Regarding the system for military personnel and public security officers upon discharge

PRIME MINISTER

Pursuant to the Government Organization Law dated September 30, 1992;

To implement the Law on Officers of the Vietnam People's Army, the Law on Military Service, the Ordinance on the People's Security Force, and the Ordinance on the People's Police Force, in accordance with the organizational requirements of the military and public security forces, and to contribute to helping discharged military personnel and public security officers stabilize their lives;

At the proposal of the Minister of National Defense, the Minister of Public Security, the Minister of Labor, War Invalids and Social Affairs, and the Minister of Finance,

DECISION:

Article 1. Officers, professional soldiers, non-commissioned officers, and conscripts of the Vietnam People's Army (referred to as military personnel); officers, non-commissioned officers, and police cadets of the People's Public Security (referred to as public security personnel), who have not yet met the conditions for retirement benefits, shall be entitled to the following allowances when discharged to localities:

1- Discharge allowance:

a. For military personnel and public security personnel eligible for salary, it is calculated by multiplying the number of years of service (military age for military personnel, seniority for public security personnel) by 1.5 months of rank pay or professional grade pay and seniority allowances; position allowances (if applicable) received before discharge.

b. For military personnel and public security personnel eligible for subsistence allowance, it is calculated by multiplying the number of years of active service by 2 months of the minimum wage.

In cases where military personnel and public security personnel have previously served as state workers or civil servants, the time spent in those roles shall be considered for the calculation of discharge allowance as if they were state workers or civil servants leaving their positions.

2- Vocational training allowance:

Upon discharge, military personnel and public security personnel shall be entitled to a vocational training allowance equivalent to 3 months of the minimum wage.

Article 2. Military personnel and public security personnel who transfer to work at administrative agencies, state enterprises, Party organizations, or mass organizations shall receive wages based on the job they undertake and shall not be entitled to the allowances stipulated in Article 1. The continuous period of service of military personnel and public security personnel prior to discharge shall be recognized as the period of social insurance contributions.

Article 3. The discharge allowance for those receiving salary from the social insurance fund shall be paid by that fund. The discharge allowance for those receiving subsistence allowance and vocational training allowance shall be provided annually from the State budget, allocated to the Defense and Interior budgets.

The management agency or unit shall pay the discharge allowance to military personnel and public security personnel before their discharge and settle accounts according to current regulations.

Article 4. Upon discharge, military personnel and public security personnel shall be given priority in vocational training or referred to employment opportunities at job promotion centers of ministries, sectors, mass organizations, and localities.

Article 5. This Decision takes effect from the date of signature.

Any previous provisions contrary to the provisions of this Decision are hereby abolished.

Article 6. The Minister of National Defense, the Minister of Public Security, the Minister of Labor, Invalids and Social Affairs, and the Minister of Finance shall coordinate to provide detailed guidance on the implementation of this Decision.

Article 7. The Minister, the Head of a ministry-level agency, the Head of an agency under the Government, and the Chairman of the People's Committee of a province or centrally governed city shall be responsible for organizing the implementation of this Decision./.
