DECISION OF THE PRIME MINISTER
On the establishment of the Fund to support people living with HIV/AIDS

Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Law on Prevention and Control of HIV/AIDS Infection dated June 29, 2006;
Considering the proposal of the Minister of Finance,
DECISION:
Article 1. Establishing the Fund to support people living with HIV/AIDS to provide support for such individuals to access medical examination and treatment.
Article 2. Authority to decide on the establishment of the Fund to support people living with HIV/AIDS
1. The Central Fund to support people living with HIV/AIDS shall be established by the Minister of Health.
2. The provincial Fund to support people living with HIV/AIDS shall be established by the Chairman of the People's Committee of the province or centrally governed city.
3. The Minister of Health and the Chairman of the People's Committee of the province or centrally governed city shall specify in detail the organizational structure of the Fund.
Article 3. The Fund to support people living with HIV/AIDS shall have legal personality; it shall have its own seal; it may open bank accounts to receive contributions and donations from domestic and foreign organizations and individuals, and open accounts at the State Treasury to receive funding from HIV/AIDS prevention and control projects and programs funded by the state budget. At the end of each fiscal year, any surplus in the Fund shall be carried over to the next year for continued use as prescribed.
Article 4. Sources of income for the Fund to support people living with HIV/AIDS
1. Contributions and donations from domestic and foreign agencies, organizations, and individuals.
2. Initial state budget support when the Fund is first established to cover certain activities, such as purchasing equipment and working tools; expenses for promotional and mobilization activities supporting the Fund.
3. Support from HIV/AIDS prevention and control projects and programs funded by the state budget.
4. Other lawful revenues.
Article 5. Expenditure items of the Fund to support people living with HIV/AIDS
1. The Central Fund to support people living with HIV/AIDS:
a) Supporting people living with HIV/AIDS who are in difficult circumstances when they seek medical examination and treatment at central-level healthcare facilities: - Supporting costs for medical examination and treatment for people living with HIV/AIDS who are not covered by health insurance; - Supporting food expenses during treatment.
b) Supporting provincial Funds to support people living with HIV/AIDS when necessary;
c) Expenses for promotional and mobilization activities supporting the Fund;
d) Management expenses and other expenses.
2. Provincial Funds to support people living with HIV/AIDS:
a) Supporting specific individuals infected with HIV/AIDS according to the authorization of contributing organizations or individuals;
b) Supporting people living with HIV/AIDS who are in difficult circumstances when they seek medical examination and treatment at local healthcare facilities: - Supporting costs for medical examination and treatment for people living with HIV/AIDS who are not covered by health insurance; - Supporting food expenses during treatment.
c) Supporting wives or husbands, children of people living with HIV/AIDS who are in difficult circumstances, including: - Costs for HIV testing for spouses and children of people living with HIV/AIDS; - Costs for counseling and providing care and treatment methods for people living with HIV/AIDS at home and in the community.
d) Supporting facilities caring for and nurturing people living with HIV/AIDS in their final stages;
đ) Expenses for promotional and mobilization activities supporting the Fund;
e) Management expenses and other expenses.
Article 6. The level of support for each category of beneficiaries with the expenditure items specified in Article 5 of this Decision shall be decided by the Minister of Health (for the Central Fund) and the Chairman of the People's Committee of the province or centrally governed city (for the provincial Fund), based on the financial capacity of the Fund.
Article 7. Management of the Fund to support people living with HIV/AIDS
1. The Fund to support people living with HIV/AIDS must organize and implement accounting and statistical work in accordance with the laws on accounting and statistics.
2. Maintaining a record of all agencies, organizations, and individuals making contributions and donations, and the beneficiaries receiving support.
3. Preparing and submitting complete and timely financial reports of the Fund on a regular basis and annual settlement reports to the Ministry of Health, the People's Committee of the province or centrally governed city, and the finance department as prescribed.
4. The Ministry of Finance, in collaboration with the Ministry of Health, shall guide the management and use of the Fund to support people living with HIV/AIDS, adhering to the principles of correct target groups, fairness, and transparency in revenue and expenditure of the Fund.
Article 8. Establishment of the Financial Mobilization Board for the Fund to support people living with HIV/AIDS
1. The Central Financial Mobilization Board for the Fund shall be chaired by the Minister of Health, with members being representatives of agencies that are part of the National Steering Committee for HIV/AIDS Prevention and Control and Drug Abuse and Prostitution Prevention and Control.
2. The Local Financial Mobilization Board for the Fund shall be chaired by the Chairman of the People's Committee of the province or centrally governed city, with the Director of the Department of Health serving as Deputy Chair, and members being representatives of agencies that are part of the Provincial Steering Committee for HIV/AIDS Prevention and Control and Drug Abuse and Prostitution Prevention and Control.
3. The Financial Mobilization Board for the Fund shall assist the Chairman of the National Steering Committee for HIV/AIDS Prevention and Control and Drug Abuse and Prostitution Prevention and Control (for the Central Fund) or the Chairman of the People's Committee of the province or centrally governed city (for the Local Fund) in reviewing and approving directions and plans for financial mobilization activities for the Fund; organizing and implementing measures to promote support for the Fund.
Article 9. Implementation Provisions
This Decision shall take effect 15 days after its publication in the Official Gazette.
The Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, the Chairman of the National Steering Committee for HIV/AIDS Prevention and Control and Drug Abuse and Prostitution Prevention and Control, and the Chairmen of the People's Committees of the provinces and centrally governed cities are responsible for implementing this Decision.
