Guidelines for managing and using funds

National Program on Crime Prevention and Combating

Implementing Resolution No. 09/1998/NQ-CP of the Government: On Strengthening Crime Prevention and Combating Work in New Circumstances; Decision No. 138/1998/QĐ-TTg dated July 31, 1998 of the Prime Minister: Approving the National Program on Crime Prevention and Combating.

The Ministry of Finance and the Ministry of Public Security issue guidelines for managing and using funds for the National Program on Crime Prevention and Combating as follows:

2. Individuals who have registered as the principal investigator of a Research Project or Pilot Production Project and those participating in its implementation shall not participate in the Evaluation and Selection Council for that Research Project or Pilot Production Project (hereinafter referred to as the Council). In necessary cases, members of the Council may be staff members of the organization registering as the principal investigator of the Research Project or Pilot Production Project, but not more than one person and they cannot serve as Chairperson, Vice-Chairperson, or reviewing member.

1\. Each year, the Government allocates a necessary amount of funds from the central budget to the Ministries, Central Agencies, and provinces and centrally-administered cities (hereinafter referred to as localities) to implement the National Program on Crime Prevention and Combating.

2\. The Central Steering Committee for the National Program on Crime Prevention and Combating (Committee 138/CP) and the Steering Committees for the National Program on Crime Prevention and Combating at the local level shall cooperate with financial agencies at all levels to strictly manage the program's funds; check expenditures according to the prescribed contents, objectives, and regulations to ensure economy, effectiveness, and practicality.

II. SPECIFIC PROVISIONS

1\. Funds for implementing the National Program on Crime Prevention and Combating allocated from the central budget to the Ministries, Central Agencies, and localities shall be used for the following purposes:

1.1\. Information dissemination, education, and mobilization for crime prevention and combating.

1.2\. Research topics, project development, and implementation, including:

- Survey costs both domestically and internationally.

- Translation costs for reference materials.

- Content development costs for projects and topics.

- Conference, seminar, and expert hiring costs.

- Implementation costs for projects and topics.

1.3\. Procurement, repair, and maintenance costs for equipment, means, and office activities of Committee 138/CP and the Steering Committees for the National Program on Crime Prevention and Combating at the local level.

1.4\. Conference, seminar, training, mid-term review, final evaluation costs for the implementation of the Program, crime prevention and combating work organized by Committee 138/CP and the Steering Committees for the National Program on Crime Prevention and Combating at the local level, including:

- Material preparation costs.

- Speaker costs.

- Delegate costs for attending conferences, seminars, trainings, mid-term reviews, final evaluations, etc.

1.5\. Reward costs.

1.6\. Costs to ensure the operation and management of Committee 138/CP and the Steering Committees for the National Program on Crime Prevention and Combating at the local level, including:

- Printing and distribution costs for materials.

- Costs for Collaborators (writing articles, providing information, etc.).

- Other expenses;

1.7\. Costs for forces directly involved in mobilizing, disseminating information, educating, and combating crime.

2\. Funds from Ministries, Central Agencies, and localities from other sources, used for the National Program on Crime Prevention and Combating, shall be implemented in accordance with the provisions of Point 1, Section II of this Circular.

3\. Budget preparation, allocation, and settlement.

Funds for the National Program on Crime Prevention and Combating shall be managed, allocated, and settled in accordance with the provisions of Circular No. 103/1998/TT-BTC dated July 18, 1998 of the Ministry of Finance: Guidelines for Delegation, Preparation, Execution, and Settlement of State Budgets; Circular No. 06/ TTLB dated April 29, 1997 of the Ministry of Planning and Investment - Ministry of Finance: Allocation, Distribution, Management, and Use of Funds for National Programs and Goals, and current regulations.

3.1\. Budget preparation work.

Each year, Ministries, Central Agencies, and localities shall prepare budgets for the National Program on Crime Prevention and Combating based on assigned plans and programs, and submit them to Committee 138/CP for consolidation. Committee 138/CP shall take the lead in coordinating with the Ministry of Finance and the Ministry of Planning and Investment to develop plans and allocate funds for the National Program on Crime Prevention and Combating to Ministries, Central Agencies, and localities for approval by the Government.

Based on the Government's approval decision, the Ministry of Finance will notify the funding targets to Ministries, Central Agencies, and localities.

3.2\. Fund allocation.

- For Ministries and Central Agencies allocated funding for the National Program on Crime Prevention and Combating: Quarterly, based on the allocated funding targets, they shall prepare budgets and submit them to the Ministry of Finance, which will directly allocate funds to Ministries and Central Agencies according to approved targets and budgets.

- For localities allocated funding for the National Program on Crime Prevention and Combating, the Ministry of Finance will allocate funds through the "Delegated Funding" method to the Provincial Departments of Finance and Prices according to approved plans and budgets.

3.3\. Fund settlement.

Quarterly and annually, Ministries, Central Agencies, and localities shall settle the allocated funds for the National Program on Crime Prevention and Combating in accordance with current regulations and submit them to the Ministry of Finance, while also sending copies to Committee 138/CP for consolidation and reporting to the Government.

Local Steering Committees' reports on the settlement of funds for the National Program on Crime Prevention and Combating must be reviewed by local financial agencies before being submitted to the Ministry of Finance and Committee 138/CP.

III. IMPLEMENTATION PROVISIONS

This Circular takes effect 15 days after its signing date. During implementation, if there are any difficulties, please report them to the relevant ministries for study and resolution.
