CIRCULAR
REGULATIONS ON THE LEVEL OF COLLECTION AND PAYMENT FOR FIRE PREVENTION AND CONTROL EQUIPMENT TESTING FEES; DESIGN REVIEW AND APPROVAL FEES FOR FIRE PREVENTION AND CONTROL; AND CITIZEN ID CARD ISSUE FEES
Pursuant to the Law on Fees and Charges dated November 25, 2015;
Pursuant to Decree No. 87/2017/NĐ-CP dated July 26, 2017, issued by the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Implementing Directive No. 11/CT-7TG dated March 4, 2020 of the Prime Minister on urgent tasks and solutions to address difficulties for production and business operations and ensure social welfare in response to the COVID-19 pandemic;
At the request of the Director of the Tax Policy Department;
The Minister of Finance issues this Circular to regulate the level of collection and payment for fire prevention and control equipment testing fees; design review and approval fees for fire prevention and control; and citizen ID card issue fees.
Article 1. Level of Collection and Payment for Fire Prevention and Control Equipment Testing Fees
Organizations and individuals when submitting applications to competent authorities to conduct fire prevention and control equipment testing shall pay the fees as follows:
1. From the date this Circular takes effect until December 31, 2020, pay fees at 50% of the levels specified in Section I, Section II, Point 2 of Section VI, Section VII, Section VIII, Section IX Part A and Part B of the Fire Prevention and Control Equipment Testing Fee Schedule issued together with Circular No. 227/2016/TT-BTC dated November 11, 2016 of the Minister of Finance regulating the level of collection, payment, management, and use of fire prevention and control equipment testing fees (hereinafter referred to as Circular No. 227/2016/TT-BTC), and 50% of the levels specified in Section III, Section IV, Section V, Point 1 of Section VI Part A of Article 1 of Circular No. 112/2017/TT-BTC dated October 20, 2017 of the Minister of Finance amending and supplementing certain provisions of Circular No. 227/2016/TT-BTC (hereinafter referred to as Circular No. 112/2017/TT-BTC).
During the period of applying the fee collection level prescribed in Clause 1 of this Article, no fire prevention and control equipment testing fees shall be paid according to the levels specified in the Fire Prevention and Control Equipment Testing Fee Schedule issued together with Circular No. 227/2016/TT-BTC and Article 1 of Circular No. 112/2017/TT-BTC.
2. From January 1, 2021 onwards, pay fire prevention and control equipment testing fees according to the levels specified in the Fire Prevention and Control Equipment Testing Fee Schedule issued together with Circular No. 227/2016/TT-BTC and Article 1 of Circular No. 112/2017/TT-BTC.
Article 2. Level of Collection and Payment for Design Review and Approval Fees for Fire Prevention and Control
Organizations and individuals when obtaining a fire prevention and control design review document from a competent state authority shall pay the fees as follows:
1. From the date this Circular takes effect until December 31, 2020, pay fees at 50% of the levels specified in Article 5 of Circular No. 258/2016/TT-BTC dated November 11, 2016 of the Minister of Finance regulating the level of collection, payment, management, and use of design review and approval fees for fire prevention and control (hereinafter referred to as Circular No. 258/2016/TT-BTC).
During the period of applying the fee collection level prescribed in Clause 1 of this Article, no design review and approval fees for fire prevention and control shall be paid according to the levels specified in Article 5 of Circular No. 258/2016/TT-BTC.
2. From January 1, 2021 onwards, pay design review and approval fees for fire prevention and control according to the levels specified in Article 5 of Circular No. 258/2016/TT-BTC.
Article 3. The level of collection and payment of fees for issuing Citizen Identity Cards
Vietnamese citizens aged 14 years or older when processing procedures to change, reissue Citizen Identity Cards, or transfer from 9-digit or 12-digit Identification Cards to Citizen Identity Cards shall pay the fee as follows:
1. From the date this Circular takes effect until December 31, 2020, pay the fee at 50% of the amount specified in Article 4 of Circular No. 59/2019/TT-BTC dated August 30, 2019, issued by the Minister of Finance on the levels of collection and payment of fees for issuing Citizen Identity Cards (hereinafter referred to as Circular No. 59/2019/TT-BTC).
During the period of applying the collection level stipulated in Clause 1 of this Article, there will be no payment of fees for issuing Citizen Identity Cards according to the level of collection specified in Article 4 of Circular No. 59/2019/TT-BTC.
2. From January 1, 2021 onwards, pay the fee for issuing Citizen Identity Cards according to the level of collection specified in Article 4 of Circular No. 59/2019/TT-BTC.
Article 4. Effective date
1. This Circular takes effect from June 22, 2020 to December 31, 2020.
2. Matters concerning the scope of regulation, subjects of application; organization of fee and tax collection; cases of exemption from payment of fees; declaration and payment of fees; management of fees; revenue receipts, publicizing the system of fee collection, and other related matters not specified in this Circular shall be implemented in accordance with Circular No. 227/2016/TT-BTC, Circular No. 258/2016/TT-BTC, and Circular No. 59/2019/TT-BTC.
3. During the implementation process, if there are any difficulties, organizations and individuals are requested to promptly report to the Ministry of Finance for research and supplementary guidance.
