors in Motor Vehicle Inspectioni

1. Incomplete or incorrect inspection content, procedure, or regulations.

2. Conducting inspections with inaccurate testing equipment; when internal computer networks are damaged; conducting inspections outside the chain contrary to regulations.

3. Arrange personnel to perform inspection tasks contrary to regulations.

4. Forcing vehicle owners to repair or maintain their vehicles at designated repair and maintenance facilities.

5. Charge fees and levies incorrectly; engage in corrupt practices, harassment, and accept money or gifts in any form.

6. Inspecting and issuing Certificates to motor vehicles beyond their service life; inspecting when there is a document requesting non-inspection from authorized state management agencies or vehicles with violations warned in the Inspection Management Program.

7. Creating false files for vehicles. Using inspection stamps not issued by the Vietnam Vehicle Registration Agency.

Article 11. Supervision and Monitoring of Inspection ActivitiesJune 2024;1. The Head of the Center is responsible for regularly self-inspecting the Center's activities according to current technical standards, procedures, and regulations.

2. The Center is subject to regular inspections, sudden specialized inspections, and monitoring mechanisms for inspection activities by competent authorities as prescribed.

3. When the competent authority discovers violations in the Center's inspection activities, they must prepare a record, clearly stating the violation, severity, time to rectify, and send it to the Vietnam Vehicle Registration Agency for consideration and handling.

4. The Center will be suspended from operations for one month if any of the following violations occur:This Resolution takes effect from the date it is adopted by the National Assembly.Water, Ice

a) Violating regulations regarding the Center's conditions.

b) Twice violating any of the behaviors stipulated in Clauses 1, 2, and 3 of Article 10 of this Circular within six months or violating any of Clauses 4, 5, 6, and 7 of Article 10 of this Circular.

5. The Center will be suspended from operations for three months if any of the following violations occur:

a) Twice violating any of Clauses 4, 5, 6, and 7 of Article 10 of this Circular within twelve months.

b) Violating prohibited behaviors stipulated in Article 10 of this Circular leading to a second one-month suspension within twelve months.

6. When the Center is suspended from inspection operations for a period, the Vietnam Vehicle Registration Agency is responsible for:

a) Issuing a decision to suspend the Center's inspection operations for a period; inventorying and sealing inspection stamps at the time of announcing the suspension decision.

b) Announcing the Center's suspension period on the Vietnam Vehicle Registration Agency's website and requiring the Center to guide customers at the suspended location.

c) Checking and evaluating the Center's rectification of violations after the suspension period ends to resume operations. The Center can only resume operations after being evaluated as having completed rectification of violations.

d) Reporting to the Ministry of Transport and notifying the local Department of Transport.

c) Inspect and assess the rectification of violations by the Center after the suspension period has ended to resume its operations. The Center may only resume operations once it has been evaluated as having fully rectified all violations.

d) Report to the Ministry of Transport and notify the local Department of Transport.

Article 13. Revocation of the Certificate of Operation for Inspection

1. The Center shall have its Certificate of Operation for Inspection revoked when:

a) It fails to remedy violations concerning conditions for the Center within six months.

b) It commits prohibited acts as stipulated in Article 10 of this Circular leading to a second suspension for three months within a twelve-month period.

2. When the Certificate of Operation for Inspection of motor vehicles has been revoked, the head of the Center and the person directly conducting the inspection shall still be responsible for motor vehicles for which valid inspection certificates were issued by the Center.

3. Organizations or individuals establishing a Center whose Certificate of Operation for Inspection has been revoked shall not be allowed to operate in the field of motor vehicle inspection for a minimum of five years. If they wish to resume operations, organizations or individuals must submit new establishment documentation according to the required procedures.

4. When the Center's violation reaches the level requiring revocation of the Certificate of Operation for Inspection of motor vehicles, the Vietnam Motor Vehicle Inspection Agency shall be responsible for:

a) Revoking the Certificate of Operation for Inspection of motor vehicles. Announcing the cessation of operations on the Vietnam Motor Vehicle Inspection Agency’s website and requiring the Center to publicly notify customers of the suspension.

b) Ceasing the issuance of inspection stamps, recovering unused stamps, damaged stamps, and stored inspection records up until the date of revocation of the Certificate of Operation for Inspection of motor vehicles.

c) Reporting to the Ministry of Transport and notifying the local Department of Transport.

Article 14. Suspension of Inspection Activities at the Center

1. Organizations or individuals wishing to cease inspection activities must send a written notice to the local Department of Transport, the Vietnam Motor Vehicle Inspection Agency, and announce it at the Center three months before ceasing operations.

2. The Vietnam Motor Vehicle Inspection Agency shall be responsible for revoking the Certificate of Operation for Inspection and inspection stamps; guiding the Center in transferring stored files and inspection data, and announcing this on the Vietnam Motor Vehicle Inspection Agency’s website.

3. After ceasing operations, the head of the Center and the person directly conducting the inspection shall still be responsible for motor vehicles for which valid inspection certificates were issued by the Center.

4. Organizations or individuals involved must continue to fulfill other obligations and responsibilities as prescribed.

 

 

Chapter IV

IMPLEMENTATION

Article 15. Responsibilities of the Vietnam Motor Vehicle Inspection Agency

1. The Director of the Vietnam Motor Vehicle Inspection Agency shall be responsible for organizing guidance, inspection, and supervision of the implementation of this Circular's provisions.

2. Adjusting and updating the planning of the Inspection Center System in accordance with actual circumstances and submitting it to the Minister of Transport for promulgation prior to the effective date of this Circular.

3. Regularly reporting to the Ministry of Transport twice a year in June and December on the establishment and operation of Centers.

Article 16. Responsibilities of the Department of Transporth duties of the Department of Transport"Article 7. Specific Prices for Using Road Services

The Director of the Department of Transport of provinces and centrally governed cities shall be responsible for state management within their jurisdiction over Inspection Centers in their locality.

Article 17. Effective Date

1. This Circular takes effect from April 1, 2014.

2. Abolish the following consolidated documents:

a) Decision No. 45/2005/QD-BGTVT dated September 23, 2005 of the Minister of Transport regarding conditions for establishment and operation of Motor Vehicle Inspection Centers.

b) Clause 2 of Circular No. 37/2011/TT-BGTVT dated May 6, 2011 of the Minister of Transport amending and supplementing certain clauses of the Regulation on the modification of road traffic vehicles, issued together with Decision No. 15/2005/QD-BGTVT dated February 15, 2005, the Regulation on conditions for establishment and operation of Motor Vehicle Inspection Centers issued together with Decision No. 45/2005/QD-BGTVT dated September 23, 2005, Circular No. 10/2009/TT-BGTVT dated June 24, 2009 on technical safety inspections and environmental protection of road traffic vehicles, and Circular No. 22/2009/TT-BGTVT dated October 6, 2009 on procedures for technical safety inspections and environmental protection of road traffic vehicles of the Minister of Transport.

Article 18. The Head of the Ministry's Office, the Inspector General of the Ministry, the Heads of the Departments, the Director of the Vietnam Vehicle Inspection Agency, the Directors of the Transport Departments of the provinces and centrally governed cities, the Heads of agencies, organizations, and individuals related to this matter shall be responsible for implementing this Circular./., amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP The Head of the Office of the Ministry, the Inspector General of the Ministry, the Heads of Departments, the Director of the Vietnam Highway Corporation, the Directors of Provincial Department of Transport under central cities and provinces, the Heads of agencies, organizations and individuals related shall be responsible for implementing this Circular.

The Head of the Ministry's Office, the Inspector General of the Ministry, the Heads of relevant Departments, the Director of the Vietnam Vehicle Inspection Agency, the Directors of the Departments of Transport of provinces and centrally governed cities, the Heads of related agencies, organizations, and individuals shall be responsible for implementing this Circular./.
