DECISION OF THE PRIME MINISTER

Regarding the establishment Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).of the National Committee for HIV/AIDS Prevention and Control and Drug and Prostitution Prevention

 

PRIME MINISTER

Pursuant to the Government Organization Law dated September 30, 1992;

Pursuant to Resolution No. 05/CP dated January 29, 1993 of the Government on preventing and controlling prostitution, Resolution No. 06/CP dated January 29, 1993 of the Government on strengthening guidance for drug prevention and control work, Resolution No. 20/CP dated March 5, 1993 of the Government on intensifying HIV/AIDS prevention and control work, Decree No. 87/CP dated December 12, 1995 of the Government on strengthening management of cultural activities and cultural services, and promoting eradication of serious social evils;

To improve and strengthen agencies assisting the Prime Minister in directing and coordinating inter-ministerial efforts in HIV/AIDS prevention and control and drug and prostitution prevention;

After consultation with the Chairman of the Central Steering Committee of the Vietnam Fatherland Front, the Chairman of the Vietnam General Confederation of Labor, the Chairman of the Vietnam Women's Union, and the First Secretary of the Communist Youth Central Committee;

Considering the proposal of the Minister, Head of the Government Organizational and Cadre Department.

 

DECISION:

Article 1. Establish the National Committee for HIV/AIDS Prevention and Control and Drug and Prostitution Prevention based on the merger of the Government Steering Committee for Social Evil Prevention, the National Committee for Drug Prevention, and the National Committee for HIV/AIDS Prevention.

The National Committee for HIV/AIDS Prevention and Control and Drug and Prostitution Prevention is an inter-ministerial organization with the function of assisting the Prime Minister in directing and coordinating HIV/AIDS prevention and control and drug and prostitution prevention work.

Article 2. The National Committee for HIV/AIDS Prevention and Control and Drug and Prostitution Prevention has the following tasks:

1. Assist the Prime Minister in formulating policies, programs, and plans for HIV/AIDS prevention and control and drug and prostitution prevention.

2. Assist the Prime Minister in directing, guiding, urging, inspecting, and evaluating the activities of ministries, sectors, and localities in implementing HIV/AIDS prevention and control and drug and prostitution prevention tasks.

3. Assist the Prime Minister in organizing coordination among ministries, sectors, and mass organizations, and guiding the integration and coordination of resources for HIV/AIDS prevention and control and drug and prostitution prevention programs and plans according to common requirements and goals.

4. Regularly report to the Prime Minister on the implementation of HIV/AIDS prevention and control and drug and prostitution prevention work.

5. Assist the Prime Minister in directing international cooperation in HIV/AIDS prevention and control and drug and prostitution prevention.

Article 3. Members of the National Committee for HIV/AIDS Prevention and Control and Drug and Prostitution Prevention include:

1. Chairperson: Deputy Prime Minister.

2. Vice Chairpersons:

- Minister of Public Security,

- Minister of Labor, Invalids and Social Affairs,

- Minister of Health,

- One representative from the Standing Board of the Central Steering Committee of the Vietnam Fatherland Front.

3. Members:

- One Deputy Minister of Culture, Sports, and Tourism,

- One Deputy Minister of Education and Training,

- One Deputy Minister of Finance,

- One Deputy Minister of Planning and Investment,

- One Deputy Minister of Justice,

- One Deputy Minister of Agriculture and Rural Development,

- One Deputy Director of the Government Office,

- One Deputy Director of the Ethnic Minorities and Mountainous Areas Commission,

- One Deputy Director General of the General Customs Department,

- One Deputy Commander of the Border Guard Force,

- One representative from the Secretariat of the Communist Youth Central Committee,

- One Deputy Chairwoman of the Vietnam Women's Union,

- One Deputy Chairman of the Vietnam General Confederation of Labor.

Article 4. Staff supporting the National Committee for HIV/AIDS Prevention and Control and Drug and Prostitution Prevention include:

1. A unit under the Government Office assisting the Chairman of the National Committee in summarizing the activities of the National Committee.

2. The permanent office for drug prevention located at the Ministry of Public Security, based on the former National Committee for Drug Prevention Office.

The permanent office for drug prevention has its own seal and bank account.

3. The permanent office for HIV/AIDS prevention located at the Ministry of Health, based on the former National Committee for HIV/AIDS Prevention Office. Transfer all personnel and facilities of the National Committee for HIV/AIDS Prevention Office to the Ministry of Health for management.

The permanent office for HIV/AIDS prevention has its own seal and bank account.

4. The Social Evil Prevention Department under the Ministry of Labor, Invalids and Social Affairs shall be responsible for the permanent office for prostitution prevention.

Article 5. Specific responsibilities of the member agencies of the National Committee for HIV/AIDS Prevention and Control and Drug and Prostitution Prevention:

1. Ministry of Public Security: is the permanent agency for drug prevention; it leads and organizes the implementation of inter-ministerial programs and plans for drug prevention and control nationwide; coordinates with the Ministry of Defense, the General Customs Department, and related agencies to combat, detect, investigate, prosecute individuals violating laws on drug and prostitution prevention and HIV/AIDS prevention; focuses on classifying drug addicts and prostitutes for treatment in accordance with the Administrative Violations Handling Ordinance.

2. Ministry of Labor, Invalids and Social Affairs: is the permanent agency for prostitution prevention; it leads and organizes the implementation of inter-ministerial programs and plans for prostitution prevention nationwide; organizes and manages treatment, rehabilitation, education, vocational training, job creation, and community reintegration for drug addicts and prostitutes at treatment centers and in the community.

3. Ministry of Health: is the permanent agency for HIV/AIDS prevention; it leads and organizes the implementation of inter-ministerial programs and plans for HIV/AIDS prevention nationwide; organizes medical examinations and treatments at healthcare facilities, treatment centers, and in the community for drug addicts, prostitutes, and those infected with HIV/AIDS; determines types of drugs and treatment regimens for drug addiction; manages the production, sale, and use of addictive and psychotropic drugs for medical purposes and support for drug addiction treatment.

4. Vietnam Fatherland Front: leads the mobilization of all strata of the people across the country to implement HIV/AIDS prevention and drug and prostitution prevention work, closely linked to the movement for all people to unite in building a civilized lifestyle.

5. Ministry of Culture, Sports and Tourism: shall take the lead and coordinate with relevant agencies to disseminate information and propaganda on the prevention and control of AIDS and the prevention and control of drug-related and prostitution-related social evils.

6. The Ministry of Education and Training: shall direct and organize educational work on the prevention and control of AIDS and the prevention and control of drug-related and prostitution-related social evils in schools.

7. The Ministry of Agriculture and Rural Development: shall take the lead and coordinate with the Committee for Ethnic Minorities and Mountainous Areas and localities to direct the conversion of production to replace opium poppy cultivation.

8. The Committee for Ethnic Minorities and Mountainous Areas: shall coordinate with the Ministry of Agriculture and Rural Development to direct the conversion of production to replace opium poppy cultivation; coordinate with the Ministry of Public Security, the Ministry of Labor, Invalids and Social Affairs, and the Border Guard Command to direct the prevention and control of drug-related social evils in mountainous areas and ethnic minority regions.

9. The General Department of Customs: shall coordinate with the Border Guard Command and the Ministry of Public Security to monitor and prevent the illegal transportation of drugs into Vietnam and out of Vietnam.

10. The Border Guard Command: shall coordinate with the Ministry of Public Security, the General Department of Customs, and related sectors in monitoring and preventing the illegal transportation of drugs across borders, and monitoring and preventing the trafficking of women and girls across borders for prostitution.

11. The Ministry of Finance: shall ensure sufficient and timely funding from the state budget according to the annual budget estimate for the prevention and control of AIDS and the prevention and control of drug-related and prostitution-related social evils; coordinate to inspect and supervise the use and settlement of funds in accordance with current regulations of the State.

12. The Ministry of Planning and Investment: shall coordinate with the Ministry of Finance and related ministries and sectors to develop the annual budget estimate for the prevention and control of AIDS and the prevention and control of drug-related and prostitution-related social evils; at the same time mobilize other resources to serve this work.

13. The Ministry of Justice: shall take the lead and coordinate with ministries, sectors, and localities to study and improve the system of regulatory legal documents on the prevention and control of AIDS and the prevention and control of drug-related and prostitution-related social evils; organize the dissemination, popularization, and education on laws regarding the prevention and control of AIDS and the prevention and control of drug-related and prostitution-related social evils.

14. Government Office shall be responsible for assisting the Chairman of the National Steering Committee in coordinating the joint activities of various fields in the prevention and control of AIDS and the prevention and control of drug-related and prostitution-related social evils; compile the overall situation to report to the Prime Minister.

15. The Vietnam General Confederation of Labor, the Vietnam Women's Union, the Ho Chi Minh Communist Youth Union: shall coordinate with ministries, sectors, localities, and other mass organizations to mobilize the strength of the entire people to participate in the prevention and control of AIDS and the prevention and control of drug-related and prostitution-related social evils.

Article 6. Establish steering committees for the prevention and control of AIDS and the prevention and control of drug-related and prostitution-related social evils at all levels and sectors as follows:

1. Heads of ministries, ministerial-level agencies, and agencies under the Government shall establish steering committees for the prevention and control of AIDS and the prevention and control of drug-related and prostitution-related social evils based on the consolidation of steering committees for drug control, steering committees for the prevention and control of social evils, and steering committees for the prevention and control of AIDS, with a Deputy Minister (or equivalent) serving as the Head, and staff members working concurrently within the ministry or sector's establishment.

2. Chairpersons of provincial People's Committees (collectively referred to as provincial level) shall establish steering committees for the prevention and control of AIDS and the prevention and control of drug-related and prostitution-related social evils based on the consolidation of steering committees for the prevention and control of social evils, steering committees for drug control, steering committees for the prevention and control of AIDS, and steering committee 87, with the Chairperson or Vice-Chairperson of the provincial People's Committee serving as the Head; Deputy Heads and other members having a similar structure to the National Steering Committee for the Prevention and Control of AIDS and the Prevention and Control of Drug-Related and Prostitution-Related Social Evils.

Provincial steering committees for the prevention and control of AIDS and the prevention and control of drug-related and prostitution-related social evils shall assist the Chairperson of the provincial People's Committee in directing, implementing, and coordinating the prevention and control of AIDS and the prevention and control of drug-related and prostitution-related social evils in their locality; the functions and responsibilities of the steering committee and its member agencies are similar to those of the National Steering Committee and its member agencies.

The Chairperson of the provincial People's Committee shall be responsible before the Prime Minister for the situation of HIV/AIDS transmission and the situation of drug-related and prostitution-related social evils in their jurisdiction.

3. Depending on the situation of each locality, Chairpersons of district and commune People's Committees shall establish steering committees for the prevention and control of AIDS and the prevention and control of drug-related and prostitution-related social evils at the same level to organize the implementation of the prevention and control of AIDS and the prevention and control of drug-related and prostitution-related social evils in their jurisdiction.

Article 7. The Chairman of the National Steering Committee for the Prevention and Control of AIDS and the Prevention and Control of Drug-Related and Prostitution-Related Social Evils shall issue rules of operation, management mechanisms, and relationships between members of the National Steering Committee, and between the National Steering Committee and steering committees of ministries, sectors, and localities to ensure close coordination and unified direction from central to local levels.

Article 8. This Decision takes effect fifteen days after the date of signature.

This Decision replaces Decisions: Decision No. 08/TTg dated January 5, 1994 of the Prime Minister on the establishment of the Steering Committee for the Prevention and Control of Social Evils, Decision No. 686/TTg dated August 25, 1997 of the Prime Minister on the establishment of the National Steering Committee for Drug Control, Decision No. 1122/1997/QĐ-TTg dated December 24, 1997 on the tasks, powers, and organizational structure of the National Steering Committee for the Prevention and Control of AIDS and the organization conducting AIDS prevention and control work at all levels and related Decisions of the Prime Minister.

Article 9. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of People's Committees of provinces and centrally governed cities are responsible for implementing this Decision./.
