ISSUING TECHNICAL PROCEDURES FOR SAFETY AND HEALTH TECHNICAL INSPECTION OF MACHINERY, EQUIPMENT, AND MATERIALS WITH STRICT REQUIREMENTS FOR SAFETY AND HEALTH UNDER THE MANAGEMENT AUTHORITY OF THE MINISTRY OF INDUSTRY AND TRADE
19/2018/TT-BGTVT) which has been amended and supplemented by Clause 7, Article 1 of Circular No. 08/2024/TT-BGTVT dated April 4, 2024, issued by the Minister of Transport, amending and supplementing certain articles of Circular No. 19/2018/TT-BGTVT 10/2017/TT-BCT dated 26 the 7 Article 2. The receipt, handling of reflections and petitions from individuals and organizations concerning administrative regulations shall be carried out in accordance with Decree No. 20/2008/NĐ-CP dated February 14, 2008 of the Government on the receipt, handling of reflections and petitions from individuals and organizations concerning administrative regulations (amended and supplemented by Decree No. 48/2013/NĐ-CP dated May 14, 2013 on amending and supplementing certain articles of decrees related to administrative procedure control and Decree No. 92/2017/NĐ-CP dated August 7, 2017 on amending and supplementing certain articles of decrees related to administrative procedure control).7 The Minister of Industry and Trade issues technical procedures for safety and health technical inspection of machinery, equipment, and materials with strict requirements for safety and health under the management authority of the Ministry of Industry and Trade, which shall take effect from September 15, 2017, amended and supplemented by:
Circular No. 12/2020/TT-BCT dated January 18 the 6 Pursuant to Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government on assigning tasks, procurement or tendering for the supply of products and services using state budget from regular operating expenses;20 The Minister of Industry and Trade amends and supplements, abolishes some provisions in the safety and health technical inspection procedures issued together with Circular No. 10/2017/TT-BCT dated July 26, 2017 of the Minister of Industry and Trade on technical procedures for safety and health technical inspection of machinery, equipment, and materials with strict requirements for safety and health under the management authority of the Ministry of Industry and Trade, effective from May 15, 2016, of the Government detailing certain provisions of the Labor Safety Law regarding safety and health technical inspection activities, safety training, labor hygiene training, and workplace environmental monitoring; 02 the 8 Pursuant to Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government on assigning tasks, procurement or tendering for the supply of products and services using state budget from regular operating expenses;20.
Pursuant to the Labor Safety Law dated June 25, 2015;
Decree No. 44/2016/NĐ-CP May 15, 2016, of the Government detailing certain provisions of the Labor Safety Law regarding safety and health technical inspection activities, safety training, labor hygiene training, and workplace environmental monitoring;
Pursuant to Decree No. 95/2012/NĐ-CP dated November 12, 2012, of the Government, detailing the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;
At the proposal of the Director of the Industrial Technical Safety and Environmental Protection Department,[1]
Article 1. Scope of Regulation and Applicability
1. Issued together with this Circular are 18 Technical Procedures for Safety and Health Technical Inspection of Machinery, Equipment, and Materials with Strict Requirements for Safety and Health under the Management Authority of the Ministry of Industry and Trade (Inspection Procedures). The names and codes of the Inspection Procedures are listed in the Appendix to this Circular.
2. This Circular applies to organizations and individuals related to safety and health technical inspection activities, management, ownership, and use of machinery, equipment, and materials with strict requirements for safety and health under the management authority of the Ministry of Industry and Trade.
Article 2. Effective Date
[2]1. This Circular takes effect from September 15, 2017.
2. Machinery, equipment, and materials with strict requirements for safety and health under the management authority of the Ministry of Industry and Trade that have been inspected before the date this Circular takes effect will continue to be valid until the expiration date stated on the Certificate of Inspection Results.Upon the next expiration date must be conducted by an inspection organization that has been certified by the Ministry of Industry and Trade as having the necessary conditions for inspection.
3. For machinery and equipment within operating production lines that cannot be separated for individual inspection, the periodic inspection cycle should follow the maintenance and repair schedule of the production line but not exceed the manufacturer's specified period or the corresponding national technical standard. Organizations and individuals managing and using such machinery and equipment must maintain safe working conditions and bear responsibility for them. Inspection organizations for safety and health technical inspection must develop detailed inspection procedures for each specific type of machinery and equipment without contravening the Inspection Procedures and corresponding national technical standards.
Article 3. Implementation Organization
1. The Industrial Technical Safety and Environmental Protection Department is responsible for guiding and organizing the implementation of this Circular.
2. 3. Inspectors must strictly comply with the detailed inspection procedures for each specific type of machinery and equipment.
4. Organizations and individuals related to safety and health technical inspection activities, management, ownership, and use of machinery, equipment, and materials with strict requirements for safety and health under the management authority of the Ministry of Industry and Trade
are responsible for implementing this Circular. management, ownership, and use of machines, equipment, materials with strict requirements for labor safety under the jurisdiction of the Ministry of Industry and Trade are responsible for implementing this Circular.
5. Any difficulties encountered during implementation should be reported to the Ministry of Industry and Trade for study and resolution./.
