Decision No. 599/QD-TTg Regarding the establishment of the Management Board for Industrial Zones in Tuyen Quang Province

Article 1. Establishing the Management Board for Industrial Zones of Tuyen Quang Province

1. Establishing the Management Board for Industrial Zones of Tuyen Quang Province (hereinafter referred to as the Management Board). The Management Board is a state management agency under the People's Committee of Tuyen Quang Province, performing the function of direct state management over industrial zones within the province according to the provisions of Decree No. 29/2008/NĐ-CP dated March 14, 2008 of the Government on industrial zones, export processing zones, and economic zones and other related laws; managing and organizing the provision of administrative public services and other supporting services related to investment and production and business activities for investors in industrial zones within the province.

2. The Management Board has legal personality, has its own bank account, office premises, and seal with the National Emblem; it is the budget planning unit of the People's Committee of Tuyen Quang Province, allocated separately from the basic construction fund from the state budget; it is subject to the guidance and management of organization, staffing, work program plans, and operational funding by the People's Committee of Tuyen Quang Province.

Article 2. Tasks and powers of the Management Board

The Management Board performs tasks and powers as prescribed in:

1. Article 81 of Decree No. 108/2006/NĐ-CP dated September 22, 2006 of the Government detailing and guiding the implementation of certain articles of the Investment Law;

2. Article 37 of Decree No. 29/2008/NĐ-CP dated March 14, 2008 of the Government on industrial zones, export processing zones, and economic zones;

3. Other related legal documents.

Article 3. Leadership, organizational structure, and staffing of the Management Board

1. Leadership of the Management Board:

The Management Board shall have a Director and not more than three Deputy Directors. The Director is appointed and relieved of duty by the Chairman of the People's Committee of Tuyen Quang Province according to the criteria set forth by the Ministry of Planning and Investment; Deputy Directors are appointed and relieved of duty by the Chairman of the People's Committee of Tuyen Quang Province upon the recommendation of the Director of the Management Board.

2. Organizational structure of the Management Board:

a) Administrative organizations include: office, specialized departments;

b) Affiliated public service organizations.

Depending on the requirements of management and development of industrial zones in each stage, the Director of the Management Board shall submit to the Chairman of the People's Committee of Tuyen Quang Province for decision on the organizational structure of the Management Board.

3. Staffing:

a) The administrative staffing of the Management Board includes: Director, specialized Deputy Directors, and the staffing of the office and specialized departments decided by the People's Committee of Tuyen Quang Province within the total administrative staffing assigned;

b) The public service staffing of the Management Board is decided by the Chairman of the People's Committee of Tuyen Quang Province in accordance with the regulations on the decentralization of administrative and public service staffing management and the staffing management mechanism for public service units of the State.

4. The Director of the Management Board shall submit to the People's Committee of Tuyen Quang Province for detailed regulations on the functions, tasks, powers, and organizational structure of the Management Board in accordance with the law;

Article 4. Effectiveness

This Decision takes effect from the date of issuance.

Article 5. Responsibility for Implementation

Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, the Chairman of the People's Committee of Tuyen Quang Province, and the Director of the Management Board for Industrial Zones of Tuyen Quang Province are responsible for implementing this Decision./.
