RESOLUTION
On Investment Orientation Construction Project expressway project from Chau Doc to Can Tho to Soc Trang phase 1
OF THE NATIONAL ASSEMBLY
Based on the Constitution of the Socialist Republic of Vietnam;
Pursuant to the Law on Public Investment No. 39/2019/QH14, as amended and supplemented by Law No. 64/2020/QH14, Law No. 72/2020/QH14, and Law No. 03/2022/QH15; Pursuant to Resolution No. 29/2021/QH15 dated July 28, 2021 of the National Assembly on the mid-term public investment plan for the period 2021-2025; After considering the Report No. 192/TTr-CP dated May 21, 2022 of the Government, the Report No. 953/BC-UBKT15 dated June 5, 2022 of the Economic Committee of the National Assembly, and the Report No. 266/BC-UBTVQH15 dated June 15, 2022 of the Standing Committee of the National Assembly on the draft Resolution regarding the investment orientation of the expressway project from Chau Doc to Can Tho to Soc Trang phase 1,
and related documents and opinions of National Assembly deputies;
Pursuant to Resolution No. 43/2022/QH15 dated January 11, 2022 of the National Assembly on fiscal and monetary policies supporting the Program to Restore and Develop the Economy and Society;
Decides to approve the investment orientation of the expressway project from Chau Doc to Can Tho to Soc Trang phase 1 (hereinafter referred to as the Project). 1. Objectives:Investing in the Project aims to form a central transverse axis through the Mekong Delta region via the city of Can Tho, An Giang province, Hau Giang province, and Soc Trang province, connecting vertical axes, enhancing the effectiveness of existing and ongoing projects, linking economic centers, international border gates, and seaports, meeting transportation needs along the Northwest-West-Southeast economic corridor; creating room, momentum, and space for development in the Mekong Delta with a synchronized and modern technical infrastructure and social infrastructure; contributing to ensuring national defense and security, poverty reduction; improving the competitiveness of the economy, gradually achieving the goals and tasks of socio-economic development according to the Resolution of the 13th National Congress of the Communist Party of Vietnam.
RESOLUTION:
Article 1
Invest approximately 188.2 kilometers, divided into four component projects under the public investment model; the scale of each component project is determined in the Appendix attached to this Resolution.
Article 2
2. Technology:
The Project will apply advanced and modern technologies, ensuring safety, synchronization, quality, and efficiency. Encouraging the application of high technology in construction organization, adapting to climate change. Implementing automatic non-stop toll collection during operation and exploitation.
2. Scope, Scale, and Form of Investment:
3. Land use requirements and compensation, support, and resettlement plans:
Preliminary land use requirements for the Project are about 1,205 hectares, including: paddy fields about 860 hectares, residential land (residential land) about 24 hectares, perennial crop land about 127 hectares, annual crop land about 64.93 hectares, aquaculture land about 10.07 hectares, and public land about 119 hectares. Permitting the conversion of paddy fields for the implementation of the Project. Clearing the entire route at once according to the planning scale.
4. Preliminary total investment and sources of capital:
The preliminary total investment of the Project is VND 44,691 billion
(fourty-four thousand, six hundred ninety-one billion dong)
a) State budget capital for the period 2021-2025 is VND 30,758 billion
(thirty thousand, seven hundred fifty-eight billion dong)- Central state budget capital is VND 26,934.5 billion, including:
(twenty-six thousand, nine hundred thirty-four billion, five hundred million dong), including: VND 14,248 billionincluding:
(fourteen thousand, two hundred forty-eight billion dong) central state budget capital in the mid-term public investment plan for the period 2021-2025; VND 1,165.5 billion(one thousand, one hundred sixty-five billion, five hundred million dong)from reviewing and rearranging the mid-term public investment plan for the period 2021-2025 of the Ministry of Transport; VND 3,800 billion(three thousand, eight hundred billion dong)state budget capital for development according to Resolution No. 43/2022/QH15 dated January 11, 2022 of the National Assembly on fiscal and monetary policies supporting the Program for Recovery and Development of the Economy and Society; VND 7,721 billion(seven thousand, seven hundred twenty-one billion dong)from increased revenue, reduced expenditure, and savings in the central state budget in 2021;- Local state budget capital is VND 3,823.5 billion(three thousand, eight hundred twenty-three billion, five hundred million dong), including: An Giang province VND 1,000 billion
(one thousand billion dong) ; Can Tho city VND 1,000 billion; Hau Giang province VND 823.5 billion (eight hundred twenty-three billion, five hundred million dong); and Soc Trang province VND 1,000 billion (eight hundred twenty-three billion, five hundred million dong)(one thousand billion dong).b) Central state budget capital for the period 2026-2030 is approximately VND 13,933 billion (thirteen thousand, nine hundred thirty-three billion dong). 5. Implementation schedule:
Prepare for investment and implement the Project starting from 2022, basically completing some sections with high traffic volume in 2025, basically completing the entire route in 2026, and fully completing and putting the entire Project into operation in 2027.1. The implementation of the Project shall be subject to the following special mechanisms and policies:
a) The Government directs the Ministry of Transport to take the lead and coordinate with the Ministry of Finance, relevant ministries, sectors, and localities to develop a plan to recover the investment capital of the Project and repay it to the central state budget and local state budgets according to the proportion of investment capital contributed to the Project;
b) Implementing the provisions of Article 5 of Resolution No. 43/2022/QH15 dated January 11, 2022 of the National Assembly on fiscal and monetary policies supporting the Program for Recovery and Development of the Economy and Society;
Article 3
c) In case of adjusting the investment orientation of the Project during periods when the National Assembly is not in session, the National Assembly authorizes the Standing Committee of the National Assembly to examine and decide;
d) The procedures, formalities, authority for review and decision-making on investment in component projects shall be carried out similarly to those for group A projects as stipulated by laws on public investment;
đ) Allow the division of the Project into component projects as specified in the Appendix attached to this Resolution.
c) In cases where the investment policy of the Project needs to be adjusted during periods when the National Assembly is not in session, the National Assembly authorizes the Standing Committee of the National Assembly to examine and decide;
d) The procedures, formalities, authority for examination and decision on investment of component projects shall be carried out similarly to those for group A projects as prescribed by laws on public investment;
d) Permits the division of the Project into component projects as specified in the Appendix attached to this Resolution.
2. The Government shall be responsible to the National Assembly for:
a) Implement, manage, operate, and exploit the Project in accordance with this Resolution and relevant laws, ensuring progress and quality of the works. Manage and use funds and resources economically and efficiently, prevent corruption and waste; direct localities to ensure funding for the Project's implementation. Direct reviews and be responsible for the feasibility of the capital from the review and restructuring of the mid-term public investment plan for the period 2021-2025 of the Ministry of Transport.
b) Calculate the scope and total investment amount of component projects within the feasibility study report stage of the Project in accordance with the provisions of the law, ensuring economy and preventing waste.
c) Lead and direct the implementation of this Resolution, ensuring compliance with objectives, transparency, and effectiveness, preventing policy exploitation, loss, and waste; annually report to the National Assembly at the end-of-year session on the implementation status of the Project; provide full information for the people to understand and support the investment policy and Project implementation.
3. The Prime Minister shall be responsible for decentralizing to localities as the managing agencies to implement component projects according to Clause 3, Article 5 of Resolution No. 43/2022/QH15 dated January 11, 2022 of the National Assembly on fiscal and monetary policies to support the Economic Recovery and Development Program, ensuring the progress and quality of those component projects; consider and decide to assign one agency to be responsible for organizing the implementation of the Project to ensure its overall and synchronized nature.
4. Localities shall be responsible before the Government for ensuring the capital as stipulated in Clause 5, Article 2 of this Resolution and the progress of compensation, support, and resettlement of the Project. In case the compensation, support, and resettlement costs in the locality exceed or fall short of the preliminary total investment cost of the Project, that locality shall be responsible for balancing the budget from the local budget according to the proportion of the contribution to the compensation, support, and resettlement costs of the Project. The agency assigned as the managing agency shall be responsible for ensuring the progress and quality of the component project assigned.
Article 4
1. The State Audit Agency, within its duties and powers, audits the implementation of this Resolution.
2. The Standing Committee of the National Assembly, the Economic Committee, the Ethnic Council, other Committees of the National Assembly, Delegations of the National Assembly, National Assembly deputies, the Vietnam Fatherland Front and its member organizations, within their duties and powers, supervise the implementation of this Resolution.
This Resolution was adopted by the National Assembly of the Socialist Republic of Vietnam, the 15th term, third session, on June 16, 2022./.
