Pursuant to the Law on Government Organization dated February 18, 2025;"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."pursuant to the Government's Resolution dated December 25, 2001;

Pursuant to the Urban Planning Law dated June 17, 2009;y The Capital Law dated December 21, 2012;

WHEREAS,ứ The Housing Law dated December 24, 2014;amendPursuant to Decree No. 11/2013/NĐ-CP dated February 14, 2013 of the Government on management of investment in urban development;

Pursuant to the Law on Bidding dated November 26, 2013;

The Government issues this Decree on management and development of industrial clusters.

Pursuant to the Law 3. Amend Clause 3 Article 2 as follows:Government Resolution No. 18/2014/NQ-CP dated June 18, 2014;

On the basis of Law At the proposal of the Minister of Planning and Investment,June 2024;Pursuant to Article 5 of Decree No. 123/2015/NĐ-CP dated November 15, 2015 issued by the Government on the implementation of the National Program for Household Registration and Statistics for the period 2017-2024;

Pursuant to the Law on Real Estate Business dated November 25, 2014;

the Government promulgates this Decision on certain special mechanisms and policies for investment in urban development on both sides of Vo Nguyen Giap Road (Nhat Tan - Noi Bai). 1 Article 1. Certain special mechanisms and policies for investment in urban development on both sides of Vo Nguyen Giap Road, Hanoi City

1. Regarding social housing: The People's Committee of Hanoi City shall base on the urban planning, urban development area on both sides of Vo Nguyen Giap Road, urban development plan, and actual needs to allocate social housing projects within the urban development area on both sides of the road, ensuring the prescribed ratio according to the law.policies 2. Regarding sources of funds for land clearance and infrastructure construction:

The Prime Minister"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."a) The People's Committee of Hanoi City shall determine and mobilize funds for compensation and land clearance according to the planning in compliance with the laws on land and the progress of project implementation.

b) Sources of funds for constructing infrastructure framework shall be mobilized from local budget, central budget, ODA funds, and socialized capital according to current regulations.

3. The People's Committee of Hanoi City shall proactively apply forms of selecting investors according to the law for each specific project, including land use rights auction, bidding for projects using land, or designation of investors to implement projects. In cases where the designation form is applied, the People's Committee of Hanoi City must ensure the selection of investors with sufficient capacity and experience (technical, financial, and management) to implement feasible and highly effective projects. The Chairman of the People's Committee of Hanoi City shall decide within his authority and bear personal responsibility under the law.

Hanoi City shall determine the land price for land use fees and land rental fees in accordance with the prevailing market price of the same type of land at the time of investor selection as the basis for proposal and negotiation. The land price for land use fees and land rental fees payable shall be determined at the time of land allocation decision; if it is lower than the negotiated land price, the Investor shall pay according to the negotiated land price.

4. Based on the approved urban development area, the People's Committee of Hanoi City shall conduct review, approval, and take responsibility for urban development projects within the urban development area. In cases where the urban development area has not been approved by the competent authority, the People's Committee of Hanoi City shall seek written opinions from the Ministry of Construction before reviewing and approving urban development projects.

The Chairman of the People's Committee of Hanoi City shall organize the review, decision-making, and take responsibility for the investment policy of group A infrastructure framework projects.

1. The Ministry of Finance shall coordinate with relevant agencies to guide the mobilization of funds for compensation and land clearance in compliance with the laws on land, state budget, and public investment, ensuring the completion of compensation and land clearance work within the prescribed timeframe; guiding the determination of land prices for land use fees and land rental fees as the basis for proposal and negotiation.

2. The Ministry of Planning and Investment shall coordinate with the People's Committee of Hanoi City to mobilize ODA funds for infrastructure framework projects in accordance with the law; coordinate with the Ministry of Finance to guide the mobilization of funds for compensation and land clearance work; guide the application of the designation form of investors to implement feasible and highly effective projects according to the law on bidding.

3. The Ministry of Construction shall coordinate with the People's Committee of Hanoi City during the process of reviewing and approving urban development projects in cases where the urban development area has not been approved by the competent authority.

4. During the implementation process, if difficulties arise outside the special mechanisms stipulated in this Decision and exceed the authority, the People's Committee of Hanoi City shall report to the Prime Minister for consideration and decision.

Article 2. Implementation

1. This Decision takes effect from January 15, 2016.

2. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies related to this matter, and the Chairman of the People's Committee of Hanoi City are responsible for implementing this Decision./.

3. The Ministry of Construction shall coordinate with the People's Committee of Hanoi City during the process of reviewing and approving urban development projects where the urban development area has not yet been approved by the competent authority.

4. In the course of implementation, if difficulties arise that fall outside the special mechanisms provided for in this Decision and exceed the authority of the People's Committee of Hanoi City, the People's Committee of Hanoi City shall report to the Prime Minister for consideration and decision.

Article 3. Effectiveness

1. This Decision takes effect from January 15, 2016.

2. The Ministers, Heads of ministerial-level agencies, Heads of government agencies concerned, and the Chairman of the People's Committee of Hanoi City are responsible for implementing this Decision./.
