Regulations on functions, tasks, powers, and organizational structure

of the Water Resources Management Department

MINISTER OF NATURAL RESOURCES AND ENVIRONMENT

Pursuant to Decree No. 91/2002/NĐ-CP dated November 11, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;

Pursuant to the proposal of the Director of the Cadre and Civil Servant Organization Department, the Director of the Water Resources Management Department,

DECISION:

Article 1. Position and Functions

The Water Resources Management Department is an organization under the Ministry of Natural Resources and Environment, with the function of assisting the Minister in performing state management tasks related to water resources including rainwater, surface water, groundwater, and seawater within the territory and maritime zones of the Socialist Republic of Vietnam.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. Draft regulations, policies, strategies, plans, programs, and objectives for the protection, exploitation, utilization, and development of water resources; monitor and inspect their implementation after approval by competent state authorities.

2. Draft procedures, norms, standards, and economic-technical quotas for water resource management according to the division of labor by the Ministry; direct their implementation and inspect their execution after approval by the Minister.

3. Draft regulations on the division of basic investigation of water resources; organize their implementation, monitor, and inspect their execution after approval by competent state authorities.

4. Draft measures for protecting water resources, preventing degradation, depletion, pollution, and restoring water sources to enhance the effectiveness of comprehensive watershed management, ensuring rational, economical, safe, and sustainable exploitation and utilization of water resources; monitor and inspect their implementation after approval by the Minister.

5. Coordinate with relevant agencies within the Ministry, other ministries, sectors, and localities in preventing and mitigating damage caused by water.

6. Aggregate data, manage the results of basic investigations, inventory, and assessment of water resources; build databases and national data exchange systems on water resources according to the division of labor by the Ministry.

7. Draft regulations on the authority, procedures for issuing, extending, revoking, and allowing the return of permits for activities such as investigating, exploring, exploiting, utilizing water resources, and discharging wastewater into water sources; organize, direct their implementation, and inspect their execution after approval by competent state authorities.

8. Review projects and works related to basic investigation of water resources, planning, specialized projects for protection, exploitation, utilization, and comprehensive development of water resources according to the division of labor by the Ministry; inspect their implementation after approval.

9. Propose policies, measures, and operational mechanisms for service organizations in the field of water resources; direct their implementation and inspect their execution according to the division of labor by the Ministry.

10. Direct and provide professional guidance on water resource management for local state management agencies.

11. Implement international cooperation in the field of water resources according to the division of labor by the Ministry.

12. Implement programs, projects, research topics, apply scientific and technological progress, and train and enhance professional skills in water resource management according to the division of labor by the Ministry.

13. Promote and guide organizations and citizens in implementing laws on water resources; respond to organizations and individuals regarding water resource policies and laws according to the division of labor by the Ministry.

14. Maintain contact with associations and non-governmental organizations; monitor and report to the Minister on the activities of these associations and non-governmental organizations in the field of water resources.

15. Perform the duties of the Office of the National Council on Water Resources.

16. Carry out inspection work and coordinate with the Ministry's Inspectorate to inspect, handle complaints, accusations, and disputes over water resources according to the division of labor by the Ministry.

17. Manage and utilize all assigned financial resources effectively; fulfill the financial accounting responsibilities of a second-level budget unit for subordinate units of the Department according to current laws.

18. Manage organizational structure, staffing, civil servants, officials, and workers; train and enhance professional skills for civil servants, officials, and workers under the Department according to the delegated level.

19. Statistically report regularly and urgently on the implementation of assigned tasks.

20. Fulfill other tasks assigned by the Minister.

Article 3. Organizational Structure

a) The leadership of the Department includes the Director and several Deputy Directors.

The Director is responsible to the Minister for assigned tasks; specifies the specific functions and tasks of subordinate units, working regulations, and manages all activities of the Department.

b) The Director's office staff:

1. Office;

2. Policy and Planning Division;

3. Water Resources Investigation Management Division;

4. Surface Water Management Division;

5. Groundwater Management Division;

6. Water Resource Protection Division;

7. Training and Community Awareness Enhancement Division.

c) The affiliated public service units:

1. Water Technology and Resource Assessment Center;

2. Water Resource Database Management Center.

d) The Water Resources Management Department and its affiliated Centers have separate seals and are allowed to open accounts according to current regulations.

Article 4. Effectiveness and Responsibility for Implementation

This Decision takes effect fifteen days from the date of publication in the Official Gazette.

The Director of the Water Resources Management Department, the Director of the Cadre and Civil Servant Organization Department, and the Heads of subordinate agencies and units of the Ministry are responsible for implementing this Decision./.
