THE MINISTER OF THE MINISTRY OF HOME AFFAIRS
Pursuant to Decree No. 36/2012/NĐ-CP dated April 18, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 61/2012/ND-CP dated August 10, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
At the request of the Director of the International Cooperation Department and the Director of the Organization and Cadre Affairs Department,
DECISION:
Article 1. Position and Functions
The International Cooperation Department is an organization under the Ministry of Home Affairs with the function of advising the Minister of Home Affairs to implement state management over international cooperation activities within the fields of the Ministry's state management.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
1. Perform advisory tasks for the Minister:
a) Drafting and submitting to competent authorities for issuance of legal documents on international cooperation within the fields of the Ministry's state management according to the Minister's assignment;
b) Drafting long-term plans, annual plans, and programs and projects of international cooperation within the fields of the Ministry's state management;
c) Uniformly managing international cooperation activities within the Ministry: taking the lead, coordinating with subordinate agencies and units of the Ministry and relevant state agencies to organize the implementation of approved international cooperation plans; monitoring, reviewing, summarizing, evaluating, and reporting to the Minister for consideration and decision;
d) Submitting to the Government for consideration and decision on policies and measures to expand relations with foreign countries and international organizations; negotiating, signing, approving, ratifying, or joining international treaties related to the fields of the Ministry's state management when the Ministry of Home Affairs represents the State or the Government;
đ) Organizing negotiations and signing international treaties according to the authorization of the competent state agency and organizing the implementation of international treaties where Vietnam is a member within the fields of the Ministry's state management; signing and organizing the implementation of international agreements in the name of the Ministry of Home Affairs as prescribed by law;
e) Deciding on participation in international organizations according to the Government's assignment;
g) Implementing policies and measures to expand international cooperation that have been approved by the Government;
h) Directing and organizing the implementation of international assistance programs and projects of the Ministry; drafting and implementing regulations on program and project management with foreign funding; taking the lead, coordinating with funding agencies and relevant agencies and units in preparing, drafting, reviewing, negotiating, and proposing implementing units; organizing inspections of international assistance programs and projects within the fields of the Ministry's state management;
i) Managing and coordinating activities of cooperation with foreign countries in administrative reform. Serving as the focal point for coordinating activities of cooperation with foreign countries in administrative reform. Guiding ministries, sectors, and localities in building programs, projects, and cooperative activities with foreign countries in administrative reform, participating in reviews, and submitting for approval;
k) Approving the operation of international conferences and seminars related to the fields of the Ministry's state management;
l) Taking the lead, serving as the focal point, coordinating, and participating in ASEAN cooperation activities in the civil service field.
2. Submitting to the Minister for review opinions on the signing of international treaties and international agreements by ministries, sectors, and localities that relate to the fields of the Ministry's state management.
3. Implementing the Ministry of Home Affairs' international cooperation plan, organizing outbound and inbound delegations according to the state budget decided or approved by the Minister. Coordinating with the Planning and Finance Department to review the use of the state budget for the Ministry's international cooperation work.
4. Coordinating with relevant units within the Ministry to advise the Ministry leadership on dispatching officials and civil servants abroad. Coordinating with state agencies and subordinate units of the Ministry to implement regulations and systems for international conferences, seminars, receiving foreign guests, diplomatic protocols, and receptions according to regulations.
5. Serving as the permanent assistant to the Management Board and coordinating with projects under the Ministry.
6. Organizing and compiling information on international conferences and seminars:
a) Drafting documents for the Minister to issue to guide government and Prime Minister's regulations on organizing international conferences and seminars related to the fields of the Ministry's state management;
b) Compiling information on the activities of international conferences and seminars of central agencies and localities related to the fields of the Ministry's state management and reporting to the Minister for submission to the Prime Minister;
c) Taking the lead or coordinating with foreign agencies and organizations to organize international conferences, seminars, and other international cooperation activities within the fields of the Ministry's state management;
d) Submitting to the Minister for review opinions on the organization of international conferences and seminars by ministries, sectors, and localities on issues within the Ministry's state management authority.
7. Leading and coordinating with functional departments of the Ministry in the activities of the ASEAN Source Center for Civil Service Management.
8. Leading or participating in scientific research and professional training in areas within the Department's functions and tasks. Implementing comprehensive statistical work, building databases on international cooperation and coordinating with the Information Technology Application Center to manage and utilize information databases to serve leadership and management.
9. Serving as the focal point for managing reports from outbound delegations for surveying, learning, and researching experiences from around the world as decided by the Minister.
10. Performing other tasks assigned by the Minister.
Article 3. Organization and working regime of the Department
1. The Department has a Director, Deputy Directors, and civil servants.
2. The Director is responsible to the Minister for organizing and implementing the tasks stipulated in Article 2 and has specific duties and powers as follows:
a) Organizing and directing the Department's tasks and being responsible to the Minister for all activities of the Department;
b) Assigning tasks, supervising, urging, and inspecting the implementation of tasks by Deputy Directors and civil servants in the Department;
c) Signing on behalf of the Minister to respond, provide guidance, and require agencies, organizations, and localities to provide information on administrative reform projects and international cooperation activities in the administrative reform field;
d) Implementing information dissemination work for civil servants in the Department according to the Ministry's working regulations;
d) Coordinate with organizations within the Ministry, related agencies in resolving issues related to the functions, tasks, and authorities of the Department;
e) Decide on the contents of reports, reviews, summaries, and recommendations to the Minister regarding policies and solutions in implementing the Department's tasks;
g) Implement the regulations of the Ministry; manage civil servants and assets assigned according to the分级授权 of the Ministry.
3. The Deputy Department Head performs professional tasks and assists the Department Head in managing one or several aspects of work as assigned by the Department Head; is responsible to the Department Head for the assigned tasks.
4. Civil servants carry out specialized tasks assigned by the Director and are accountable to the Director for performing those tasks.
5. The Department operates under a specialist system combined with a chief executive system; in cases where the Ministry leadership works directly with the Deputy Department Head or specialists, the Deputy Department Head or specialists are responsible for implementing the leadership's opinions and promptly reporting back to the Department Head thereafter.
Article 4. Effectiveness and Responsibility for Implementation
1. This Decision takes effect from the date of signature.
Repeal Decision No. 08/QĐ-BNV dated January 6, 2009 of the Minister of Home Affairs stipulating the functions, tasks, authorities, and organizational structure of the Department of International Cooperation.
2. The Director of the Ministry’s Office, the Heads of the Department of Cadre and Civil Service Organization, the Department of International Cooperation, the Heads of subordinate agencies and units under the Ministry, and the civil servants of the Department of International Cooperation are responsible for implementing this Decision./.
