CIRCULAR

Regulations on the List of State Secrets of Confidential Level for the Labor - War Invalids and Social Affairs Sector

Confidential Level of the Labor - War Invalids and Social Affairs Sector

Pursuant to the Ordinance on Protection of State Secrets dated December 28, 2000;

Pursuant to the Decree No. 33/2002/NĐ-CP dated March 28, 2002 of the Government detailing the implementation of the Ordinance on Protection of State Secrets;

Pursuant to the Decree No. 77/2009/NĐ-CP dated September 15, 2009 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

Pursuant to the Decree No. 21/2014/NĐ-CP dated March 25, 2014 of the Government amending Article 3 of the Decree No. 77/2009/NĐ-CP dated September 15, 2009 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

After reaching consensus with the Minister of Labor - War Invalids and Social Affairs, the Ministry of Public Security promulgates the List of State Secrets of Confidential Level for the Labor - War Invalids and Social Affairs Sector.

Article 1. The List of State Secrets of Confidential Level for the Labor - War Invalids and Social Affairs Sector includes information within the following scope:

1. Plans and contents of negotiations with other countries and international organizations regarding cooperation in labor and experts, children, not yet published; complex situations concerning Vietnamese labor abroad related to foreign affairs not yet published.

2. Contents of cooperation with foreign countries related to the labor, war invalids, and social affairs sectors not yet published or not to be published (except for information and documents already classified as Top Secret).

3. Reports on foreign nationals working in Vietnam not yet published.

4. Periodic work reports and special topic reports of the Labor - War Invalids and Social Affairs sector not yet published.

5. Indicators, plans, and investment budgets in the Labor - War Invalids and Social Affairs sector not yet published.

6. Proposals for salary reform policies, social insurance, and preferential allowances for those who have rendered meritorious service not yet published.

7. Survey and investigation data on labor, employment, and salaries not yet published.

8. Data on strikes occurring annually not yet published.

9. Documentation on the national database of the labor market not yet published.

10. Information, documents, survey results, and evaluations on the current status of children's rights and special measures to protect and care for children not yet published.

11. Projects and documentation funded by foreign countries and international organizations not yet published.

12. Information, documents, survey results, and evaluations on the current status of social evils and special measures to address them not yet published.

13. Information, documents, survey results, and evaluations on gender equality and measures to ensure it not yet published.

14. Absolute figures on gender composition and ratios not yet published.

15. Files and documents under inspection, inspection results, and resolution of complaints and denunciations related to issues listed in the List of State Secrets of the Labor - War Invalids and Social Affairs sector not yet published; documents on political and internal matters of the Labor - War Invalids and Social Affairs sector not yet published.

16. Information, documents, and files on handling officials related to internal political security work in the Labor - War Invalids and Social Affairs sector; personnel files of leaders at the department level (equivalent) and above; planning, rotation, training of key officials, successors, and potential candidates in the Labor - War Invalids and Social Affairs sector not yet published.

Article 2. Effective Date

This Circular takes effect from December 31, 2014, replacing Decision No. 410/2004/QĐ-BCA(A11) dated May 5, 2004 of the Minister of Public Security.

Provisions related to children in Decision No. 214/2006/QĐ-BCA(A11) dated March 24, 2006 of the Ministry of Public Security on the List of State Secrets of Confidential Level for the Population, Family, and Children Commission that conflict with this Circular are abolished.

Article 3. Responsibility for Implementation

1. The Ministry of Labor - War Invalids and Social Affairs and the Ministry of Public Security shall be responsible for inspecting and guiding the implementation of this Circular.

2. Ministries, ministerial-level agencies, agencies under the Government; People's Committees of provinces and centrally governed cities shall be responsible for implementing this Circular./.
