Circular No. 60/2008/TT-BNN amending and supplementing certain contents of Circular No. 92/2007/BNN dated November 19, 2007 of the Ministry of Agriculture and Rural Development guiding the implementation of some provisions of Decision No. 1405/QĐ-TTg dated October 16, 2007 of the Prime Minister on conditions for egg incubation facilities and waterfowl breeding.

CIRCULAR

Amending and supplementing certain contents of Circular No. 92/2007/BNN dated November 19, 2007 of the Ministry of Agriculture and Rural Development on guiding the implementation of some provisions of Decision No. 1405/QĐ-TTg dated October 16, 2007 of the Prime Minister on conditions for hatching poultry eggs and raising waterfowl.

On conditions for hatching poultry eggs and raising waterfowl;

Pursuant to Decision No. 1405/QĐ-TTg dated October 16, 2007 of the Prime Minister on conditions for hatching poultry eggs and raising waterfowl;

Considering the actual situation and the proposals of some provinces and cities;

The Ministry of Agriculture and Rural Development amends and supplements certain contents of Circular No. 92/2007/BNN dated November 19, 2007 on guiding the implementation of some provisions of Decision No. 1405/QĐ-TTg dated October 16, 2007 of the Prime Minister on conditions for hatching poultry eggs and raising waterfowl as follows:

Clause 1. Conditions for hatching poultry eggs

Point d. The location of the hatching facility for poultry eggs shall be amended and supplemented as follows:

- All hatching facilities for poultry eggs, regardless of scale, must be located outside the inner city or town.

- Industrial hatching facilities for poultry eggs must be at least 200 meters away from schools, hospitals, markets, administrative offices, residential areas, and have surrounding walls enclosing the hatching area.

- Small-scale traditional hatching facilities for poultry eggs that hatch eggs in rotation must be isolated from living quarters, schools, hospitals, markets, administrative offices, and other public places by surrounding walls to ensure biological safety isolation conditions.

Clause 2. Conditions for raising waterfowl (excluding seasonal ducks and temporary ducks)

Point c. The location for raising waterfowl shall be amended and supplemented as follows:

- All facilities for raising waterfowl, regardless of scale, must be located outside the inner city or town.

- Facilities for raising waterfowl in farms or industrial settings must be at least 200 meters away from schools, hospitals, markets, administrative offices, residential areas, and have surrounding walls or fences enclosing the raising area.

Clause 3. Implementation organization

Point a. The responsibilities of the Department of Agriculture and Rural Development shall be amended and supplemented as follows:

- Advising the People's Committee of the province or city to approve the plan for implementing Decision No. 1405/QĐ-TTg dated October 16, 2007 of the Prime Minister on conditions for hatching poultry eggs and raising waterfowl.

- Coordinating with the information and communication sector and mass organizations to disseminate and popularize Decision No. 1405/QĐ-TTg dated October 16, 2007 of the Prime Minister and guiding documents of the Ministry of Agriculture and Rural Development to relevant organizations and individuals involved in hatching poultry eggs and raising waterfowl.

- Printing registration books for raising seasonal ducks and handing them over to the People's Committee of the commune or the district veterinary station for distribution to households raising seasonal ducks.:

- Inspecting and urging districts and communes to manage and supervise well the hatching facilities for poultry eggs and raising waterfowl within their jurisdiction.

- Taking the lead in coordinating with relevant departments to conduct regular and spot inspections of hatching facilities for poultry eggs and raising waterfowl. Firmly handling violations and those who deliberately fail to comply with regulations.

- Based on the actual situation of the locality, advising the People's Committee of the province or city to specify specific conditions regarding location and implementation timeline for hatching facilities for poultry eggs and raising waterfowl within the entire province or city. Accordingly, for hatching facilities for poultry eggs and raising waterfowl built before the effective date of Decision No. 1405/QĐ-TTg, the province or city shall decide on the relocation timeline suitable to the actual situation. For hatching facilities for poultry eggs and raising waterfowl in farms or industrial settings built after the effective date of Decision No. 1405/QĐ-TTg, they must comply with the provisions of the aforementioned Decision and guiding circulars of the Ministry of Agriculture and Rural Development.

Clause 4. Effective Date

This Circular shall take effect 15 days from the date of publication in the Official Gazette.

The Head of the Office of the Ministry, Directors of the Departments of Agriculture and Rural Development of centrally governed cities and provinces, Heads of the Livestock Breeding Bureau, Heads of the Animal Health Bureau, and Heads of related units are responsible for implementing this Circular.

During the process of implementation, if there are arising issues and difficulties, the Departments of Agriculture and Rural Development of centrally governed cities and provinces are requested to report in writing to the Ministry of Agriculture and Rural Development for timely adjustment and supplementation./.

This Circular shall take effect fifteen days after its publication in the Official Gazette.

The Director of the Ministry's Office, the Directors of the Departments of Agriculture and Rural Development of the provinces and centrally governed cities, the Heads of the Livestock Production Department, the Heads of the Animal Health Department, and the Heads of relevant units shall be responsible for implementing this Circular.

During the process of implementation, if any issues arise or difficulties occur, the Departments of Agriculture and Rural Development of the provinces and centrally governed cities are requested to report them in writing to the Ministry of Agriculture and Rural Development for timely adjustment and supplementation./.
