Pursuant to Decree No. 77/2003/ND-CP dated July 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Decree No. 57/2002/ND-CP dated June 3, 2002 of the Government detailing the implementation of the Ordinance on Fees and Charges; and Decree No. 24/2006/ND-CP dated March 6, 2006 amending and supplementing certain articles of Decree No. 57/2002/ND-CP dated June 3, 2002 of the Government;
Pursuant to Decree No. 24/2004/ND-CP dated January 14, 2004 of the Government detailing the implementation of certain provisions of the Ordinance on Posts and Telecommunications regarding radio frequency spectrum;
After receiving the opinion of the Ministry of Posts and Telecommunications at Circular No. 611/BBCVT-KHTC dated March 30, 2007 concerning the amendment and supplementation of Decision No. 22/2005/QD-BTC on the collection rates for license fees for radio frequency spectrum and usage fees for radio frequency spectrum;
At the proposal of the Director of the Enterprise Financial Department,
DECISION:
Article 1. Amending and supplementing certain articles of Decision No. 22/2005/QD-BTC dated April 11, 2005 of the Minister of Finance on the collection rates for license fees for radio frequency spectrum and usage fees for radio frequency spectrum as follows:
1. Adding Point g to Clause 2, Article 2 as follows:
"2. Temporarily not collecting usage fees from the following entities:
...
g) Radio broadcasting stations installed on fishing vessels operating only within the designated bands for fishing vessels."
2. Amending Point 1 and Point 2 of Item XII in Part B "Usage Fees for Frequency" in the Table of Collection Rates for Frequency Spectrum Fees and Charges (Annexed to Decision No. 22/2005/QD-BTC dated April 11, 2005 of the Minister of Finance) to become Point 1 as follows:

10% of the corresponding fee (*): The fee prescribed in this point is calculated based on a channel bandwidth of 25 kHz. For a bandwidth of 12.5 kHz, it is calculated at 70% of the corresponding fee; for a bandwidth of 6.25 kHz, it is calculated at 50% of the corresponding fee. |
This Decision takes effect 15 days after its publication in the Official Gazette.
Article 2. For radio frequency spectrum licenses granted before the effective date of this Decision but still valid after that date, there will be no retroactive collection or refund of the difference in frequency spectrum fees and charges as prescribed in this Decision.
Other contents not amended or supplemented in this Decision shall continue to be implemented according to Decision No. 22/2005/QD-BTC dated April 11, 2005 and Decision No. 66/2006/QD-BTC dated November 20, 2006 of the Minister of Finance on adjusting the State budget contributions from the collection of license fees and usage fees for radio frequency spectrum prescribed in Decision No. 22/2005/QD-BTC dated April 11, 2005.
