Decision No. 591/QD-TTg on the establishment of the Management Board of the Economic Zone of Binh Dinh Province

Article 1. On the establishment and definition of the position and functions of the Management Board of the Economic Zone of Binh Dinh Province

1. Establish the Management Board of the Economic Zone of Binh Dinh Province (hereinafter referred to as the Management Board) based on the merger of the Management Board of the Nhon Hoi Economic Zone of Binh Dinh Province (established pursuant to Decision No. 256/2005/QD-TTg dated October 18, 2005 of the Prime Minister) with the Management Board of Industrial Zones of Binh Dinh Province (established pursuant to Decision No. 49/1999/QD-TTg dated March 24, 1999 of the Prime Minister).

2. The Management Board is an agency under the People's Committee of Binh Dinh Province, performing the function of direct state management over the Nhon Hoi Economic Zone and industrial zones within the territory of Binh Dinh Province; managing and organizing the provision of administrative public services and other supporting services related to investment and business activities for investors in the Nhon Hoi Economic Zone and industrial zones within the territory of Binh Dinh Province in accordance with the provisions of the law.

3. The Management Board has legal personality, has a bank account, a seal bearing the National Emblem, its office located in Quy Nhon City, Binh Dinh Province; it is the budget planning unit of Binh Dinh Province; it is allocated separate development investment capital from the central budget. Administrative state management expenses and public service expenses of the Management Board are funded from the state budget in accordance with the provisions of the law.

Article 2. Tasks and powers of the Management Board

The Management Board performs tasks and powers as prescribed in:

1. Article 81 of Decree No. 108/2006/NĐ-CP dated September 22, 2006 of the Government detailing and guiding the implementation of certain articles of the Investment Law;

2. Articles 37 and 38 of Decree No. 29/2008/NĐ-CP dated March 14, 2008 of the Government on industrial zones, export processing zones, and economic zones;

3. Other relevant legal documents.

Article 3. Organizational structure and staffing of the Management Board

1. Leadership of the Management Board: The Management Board has a Director and not more than three Deputy Directors. The Director is appointed and relieved of duty by the Chairman of the People's Committee of Binh Dinh Province according to the criteria set forth by the Ministry of Planning and Investment; Deputy Directors are appointed and relieved of duty by the Chairman of the People's Committee of Binh Dinh Province upon the recommendation of the Director of the Management Board.

2. Organizational structure of the Management Board:

a. Administrative organizations include: office; specialized and professional departments; representatives of the Management Board in the Nhon Hoi Economic Zone and in industrial zones within the province;

b. Affiliated public service organizations:

Based on the requirements and tasks for developing the Nhon Hoi Economic Zone and industrial zones within the territory of Binh Dinh Province during each specific period, the Director of the Management Board shall take the lead and coordinate with relevant Departments and agencies to submit to the Chairman of the People's Committee of Binh Dinh Province for decision within their authority regarding the organizational structure of the Management Board.

3. Staffing:

a. Administrative staffing of the Management Board includes: the Director, Deputy Directors, and the staffing of the Office, specialized and professional departments, and representatives of the Management Board in the Nhon Hoi Economic Zone and industrial zones, decided by the People's Committee of Binh Dinh Province within the total administrative staffing assigned;

b. Public service staffing of the Management Board is decided by the Chairman of the People's Committee of Binh Dinh Province in accordance with the provisions of the law on the delegation of administrative and public service staffing management and the mechanism for managing staffing of public service units of the State.

4. The Director of the Management Board shall take the lead and coordinate with the Director of the Department of Home Affairs to issue a decision detailing the functions, tasks, powers, and organizational structure of the Management Board in accordance with the provisions of the law.

Article 4. Effectiveness

This Decision takes effect from the date of issuance and replaces Decision No. 256/2005/QD-TTg dated October 18, 2005 of the Prime Minister on the establishment of the Management Board of the Nhon Hoi Economic Zone of Binh Dinh Province and Decision No. 49/1999/QD-TTg dated March 24, 1999 of the Prime Minister on the establishment of the Management Board of Industrial Zones of Binh Dinh Province.

Article 5. Responsibility for Implementation

Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, the Chairman of the People's Committee of Binh Dinh Province, and the Director of the Management Board of the Economic Zone of Binh Dinh Province are responsible for implementing this Decision.
