||| The Prime Minister issued Decision stipulating the functions, tasks, and powers and 1. Article 1. Position and Functions
||| Vietnam Highway Corporation is an organization under the Ministry of Transport, performing the function of advising and assisting the Minister of Transport (hereinafter referred to as the Minister) in state management and enforcement of laws on road transport throughout the country; organizing the implementation of public service activities related to road transport according to the provisions of the law.
The Vietnam Highway Administration has legal personality, its seal bearing the National Emblem, a separate account at the State Treasury, and its headquarters in Hanoi City.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
||| 1. Drafting for the Minister to submit to competent authorities or promulgating within its authority:
||| a) Draft laws, ordinances, and draft regulatory legal documents on road transport;
||| b) Strategies, plans, long-term programs, five-year plans, annual plans, national programs, projects, and development proposals for road transport throughout the country.
||| 2. Drafting national standards, technical regulations, and economic-technical norms specific to road transport, submitting them to the Minister for promulgation within his/her authority or for the Minister to propose to competent authorities for review and publication; organizing the drafting, reviewing, and publishing of basic standards specific to road transport.
||| 3. Directing, inspecting, and organizing the implementation of regulatory legal documents, mechanisms, policies, strategies, national programs, plans, proposals, and projects on road transport after they have been approved or promulgated by competent authorities.
5. Regarding investment construction, operation, and maintenance of road infrastructure:
||| 5. On management, operation, and maintenance of road infrastructure:
||| a) Drafting regulations on management, operation, and maintenance of road infrastructure for the Minister to promulgate;
||| b) Drafting regulations on classification and adjustment of the national highway system; connection requirements to roads; weight and dimension limits for roads and their announcement for national highways; traffic signs; vehicle speed limits and speed limit sign placement; organization and operation of weigh stations; issuance of permits for oversized, overweight vehicles, tracked vehicles, and vehicles transporting extra-long and extra-heavy cargo, and organizing their implementation;
||| c) Drafting mechanisms to generate funds for construction, management, and maintenance of road infrastructure for the Minister to submit to competent authorities for promulgation and organizing their implementation;
||| d) Organizing traffic on the national highway system, ensuring safe and smooth traffic flow; managing, operating, and maintaining road infrastructure managed by Vietnam Highway Corporation according to technical standards and regulations;
||| đ) Guiding the management, operation, and maintenance of local roads; compiling the development status of the local road system nationwide;
g) Coordinate with relevant agencies and local authorities to protect road infrastructure and road safety zones;
||| g) Drafting toll and fee rates for roads, submitting them to competent authorities for approval and organizing toll and fee collection activities according to the law;
||| h) Cooperating with relevant agencies and local authorities to protect road infrastructure and road safety zones;
||| i) Organizing bidding, ordering, or assigning production and supply plans for public services in the management and maintenance of national highways according to the law.
||| 6. On investment management of road infrastructure:
||| a) Drafting technical standards, economic-technical norms for road infrastructure for the Minister to promulgate within his/her authority and guiding and inspecting their implementation;
||| b) Performing the duties and powers of the investment decision-making agency and project owner for road construction projects according to the law and the delegation and authorization of the Minister;
||| c) Performing the duties and powers of the competent state agency for investment projects under the Build-Operate-Transfer (BOT), Build-Transfer-Operate (BTO), Build-Transfer (BT), and other contractual forms authorized by the Minister.
||| 7. On management of expressways:
||| a) Leading the drafting of technical standards, economic-technical norms, mechanisms, and policies for expressway management;
||| b) Organizing the management, maintenance, and operation of expressway systems according to the law;
||| c) Mobilizing investment capital, organizing the management of construction projects, and performing the functions of a competent state agency for expressway investment projects according to the delegation and authorization of the Ministry of Transport.
||| 8. On management of motor vehicles and drivers of motor vehicles on road transport (excluding motor vehicles and drivers of motor vehicles serving defense and security purposes):
||| a) Drafting regulations on training, examination, issuance, renewal, and revocation of driving licenses for drivers of motor vehicles on road transport; regulations on issuing legal knowledge certificates for specialized motorcycle drivers participating in road transport and guiding their implementation;
||| b) Drafting regulations on technical standards and norms for driving test centers; issuing certificates for driving test centers for motor vehicles meeting the conditions for operation according to the law and guiding and inspecting their implementation;
d) Manage training, examination, and issuance of driving licenses for motor vehicles and certificates of traffic law knowledge enhancement for special-purpose motorcycle drivers participating in traffic according to the delegation of the Minister.
||| d) Managing training, examination, issuance of driving licenses for motor vehicles and legal knowledge certificates for specialized motorcycle drivers participating in road transport according to the delegation of the Minister;
d) Organize the registration of specialized motorcycles participating in road traffic;
||| e) Collaborating in drafting technical standards and norms for transportation equipment and devices;
||| 9. On management of road transport:
||| a) Drafting regulations on organization and management of road transport activities and supporting services for road transport for the Minister;
b) Draft and submit to the Minister for approval the program and plan for international cooperation in road transport; draft and submit to the Minister for submission to the competent authority for approval proposals on signing or joining international treaties on roads; participate in negotiating international treaties according to authorization, decentralization, and organize negotiations, signing agreements, and international cooperation programs as prescribed; organize the issuance of permits for international road transport according to international treaties and agreements on road transport as decentralized by the Minister;
c) Manage road transport activities and supporting services for road transport as prescribed by law; manage bus passenger transport routes as assigned by the Minister;
d) Guide and inspect the implementation of business conditions for road transport; guide the development of collective economic organizations in road transport;
đ) Coordinate in developing pricing frameworks for freight rates, loading and unloading, and other monopoly-operated supporting services for road transport, as well as those subsidized by the State or entrusted to enterprises;
10. On road traffic safety:
a) Draft and submit to the Minister projects and solutions to ensure traffic order and safety on roads; guide and inspect the implementation of measures to ensure road traffic safety as prescribed by law;
b) Organize propaganda on road traffic safety and measures to reduce road traffic accidents;
c) Organize the implementation of work to prevent and combat typhoons, floods, and coordinate search and rescue operations in road traffic according to the division of labor by the Minister;
d) Draft and submit to the Minister regulations on assessing road traffic safety in road construction, management, and maintenance; implement and coordinate the implementation of projects on road traffic safety;
đ) Coordinate with public security agencies and the National Road Safety Committee in providing data on vehicle registration, accident statistics, and driver's license revocation;
11. On environmental protection in road transport:
a) Draft and submit to the Minister technical standards and norms on the environment in road infrastructure construction, operation, and maintenance;
b) Organize the preparation and submit to the competent authority for review and approval strategic environmental assessments, environmental impact assessments, and environmental protection commitments for planning, programs, and projects on the development of road infrastructure according to the provisions of the law;
c) Organize the implementation of programs, projects, plans, and master plans on environmental protection in road infrastructure construction, management, and maintenance within the scope of management of the Vietnam Highway Administration;
12. Implement international cooperation in road transport according to the decentralization by the Minister;
13. Research and apply scientific progress and transfer technology in the field of road transport; build and maintain a specialized electronic information portal and a database on roads to serve the management of road transport;
14. Carry out specialized inspection work in road transport according to the provisions of the law; handle complaints and denunciations; prevent and combat corruption, practice thrift, and waste according to the authority granted;
15. Manage organizational structure, staffing, cadres, civil servants, officials, and employees; implement salary systems and incentive policies, rewards, and disciplinary measures for cadres, civil servants, officials, and employees under the management of the General Department according to the provisions of the law; draft and submit to the Minister the organizational structure, job positions, and civil service grade structure of the Vietnam Highway Administration;
16. Manage finances and assets assigned, organize the implementation of budget management according to the provisions of the law and decentralization by the Minister;
17. Perform other tasks and powers delegated by the Minister and as prescribed by law;

The organizations from Clause 1 to Clause 16 of this Article assist the Director-General in performing state management functions; the organizations from Clause 17 to Clause 21 of this Article are affiliated non-profit organizations under the Vietnam Highway Administration;
The Highway Management Bureaus I, II, III, and IV have functional departments and highway management branches. The Minister of Transport decides on the establishment of branches according to the Project attached to the Memorandum No. 6073/TTr-BGTVT dated June 26, 2013 of the Ministry of Transport;
The Director-General of the Vietnam Highway Administration shall prescribe the functions, tasks, powers, and organizational structures of the affiliated organizations;
Article 4. Leadership of the General Department
1. The Vietnam Highway Administration has a Director-General and not more than three Deputy Director-Generals;
2. The Director-General and Deputy Director-Generals are appointed, relieved of duty, or dismissed by the Minister of Transport according to the provisions of the law;
3. The Director-General of the Vietnam Highway Administration is responsible before the Minister of Transport and the law for all activities of the Vietnam Highway Administration. Deputy Director-Generals are responsible before the Director-General and the law for the areas they are assigned;
Article 5. Effectiveness and Responsibility for Implementation
1. This Decision takes effect from December 10, 2013 and replaces Decision No. 107/2009/QĐ-TTg dated August 26, 2009 of the Prime Minister prescribing the functions, tasks, powers, and organizational structure of the Vietnam Highway Administration under the Ministry of Transport;
2. Ministers, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairmen of provincial and centrally-administered city People's Committees, Director-General of the Vietnam Highway Administration, relevant agencies, organizations, and individuals are responsible for implementing this Decision./.
