On administrative penalties for violations in the civil aviation sector

Pursuant to the Government Organization Law  August 25 the 12 year 2001;

Pursuant to the Civil Aviation Law of Vietnam dated June 29, 2006;

BASED ON THE ADMINISTRATIVE VIOLATION HANDLING ORDINANCE NO. 44/2002/PL-UBTVQH10 dated July 2, 2002 AND THE AMENDMENT AND SUPPLEMENT TO CERTAIN PROVISIONS OF THE ADMINISTRATIVE VIOLATION HANDLING ORDINANCE NO. 04/2008/PL-UBTVQH12 dated April 2, 2008 BY THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY (HEREINAFTER REFERRED TO AS THE ADMINISTRATIVE VIOLATION HANDLING ORDINANCE); 1. THIS DECREE REGULATES VIOLATIONS, FORMS AND LEVELS OF PENALTIES, MEASURES TO REMEDY CONSEQUENCES, AUTHORITY AND PROCEDURES FOR HANDLING ADMINISTRATIVE VIOLATIONS IN THE CIVIL AVIATION SECTOR.

Considering the proposal of the Minister of Transport,

DECREE:

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation

2. ADMINISTRATIVE VIOLATIONS IN THE CIVIL AVIATION SECTOR

ARE ACTIONS PERFORMED INTENTIONALLY OR UNINTENTIONALLY BY ORGANIZATIONS AND INDIVIDUALS THAT VIOLATE THE LAWS ON CIVIL AVIATION WITHOUT REACHING THE LEVEL OF CRIMINAL LIABILITY AND MUST BE SUBJECT TO ADMINISTRATIVE VIOLATION PENALTIES UNDER THE LAWS. a) VIOLATIONS OF AIRCRAFT REGULATIONS;including:

VIOLATIONS OF AIRPORT AND AIRFIELD REGULATIONS;

b) c) VIOLATIONS OF CIVIL AVIATION STAFF REGULATIONS;

d) VIOLATIONS OF FLIGHT OPERATIONS REGULATIONS;

đ) VIOLATIONS OF CIVIL AVIATION PASSENGER AND FREIGHT TRANSPORT REGULATIONS AND GENERAL AVIATION REGULATIONS;

e) VIOLATIONS OF CIVIL AVIATION SECURITY REGULATIONS.

OTHER ADMINISTRATIVE VIOLATIONS AT AIRPORTS ARE HANDLED IN ACCORDANCE WITH THE LAWS ON HANDLING VIOLATIONS IN THE RESPECTIVE SECTORS.

3. 1. VIETNAMESE INDIVIDUALS AND ORGANIZATIONS AND FOREIGN INDIVIDUALS AND ORGANIZATIONS THAT COMMIT ADMINISTRATIVE VIOLATIONS IN THE CIVIL AVIATION SECTOR.

Article 2. Applicability
2. OTHER INDIVIDUALS AND ORGANIZATIONS RELATED TO THE HANDLING OF ADMINISTRATIVE VIOLATIONS IN THE CIVIL AVIATION SECTOR.

FOR MINORS WHO COMMIT ADMINISTRATIVE VIOLATIONS IN THE CIVIL AVIATION SECTOR, THE PROVISIONS OF ARTICLES 7(1) AND 7(3) OF THE ADMINISTRATIVE VIOLATION HANDLING ORDINANCE SHALL APPLY.

3. 1. THE HANDLING OF ADMINISTRATIVE VIOLATIONS IN THE CIVIL AVIATION SECTOR SHALL BE CONDUCTED IN ACCORDANCE WITH THE PRINCIPLES SET OUT IN ARTICLE 3 OF THE ADMINISTRATIVE VIOLATION HANDLING ORDINANCE.

Article 3. Principles of Administrative Penalties
2. THE HANDLING OF ADMINISTRATIVE VIOLATIONS IN THE CIVIL AVIATION SECTOR MUST BE CONDUCTED BY PERSONS WITH AUTHORITY AS PROVIDED FOR IN ARTICLES 13, 14, 15, 16 AND THOSE AUTHORIZED UNDER ARTICLE 18 OF THIS DECREE.

3. MITIGATING AND AGGRAVATING CIRCUMSTANCES IN THE CIVIL AVIATION SECTOR ARE REGULATED IN ARTICLES 8 AND 9 OF THE ADMINISTRATIVE VIOLATION HANDLING ORDINANCE.

ARTICLE 4. FORMS OF PENALTY AND MEASURES TO REMEDY CONSEQUENCES

1. FOR EACH ADMINISTRATIVE VIOLATION IN THE CIVIL AVIATION SECTOR, THE VIOLATOR MUST BE SUBJECTED TO ONE OF THE FOLLOWING PRIMARY PUNISHMENTS:

WHEN IMPOSING A FINANCIAL PENALTY, THE SPECIFIC LEVEL OF THE FINANCIAL PENALTY FOR A VIOLATION IS THE MIDPOINT OF THE FINANCIAL PENALTY RANGE PRESCRIBED FOR THAT VIOLATION; IF THE VIOLATION HAS MITIGATING CIRCUMSTANCES, THE FINANCIAL PENALTY MAY BE REDUCED BUT NOT BELOW THE MINIMUM LEVEL OF THE RANGE; IF THE VIOLATION HAS AGGRAVATING CIRCUMSTANCES, THE FINANCIAL PENALTY MAY BE INCREASED BUT NOT ABOVE THE MAXIMUM LEVEL OF THE RANGE. THE MIDPOINT OF THE FINANCIAL PENALTY RANGE IS DETERMINED BY DIVIDING THE SUM OF THE MINIMUM AND MAXIMUM LEVELS BY TWO.

a) Warning;

b) Fine.

2. DEPENDING ON THE NATURE AND GRAVITY OF THE VIOLATION, THE VIOLATOR IN THE CIVIL AVIATION SECTOR MAY ALSO BE SUBJECTED TO THE FOLLOWING ADDITIONAL PUNISHMENTS:

a) SUSPENSION OF LICENSES, CERTIFICATES, AND PROFESSIONAL CERTIFICATES;

3. IN ADDITION TO THE PRIMARY AND ADDITIONAL PUNISHMENTS REGULATED IN PARAGRAPHS 1 AND 2 OF THIS ARTICLE, THE VIOLATOR IN THE CIVIL AVIATION SECTOR MAY ALSO BE SUBJECTED TO ONE OR MORE OF THE FOLLOWING MEASURES TO REMEDY CONSEQUENCES:

b) Confiscation of property or means of transport used to commit the administrative violation.

d) ORDERED TO DESTROY ITEMS HARMFUL TO HUMAN HEALTH, ANIMALS, PLANTS, AND HARMFUL CULTURAL PRODUCTS;

a) Compelling restoration to the original state prior to the change caused by the administrative violation or compelling demolition of unauthorized construction works;

b) Compelling implementation of measures to address environmental pollution or the spread of diseases caused by the administrative violation;

c) Compelling removal from the territory of Vietnam or compelling re-export of goods, items, or means of transport;

đ) PROHIBITED FROM CARRYING GOODS BY AIR FOR A PERIOD OF UP TO 12 MONTHS COUNTING FROM THE DATE OF THE DECISION TO IMPOSE THE PENALTY.

1. THE STATUTE OF LIMITATIONS FOR HANDLING ADMINISTRATIVE VIOLATIONS IN THE CIVIL AVIATION SECTOR IS ONE YEAR FROM THE DATE OF THE VIOLATION, EXCEPT AS PROVIDED FOR IN PARAGRAPHS 2 AND 3 OF THIS ARTICLE.

Article 5. Statute of Limitations for Administrative Sanctions

2. THE STATUTE OF LIMITATIONS FOR VIOLATIONS RELATING TO PRICES, FEES, AND CHARGES IN CIVIL AVIATION, CONSTRUCTION OF FACILITIES FOR CIVIL AVIATION ACTIVITIES, OR CONSTRUCTION OF OTHER FACILITIES AFFECTING CIVIL AVIATION ACTIVITIES IS TWO YEARS FROM THE DATE OF THE VIOLATION.

3. FOR INDIVIDUALS WHO HAVE BEEN PROSECUTED, PROSECUTED, OR WHO HAVE A CASE INITIATED FOR TRIAL UNDER CRIMINAL PROCEDURE BUT LATER HAVE A DECISION TO SUSPEND INVESTIGATION OR DISMISS THE CASE WHERE THE VIOLATION HAS CHARACTERISTICS OF AN ADMINISTRATIVE VIOLATION IN THE CIVIL AVIATION SECTOR, THEY SHALL BE HANDLED FOR ADMINISTRATIVE VIOLATIONS
; WITHIN THREE DAYS FROM THE DATE OF THE DECISION TO SUSPEND INVESTIGATION OR DISMISS THE CASE, THE DECISION MAKERMUST SEND THE DECISION TO THE AUTHORITY RESPONSIBLE FOR HANDLING VIOLATIONS; IN THIS CASE, THE STATUTE OF LIMITATIONS FOR HANDLING ADMINISTRATIVE VIOLATIONS IS THREE MONTHS FROM THE DATE THE AUTHORITY RECEIVES THE DECISION TO SUSPEND AND THE VIOLATION FILE. 4. WITHIN THE PERIODS PROVIDED FOR IN PARAGRAPHS 1, 2, AND 3 OF THIS ARTICLE, IF THE INDIVIDUAL OR ORGANIZATION AGAIN COMMITS A NEW VIOLATION IN THE CIVIL AVIATION SECTOR OR INTENTIONALLY EVADES OR OBSTRUCTS THE HANDLING OF VIOLATIONS, THE STATUTE OF LIMITATIONS PROVIDED FOR IN PARAGRAPHS 1, 2, AND 3

SHALL NOT APPLY. where there is evasion or obstruction of punishment, the time limit prescribed in Clauses 1, 2, and 3 shall not be applied. The statute of limitations for administrative violations in the civil aviation sector shall be recalculated from the time of committing a new administrative violation or the time when the act of evading or obstructing punishment ceases.

5. If the aforementioned deadlines have passed, no punishment shall be imposed, but measures to remedy consequences shall still be applied as stipulated in this Decree.

Article 6. Time considered as not having been punished

Individuals or organizations that have been administratively punished in the civil aviation sector, if they do not reoffend within one year from the date of completing the execution of the punishment decision or from the date when the deadline for enforcing the punishment decision expires, shall be deemed as not having been administratively punished in the civil aviation sector.

Chapter II
VIOLATIONS, FORMS, AMOUNTS OF PUNISHMENT AND MEASURES TO REMEDY CONSEQUENCES

Article 7. Violations concerning aircraft

1. A fine of VND 500,000 to VND 1,000,000 for each of the following acts:

a) Smoking in the toilet or other unauthorized areas on board the aircraft;

b) Passengers using electronic devices or radio transmitters on board the aircraft without permission;
c) Passengers failing to comply with crew members' instructions regarding air traffic order, security, safety, and disease prevention;
d) Stealing or appropriating items, equipment, or property on board the aircraft.

2. A fine of VND 1,000,000 to VND 5,000,000 for each of the following acts:

a) Passengers improperly using safety equipment on board the aircraft;
b) Damaging the aircraft, engines, propellers, or equipment on board the aircraft.

3. A fine of VND 5,000,000 to VND 10,000,000 for each of the following acts:

a) Flight crew members not carrying all required documents and materials as prescribed;
b) Crew members using electronic devices or radio transmitters on board the aircraft without permission;
c) Aircraft operators using insecticides or bactericides prohibited or restricted for use in Vietnam.

4. A fine of VND 10,000,000 to VND 20,000,000 for each of the following acts:

a) Illegally opening emergency exits on operating aircraft;

b) Crew members using narcotics on board the aircraft;

c) Aircraft operators maintaining aircraft, engines, propellers, or equipment on board the aircraft at unapproved maintenance facilities;

d) Aircraft operators not complying with issued Airworthiness Certificates;

đ) Aircraft operators not complying with issued Radio Equipment Usage Permits;
e) Aircraft operators putting aircraft into operation with onboard equipment lacking appropriate certification;

g) Operating aircraft under lease contracts without approval from competent authorities;

h) Aircraft, engines, or propellers produced in or imported into Vietnam lacking or not conforming to issued Type Certificates;

i) Service providers designing, manufacturing, maintaining, or testing aircraft, engines, propellers, or onboard equipment without complying with issued Operating Licenses;

k) Aircraft operators not purchasing third-party liability insurance or purchasing below the required limit;

5. A fine of VND 20,000,000 to VND 30,000,000 for each of the following acts:
a) Aircraft operators not complying with issued Operator Certificates;
b) Aircraft operators incorrectly painting or attaching nationality marks or registration marks;
c) Aircraft operators maintaining aircraft, engines, propellers, or onboard equipment not according to approved maintenance schedules;

d) Aircraft operators using aircraft, engines, propellers, or parts imported for educational purposes or non-commercial activities;

đ) Aircraft operators installing radio equipment without installation permits;

e) Aircraft operators not staffing sufficient crew members as required;

g) Aircraft operators not complying with regulations on monitoring safety and security during operations;

h) Importing aircraft not in compliance with age restrictions.

6. A fine of VND 30,000,000 to VND 50,000,000 for each of the following acts:

a) Aircraft operators putting aircraft into operation without Nationality Registration Certificates;

b) Service providers designing, manufacturing, maintaining, or testing aircraft, engines, propellers, or onboard equipment without Operating Licenses;

c) Aircraft operators putting aircraft into operation without Airworthiness Certificates;;

d) Aircraft operators operating aircraft for commercial purposes without Operator Certificates; đ) Aircraft operators not organizing monitoring of safety and security during operations as required.

a) Revocation of certificates, licenses, and qualifications for up to three months for violations specified in points a, b, d, đ, i Clause 4, point a, c Clause 5, and point đ Clause 6 of this Article;

7. Additional forms of administrative sanction:

b) Confiscation of objects and means used to commit violations specified in point d Clause 1, point b Clause 2, and point b Clause 4 of this Article; suspension of the practice certificate for up to three months for violations specified in Points a, b, d, đ, i Clause 4, Point a, c Clause 5, and Point đ Clause 6 of this Article;

b) Confiscation of objects and means used to commit violations specified in Point d Clause 1, Point b Clause 2, and Point b Clause 4 of this Article.

8. Measures to remedy consequences:
a) Compelling remediation of environmental pollution and disease spread for violations specified in point c Clause 3 of this Article;

b) Compelling re-export of aircraft for violations specified in point h Clause 5 of this Article.

Article 8. Violations concerning civil airports and airfields
1. Warning or a fine from VND 100,000 to VND 500,000 for each act of smoking in areas where it is not permitted within the airport premises or while operating vehicles within the airport premises.

2. A fine from VND 500,000 to VND 1,000,000 for each of the following acts:

a) Raising, releasing birds, livestock, or poultry within civil airports or airfields;

b) Placing or using objects or animals illegally to attract birds and animals within civil airports or airfields;
c) Dumping materials, waste, drilling, or excavating illegally within civil airports or airfields.

3. A fine from VND 1,000,000 to VND 5,000,000 for each of the following acts:

a) Operating aircraft, equipment, or devices within the airport premises contrary to regulations, procedures, or operational rules;

b) The operator of equipment, devices, or maintenance and repair facilities within civil airports or airfields failing to comply with regulations or safety, hygiene, fire prevention, and explosion control requirements;

c) Airports enterprises failing to report statistical data on airport operations as required;

d) Damaging aircraft, equipment, or devices within civil airports or airfields;

đ) Organizations or individuals conducting business at civil airports or airfields improperly storing hazardous materials, flammable substances, or explosives within civil airports or airfields;

e) Organizations or individuals providing non-airline services failing to publicly display prices for such services.

4. A fine from VND 5,000,000 to VND 10,000,000 for each of the following acts:

a) Destroying, damaging, altering, or moving markers, barriers, signaling devices, or protective objects within civil airports or airfields;

b) Damaging signs or identification equipment within civil airports or airfields;

c) Damaging aircraft, equipment, or devices within the airport premises;

d) Putting into operation within restricted areas of civil airports or airfields equipment or devices that do not meet technical conditions and environmental protection requirements;

đ) Operators of equipment failing to equip fire prevention and explosion control devices for equipment operating within the airport premises as required;

e) Aircraft operators, or operators of equipment, devices for inspection, maintenance, repair, or cleaning of aircraft, equipment, or devices in areas where they are not permitted within civil airports or airfields.

5. A fine from VND 10,000,000 to VND 20,000,000 for each of the following acts:

a) Airport enterprises failing to comply with the issued Airport Operation Certificate;failing to comply with the Airports and Airfields Operation Certificate that has been issued;

b) Putting into operation within the airport premises equipment or devices that do not meet technical conditions and environmental protection requirements;

c) Airport enterprises allowing or implementing advertising forms within the airport area that affect civilian aviation activities;

d) Organizations or individuals using leased land at civil airports or airfields transferring, assigning, giving, leasing, mortgaging, guaranteeing, or contributing capital through land use rights at civil airports or airfields;

đ) Installing or using lights, signs, signals, or objects affecting aircraft takeoff and landing or identification of civil airports or airfields within civil airports or airfields or adjacent areas;

e) Constructing or installing technical facilities within civil airports or airfields or adjacent areas violating regulations on aviation obstacle height management;

g) Constructing, renovating, upgrading, repairing facilities or installing equipment at civil airports or airfields without notification or approval from competent authorities as prescribed;

h)||| Releasing equipment, items, or other objects within civil airports or airfields affecting flight safety;

i) Operators of equipment putting into operation equipment or devices within the airport premises without a permit as prescribed;

k) Airport enterprises, air service providers, airlines, and air traffic service providers failing to implement or improperly implementing regulations on typhoon and flood prevention at civil airports or airfields;

l) Violating regulations on ensuring security and safety during construction, renovation, upgrading, or repair of facilities at civil airports or airfields;

m) Air service providers failing to comply with the issued Air Service Provision Permit;

n) Airport enterprises, air service providers failing to implement or fully implement their responsibilities as prescribed by law.

6. A fine from VND 20,000,000 to VND 30,000,000 for each of the following acts:

a) Constructing civil airports or airfields or components thereof inconsistent with approved planning, except when authorized by competent authorities;;

b) Using land at civil airports or airfields for purposes not in accordance with regulations;

c) Ceasing to provide air services affecting civilian aviation operations without approval from competent authorities;

d) Airport enterprises, air service providers failing to properly implement regulations on monitoring safety and security for aircraft operations;

đ) Air service providers providing air services at civil airports or airfields without an Air Service Provision Permit, except for flight support services.

7. A fine from VND 30,000,000 to VND 50,000,000 for each of the following acts:

a) Airport enterprises operating airports without an Airport Business License; b) Airport operators operating airports without an Airport Operation Certificate;

c) Airport enterprises, air service providers failing to organize monitoring of safety and security for aircraft operations or air service provision as prescribed.

c) Airports enterprises and air service providers do not organize safety and security supervision for aircraft operations or air services as prescribed.

8. Additional forms of punishment:

a) Revoke the right to use the Certificate, Permit, professional certificate for up to three months for violations stipulated at point a Clause 3, point d, đ Clause 4, point a, b, m Clause 5 and point c Clause 7 of this Article;

b) Confiscate the objects, means of transport used to commit violations stipulated at points b, c Clause 2, point d Clause 3, points a, b, c Clause 4 and point h Clause 5 of this Article.

9. Remedial measures

a) Compel restoration to the original state changed due to administrative violation or compel removal of illegal construction works for violations stipulated at point a Clause 2, point a Clause 4, points c, đ, e Clause 5 and point a Clause 6 of this Article; d) Determine the average monthly business travel distance of the position b) Compel implementation of measures to remedy environmental pollution caused by administrative violations stipulated at point c Clause 2, points b, đ Clause 3 and point e Clause 4 of this Article.

Article 9. Violations concerning aviation staff, training institutions for aviation staff

1. Warning or impose a fine from VND 100,000 to VND 500,000 for each of the following acts:

a) Aviation staff performing duties without carrying the valid relevant Permit;

b) Crew members, air traffic controllers performing duties without carrying the valid medical fitness Certificate;

c) Aviation staff performing duties not in accordance with prescribed procedures affecting civil aviation operations but not threatening aviation security and safety.

a) Crew members performing duties without carrying the valid relevant Permit;

2. A fine from VND 500,000 to VND 1,000,000 for each of the following acts:

b) Aviation staff performing duties without wearing the prescribed safety uniform;

c) Air traffic controllers, personnel operating equipment in the airfield using mobile phones during duty except when using radios for communication purposes;

d) Aviation staff not performing duties or performing them incorrectly according to issued or recognized professional certificates;

đ) Aviation staff performing duties not in accordance with prescribed procedures threatening aviation security and safety;

e) Crew members, air traffic controllers, aircraft maintenance personnel performing

duties not in accordance with prescribed procedures affecting civil aviation operations but not threatening aviation security and safety. a) Aviation staff performing duties without one of the required Permits, professional certificates, medical fitness Certificates;

3. A fine from VND 1,000,000 to VND 5,000,000 for each of the following acts:

b) Crew members, air traffic controllers, aircraft maintenance personnel performing duties not in accordance with prescribed procedures threatening aviation security and safety;

The aircraft commander deciding to commence a flight without

c) the requisite crew members; d) Employers scheduling work and rest periods for aviation staff not in accordance with regulations;

đ) Aviation staff performing duties with breath alcohol concentration exceeding permissible levels;

e) Aviation staff stealing or appropriating passengers' luggage, cargo, mail, parcels, letters transported by aircraft.

a) Aviation staff using forged Permits, professional certificates, medical fitness Certificates;

4. A fine from VND 5,000,000 to VND 10,000,000 for each of the following acts:

b) Persons assigned to train or guide practical exercises not fulfilling their training or guidance duties leading to trainees committing violations threatening civil aviation safety;

d) Employers scheduling work and rest periods for crew members, air traffic controllers, aviation security personnel not in accordance with regulations.

6. A fine from VND 20,000,000 to VND 30,000,000 for each of the following acts:

failing to assign or assigning personnel to positions requiring Permits, professional certificates, medical fitness Certificates without the appropriate Permits, professional certificates, medical fitness Certificates; b) Training institutions implementing training programs and contents not approved, using instructors not in accordance with regulations;

c) Training institutions intentionally falsifying examination results of trainees.

a) Revoke the right to use the Certificate, Permit, professional certificate for up to three months for violations stipulated at points d, đ, e Clause 2, points b, c, đ, e Clause 3, points b, c, d Clause 4, points a, b Clause 5 and points b, c Clause 6 of this Article;

7. Additional forms of punishment

b) Confiscate the objects, means of transport used to commit violations stipulated at point e Clause 3 and point a Clause 4 of this Article.

Compel implementation of measures to remedy environmental pollution caused by administrative violations stipulated at point b Clause 5 of this Article.

8. Measures to remedy consequences:

Order remedial measures to address environmental pollution caused by administrative violations specified in Point b Clause 5 of this Article.

Article 10. Violations of provisions on flight activities

1. A fine of VND 1,000,000 to VND 5,000,000 for each of the following acts:

a) Dropping equipment, objects, and other items outside airports affecting the safety of flight operations, except in cases provided for in point b, Clause 5, Article 9 of this Decree;

b) failing to submit evidence regarding aircraft accidents or incidents when requested by competent authorities;

c) Organizations and individuals responsible for not protecting aircraft involved in accidents or incidents, or equipment and items on such aircraft for investigative purposes;

d) Causing damage to technical systems and equipment ensuring flight operations;

đ) Destroying, intentionally distorting information, damaging equipment required for inspection, and other evidence related to aircraft accidents or incidents.

2. A fine of VND 5,000,000 to VND 10,000,000 for each of the following acts:

a) Organizations and individuals responsible for not reporting aircraft accidents or incidents within the prescribed time limit;

b) Failing to comply with regulations on painting, marking, and installing warning lights for aviation obstacles;

(VND) from small renewable energy power plants, as specified in Clause 2 of this Article;air navigation service providers fail to promptly notify search and rescue service providers upon receiving signals, notifications, or information about aircraft in distress or emergency situations.

3. A fine of VND 10,000,000 to VND 20,000,000 for each of the following acts:

a) Constructing or installing facilities and technical equipment exceeding aviation obstacle limits outside airports;

b) Concealing aircraft accidents or incidents;

c) Air navigation service providers operating systems and equipment without complying with the Operating Permit issued;

4. A fine of VND 20,000,000 to VND 30,000,000 for each of the following acts:

a) Aircraft operators or carriers providing false information or engaging in deceptive acts when applying for flight permits;

b) Aircraft operators or carriers using aircraft contrary to the purpose of the flight permit granted;c) Air navigation service providers operating systems and equipment ensuring flight operations without a Permit issued by competent authorities;

d) Air navigation service providers failing to comply with the Operating Permit for air navigation service provision issued;

đ) Air navigation service providers failing to comply with regulations on monitoring safety and security in the provision of air navigation services as prescribed.

5. A fine of VND 30,000,000 to VND 50,000,000 for each of the following acts:

Intentionally using communication stations or other equipment to interfere with or affect the operation of aviation radio stations;

a) b) Operating air navigation service providers without a Permit issued by competent authorities;

c) Air navigation service providers failing to organize monitoring of safety and security in the provision of air navigation services as prescribed.

6. A fine of VND 50,000,000 to VND 100,000,000 for each of the following acts:

a) Aircraft operators conducting flights without a flight permit issued by competent authorities;

b) Aircraft operators conducting demonstration or training flights over densely populated areas without permission from competent state authorities.

a) Revoking the right to use Permits, Certificates, and Professional Certificates for up to three months for violations stipulated in point a, Clause 2, points b and c, Clause 3, point d, Clause 4, point c, Clause 5, and points a and b, Clause 6 of this Article;

7. Additional forms of punishment

b) Confiscating property and means used to commit violations stipulated in point a, d, đ, Clause 1 and point a, Clause 5 of this Article.  Compelling the removal of unauthorized construction works for violations stipulated in point a, Clause 3 of this Article.

b) Confiscation of objects and means used to commit violations specified in Points a, d, đ Clause 1 and Point a Clause 5 of this Article.

8. Measures to remedy consequences:

Order the demolition of unauthorized construction works for violations specified in Point a Clause 3 of this Article.

Article 11. Violations concerning air transport activities and general air transport operations  common aviation

1. A fine of VND 1,000,000 to VND 5,000,000 for each of the following acts:

a) Vietnamese and foreign airlines fail to provide air transport statistical data to the competent authority as prescribed;
b) Vietnamese airlines implement cooperation related to air transport rights without approval from the competent state agency;
c) Vietnamese airlines fail to register their air transport regulations with the competent state agency as prescribed;
d) Aircraft operators fail to submit or submit insufficient flight documentation to the Civil Aviation Port Authority as prescribed.

2. A fine of VND 5,000,000 to VND 10,000,000 for each of the following acts:

a) Conducting non-commercial general air transport operations without a General Air Transport Operation Registration Certificate issued by the competent authority;

b) Airlines, air service providers fail to comply with rules for transporting dangerous goods by air; does not comply with the rules on transporting dangerous goods by air;

c) Airlines fail to comply with regulations on transporting special cargo by air;

d) Airlines fail to request approval or register with the competent authority as prescribed when changes occur in the contents stipulated in the issued permit during operation;

e) Air service providers fail to enter into contracts for providing general air services with organizations or individuals permitted to use such services;;

f) Representative offices or ticket sales offices of foreign airlines operating in Vietnam fail to fulfill obligations and regulations as prescribed in the issued permits; issuance;

g) Airlines transport passengers prohibited from commercial air travel unless authorized by the competent state agency;

3. A fine of VND 10,000,000 to VND 20,000,000 for each of the following acts:

a) Airlines fail to comply with regulations on applying air transport fare rates;failing to comply with b) Computerized reservation system businesses fail to comply with principles for operating computerized reservation systems;

b) Businesses operating computer reservation systemsfailing to comply principles for operating computer reservation systems;

c) Airlines fail to purchase civil liability insurance for passengers, baggage, cargo, or purchase it below the prescribed limit; Carriers fail to perform or perform incompletely their obligations as prescribed in cases of flight delays, cancellations, or refusal to transport;

d) The carrier fails to perform or performs incompletely its obligations as prescribed in cases of flight delays, cancellations, or refusal to carry passengers.;

d) Ticket agents conduct agency ticket sales activities for foreign airlines in Vietnam without a Ticket Agency Contract Registration Certificate issued by the competent authority;.

4. A fine of VND 20,000,000 to VND 30,000,000 for each of the following acts:

a) Airlines transport luggage not accompanying passengers, except as provided for in Clause 2, Article 149 of the Civil Aviation Law of Vietnam;

b) Representative offices or ticket sales offices of foreign airlines operating in Vietnam operate without an office establishment permit; c) Cargo handling enterprises conducting air cargo handling services without registration or failing to comply with the registration for issuing secondary air waybills;

c) Cargo handling enterprises providing cargo handling services by air without having or failing to comply with n tham gia ca the secondary air waybill registration;

d) Airlines conduct trade promotion, advertising, marketing activities using images, brands, symbols, trademarks in violation of regulations;

5. A fine of VND 30,000,000 to VND 50,000,000 shall be imposed on airlines that fail to comply with the business permit for air transport or the business permit for general air transport operations already issued.

a) Aircraft operators conducting flights without a flight permit issued by competent authorities;

a) Airlines transport dangerous goods without a Dangerous Goods Air Transport Qualification Certificate issued or recognized by the competent authority;

b) Airlines transport passengers, baggage, cargo, mail packages, letters for commercial purposes without an air transport business permit or conduct general air transport operations for commercial purposes without a general air transport business permit;

c) Airlines engage in air transport business before obtaining the right to transport or violate the conditions of the granted air transport rights; purchase, sell, transfer air transport rights;

d) Airlines transport weapons, war tools, nuclear waste without permission from the competent authority;

7. Additional forms of administrative sanction:

a) Suspension of the use of the Business Permit, Qualification Certificate, Professional Certificate for up to three months for violations as specified in points b, e Clause 2, point b Clause 3, point c Clause 4, Clause 5, and point c Clause 6 of this Article; suspension of the practice certificate for up to three months for violations specified in Points b, e Clause 2, Point b Clause 3, Point c Clause 4, Clause 5, and Point c Clause 6 of this Article;
b) Confiscation of contraband items, means of transportation used for administrative violations as specified in point d Clause 3 and points b, c Clause 4 of this Article; confiscation of objects and means used to commit administrative violations specified in Point đ Clause 3 and Points b, c Clause 4 of this Article.
8. Measures to remedy consequences:

Order remedial measures to address environmental pollution and disease spread caused by administrative violations as specified in point b, c Clause 2 and points a, d Clause 6 of this Article. Points b, c Clause 2 and Points a, d Clause 6 of this Article.

Article 12. Violations concerning aviation security provisions

a) Aviation staff performing duties without carrying the valid relevant Permit;

a) Using an access control card outside the scope indicated on the card;
b) Failing to comply with instructions from aviation security personnel when in restricted areas of airports;
c) Losing an access control card without immediately reporting it to the issuing authority;
d) Illegally entering restricted areas of airports;

d) Aviation staff not wearing an access control card while performing duties in restricted areas of airports.

2. A fine from VND 500,000 to VND 1,000,000 for each of the following acts:
a) Using another person's access control card to enter restricted areas of airports, boarding aircraft;
b) Causing disturbances, inciting others to cause disturbances, disrupting aviation security and order at airports;  c) Passengers failing to comply with regulations regarding carrying liquids into restricted areas

boarding aircraft., boarding the aircraft.

3. A fine of VND 1,000,000 to VND 3,000,000 for each of the following violations:

a) Entering restricted areas, boarding aircraft without undergoing aviation security screening;

b) Passengers violating discipline on board aircraft;

c) Threatening civil servants, employees, officials, aviation staff performing their duties at airports and other restricted areas;
d) Threatening passengers, crew members at airports;

đ) Entering quarantine areas, boarding aircraft using another person's identity documents, boarding passes;

e) Airports enterprises, aviation security service providers failing to provide sufficient documentation at security checkpoints as required;

g) Illegally entering restricted areas of airports and civil aviation facilities, equipment causing aviation security and safety risks;

h) Failing to comply with regulations regarding registration, acceptance of weapons, support tools, dangerous items permitted to be brought into restricted areas.

4. A fine of VND 3,000,000 to VND 5,000,000 for each of the following violations:

a) Bringing persons, luggage, goods, mail, packages, letters, and other objects not yet screened through aviation security into restricted areas at airports, boarding aircraft;

b) Assaulting or threatening crew members, passengers on board aircraft;

c) The aircraft commander allowing persons, objects into the cockpit contrary to regulations;

d) The aircraft commander failing to lock the cockpit door according to regulations during flight;

đ) Renting, lending, forging access control cards to enter restricted areas;

e) Airports enterprises failing to store operation logs, maintenance records of security equipment as required;

g) Organizations, individuals responsible for failing to report or reporting inaccurately incidents of illegal interference with civil aviation operations;

h) Assaulting civil servants, employees, officials, aviation staff performing their duties at airports and other restricted areas;
i) Assaulting passengers, crew members at airports;

k) Airlines failing to comply with regulations regarding transporting weapons carried by persons on flights.

5. A fine of VND 5,000,000 to VND 10,000,000 for each of the following violations:

a) Bringing prohibited hazardous items into restricted areas, boarding aircraft;

b) Airports enterprises using security equipment that does not meet standards for conducting security checks, scans, surveillance as prescribed;  c) Airlines transporting more than the allowed number of criminal suspects, deportees, extraditees;

d) Airports enterprises failing to record images or record images from X-ray machines, video surveillance cameras as required.

d) Airports enterprises fail to record images or record images through X-ray machines, surveillance cameras at the prescribed times.

6. A fine of VND 10,000,000 to VND 20,000,000 for each of the following violations:

a) Illegally entering aircraft;

b) Bringing prohibited support tools, crude weapons into restricted areas, boarding aircraft;

c) Spreading false information about bombs, explosive materials, explosives, radioactive substances, chemical biological weapons or other types of information that may threaten the safety of aircraft, people on the ground, civil aviation facilities, equipment and affect normal civil aviation operations;  d) Airports enterprises, airlines, catering service providers, fuel suppliers, air traffic control agents using unauthorized security seals;

đ) Airports enterprises, airlines, aircraft operators, service providers ensuring flight operations, air service providers failing to comply with approved or authorized aviation security programs, security regulations.

7. A fine of VND 20,000,000 to VND 30,000,000 for each of the following violations:

a) Bringing explosives, explosive materials, radioactive substances, military weapons, flammable materials into restricted areas, boarding aircraft;
Spreading false information about bombs, explosive materials, explosives, radioactive substances, chemical biological weapons or other types of information
b) that may threaten the safety of aircraft in flight; c) Airports enterprises, airlines, aircraft operators, air navigation service providers, air service providers lacking approved or authorized aviation security programs, security regulations. a) Revocation of license, professional certificate for up to three months for violations stipulated in point a Clause 4, point a Clause 5, points b, c Clause 6 and points a, b Clause 7 of this Article;

b) Confiscation of evidence, means used to commit violations

Chapter III
AUTHORITY TO IMPOSE PENALTIES
Article 13. Competence to impose administrative penalties of Chairpersons of People's Committees at all levels

1. Chairperson of the People's Committee at the commune level:

a) To issue warnings;

b) To impose fines up to VND 2,000,000.

c) To confiscate items or means used for administrative violations valued up to two million dong;

d) Apply the measures to remedy consequences specified in points a, b, and d Clause 3 Article 4 of this Decree.

2. Chairperson of the People's Committee at the district level:

a) To issue warnings;

b) Impose fines up to thirty million dong;

c) Revoke the right to use Licenses, Certificates, and practice certificates within their competence;

d) Confiscate objects and means used to commit administrative violations;

đ) Apply the measures to remedy consequences specified in points a, b, and d Clause 3 Article 4 of this Decree;

3.  Chairperson of the People's Committee at the provincial level:

a) To issue warnings;

b) Impose a fine up to VND 100,000,000.

c) Revoke the right to use Licenses, Certificates, and practice certificates within their competence;

d) Confiscate objects and means used to commit administrative violations;

đ) Apply the measures to remedy consequences specified in points a, b, c, d, and đ Clause 3 Article 4 of this Decree.

Article 14. Competence to impose administrative penalties for violations of civil administration of the People's Public Security

1. Public security officers performing their duties have the authority to:

a) To issue warnings;

b) Imposing a fine up to VND 200,000.

2. The Station Chief, Team Leader of those specified in Clause 1 of this Article have the authority:

a) To issue warnings;

b) Impose a fine up to 500,000 VND.

3. The Head of the Public Security Police Station has the authority:

a) To issue warnings;

b) To impose fines up to VND 2,000,000.

c) To confiscate items or means used for administrative violations valued up to two million dong;

d) Apply the measures to remedy consequences specified in points a, b, and d Clause 3 Article 4 of this Decree.

4. The Head of the County Public Security Office has the authority:

a) To issue warnings;

b) Impose fines up to 10,000,000 VND;

c) Revoke the right to use Licenses and practice certificates within their competence;

d) Confiscate objects and means used to commit administrative violations;

đ) Apply the measures to remedy consequences specified in points a, b, and d Clause 3 Article 4 of this Decree.

5. The Director of the Provincial Police Department has the authority to:

a) To issue warnings;

b) Impose fines up to thirty million dong;

c) Revoke the right to use Licenses and practice certificates within their competence;

d) Confiscate objects and means used to commit administrative violations;

đ) Apply the measures to remedy consequences specified in points a, b, and d Clause 3 of this Decree.
6. The person with the authority to impose administrative penalties of public security agencies shall impose penalties on administrative violations in the field of civil aviation in the following cases:

a) Administrative violations discovered during the implementation of emergency plans;

b) Administrative violations in the field of civil aviation concerning security, public order, and social safety in public areas at airports, which are transferred by civil aviation authorities.

Article 15. Competence rights to impose penalties of Civil Aviation Inspectors, Heads of Civil Aviation Inspection, and Heads of the Ministry of Transport's Inspection

1. Civil Aviation Inspectors performing official duties have the right:

a) To issue warnings;

b) Impose a fine up to 500,000 VND;

c) Confiscate objects and means used to commit administrative violations up to VND 2,000,000 in value;

d) Apply the measures to remedy consequences specified in points a, b, and d Clause 3 Article 4 of this Decree, except for the measure of dismantling illegal construction works.

2. Head of Civil Aviation Inspection has the right:

a) To issue warnings;

b) Impose fines up to thirty million dong;

c) Revoke the right to use Licenses, professional certificates, and Certificates;

d) Confiscate objects and means used to commit administrative violations;

đ) Apply the measures to remedy consequences specified in points a, b, d, and đ Clause 3 Article 4 of this Decree.

5. The Director of the Port Marine Traffic Inspectorate, the Head of the Specialized Inspection Team of the Port Marine Traffic Inspectorate have the authority:

a) To issue warnings;

b) Impose a fine up to VND 100,000,000.

c) Revoke the right to use Licenses, professional certificates, and Certificates;

d) Confiscate objects and means used to commit administrative violations;

đ) Apply the measures to remedy consequences specified in points a, b, d, and đ Clause 3 Article 4 of this Decree.

Article 16. Competence to impose penalties of Directors of Civil Aviation Port Authorities

1. Issue a warning;

2. Fine up to VND 10,000,000;

3. Revoke the right to use Licenses, professional certificates, and Certificates;

4. Confiscate objects and means used to commit administrative violations;

5. Apply the measures to remedy consequences specified in points a, b, and d Clause 3 Article 4 of this Decree.

Article 17. Principles for determining competence  Additional penalties:  1. Persons violating the law who are sentenced by the court to a warning, fine, or non-custodial reeducation shall be disciplined with a warning, demotion, or dismissal.  to impose administrative penalties
1. The person with the authority to impose administrative penalties in the field of civil aviation has the authority to impose administrative penalties within their management scope. In cases of fines, the authority to impose penalties is determined based on the maximum amount of the fine prescribed for each specific violation. 2. In cases where an administrative violation falls under the competence to impose penalties of multiple persons, the penalty shall be imposed by the first person to handle the case.
3. Determining the authority to impose penalties for forms of penalties and measures to remedy consequences in specific cases shall be carried out according to the provisions at

3. The determination of the authority to impose penalties and remedial measures for specific cases shall be carried out in accordance with the provisions of              Article 42 of the Ordinance and Article 15 Decree No. 128/2008/NĐ-CP dated December 16, 2008 of the Government detailing the implementation of certain provisions of the Administrative Violation Handling Ordinance 2002 and the Ordinance amending and supplementing certain provisions of the Administrative Violation Handling Ordinance 2008.

Article 18. Delegation to impose administrative penalties
1. The Chairpersons of People's Committees at all levels, the Heads of the Inspection Department under the Ministry of Transport, the Heads of Civil Aviation Inspectors, the Directors of Civil Aviation Port Control Departments, and the heads of public security forces at all levels specified in Article 14 of this Decree may delegate their deputies to impose administrative penalties.

2. The delegation shall be carried out in accordance with Article 41 of the Ordinance and Article 16 of Decree No. 128/2008/NĐ-CP dated December 16, 2008 of the Government detailing the implementation of certain provisions of the Administrative Violation Handling Ordinance 2002 and the Ordinance amending and supplementing certain provisions of the Administrative Violation Handling Ordinance 2008.

Chapter IV
PROCEDURES FOR IMPOSING PENALTIES

Article 19. Suspension of administrative violation acts

When discovering administrative violations in the civil aviation sector, the authorized penalty-imposing authority and those performing official duties must immediately issue an order to suspend the violation act.

Article 20. Simplified Penalty Procedure

1. The simplified penalty procedure shall be applied in cases where a warning or a fine up to VND 200,000 is imposed, except for cases where the administrative violation is discovered through the use of technical equipment.

2. In cases where penalties are imposed according to the simplified procedure, the authorized authority does not prepare a record but decides on the penalty on the spot. The penalty decision must be in writing according to the Model Decision No. 2 attached to this Decree.

Article 21. Preparation of Administrative Violation Records

1. In cases where administrative penalties are imposed in the form of fines over VND 200,000 or administrative violations are discovered through the use of technical equipment, the person performing official duties must prepare an administrative violation record according to Model Record No. 01 attached to this Decree.

2. In cases where administrative violations in the civil aviation sector are discovered through the use of technical equipment, the preparation of the administrative violation record must be conducted immediately after identifying the violator.

Evidence collected through technical equipment must be reflected in the administrative violation record.

The use of technical equipment to track down and discover violators in the civil aviation sector is regulated in Article 55a of the Administrative Violation Handling Ordinance.

3. In cases where the violator intentionally avoids or due to objective reasons is absent from the location of the violation, the completed record must have the signature of a representative of the local authority where the violation occurred or of two witnesses.

Article 22. Penalty Decision

1. The deadline for issuing a penalty decision is ten days, counted from the date of preparing the administrative violation record; for complex administrative violation cases, the deadline for issuing a penalty decision is thirty days. If additional time is needed for verification and evidence collection, the authorized authority must report in writing to their direct superior to request an extension; the extension must be in writing, and the extended period cannot exceed thirty days. Beyond the said deadline, the authorized authority may not issue a penalty decision; if no penalty decision is issued, other remedial measures provided for in this Decree can still be applied.

2. When imposing penalties on a person who commits multiple administrative violations, the authorized authority shall issue only one penalty decision specifying the form and level of penalty for each violation; if the penalties are fines, they shall be combined into a total fine.

3. The penalty decision must clearly state whether payment is to be made in one or several installments; if in several installments, the amount and deadline for each installment must be specified. Payment in installments is regulated in Article 27 DECREE               number 128/2008/NĐ-CP dated December 16, 2008  of the Government.
4. The penalty decision takes effect from the date of signing, except when a specific effective date is stipulated in the decision. The effective decision must be sent to the organization or individual subject to the penalty and the revenue collection agency within three days from the date of issuance of the penalty decision.

Article 23. Procedure for Imposing Fines

1. In cases where fines are imposed on individuals or organizations that have violated regulations, the authorized authority imposing penalties may temporarily detain the Vehicle Circulation Permit, Driver's License, or other necessary related documents to ensure the enforcement of the penalty decision. If the violator does not possess such documents, the authorized authority imposing penalties may temporarily detain the contraband items or vehicles involved in the violation, but shall not temporarily detain vehicles belonging to others that the violator has used improperly or vehicles that are legitimate assets of organizations entrusted to the violator for use or control.

2. The authorized authority imposing penalties may only temporarily detain security control cards or Aircrew Permits if the individual being penalized does not have other identification documents.

3. The temporary detention of documents, contraband items, or vehicles must be recorded in a record form attached to this Decree.

4. The person issuing the penalty decision must return the detained documents, contraband items, or vehicles immediately upon completion of the penalty decision execution by the individual or organization. The person issuing the penalty decision and the individual or organization whose documents, contraband items, or vehicles were temporarily detained must sign the detention record regarding the return and receipt of the documents, contraband items, or vehicles.

5. The procedure for temporarily detaining and handling contraband items or vehicles involved in administrative violations for verification of circumstances serving as grounds for handling or to immediately stop the violation shall be applied according to Clause 5 of Article 46 of the Ordinance on Handling Administrative Violations.

6. Organizations or individuals fined must pay the fine at the location specified in Article 28 of Decree No. 128/2008/NĐ-CP dated December 16, 2008 of the Government.

Article 24. Transfer of Violation Case Files with Signs of Criminal Offenses for Criminal Liability Pursuit

When considering a violation case to decide on a penalty, if it is found that the violation has signs of criminal offenses or if after issuing a penalty decision, it is discovered that the violation has signs of criminal offenses within the statute of limitations for criminal liability pursuit, then the penalty decision must be revoked and the violation case file transferred to the competent criminal proceedings authority according to Article 62 of the Ordinance on Handling Administrative Violations.

Article 25. Execution of Administrative Violation Penalty Decision

1. Individuals or organizations penalized for administrative violations in the civil aviation sector must execute the penalty decision within ten days from the date they receive the penalty decision. If the individual or organization penalized fails to voluntarily execute the penalty decision beyond this period, coercive measures will be enforced according to the law.

2. Individuals penalized with a fine of VND 500,000 or more may have their payment of the fine postponed according to the provisions of Article 65 of the Administrative Violation Handling Ordinance.

Article 26. Coercive Enforcement of Administrative Violation Penalty Decision

1. Individuals or organizations penalized for administrative violations who fail to voluntarily execute the penalty decision shall have coercive enforcement measures applied as stipulated in Clause 1 of Article 66 of the Ordinance. on Handling Administrative Violations.

2. The procedures for applying coercive enforcement measures for administrative violation penalty decisions in the civil aviation sector shall be carried out according to the provisions of Clauses 2, 3, 4, 5, and 6 of Article 66 and 66a of the Ordinance on Handling Administrative Violations and Decree No. 37/2005/NĐ-CP dated March 18, 2005 of the Government on the procedures for applying coercive enforcement measures for administrative violation penalty decisions.
3. The Director of the Ministry of Transport Inspectorate decides on and organizes the coercive enforcement of administrative violation penalty decisions in the civil aviation sector issued by themselves and subordinate levels.
4. The Civil Aviation Inspector decides on and organizes the coercive enforcement of administrative violation penalty decisions in the civil aviation sector issued by themselves, subordinate levels, and the Director of the Civil Aviation Port Authority.

5. The Director of the Civil Aviation Port Authority decides on and organizes the coercive enforcement of administrative violation penalty decisions in the civil aviation sector issued by themselves and subordinate levels.

Article 27. Time limit for enforcement of administrative penalty decisions

The time limit for enforcing an administrative penalty decision is one year, counted from the date of issuance of the penalty decision. In cases where individuals or organizations being penalized intentionally evade or delay, the aforementioned time limit shall be recalculated from the date when such evasive or delaying actions cease..

Article 28. Forms of records and decisions to be used in administrative penalties

Attached hereto as an appendix to this Decree are forms of records and decisions to be used in the process of imposing administrative penalties in the civil aviation sector.

Chapter V
IMPLEMENTING PROVISIONS
Article 29. Effective Date

This Decree takes effect from July 20, 2010, and replaces Government Decree No. 91/2007/NĐ-CP dated June 1, 2007, on administrative penalties in the civil aviation sector.

Article 30. Implementation
1. The Minister of Transport is responsible for implementing this Decree.

2. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairmen of People's Committees of provinces and centrally administered cities are responsible for implementing this Decree./.
