CIRCULAR

Specifies procedures, methods for determining and statistical forms for actual mineral production volumes

Based on the Minerals LawNo. 60/2010/QH12 dated November 17, 2010;

Based on Decree No. 36/2017/NĐ-CP dated April 4, 2017 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment and the Vietnam Geological and Mineral Resources Department and the Director of the Legal Department;This Resolution takes effect from the date it is adopted by the National Assembly.;

Pursuant to Decree No. 158/2016/NĐ-CP dated November 29, 2016 of the Government detailing implementation of certain provisions of the Minerals Law;

At the proposal of the Director General of the Forest Protection Department;, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CPThe Minister of Natural Resources and Environment issues this Circular to specify procedures, methods for determining and statistical forms for actual mineral production volumes.

Article 1. Scope of Regulation

Article 3. Determining Actual Mineral Production Volumes

Article 2. Applicability

Organizations and individuals exploiting minerals shall be responsible for implementing the provisions set forth in this Article to determine actual mineral production volumes, including:

1. Establishing, updating, and managing technical books and documents, financial vouchers and documents, and statistical forms for actual mineral production volumes as prescribed in Clause 2 and Clause 3 of Article 41 of Decree No. 158/2016/NĐ-CP and the statistical forms for actual mineral production volumes issued together with this Circular.

2. Implementing the provisions set forth in Clause 2 of Article 42 of Decree No. 158/2016/NĐ-CP. For weighbridges, they must be installed permanently, suitable to the specific topography of the mine, ensuring full control over all actual mineral production volumes, where the type and size of scales installed at the weighbridge must be selected appropriately based on the scale, capacity, technical infrastructure of the mine, and the type of mineral being mined, and the type of transportation means. On the basis of the above principles, proceed to select and invest in technical infrastructure to install weighbridges.

3. Implementing the provisions set forth in Clause 3 of Article 42 of Decree No. 158/2016/NĐ-CP, annually compiling data on actual mineral production volumes, including both primary minerals, associated minerals, and the volume of waste rock (if any) to be included in the periodic mineral exploitation report.

4. Implementing the provisions set forth in Article 43 of Decree No. 158/2016/NĐ-CP, organizations and individuals exploiting minerals shall be responsible under the law for the accuracy of information and data recorded in technical books and documents, invoices, financial vouchers, statistical forms, and other relevant documents to determine actual mineral production volumes.

5. Determination of actual mineral production volumes must ensure compliance with the procedures and methods for determination prescribed in this Circular.

Article 4. Procedures for Determining Actual Mineral Production Volumes for Solid Mineral Mines

The determination of actual mineral production volumes for solid mineral mines shall be carried out as follows:

1. Based on the approved mine design; five-year mining plan, the final status of the mining area in the previous year, organizations and individuals exploiting minerals shall establish a mining plan (forecast) for the calculation year.

2. Establish various types of books to record and update data and information for each stage of mine extraction technology, including: mine rock preparation, drilling - blasting (if applicable); mine rock excavation; mine transportation; mineral processing, enrichment (if applicable), and data and information about raw mineral storage areas (if applicable).

3. Conduct measurements, recording, and updating quantities and quality of each task (for projects that can directly measure and determine quantities); check files, measurement results, update maps, calculate quantities for each task (for projects that must measure and determine quantities through current status maps, cross-sections, drawings, tables, etc.) for each stage of mine extraction technology as specified in Clause 2 of this Article.

4. Inspect, prepare inspection reports for quantities recorded and calculated for each project of each stage of mine extraction technology; collect all invoices, vouchers, accounting books, quality inspection results of minerals (if applicable) to determine actual mineral production volumes.

5. Compile recorded and updated data and information into statistical tables according to the forms issued with this Circular; compare the total mine quantity (including waste rock and valuable minerals) actually determined up to December 31 of the calculation year; compare with the forecasted mining plan as prescribed in Clause 1 of this Article to adjust the plan for the following year.

4. Inspect, prepare minutes for the acceptance of recorded quantities and calculated volumes for each item of work at each technological stage of mining; collect all invoices, documents, accounting books, and quality inspection results of minerals (if available) to determine the actual quantity of minerals extracted.

5. Compile recorded data and information, update and incorporate them into statistical tables according to the forms issued together with this Circular; compare the total actual volume of the mine (including waste rock and valuable minerals) determined up to December 31 of the calculation year; adjust the extraction plan for the following year by comparing it with the planned (estimated) figures stipulated in Clause 1 of this Article.

Article 5. The procedure for determining the actual production volume of minerals extracted by households and sand and gravel mining from riverbeds, including activities to recover sand from dredging projects and channel clearance operations.

The determination of the actual production volume of minerals extracted by households and individuals engaged in the extraction of construction materials as stipulated in Point b, Clause 2, Article 64 of the 2010 Minerals Law; sand and gravel mining from riverbeds, including activities to recover sand from dredging projects and channel clearance operations shall be carried out as follows:

1. Establish various types of ledgers to record and update data and information during the extraction process; for each stage of mine extraction technology (if applicable) as prescribed in Clause 2 of this Circular.

2. Conduct measurements, record, and update the volume and quality of each task in the ledgers as prescribed in Clause 1 of this Article; collect all invoices, certificates, accounting books, and results of mineral quality testing (if applicable) to determine the actual production volume of minerals extracted.

3. Compile recorded and updated data and information into statistical tables according to Models 01, 03, 04, 05, and Model 06 issued with this Circular; compare the total actual volume of the mine (including waste rock and valuable minerals if any) determined up to December 31 of the calculation year.

Article 6. The procedure for determining the actual production volume of minerals extracted from mineral water and natural hot water mines.

The determination of actual mineral production from mineral water and natural hot water mines shall be carried out as follows:

1. Based on the approved mine design; the actual production volume of the previous year, organizations and individuals extracting minerals prepare an extraction plan (forecast) for the calculation year.

2. Establish various types of ledgers to record and update data and information about the flow rate of source mineral water used; the volume of mineral water and hot water used for different purposes in the production process for each stage according to the approved mine design.

3. Record and update the actual flow rate into the ledgers prescribed in Clause 2 of this Article; collect all invoices, certificates, accounting books, and results of mineral water and natural hot water quality testing (if applicable) to determine the actual production volume of minerals extracted.

4. Compile recorded and updated data and information into statistical tables according to Models 03, 04, 05, and Model 06 issued with this Circular; compile the actual flow rate determined up to December 31 of the calculation year.

Article 7. Method for determining the actual production volume of solid minerals extracted.

Depending on the type of solid mineral being exploited, the actual mineral production volume specified in Clause 1 of Article 42 of Decree No. 158/2016/NĐ-CP shall be determined as follows:

1. In cases where a mineral deposit is mined without waste rock and accompanying minerals, the actual production volume of minerals extracted is the arithmetic mean of the values determined from the following sources of data:

a) Data on production volume from direct measurement of the volume of excavated material at the mining site based on current status maps and cross-sections of the mining area.

b) Data on production volume from statistics and consolidation of ledgers for each stage of mining technology (excavation, transportation...).

c) Data on production volume determined according to consumption standards for raw materials and fuel and consolidation of certificates of raw materials, fuel, and industrial explosives (if any) used in the calculation year.

d) Data on production volume from statistics and consolidation of financial invoices and certificates in the calculation year, including the actual general loss factor.

2. In cases where a mineral deposit is mined with waste rock and accompanying minerals, the actual production volume of minerals extracted is the arithmetic mean of the values determined from the following sources of data:

a) Data on production volume from statistics and consolidation of ledgers in the preparation stage of mine waste rock and each stage of mining technology (excavation, transportation of mine material...).

b) Data on production volume from statistics and consolidation of ledgers of minerals through screening and enrichment processes (if any).

c) Data on production volume determined according to consumption standards for raw materials and fuel and consolidation of certificates of raw materials, fuel, and industrial explosives (if any) used in the calculation year.

d) Data on production volume from statistics and consolidation of financial invoices and certificates in the calculation year, including the actual general loss factor.

3. The discrepancy in the data on the actual production volume of minerals extracted determined according to each stage of mining technology as stipulated in Point b, Clause 1, and Point a, Clause 2 of this Article; the data determined according to each source of data as stipulated in Clauses 1 and 2 of this Article when compared with each other must not exceed the loss factor standard (expressed as a percentage) determined in the approved mine design. The volume of waste rock, the actual production volume of the main mineral, and accompanying minerals as stipulated in Clause 2 of this Article must be separately recorded and inventoried.

Article 8. Methods for determining the actual production volume of minerals mined by households and sand and gravel extraction from riverbeds, including activities to recover sand from dredging projects to clear channels and waterways.

The actual production volume of minerals mined by households and individuals mining ordinary construction materials as stipulated in Point b Clause 2 Article 64 of the 2010 Minerals Law; sand and gravel extraction from riverbeds, including activities to recover sand from dredging projects to clear channels and waterways, is the arithmetic mean of the production volumes determined from the following data sources:

1. Production data from statistics, consolidation of record books, and updates on quantities within the calculation year.

2. Production statistics and consolidation from financial invoices and documents within the calculation year.

Article 9. Methods for determining the actual production volume of mineral water and natural hot water mines

The actual production volume of mineral water and natural hot water mines is the arithmetic mean of the production volumes determined from the following sources of data:

1. Production data from statistics and records of flow rates of mineral water and natural hot water at drill holes (in cases where mineral water and natural hot water are extracted from drill holes) or compiled during each stage of using mineral water and natural hot water for different purposes in the production process according to the approved mine design (in cases where mineral water and natural hot water are extracted from natural outflows).

2. Production statistics and consolidation from financial invoices and documents within the calculation year.

Article 10. Statistical forms for determining the actual production volume of minerals

The statistical forms for determining the actual production volume of minerals are established according to the forms issued together with this Circular, including:

1. Form No. 01. Monthly acceptance results of mineral quantities by technological stages for open-pit mining.

2. Form No. 02. Monthly acceptance results of mineral quantities by technological stages for underground mining.

3. Form No. 03. Report on the actual production volume, processing, consumption, and inventory of minerals for the year.

4. Form No. 04. Statistics of raw mineral quantities through weighbridges.

5. Form No. 05. Annual production statistics of actually mined minerals calculated by technological stages of mining and the actual amount of industrial explosives consumed.

6. Form No. 06. Statistics of key indicators in mineral mining.

Article 11. Effective Date

This Circular takes effect from March 7, 2018.

Article 12. Implementation Organization

1. The Vietnam General Department of Geology and Mineral Resources shall be responsible for guiding, urging, and inspecting the implementation of this Circular.

2. Provincial People's Committees and municipal people's committees under the central government shall direct provincial Departments of Natural Resources and Environment to urge organizations and individuals holding mining licenses within their jurisdiction as stipulated in Clause 2 Article 82 of the 2010 Minerals Law to determine the actual production volume of minerals; compile the actual production volume of minerals on their territory into annual reports on state management of minerals to be submitted to the Ministry of Natural Resources and Environment for consolidation and reporting to the Government Prime Minister as prescribed.

3. During the implementation of this Circular, if difficulties or issues arise, agencies, organizations, and individuals are requested to promptly reflect them to the Ministry of Natural Resources and Environment for study, amendment, and supplementation as appropriate./.
