CIRCULAR

GUIDELINES ON THE STICKING OF ENERGY LABELS FOR MOTORCYCLES AND BICYCLE VEHICLES PRODUCED, ASSEMBLED, AND IMPORTED

Pursuant to the Law on Rational and Efficient Energy Use dated June 17, 2010;

Pursuant to Decree No. 21/2011/NĐ-CP dated March 29, 2011 of the Government detailing and providing implementation measures for the Law on Rational and Efficient Energy Use;

Pursuant to Decree No. 12/2017/NĐ-CP dated February 10, 2017, issued by the Government on the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Pursuant to Decision No. 04/2017/QĐ-TTg dated March 9, 2017 of the Prime Minister stipulating the list of equipment and vehicles required to have energy labels affixed, minimum energy performance levels, and implementation timelines;

At the proposal of the Director of the Department of Environment and the Director of the Vietnam Vehicle Inspection Agency;

The Minister of Transport hereby issues this Circular. guidance the sticking of energy labels for motorcycles and bicycle vehicles produced, assembled, and imported.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

Article 1. This Circular guides the sticking of energy labels for motorcycles and bicycle vehicles (hereinafter referred to as "vehicles") newly produced, assembled, or imported without prior use.

Article 2. This Circular does not apply to

a) Vehicles produced, assembled, or imported for direct use in national defense and security purposes by the Ministry of National Defense and the Ministry of Public Security;

b) Temporarily imported and re-exported vehicles; transit vehicles; vehicles of diplomatic and consular missions;

c) Imported vehicles not for business purposes;

đ) Vehicles imported according to special regulations of the Prime Minister;

d) Vehicles using fuels other than gasoline, diesel, liquefied petroleum gas (LPG), or natural gas (NG).

Article 2. Applicability

This Circular applies to organizations related to the production, assembly, importation, and sale of vehicles; organizations related to testing fuel consumption and monitoring the implementation of vehicle energy label sticking.

Article 3. Explanation of Terms

Some terms defined in this Circular are understood as follows:

1. The energy label of a vehicle (hereinafter referred to as "energy label") provides information related to the type of fuel used and the vehicle's fuel consumption level.

2. Fuel consumption level of (Certificate No.) the vehicle (fuel consumption level) is the amount of fuel consumed by the vehicle over a specified distance and test cycle. The unit of measurement for fuel consumption is liters (l)/100 kilometers (km) (for gasoline, LPG, and diesel) or cubic meters (m³)/100 kilometers (km) (for NG).3­)/100 kilometers (km) (for fuel type NG).

3. Motorcycles and bicycle vehicles are defined in Section 1.3.1 and Section 1.3.2 of the National Technical Regulation on Quality, Safety, and Environmental Protection for Motorcycles and Bicycle Vehicles - QCVN 14:2015/BGTVT issued by the Minister of Transport.

4. Vehicle model is defined in the following documents:

a) Section 1.3.3 of the National Technical Regulation on Exhaust Emissions from Motorcycles and Bicycle Vehicles Produced, Assembled, and Newly Imported - QCVN 04:2009/BGTVT issued by the Minister of Transport (hereinafter referred to as QCVN 04:2009/BGTVT);

b) Section 1.3.2 of the National Technical Regulation on Exhaust Emissions Level 3 for Two-Wheeled Motorcycles Produced, Assembled, and Newly Imported - QCVN 77:2014/BGTVT issued by the Minister of Transport (hereinafter referred to as QCVN 77:2014/BGTVT).

5. Quality Management Agency (hereinafter referred to as the supervisory authority) is the Vietnam Vehicle Inspection Center under the Ministry of Transport.

6. Production and assembly facility is an organization producing and assembling vehicles (hereinafter referred to as the production facility) established and operating in accordance with the law.

7. Import establishment is an organization conducting vehicle imports.

8. Vehicle sales facility is an organization selling and distributing vehicles to the market.

9. Fuel consumption testing facility, fuel consumption testing laboratory (hereinafter referred to as the testing facility) is a specialized testing organization meeting the conditions stipulated in Article 5 of Decree No. 107/2016/NĐ-CP dated July 1, 2016 of the Government on the conditions for operating conformity assessment services or recognized by mutual recognition agreements (International Laboratory Accreditation Cooperation (ILAC), Asia Pacific Laboratory Accreditation Cooperation (APLAC)); having machinery, equipment, and tools suitable for the testing field prescribed in one of the following technical regulations: QCVN 04:2009/BGTVT; QCVN 77:2014/BGTVT.

Chapter II

TESTING FUEL CONSUMPTION LEVEL

Article 4. Fuel Consumption Testing

1. The results of fuel consumption testing shall be used as the basis for publicly disclosing fuel consumption levels.

2. Fuel consumption testing may be conducted independently or in conjunction with exhaust emission testing.

In cases where it is conducted in conjunction with exhaust emission testing, the value of fuel consumption is calculated according to the carbon balance calculation method specified in Form No. 01 of the Appendix issued together with this Circular.3. Requirements for fuel consumption testing

a) Two-wheeled motorcycles shall be tested according to the cycle of Type I exhaust emission test as stipulated in QCVN 77:2014/BGTVT

b) Motorcycles (excluding two-wheeled motorcycles) and motorized vehicles shall be tested according to the cycle of Type I exhaust emission test as stipulated in QCVN 04:2009/BGTVT;

c) For vehicle types with new structures and technologies not yet regulated by QCVN 77:2014/BGTVT and QCVN 04:2009/BGTVT, fuel consumption testing shall be carried out according to the corresponding UNECE, EC, EEC standards and regulations.;

Article 5. Content of Test Report.

1. The test report on fuel consumption test results (hereinafter referred to as the test report) issued by the testing facility for registered vehicles shall include the following contents.

For vehicles that meet the conditions for expanded recognition of exhaust emission test results as provided for in Section 3.6 of QCVN 77:2014/BGTVT or Section 3.7 of QCVN 04:2009/BGTVT, the fuel consumption results of such vehicle types may be used. for PUBLIC DISCLOSURE OF FUEL CONSUMPTION INFORMATION AND ENERGY LABELING testing Article 6. Public Disclosure of Fuel Consumption Information d) Determine the average monthly business travel distance of the position Form No. 02 the format attached as the Appendix to this Circular.

1. Production and import entities must disclose information about fuel consumption levels as prescribed before implementing energy labeling..

Chapter III

Production and import entities base their disclosure of fuel consumption information on the test reports stipulated in Article 5 of this Circular.

The disclosed fuel consumption level must not be less than 4% lower than the average measurement result recorded in the test report.

The public disclosure of fuel consumption levels for vehicle types is made according to the form specified in Form No. 03 of the Appendix issued together with this Circular.

2.  For imported vehicles of the same type as those already disclosed for fuel consumption levels, import entities are permitted to use the disclosed fuel consumption values for registration without having to conduct fuel consumption testing. Disclosure of information related to fuel consumption levels shall be made through the following methods: a) Sending the public disclosure of fuel consumption levels for vehicle types to the management agency to be disclosed on the management agency's electronic information website; b) Publishing fuel consumption levels on the electronic information website of production, import, and sales entities (if applicable). 4. Disclosed information must be maintained throughout the period during which production, import, and sales entities supply such vehicle types to the market.. Article 7. Energy Labeling

1. Production and import entities print energy labels according to the model prescribed by the Ministry of Industry and Trade. use 2. After sending the disclosed information to the management agency, production and import entities implement energy labeling.

before releasing them to the market. Energy labels must be maintained on the vehicles by production, import, and sales entities until the vehicles are delivered to consumers.

b) Publish the fuel consumption rate on the electronic information page of the production, import, and business entity of vehicles (if available).

4. The public information must be maintained throughout the period during which the production, import, and business entity supplies that vehicle model to the market.

Article 7. Energy Labeling

1. Production and import entities shall print energy labels according to the prescribed format by the Ministry of Industry d.1. Amount of taxable income in Vietnam:trade.

2. After submitting public information to the regulatory authority, the production and import entities shall affix energy labels on each vehicle at a visible location before releasing it to the market. The energy label must be kept on the vehicle by the production, import, and business entity until the vehicle is delivered to the consumer.

Article 8. Re-disclosure of Fuel Consumption Information and Re-affixing Energy Labels

1. Production and import bases must person and re-disclose fuel consumption information and re-affix energy labels when:

a) Standards and technical regulations change;

b) Vehicle models that have been disclosed with fuel consumption information and affixed with energy labels undergo changes that do not meet the conditions for expanding the recognition of emission test results as stipulated in Section 3.6 QCVN 77:2014/BGTVT or Section 3.7 QCVN 04:2009/BGTVT;

c) Incorrectly disclosing fuel consumption or inspection and supervision results as prescribed in Article 9, revealing actual fuel consumption exceeding 4% compared to the disclosed figures by production and import bases.

2. Content and form of re-disclosing fuel consumption information and re-affixing energy labels shall be carried out in accordance with the provisions of Articles 6 and 7 of this Circular.

Article 9. Inspection and Supervision Related to Labeling

CManagement agency organization conducts inspection and supervision related to labeling as follows:

1. Annually, develop and implement plans to inspect compliance with the disclosure of fuel consumption information and the implementation of labeling for production, import, and business vehicle bases in accordance with Chapter III of this Circular.

2. Conduct spot inspections upon receiving reports or complaints about violations related to labeling implementation by production and import bases. In cases where clear signs of violation regarding disclosed fuel consumption levels are detected, the management agency has the right to require production and import bases to re-test fuel consumption levels..

Chapter IV

IMPLEMENTATION

Article 10. Responsibilities of the Management Agency

1. Publicize testing facilities meeting the conditions for conducting fuel consumption tests on the management agency's website.

2. Accept publicized information related to vehicle fuel consumption as prescribed in this Circular on the website.

3. Coordinate with relevant agencies to resolve complaints, disputes, and handle violations related to the disclosure of vehicle fuel consumption and labeling.

4. Report to competent state authorities to handle violations according to regulations when discovering violations related to labeling by production, import, and business vehicle bases.

5. Summarize the results of vehicle labeling inspection work and report to the Ministry of Transport upon request.

Article 11. Responsibilities of Testing Facilities

Are responsible for the accuracy of test results and provide accurate test reports as prescribed in this Circular.

Article 12. Responsibilities of Production, Import, and Business Vehicle Bases

1. Disclose fuel consumption information and affix energy labels on vehicles as prescribed in this Circular before bringing them to market.

2. Bear legal responsibility for the accuracy and honesty of disclosed fuel consumption information.

3.  Production and import basesretain relevant documentation related to the disclosure of fuel consumption information, including: disclosure statements of fuel consumption; copies oftest reports on fuel consumption of vehicle models for at least 03 five years from the date of cessation of production or import of vehicle models.

4. Production and import bases submit regular reports to the management agency before January 15th each year in the format prescribed in Form No. 04 attached to this Circular.

Article 13. Effective Date

1. This Circular takes effect from January 1, 2020; encouraging production, assembly, and import bases to disclose fuel consumption information and affix energy labels prior to the effective date of this Circular.

2. In cases where referenced documents, materials, standards, and technical regulations in this Circular are amended, supplemented, or replaced, they shall be applied according to the amended, supplemented, or replaced documents..

1. The Minister, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairmen of provincial People's Committees under the central government, and related agencies, units, and individuals are responsible for implementing this Circular.

The Director of the Office of the Ministry, the Inspector General of the Ministry, Heads of Departments, Directors of the Vietnam Motor Vehicle Registration Agency, Heads of agencies, units, organizations, and individuals concerned are responsible for implementing this Circular./.
