Article 1. Clause 2 of Article 5 of Circular No. 202/2013/TT-BTC shall be amended and supplemented as follows:
The revenue from the use of telecommunications number blocks fees, the fee collection agency is entitled to retain 90% for organizing the collection process and using it in accordance with Circular No. 188/2011/TT-BTC dated December 19, 2011 issued by the Ministry of Finance guiding the financial mechanism of the Telecommunications Administration. The remaining revenue (10%) shall be remitted to the State budget according to the current State budget classification. This provision shall be implemented until December 31, 2016. From 2017 onwards, it shall be carried out in accordance with the Law on Fees and Charges and detailed regulations implementing this law.
The Ministry of Information and Communications is responsible for organizing an assessment of the collection capacity and expenditure needs from telecommunications number block usage fees to determine the retention rate for subsequent periods, and submitting these assessments to the Ministry of Finance for review and decision-making.
Article 2. Implementation
1. This Circular shall take effect from May 19, 2016 and apply to the fiscal year 2016.
2. Other provisions related to allocation fees and telecommunications number block usage fees not mentioned in this Circular shall continue to be implemented according to Circular No. 202/2013/TT-BTC.
3. Organizations, individuals subject to payment of fees and charges, and relevant agencies are responsible for implementing this Circular. During the implementation process, if any difficulties arise, organizations and individuals are requested to promptly report them to the Ministry of Finance for review and guidance./.
