DECREE

Article 1 stipulates the functions, tasks, powers, and organizational structure of the Committee for Ethnic Minority Affairs.

THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated December 25, 2001;

BASED ON THE GOVERNMENT DECREE NO. 178/2007/NĐ-CP OF DECEMBER 3, 2007, DEFINING THE FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF MINISTRIES AND GOVERNMENTAL BODIES AT THE MINISTRY LEVEL;

Considering the proposal of the Minister, Chairman of the National Ethnic Minorities Committee,

 

DECREE:

Article 1. Position and Functions

The Committee for Ethnic Minorities is a governmental body at the ministry level under the Government, performing state management functions regarding ethnic affairs throughout the country; managing public services within the scope of the Committee for Ethnic Minorities' state management as prescribed by law.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

The Committee for Ethnic Minorities shall perform the tasks and powers stipulated in the Government Decree No. 178/2007/NĐ-CP of December 3, 2007, defining the functions, tasks, powers, and organizational structure of ministries and governmental bodies at the ministry level, and the following specific tasks and powers:

1. Submit to the Government draft laws, draft resolutions of the National Assembly, draft ordinances, draft resolutions of the Standing Committee of the National Assembly, draft resolutions, decrees of the Government according to the annual legislative program and plan of the Committee for Ethnic Minorities that have been approved, and projects and programs assigned by the Government and the Prime Minister.

2. Submit to the Prime Minister strategies, plans, programs, projects, and programs on ethnic affairs, and draft decisions and directives on ethnic affairs within the Prime Minister's authority to direct and manage.

3. Issue decisions, directives, and circulars within the scope of the Committee for Ethnic Minorities' state management; guide and inspect the implementation of these documents.

4. Take the lead or coordinate with ministries, governmental bodies at the ministry level, government agencies, and related organizations to develop strategies, policies, programs, projects, national target programs, action programs, plans, regional plans on economic and social development, security consolidation, and defense in ethnic regions to submit to the Government and the Prime Minister for approval or issuance; direct, inspect, and guide the implementation of these strategies, policies, programs, projects, plans.

5. Take the lead or coordinate with ministries, governmental bodies at the ministry level, government agencies, and political-social organizations to review, summarize, and evaluate the implementation of the Party's guidelines and policies and the State's laws related to ethnic affairs; report regularly and urgently to the Government and the Prime Minister as prescribed.

6. Take the lead in developing and issuing, or submitting to competent authorities for issuance and organizing the implementation of special policies, programs, projects, and programs for developing areas with particularly difficult socio-economic conditions; policies for ethnic minorities living in border areas, remote areas, mountainous areas, and headwaters of rivers and streams frequently affected by natural disasters.

7. Take the lead in developing and issuing, or submitting to competent authorities for issuance criteria for identifying ethnic minority components; criteria for delineating ethnic regions based on their level of development; regulations on reidentifying ethnic components upon citizens' requests and as prescribed by law.

8. Conduct surveys, research, and build a database on Vietnam's ethnic minorities.

9. Take the lead in developing and issuing, or submitting to competent authorities for issuance special policies for cadres and civil servants working in ethnic affairs; policies to attract and strengthen cadres, civil servants, and public officials working in ethnic regions.

10. Coordinate with ministries, governmental bodies at the ministry level, government agencies, and related organizations to develop and issue, or submit to competent authorities for issuance human resource training policies, vocational training, and education improvement in ethnic regions; poverty and hardship criteria in ethnic regions; policies for preserving and promoting traditional cultural characteristics of ethnic groups; ensuring the right to use languages and scripts of ethnic minorities.

11. Participate in reviewing draft regulatory legal documents of ministers, heads of governmental bodies at the ministry level, provincial People's Councils, and municipal People's Councils directly under the central government related to ethnic affairs; inspect the implementation of the Party's guidelines and policies and the State's laws related to ethnic affairs in ministries, governmental bodies at the ministry level, government agencies, and localities.

12. Direct, guide, and inspect the organization and implementation of economic and social development programs in ethnic regions; investment and support policies to stabilize the lives of ethnic minorities; policies and projects for preserving and developing ethnic minorities.

13. Take the lead and coordinate with the Ministry of Justice, mass media agencies, and localities to promote and disseminate laws within the scope of the Committee for Ethnic Minorities' state management to ethnic minorities; mobilize ethnic minorities to implement the Party's guidelines and policies and the State's laws.

14. Participate in appraising projects, programs, and plans led by ministries, governmental bodies at the ministry level, government agencies, and related organizations concerning ethnic minorities; participate in managing and directing the implementation of programs and projects funded and invested by foreign countries and international organizations in ethnic minority regions as prescribed by law.

15. Receive, visit, and coordinate with ministries, sectors, and localities to address the aspirations of ethnic minorities according to policies, regulations, and laws.

16. Regularly organize national conferences and congresses of outstanding ethnic minorities in local competition movements; organize exchange activities between ethnic minority representatives from different regions to enhance the solidarity among ethnic groups in Vietnam.

17. To lead and coordinate with ministries, ministerial-level agencies, and government agencies in the construction, issuance according to their authority or submission to competent authorities for issuance, and implementation of policies towards people of high standing among ethnic minorities; to award commendations according to their authority or propose competent authorities to award commendations to outstanding collectives and individuals from ethnic minorities who have achieved remarkable success in labor, production, economic and social development, maintaining security and order, and serving as exemplary models in implementing Party guidelines and State policies.

18. To direct and organize the implementation of the administrative reform plan of the Committee for Ethnic Affairs according to the national administrative reform program approved by the Prime Minister.

19. To organize and direct the implementation of scientific research, technological, and environmental activities within the scope of ethnic work and regions inhabited by ethnic groups.

20. To cooperate internationally in fields under the management of the Committee for Ethnic Affairs in accordance with the law.

21. To inspect and supervise the implementation of ethnic policies; to resolve complaints, denunciations, and citizen proposals; to implement anti-corruption, thrift, and negative practices, and handle violations of the law within the authority of the Committee for Ethnic Affairs.

22. To manage organizational structure and staffing; to implement salary systems and incentive, reward, and disciplinary policies for civil servants and public officials under the Committee for Ethnic Affairs' jurisdiction; to train and enhance professional skills for civil servants, public officials, and those engaged in ethnic work; to establish professional standards for civil service positions assigned and delegated to the Committee for Ethnic Affairs for the Ministry of Home Affairs to promulgate; to issue job titles for heads of ethnic work agencies under provincial and centrally-administered city People's Committees.

23. To prepare annual budget estimates; to coordinate with the Ministry of Finance in drafting and consolidating revenue and expenditure budgets according to sectors and fields under the Committee for Ethnic Affairs' jurisdiction for submission to the Government; to manage, organize, and settle the state budget; to perform other tasks related to the state budget, finance, and assets as prescribed by law.

24. Perform other duties and powers assigned by the Government and the Prime Minister, and as prescribed by law.

Article 3. Organizational Structure

1. Department of Planning and Finance.

2. Cadre and Civil Servant Department;

3. Department of Legal Affairs.

4. International Cooperation Department.

5. Inspectorate.

6. Office.

7. The General Department.

8. The Ethnic Policy Department.

9. The Propaganda Department.

10. The Localities I Department.

11. The Localities II Department.

12. The Localities III Department.

13. The Ethnic Institute.

14. The Ethnic Cadres School.

15. The Information Center.

16. The Ethnic Magazine.

17. The Ethnic Development Newspaper.

In this Article, units specified from Clause 1 to Clause 12 are units assisting the Minister and Chairman of the Committee for Ethnic Affairs in performing state management functions; units specified from Clause 13 to Clause 17 are non-profit units serving the state management functions of the Committee for Ethnic Affairs.

The General Department, the Ethnic Policy Department, the Localities II Department, the Localities III Department, the Inspectorate of the Committee for Ethnic Affairs, and the Office of the Committee for Ethnic Affairs shall be organized into divisions.

Article 4. Members of the Committee for Ethnic Affairs.

Members of the Committee for Ethnic Affairs include:

1. The Minister and Chairman of the Committee for Ethnic Affairs.

2. Deputy Chairmen of the Committee for Ethnic Affairs.

3. Other members are Deputy Ministers of the following Ministries:

a) The Ministry of Planning and Investment;

b) Ministry of Finance;

c) The Ministry of Home Affairs;

d) The Ministry of Agriculture and Rural Development;

đ) The Ministry of Labor, Invalids, and Social Affairs;

e) The Ministry of Education and Training;

g) The Ministry of Culture, Sports, and Tourism;

h) The Ministry of Natural Resources and Environment.

Article 5. Working regime of members of the National Ethnic Committee

1. The Minister and Head of the National Ethnic Committee is a member of the Government, heads the National Ethnic Committee, and decides issues in accordance with the provisions of the law.

2. Members of the National Ethnic Committee as stipulated in Article 4 of this Decree shall operate under the Rules of Procedure to be submitted by the Minister and Head of the National Ethnic Committee for promulgation by the Prime Minister.

Article 6. Effectiveness

1. This Decree takes effect fifteen days from the date of publication in the Official Gazette and replaces Decree No. 51/2003/NĐ-CP dated May 16, 2003 of the Government on the functions, tasks, powers, and organizational structure of the National Ethnic Committee.

Article 2. Abolish previous provisions that conflict with this Decree.

Article 7. Responsibility for Implementation

Ministers, Heads of Ministries equivalent to ministries, Heads of government agencies, and Chairpersons of provincial and centrally-administered city People's Committees are responsible for implementing this Decree./.
