DECREE
Regulations on Functions, Tasks, Authorities, and Organizational Structure of the Management Board of Ho Chi Minh Mausoleum
Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;
Pursuant to Decree No. 10/2016/NĐ-CP dated February 1, 2016 of the Government stipulating agencies under the Government; Decree No. 47/2019/NĐ-CP dated June 5, 2019 of the Government amending and supplementing certain articles of Decree No. 10/2016/NĐ-CP dated February 1, 2016 of the Government stipulating agencies under the Government;
"Based on the proposal of the Minister of National Defense;"
The Government promulgates this Decree stipulating functions, tasks, authorities, and organizational structure of the Management Board of Ho Chi Minh Mausoleum.
Article 1. Position and Functions
The Management Board of Ho Chi Minh Mausoleum (hereinafter referred to as the Management Board) is an agency under the Government, performing the function of preserving permanently and ensuring absolute safety for the remains of President Ho Chi Minh; managing and ensuring security and rituals; organizing activities at the Ho Chi Minh Mausoleum, Ba Dinh Square, Martyrs' Memorial, Reception Area, and Ho Chi Minh Presidential Site at Ba Chong Rock in Ba Vi District, Hanoi City (also known as K9 Historical Relic Zone) and related structures; organizing the implementation of public services according to the law.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
1. On strategy, programs, plans
a) Submitting to the Government and the Prime Minister long-term strategies, five-year plans, annual plans, important projects and proposals of the Management Board and implementing them after approval;
b) Participating in appraising proposals and projects within its management scope upon request of the Government;
c) Deciding on investment projects within its authority according to the law.
2. Advising the Party and State on permanently preserving and absolutely ensuring the safety of the remains of President Ho Chi Minh; ensuring security and safety in the area; welcoming visitors, propaganda; ensuring environmental aesthetics and organizing activities in the managed areas.
3. On permanently preserving and absolutely ensuring the safety of the remains of President Ho Chi Minh; ensuring security and safety in the area
a) Implementing medical tasks to preserve and maintain the remains of President Ho Chi Minh permanently;
b) Ensuring the safety of the remains of President Ho Chi Minh;
c) Managing and operating, ensuring infrastructure and technical systems; renovating the Ho Chi Minh Mausoleum, Ba Dinh Square, Martyrs' Memorial, Reception Area, K9 Historical Relic Zone and related structures;
d) Researching, proposing, building and implementing plans, measures to ensure security and safety in the Ho Chi Minh Mausoleum, Ba Dinh Square, Martyrs' Memorial, K9 Historical Relic Zone and other areas under its management.
4. On welcoming visitors, propaganda; ensuring environmental aesthetics and organizing activities in the managed areas
a) Organizing propaganda on political tasks, promoting the political and cultural significance of the Ho Chi Minh Mausoleum project and related structures;
b) Organizing reception and service for the people and international guests visiting to pay respects, commemorate heroes and martyrs, engage in political and cultural activities, and tour the Ho Chi Minh Mausoleum, Martyrs' Memorial, Ba Dinh Square, and K9 Historical Relic Zone;
c) Taking the lead and coordinating with the People's Committee of Hanoi City, Ho Chi Minh Museum, and Ho Chi Minh Presidential Site at the Presidential Palace to guide, welcome, and organize service activities for the people and international guests engaging in political and cultural activities at the Ba Dinh Historical and Cultural Relic Complex;
d) Implementing state and military ceremonies at the Ho Chi Minh Mausoleum, Martyrs' Memorial, and K9 Historical Relic Zone according to regulations;
đ) Organizing the production, care of flowers and ornamental plants, decoration, and ensuring environmental aesthetics.
5. On implementing public services
a) Organizing the implementation of public services assigned by the Government;
b) Inspecting the organization and implementation of public services by subordinate agencies and units of the Management Board.
6. On international cooperation
a) Signing, amending, supplementing, extending, terminating, or temporarily suspending the implementation of international agreements on behalf of the Management Board according to the law;
b) Organizing international cooperation in fields under the Management Board's jurisdiction according to the Prime Minister's assignment;
c) Organizing the implementation and inspecting the implementation of international funded programs and projects according to regulations;
d) Participating in conferences, seminars, international cooperation programs, and plans.
7. Deciding and directing the implementation of the administrative reform program of the Management Board according to the goals and contents approved by the Prime Minister.
8. On information and reporting systems
a) Organizing information, propaganda, and dissemination of political tasks, policies, systems, and laws of the State in fields under its jurisdiction;
b) Implementing the reporting system to the Prime Minister and competent authorities according to regulations.
9. On organizational structure and staffing
a) The Ministry of National Defense submits to the Government regulations on the functions, tasks, authorities, and organizational structure of the Management Board of Ho Chi Minh Mausoleum;
b) Managing organizational structure, civil servants, officials, and employees; organizing the implementation of planning, training, development, recruitment, utilization, transfer, appointment, rotation, retirement, commendation, discipline, and other systems for civil servants, officials, and employees under its management according to regulations;
c) Deciding and organizing the implementation of specific measures to strengthen administrative discipline for civil servants, officials, and employees under its management; preventing corruption, waste, bureaucracy, arrogance, favoritism, and negative practices in the activities of the Management Board;
d) Inspecting compliance with policies, laws, and assigned tasks by civil servants, officials, and employees under its management; resolving complaints and denunciations related to civil servants, officials, and employees under its management according to the law.
10. On financial management and assets
a) Prepare the annual budget estimate, the three-year financial-plan-budget of the State, the annual state capital investment plan, and the medium-term state capital investment plan of the Ho Chi Minh Mausoleum Management Board for competent state authorities to decide;
b) Coordinate with relevant ministries and sectors to establish financial mechanisms, regulations, standards, and budget expenditure norms of the Ho Chi Minh Mausoleum Management Board in the assigned fields or submit them to competent authorities for issuance;
c) Implement investment management, finance, and accounting activities in accordance with regulations;
d) Manage and utilize state financial resources and assets effectively.
11. Organize scientific research, technology application, and environmental protection in specialized fields serving assigned tasks.
12. Perform other tasks and exercise other powers assigned by the Government and the Prime Minister in accordance with the law.
Article 3. Organizational Structure
1. The Office of the Ho Chi Minh Mausoleum Management Board.
2. Public service units
a) The Ho Ba Dinh Square Management Board;
b) The Science, Technology and Environment Center.
3. Specialized subordinate units
a) The Ho Chi Minh Mausoleum Protection Command, Ministry of National Defense;
b) The 375th Regiment, Security Command, Ministry of Public Security.
4. The Director of the Ho Chi Minh Mausoleum Management Board shall define the functions, tasks, powers, organizational structure, and working relationships; the authority and responsibility of the head; appoint, relieve from duty, and discipline the head and deputy heads of agencies and units under Clause 1 and Clause 2 of this Article in accordance with the law.
5. The Office of the Ho Chi Minh Mausoleum Management Board is an administrative organization that advises and assists the head of the Ho Chi Minh Mausoleum Management Board, has its own seal, and has an organizational structure consisting of three departments.
Article 4. Heads and deputies of the Ho Chi Minh Mausoleum Management Board
1. The Director of the Ho Chi Minh Mausoleum Management Board is the head of the Ho Chi Minh Mausoleum Management Board, who is also the Commander of the Ho Chi Minh Mausoleum Protection Command appointed by the Prime Minister; he is responsible before the Government, the Prime Minister, and the law for all aspects of the Ho Chi Minh Mausoleum Management Board's operations.
2. Deputy Directors of the Ho Chi Minh Mausoleum Management Board are deputies of the head of the Ho Chi Minh Mausoleum Management Board, including Deputy Commanders of the Ho Chi Minh Mausoleum Protection Command, Ministry of National Defense; Deputy Commanders of the Security Command, Ministry of Public Security, appointed by the Prime Minister upon the recommendation of the Director of the Ho Chi Minh Mausoleum Management Board; they are responsible for assisting the Director of the Ho Chi Minh Mausoleum Management Board in directing and resolving certain areas of work as assigned by the Director of the Ho Chi Minh Mausoleum Management Board and are accountable to the Director of the Ho Chi Minh Mausoleum Management Board and the law for the tasks assigned to them. The number of Deputy Directors of the Ho Chi Minh Mausoleum Management Board shall not exceed two persons.
Article 5. Effectiveness and Responsibility for Implementation
1. This Decree takes effect from September 12, 2022; replacing Decree No. 18/2018/NĐ-CP dated February 2, 2018 of the Government on the functions, tasks, powers, and organizational structure of the Ho Chi Minh Mausoleum Management Board.
2. The Director of the Ho Chi Minh Mausoleum Management Board, Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, and Chairpersons of provincial People's Committees directly under the central government are responsible for implementing this Decree.
