Decree No. 60/2001/NĐ-CP Amending Article 3 of the Prison Regulation (Annexed to Decree No. 60/CP dated September 16, 1993 of the Government).

DECREE OF THE GOVERNMENT

REGARDING THE AMENDMENT OF ARTICLE 3 OF THE PRISON REGULATIONS

(ISSUED TOGETHER WITH DECREE NO. 60/CP OF SEPTEMBER 16, 1993 OF THE GOVERNMENT)

THE GOVERNMENT

Pursuant to the Government Organization Law dated September 30, 1992;

BASED ON ARTICLE 37 OF THE ORDINANCE ON ENFORCEMENT OF SENTENCES OF IMPRISONMENT OF MARCH 8, 1993;

At the proposal of the Minister of Public Security, 

DECREE:

Article 1. AMENDS ARTICLE 3 OF THE PRISON REGULATIONS (ISSUED TOGETHER WITH DECREE NO. 60/CP OF SEPTEMBER 16, 1993) AS FOLLOWS:

THE SCALE OF PRISONERS IN EACH PRISON UNDER THE MINISTRY OF PUBLIC SECURITY'S MANAGEMENT IS FROM 1,000 TO 4,000 PRISONERS (EXCEPT FOR THU DUC PRISON). EACH PRISON MAY ESTABLISH ONE OR MORE SUB-PRISONS. THE SCALE OF EACH SUB-PRISON IS FROM 500 TO 1,000 PRISONERS.

THE SCALE OF PRISONERS IN EACH PRISON UNDER THE MINISTRY OF NATIONAL DEFENSE'S MANAGEMENT IS FROM 100 TO 300 PRISONERS.

Article 2. THE MINISTRY OF PUBLIC SECURITY SHALL DEVELOP PLANS FOR INVESTMENT TO INCREASE THE SCALE OF PRISONER HOUSING IN SUB-PRISONS OF PRISONS AND UNIFY WITH THE MINISTRY OF FINANCE TO INCORPORATE INTO ANNUAL BUDGET BALANCING APPROPRIATELY.

Article 3. This Decree takes effect fifteen days from the date of signature.

Article 4. THE MINISTER OF PUBLIC SECURITY SHALL CHAIR AND COORDINATE WITH RELATED AGENCIES TO ISSUE GUIDELINES FOR IMPLEMENTATION OF THIS DECREE.

Article 5. Ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, Chairpersons of provincial and municipal People's Committees directly under the Central Government are responsible for implementing this Decree./.
