Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary regimes for cadres, civil servants, public officials, and armed forces;
Pursuant to Decision No. 128/QĐ-TW dated December 14, 2004 of the Central Committee Secretariat on salary regimes for cadres, civil servants, and public officials in Party agencies, People's Front organizations, and mass organizations;
Considering the proposal of the Minister of Education and Training and the First Secretary of the Central Communist Youth Union Ho Chi Minh,
DECISION:
Article 1. Scope and Applicability
This Decision stipulates the regime and policies for cadres of the Communist Youth Union Ho Chi Minh, the Vietnam Student Association, and the Vietnam Youth Federation in universities, colleges, vocational high schools, vocational training schools, and general secondary schools (hereinafter referred to collectively as cadres of the Youth Union and Associations) with the aim of promoting the role of youth union and student association work in educational institutions, which is an important part of educational and training activities.
Article 2. Regime and policies for cadres of the Youth Union and Associations who are lecturers, teachers, or non-teaching staff
1. Regulations on time spent on Youth Union and Association work calculated according to standard hours:
a) For universities, colleges, vocational high schools, and vocational training schools with fewer than 5,000 students:
- The School Youth Union Secretary who is a lecturer or teacher shall have their Youth Union work time counted as 50% of the standard hours; if they are non-teaching staff, they shall be allocated 50% of their working time for Youth Union work.
- The Deputy Secretary of the Youth Union, President of the Student Association, and President of the Youth Federation at the school level who are lecturers or teachers shall have their Youth Union and Association work time counted as 30% of the standard hours; if they are non-teaching staff, they shall be allocated 30% of their working time for Youth Union and Association work.
b) For universities, colleges, vocational high schools, and vocational training schools with from 5,000 to fewer than 10,000 students:
- The School Youth Union Secretary who is a lecturer or teacher shall have their Youth Union work time counted as 60% of the standard hours; if they are non-teaching staff, they shall be allocated 60% of their working time for Youth Union work.
- The Deputy Secretary of the Youth Union, President of the Student Association, and President of the Youth Federation at the school level who are lecturers or teachers shall have their Youth Union and Association work time counted as 40% of the standard hours; if they are non-teaching staff, they shall be allocated 40% of their working time for Youth Union and Association work.
c) For universities, colleges, vocational high schools, and vocational training schools with 10,000 students or more:
- The School Youth Union Secretary who is a lecturer or teacher shall have their Youth Union work time counted as 70% of the standard hours; if they are non-teaching staff, they shall be allocated 70% of their working time for Youth Union work.
- The Deputy Secretary of the Youth Union, President of the Student Association, and President of the Youth Federation at the school level who are lecturers or teachers shall have their Youth Union and Association work time counted as 50% of the standard hours; if they are non-teaching staff, they shall be allocated 50% of their working time for Youth Union and Association work.
d) For general secondary schools, cultural supplementary schools, and regular education centers:
- The time spent on Youth Union work by the Secretary (or Youth Assistant, Youth Advisor, hereinafter referred to collectively as Youth Assistant) in schools with fewer than 28 classes shall be counted as 70% of the standard hours per week; in schools with 28 classes or more, it shall be counted as 2 hours per week.
- The time spent on Youth Union work by the Deputy Secretary in schools with fewer than 28 classes shall be counted as 35% of the standard hours per week; in schools with 28 classes or more, it shall be counted as 50% of the standard hours per week.
The provisions regarding the number of students in points a, b, and c above only apply to full-time students. Cadres of the Youth Union and Associations who participate in teaching shall be entitled to overtime pay as prescribed.
2. Allowances for cadres of the Youth Union and Associations in schools:
a) For universities, colleges, vocational high schools, and vocational training schools:
- The School Youth Union Secretary shall be entitled to allowances equivalent to those of a Department Head.
- The Deputy Secretary of the Youth Union, President of the Student Association, and President of the Youth Federation at the school level shall be entitled to allowances equivalent to those of a Deputy Department Head.
b) For general secondary schools, cultural supplementary schools, and regular education centers:
The Secretary, Deputy Secretary of the Youth Union, Youth Assistant, and President of the Youth Federation at the school level shall be entitled to allowances equivalent to those of a Subject Team Leader or Department Head.
c) In cases where cadres of the Youth Union and Associations are lecturers, teachers, or hold positions with allowances equivalent to or higher than those of a Department Head, Deputy Department Head, Subject Team Leader, or Department Head, they shall be entitled to the highest allowance.
3. Provisions on dedicated staff for Youth Union and Association work in schools:
a) Dedicated staff for Youth Union and Association work in universities, colleges, vocational high schools, and vocational training schools:
- Schools with fewer than 5,000 students shall allocate a minimum of 01 dedicated staff member.
- Schools with from 5,000 to fewer than 10,000 students shall allocate a minimum of 02 dedicated staff members.
- Schools with 10,000 students or more shall allocate a minimum of 03 dedicated staff members.
b) General secondary schools, cultural supplementary schools, and regular education centers with 28 classes or more shall allocate a minimum of 01 dedicated staff member.
Article 3. Regulations on policies for League and Association cadres who are students and pupils
1. Members of the Central Committee of the League, the Central Committee of the Vietnam Youth Federation, the Central Committee of the Vietnam Student Association, Secretaries and Deputy Secretaries of School Leagues; Presidents and Vice-Presidents of School Student Associations and Presidents and Vice-Presidents of School Youth Federations shall be given priority in adding points to their discipline assessment results, scholarship consideration, job placement recommendations, and additional support regarding working and studying conditions according to their capabilities and actual situations at each school.
2. The schools shall have the responsibility to provide activity fees for members of the Central Committee of the League, the Central Committee of the Vietnam Youth Federation, the Central Committee of the Vietnam Student Association, Secretaries and Deputy Secretaries of School Leagues, Presidents and Vice-Presidents of School Student Associations, and Presidents and Vice-Presidents of School Youth Federations who are students and pupils. The level of support shall be applied appropriately based on the conditions and capacity of the school.
3. Schools shall have the responsibility to create favorable conditions for League and Association cadres to enhance their professional and vocational qualifications; ensure funding and material infrastructure for League and Association activities; and apply specific regulations and policies for other League and Association cadres in accordance with work requirements and school conditions.
Article 4. Policies for League and Association cadres in private schools
Private schools shall base this decision to implement regulations and policies for League and Association cadres in accordance with their conditions and financial capacity.
Article 5. Effective Date
1. This Decision takes effect fifteen days after its publication in the Official Gazette.
2. Abolish the effectiveness of previous regulations on policies for League and Association cadres in universities, colleges, secondary specialized schools, vocational schools, and high schools:
a) Clause 2 of Article 4 of Decision No. 243/CP dated June 28, 1979 of the Council of Ministers on the organizational structure and staffing of general education schools.
b) Point V of Part B of Circular No. 21/TT-GD dated December 10, 1968 of the Ministry of Education; Article 4 of Decision No. 1419/QD dated January 7, 1976 of the Ministry of Higher Education and Secondary Specialized Schools; Article 12 of Decision No. 1712/QĐ-BĐH dated December 18, 1978 of the Ministry of Higher Education and Secondary Specialized Schools; Section VI of Circular No. 49/TT dated November 29, 1979 of the Ministry of Education; Circular No. 1196/TCCB dated April 8, 1988 of the Ministry of Higher Education, Secondary Specialized Schools, and Vocational Training.
Article 6. Implementation Organization
1. Funding for implementing the policies stipulated in this Decision shall be allocated from the operational budget of the schools and educational training institutions.
2. The Ministry of Education and Training shall take the lead and coordinate with the Ministry of Finance, the Ministry of Home Affairs, the National Committee for Youth of Vietnam, and the Central Committee of the Ho Chi Minh Communist Youth Union to direct and inspect the implementation of this Decision.
3. The Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, and Chairpersons of People's Committees of provinces and centrally governed cities shall be responsible for enforcing this Decision.
