DECREE

REGULATIONS ON THE CONSIDERATION AND BESTOWAL OF THE TITLES "PEOPLE'S ARTIST" AND "OUTSTANDING ARTIST"

Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Law on Encouragement and Reward dated June 15, 2022;

At the proposal of the Minister of Culture, Sports and Tourism;

The Government promulgates this Decree on the consideration and bestowal of the titles "People's Artist" and "Outstanding Artist",

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decree stipulates the subjects, criteria, procedures, and formalities for the consideration and bestowal of the titles "People's Artist" and "Outstanding Artist".

Article 2. Applicability

1. This Decree applies to:

a) Individuals engaged in cultural and artistic activities at state-owned cultural and artistic units;

b) Individuals engaged in cultural and artistic activities at non-state-owned cultural and artistic units;

c) Individuals currently working in teaching or management in the field of culture and art but still participating in professional cultural and artistic performance activities;

d) Individuals engaged in professional freelance cultural and artistic activities;

đ) Individuals engaged in creative cultural and artistic works;

e) Organizations and individuals related to the activity of considering and bestowing the titles "People's Artist" and "Outstanding Artist".

2. The individuals specified in points a, b, c, d, and đ of Clause 1 of this Article include:

a) Performers: singers, dancers, musicians, reciters; performers in the fields of Tuong, Cheo, Cai Luong, Folk Opera, Drama, Physical Theatre, Musical, Ballet, Circus, Puppetry; film actors; television actors;

b) Directors of comprehensive artistic programs including music and dance; directors of works in the fields of Tuong, Cheo, Cai Luong, Folk Opera, Drama, Physical Theatre, Musical, Ballet, Circus, Puppetry; film directors, television directors of various types of films: feature films, documentary films, scientific films, animated films, and hybrid films; stage directors for radio broadcasts; stage directors for television broadcasts;

c) Sound technicians (sound directors) in film and television works; sound technicians in stage works; stage lighting technicians and technicians for comprehensive artistic programs;

d) Choreographers; conductors of orchestras; choral conductors; conductors of symphonic ballets; artistic directors;

đ) Cinematographers (image directors) in films and television of various types: feature films, documentary films, scientific films, animated films, and hybrid films;

e) Puppet designers; animated film designers and performers; stage set designers; film designers for feature films and television series; makeup artists, costume designers for stage performances, feature films, and television series;

g) Radio announcers and television announcers working in the field of culture and art;

h) Composers of musical works, photographers.

Article 3. Explanation of Terms

In this Decree, the following terms are understood as follows:

1. National Gold Award is the Golden Lotus Award at the Vietnam Film Festival or the Gold Medal or First Prize or Class A or Excellent Award or Golden Cup at national professional cultural and artistic competitions, festivals, exhibitions organized by the Ministry of Culture, Sports and Tourism.

2. National Silver Award is the Silver Lotus Award at the Vietnam Film Festival or the Silver Medal or Second Prize or Class B or Silver Cup at national professional cultural and artistic competitions, festivals, exhibitions organized by the Ministry of Culture, Sports and Tourism.

3. The period of professional cultural and artistic activities of individuals specified in Clause 2 of Article 2 of this Decree shall be calculated from the time:

a) The individual graduates from a professional cultural and artistic school and then engages in cultural and artistic activities at a professional cultural and artistic unit.

b) Or the individual is at least 18 years old and engages in cultural and artistic activities at a professional cultural and artistic unit.

c) Or the individual is at least 18 years old and engages in professional cultural and artistic activities.

Article 4. Principles for awarding the titles "People's Artist" and "Meritorious Artist"

1. Implement the provisions set forth in points a, b, and point c, Clause 2, Article 5 of the Law on Encouragement of Excellence and Commendation.

2. The Councils at all levels may only submit to higher authorities for consideration cases that meet the conditions, criteria, procedures, formalities, and files as prescribed in this Decree.

3. The titles "People's Artist" and "Meritorious Artist" shall not be awarded to co-authors of musical works and photographic works.

Article 5. Time for awarding, announcing, and organizing the presentation of the titles "People's Artist" and "Meritorious Artist"

1. The titles "People's Artist" and "Meritorious Artist" shall be awarded and announced in accordance with the provisions set forth in Clause 4, Article 66 of the Law on Encouragement of Excellence and Commendation.

2. The Ministry of Culture, Sports and Tourism shall organize the ceremony for presenting the titles "People's Artist" and "Meritorious Artist".

Article 6. Rights and Obligations of Individuals Awarded the Titles "People's Artist" and "Meritorious Artist"

1. Individuals receiving the Medal, Certificate of Recognition from the President, monetary awards, and other benefits as stipulated by law.

2. Individuals have the obligation to maintain the awarded items; continue creative labor in culture and art to produce many films, programs, plays, performances, cultural and artistic works of value to serve the people.

Chapter II

CRITERIA FOR AWARDING THE TITLES "PEOPLE'S ARTIST" AND "MERITORIOUS ARTIST"

Article 7. Criteria for awarding the title "People's Artist"

The title "People's Artist" shall be awarded to individuals specified in Clause 2, Article 2 of this Decree who meet the following criteria:

1. Loyalty to the country; good compliance with the Party’s policies, state laws, regulations, internal rules, and charter of agencies, organizations, and localities.

2. Good moral character, exemplary in life, dedicated to their profession; outstanding talent in a specific form, field, or profession of culture and art; professional reputation; significant contributions to the revolutionary cause of Vietnam, recognized and beloved by colleagues and the public.

3. At least 20 years of continuous or cumulative professional activity in the field of culture and art, or at least 15 years for circus and dance arts.

4. Having been awarded the title "Meritorious Artist," subsequently meeting one of the following criteria:

a) At least two National Gold Awards, including one National Gold Award for individual achievement.

Individual domestic Gold Awards or Gold Awards for films, programs, plays, or performances are converted according to the provisions in Appendix II attached to this Decree to calculate achievements for individuals.

International awards for individuals or for films, programs, plays, or performances are reviewed by specialized agencies under the Ministry of Culture, Sports and Tourism, and converted into documents to serve as the basis for calculating achievements for individuals according to the provisions in Appendix II attached to this Decree.

b) In the absence of one National Gold Award for individual achievement, there must be at least three National Gold Awards converted for individual achievement according to the provisions in Appendix II attached to this Decree.

Individual domestic Gold Awards or Gold Awards for films, programs, plays, or performances are converted according to the provisions in Appendix II attached to this Decree to calculate achievements for individuals.

International awards for individuals or for films, programs, plays, or performances are reviewed by specialized agencies under the Ministry of Culture, Sports and Tourism, and converted into documents to serve as the basis for calculating achievements for individuals according to the provisions in Appendix II attached to this Decree.

c) At least two National Gold Awards for musical works or photographic works.

Domestic Gold Awards for musical works or photographic works are converted according to the ratio specified in Appendix II attached to this Decree.

International awards for musical works or photographic works are reviewed by specialized agencies under the Ministry of Culture, Sports and Tourism, and converted into documents to serve as the basis for calculating achievements for individuals according to the provisions in Appendix II attached to this Decree.

d) Outstanding contributions, exceptional artistic talent, not meeting the criteria set out in point a or point b of this clause but discussed and unanimously recommended by Councils at all levels to the Prime Minister for consideration and decision in one of the following specific cases:

Individuals who are senior citizens as defined in Article 2 of the Law on Senior Citizens; having additional 10 years of professional artistic activity compared to the provision in Clause 3 of this Article; making outstanding contributions in the form, field, or profession of art being honored, especially during the period of national resistance wars;

Individuals having additional 10 years of professional artistic activity compared to the provision in Clause 3 of this Article; making outstanding contributions in the form, field, or profession of art being honored; currently actively participating in professional artistic performances, serving provincial, municipal, ministry-level, and national-level political tasks;

Individuals having additional 10 years of professional artistic activity compared to the provision in Clause 3 of this Article; making outstanding contributions in the form, field, or profession of art being honored; currently actively participating in professional artistic performances in symphonic chamber music, ballet, opera;

Individuals who are teachers or lecturers at professional cultural and artistic training institutions; directly training at least three students who win National Gold Awards at national or international artistic competitions (international awards for students and trainees reviewed by specialized agencies of the Ministry of Culture, Sports and Tourism, confirmed in documents to serve as the basis for calculating achievements for teachers and lecturers), currently actively participating in professional artistic performances and making outstanding contributions in the form, field, or profession of art being honored, or having additional 10 years of professional artistic activity compared to the provision in Clause 3 of this Article, making outstanding contributions in the form, field, or profession of art being honored, currently actively participating in professional artistic performances, serving provincial, municipal, ministry-level, and national-level political tasks.

Article 8. Criteria for awarding the title "Outstanding Artist"

The title "Outstanding Artist" shall be awarded to individuals specified in Clause 2, Article 2 of this Decree who meet the following criteria:

1. Loyalty to the country; good compliance with the Party's guidelines, state policies and laws, internal regulations, rules, and charters of agencies, organizations, and localities.

2. Possess good moral character, serve as a model in life, be dedicated to their profession; demonstrate outstanding artistic talent in the recognized cultural and artistic form, field, or occupation; have professional reputation; have a spirit of serving the people, recognized and loved by colleagues and the public.

3. Have at least 15 years of continuous or cumulative professional activity in the field of culture and art, or at least 10 years for circus and dance arts.

4. Meet one of the following criteria:

a) At least two National Gold Awards, including one National Gold Award for individual achievement.

Individual domestic Gold Awards or Gold Awards for films, programs, plays, or performances are converted according to the provisions in Appendix II attached to this Decree to calculate achievements for individuals.

International awards for individuals or for films, programs, plays, or performances are reviewed by specialized agencies under the Ministry of Culture, Sports and Tourism, and converted into documents to serve as the basis for calculating achievements for individuals according to the provisions in Appendix II attached to this Decree.

b) At least one National Gold Award and two National Silver Awards, including one National Gold Award for the individual.

Individual domestic Gold Awards or Gold Awards for films, programs, plays, or performances are converted according to the provisions in Appendix II attached to this Decree to calculate achievements for individuals.

International awards for individuals or for films, programs, plays, or performances are reviewed by specialized agencies under the Ministry of Culture, Sports and Tourism, and converted into documents to serve as the basis for calculating achievements for individuals according to the provisions in Appendix II attached to this Decree.

The conversion ratio of individual National Silver Awards or for films, programs, plays, or performances is calculated according to the conversion ratio of National Gold Awards.

c) In cases where there is no individual National Gold Award, there must be at least three National Gold Awards converted for the individual according to the provisions in Appendix II attached to this Decree.

Individual domestic Gold Awards or Gold Awards for films, programs, plays, or performances are converted according to the provisions in Appendix II attached to this Decree to calculate achievements for individuals.

International awards for individuals or for films, programs, plays, or performances are reviewed by specialized agencies under the Ministry of Culture, Sports and Tourism, and converted into documents to serve as the basis for calculating achievements for individuals according to the provisions in Appendix II attached to this Decree.

d) At least two National Gold Awards for musical works or photographic works.

Domestic Gold Awards for musical works or photographic works are converted according to the ratio specified in Appendix II attached to this Decree.

International awards for musical works or photographic works are reviewed by specialized agencies under the Ministry of Culture, Sports and Tourism, and converted into documents to serve as the basis for calculating achievements for individuals according to the provisions in Appendix II attached to this Decree.

đ) Demonstrate outstanding contributions, exceptional artistic talent, not meeting the criteria set forth in points a, b, or c of this clause but discussed and agreed upon by the Councils at all levels to submit to the Prime Minister for consideration and decision in one of the following specific cases:

Individuals who are elderly as defined in Article 2 of the Law on Elderly People; have additional 10 years of professional artistic activity compared to the provision in Clause 3 of this Article; have made significant contributions in the recognized artistic form, field, or occupation, especially during the anti-war resistance period;

Individuals have additional 10 years of professional artistic activity compared to the provision in Clause 3 of this Article; have made significant contributions in the recognized artistic form, field, or occupation; currently actively participate in professional artistic performance activities, serving provincial, municipal, ministry-level, and national political tasks;

Individuals have additional 10 years of professional artistic activity compared to the provision in Clause 3 of this Article; have made significant contributions in the recognized artistic form, field, or occupation; currently actively participate in professional artistic performance activities in symphonic chamber music, ballet music, opera;

Individuals are teachers or lecturers at professional cultural and artistic training schools; directly train at least three students, among whom at least two students win National Gold Awards and one student wins a National Silver Award in national or international artistic competitions (international awards for students and trainees recognized by specialized agencies under the Ministry of Culture, Sports and Tourism to confirm achievements for teachers and lecturers); currently actively participate in professional artistic performance activities and make outstanding contributions in the recognized artistic form, field, or occupation, or have additional 10 years of professional artistic activity compared to the provision in Clause 3 of this Article, making outstanding contributions in the recognized artistic form, field, or occupation, currently actively participating in professional artistic performance activities, serving provincial, municipal, ministry-level, and national political tasks.

Chapter III

COUNCIL FOR AWARDS OF THE TITLES "PEOPLE'S ARTIST", "OUTSTANDING ARTIST"

Article 9. Operation of the Council for Awarding the Titles "People's Artist" and "Meritorious Artist"

1. The Council for Awarding the Titles "People's Artist" and "Meritorious Artist" shall be established for each awarding session. The Council shall dissolve itself upon completion of its tasks.

2. Levels of the Council

a) Basic-level Council;

b) Ministry-level Council (hereinafter referred to as the Ministry-level Council); Provincial-level Council (hereinafter referred to as the Provincial-level Council);

c) National-level Council.

Article 10. Basic-level Council

1. The basic-level Council at units, including: Theater, professional art troupe under ministries, provinces, centrally governed cities; academy, cultural and artistic training institution under ministries, provinces, centrally governed cities with functions of researching, training, and creating cultural and artistic works; specialized agency on cultural and artistic activities of the Ministry of Culture, Sports and Tourism; management agency on cultural and artistic activities under the Ministry of Public Security and the Ministry of Defense; Department of Culture, Sports and Tourism or Department of Culture and Sports; Radio Station, Television Station, Radio and Television Station of provinces, centrally governed cities established by the head of the unit to examine applications for individuals (currently employed or retired) as stipulated in point a and point c Clause 1 Article 2 of this Decree.

a) Number of Council members: From five to seven members;

b) Composition of the Council:

Chairman of the Council: The head of the unit. In case the head of the unit has an application for awarding the title "People's Artist" or "Meritorious Artist", then the deputy in charge of culture and arts of the unit shall be the Chairman of the Council.

Vice-Chairman of the Council: The deputy in charge of arts of the unit. In case the deputy in charge of culture and arts of the unit has an application for awarding the title "People's Artist" or "Meritorious Artist", then the unit must report in writing to the immediate superior to appoint a replacement.

Members of the Council: The person in charge of commendation and reward work of the unit; representative with prestige in the field of cultural and artistic profession, People's Artist, Meritorious Artist of the unit.

c) The Council uses the seal of the unit.

d) The Council has a Secretariat established by the Chairman of the Council.

2. The basic-level Council at the Department of Culture, Sports and Tourism or Department of Culture and Sports established by the Director of the Department to examine applications for individuals as stipulated in points b, d, and đ Clause 1 Article 2 of this Decree; individuals (retired) as stipulated in point a and point c Clause 1 Article 2 of this Decree.

a) Number of Council members: From five to seven members;

b) Composition of the Council:

Chairman of the Council: Director of the Department of Culture, Sports and Tourism or Department of Culture and Sports. In case the Director of the Department has an application for awarding the title "People's Artist" or "Meritorious Artist", then the Deputy Director of the Department in charge of culture and arts shall be the Chairman of the Council.

Vice-Chairman of the Council: Deputy Director of the Department in charge of culture and arts. In case the Deputy Director of the Department in charge of culture and arts has an application for awarding the title "People's Artist" or "Meritorious Artist", then the unit must report in writing to the immediate superior to appoint a replacement.

Members of the Council: The person in charge of commendation and reward work of the Department of Culture, Sports and Tourism or Department of Culture and Sports; representative of the Federation of Literature and Art Associations or local Literature and Art Association; representative with prestige in the field of cultural and artistic profession; People's Artist, Meritorious Artist belonging to the local cultural and artistic professional field.

c) The Council uses the seal of the Department of Culture, Sports and Tourism or Department of Culture and Sports.

d) The Council has a Secretariat established by the Chairman of the Council.

3. Principles of operation of the Council

a) Individuals with applications for awarding the titles "People's Artist" or "Meritorious Artist" shall not participate in the Council;

b) The Council operates based on democratic, transparent principles and secret ballot;

c) The Council convenes a meeting when at least 90% of the Council members are present, including the Chairman of the Council or the Vice-Chairman of the Council authorized by the Chairman of the Council;

d) The Council examines the process and duration of professional cultural and artistic activities continuously or cumulatively; evaluates the reputation, expertise, and influence of each individual with an application for awarding the title "People's Artist" or "Meritorious Artist" according to the standards prescribed in Article 7 or Article 8 of this Decree;

đ) The basic-level Council only examines applications submitted by individuals as stipulated in Article 13 of this Decree.

Article 11. Ministry Councils, Provincial Councils

1. The Ministry Council at the Ministry of Culture, Sports and Tourism, the Ministry of National Defense, the Ministry of Public Security shall be established by the Minister; at Vietnam Television and Voice of Vietnam by the General Director.

a) Number of Council members: From nine to eleven members.

b) Composition of the Council:

Chairman of the Council: A representative from the leadership of the Ministry of Culture, Sports and Tourism or the Ministry of Public Security or the Ministry of National Defense or Vietnam Radio or Vietnam Television;

Vice Chairmen of the Council: Heads of specialized agencies on commendation and reward work under the Ministry of Culture, Sports and Tourism or representatives from the leadership of specialized agencies on commendation and reward work under the Ministry of Public Security, the Ministry of National Defense, Vietnam Radio, Vietnam Television; Heads of specialized agencies on cultural and artistic activities under the Ministry of Culture, Sports and Tourism or the Ministry of Public Security or the Ministry of National Defense or Vietnam Radio or Vietnam Television;

Council members: Experts in the field of culture and art; People's Artists, Meritorious Artists.

c) The Council uses the seal of the ministry or sector where the Ministry Council is established.

d) Specialized agencies on commendation and reward work under the Ministry of Culture, Sports and Tourism or specialized agencies on commendation and reward work under the Ministry of Public Security, the Ministry of National Defense, Vietnam Radio, Vietnam Television are the permanent bodies of the Council.

đ) The Council has a Secretariat established by the Chairman of the Council.

2. The Provincial Council shall be established by the Chairman of the Provincial People's Committee.

a) Number of Council members: From nine to eleven members.

b) Composition of the Council:

Chairman of the Council: Deputy Chairman of the Provincial People's Committee;

Vice Chairmen of the Council: Representatives from the leadership of the Propaganda Department; Director or Deputy Director in charge of cultural and artistic activities of the Department of Culture, Sports and Tourism or the Department of Culture and Sports;

Council members: Representatives from the leadership of the Department of Home Affairs; representatives from the leadership of the Association of Literature and Art or local Literature and Art Association; experts in various fields of culture and art; People's Artists; Meritorious Artists in the field of local culture and art.

c) The Council uses the seal of the Provincial People's Committee.

d) The Department of Culture, Sports and Tourism or the Department of Culture and Sports is the permanent body of the Council. The permanent body of the Council may use its seal for some activities of the Council authorized by the Chairman of the Council;

đ) The Council has a Secretariat established by the Chairman of the Council.

3. Principles of operation of the Council

a) Individuals with applications for awarding the titles "People's Artist" or "Meritorious Artist" shall not participate in the Council;

b) The Council operates based on democratic, transparent principles and secret ballot;

c) The Council convenes a meeting when at least 90% of the Council members are present, including the Chairman of the Council or the Vice-Chairman of the Council authorized by the Chairman of the Council;

d) The Council examines the files, procedures, and formalities of the grassroots Council for awarding titles; evaluates the reputation, expertise, and influence of each individual with a file requesting the awarding of the title "People's Artist" or "Meritorious Artist" according to the standards prescribed in Article 7 or Article 8 of this Decree;

đ) The Ministry-level or provincial Council only examines files submitted by the grassroots Council according to the procedures, formalities, and files prescribed in Article 13 and Article 14 of this Decree.

Article 12. National Council

The National Council operates in two stages:

1. Stage 1: The specialized National Council shall be established by the Minister of Culture, Sports and Tourism according to the field of culture and art.

a) Number of Council members: From eleven to fifteen members.

b) Composition of the Council:

Chairman of the Council: A representative from the leadership of the Ministry of Culture, Sports and Tourism;

Vice Chairmen of the Council include: Heads of specialized agencies on commendation and reward work under the Ministry of Culture, Sports and Tourism; Heads of specialized agencies on cultural and artistic activities under the Ministry of Culture, Sports and Tourism;

Council members: Representatives from the leadership of the Central Propaganda Department's Arts and Literature Division, representatives from the leadership of central specialized literature and art associations; experts in specialized fields of culture and art; People's Artists; Meritorious Artists.

c) Principles of operation of the Council

Individuals with files requesting the awarding of the title "People's Artist" or "Meritorious Artist" do not participate in the Council;

The Council operates on the principles of democracy, transparency, and secret ballot;

The Council convenes a session when at least 90% of the Council members are present, including the Chairman of the Council or a Vice Chairman of the Council authorized by the Chairman of the Council;

The Council examines the files, procedures, and formalities of the Ministry-level or provincial Council for awarding titles; evaluates the reputation, expertise, and influence of each individual with a file requesting the awarding of the title "People's Artist" or "Meritorious Artist" according to the standards prescribed in Article 7 or Article 8 of this Decree;

The specialized National Council only examines files submitted by the Ministry-level or provincial Council according to the procedures, formalities, and files prescribed in Article 13 and Article 15 of this Decree.

d) The specialized National Council uses the seal of the Ministry of Culture, Sports and Tourism.

đ) Specialized agencies on commendation and reward work under the Ministry of Culture, Sports and Tourism are the permanent bodies of the Council.

e) The Council has a Secretariat established by the Chairman of the Council.

2. Stage 2: The National Council shall be established by the Prime Minister upon the proposal of the Minister of Culture, Sports and Tourism.

a) Number of Council members: From seventeen to twenty-one members.

b) Composition of the Council:

Chairman of the Council: Minister of Culture, Sports and Tourism;

Vice Chairmen of the Council: Chairman of the specialized National Council; representatives from the leadership of the Central Propaganda Department; representatives from the Ministry of Home Affairs (Head of the Central Commendation and Reward Board);

Council members: Representatives from the leadership of the Vietnam Association of Literature and Art; representatives from the leadership of central specialized literature and art associations; Heads of specialized agencies on commendation and reward work under the Ministry of Culture, Sports and Tourism; representatives from the leadership of related agencies involved in the awarding of titles "People's Artist", "Meritorious Artist"; experts in various fields of culture and art; People's Artists.

c) Principles of operation of the Council

Individuals with files requesting the awarding of the title "People's Artist" or "Meritorious Artist" do not participate in the Council;

The Council operates on the principles of democracy, transparency, and secret ballot;

The Council convenes a session when at least 90% of the Council members are present, including the Chairman of the Council or a Vice Chairman of the Council authorized by the Chairman of the Council;

The Council examines the files, procedures, and formalities of the specialized National Council for awarding titles; evaluates the reputation, expertise, and influence of each individual with a file requesting the awarding of the title "People's Artist" or "Meritorious Artist" according to the standards prescribed in Article 7 or Article 8 of this Decree;

The State Council shall only examine files submitted by the State Professional Council in accordance with the procedures, formalities, and file requirements stipulated in Article 13 and Clause 1 of Article 16 of this Decree.

d) The Ministry of Culture, Sports and Tourism is the permanent body of the Council.

đ) The State Council shall use the seal of the Ministry of Culture, Sports and Tourism.

e) The Council shall have a Secretariat established by the Chairperson of the Council.

Chapter IV

FILES, PROCEDURES, AND FORMALITIES FOR CONSIDERING THE BESTOWAL OF THE TITLES "PEOPLE'S ARTIST" AND "OUTSTANDING ARTIST"

Article 13. Files, methods for submitting files, and agencies receiving files for considering the bestowal of the titles "People's Artist" and "Outstanding Artist"

1. The file for requesting consideration for the bestowal of the title "People's Artist" or "Outstanding Artist" includes:

a) A request form for the bestowal of the title "People's Artist" or "Outstanding Artist" according to Form No. 1a or Form No. 1b attached as Appendix I to this Decree;

b) A copy from the original book or a certified copy or a copy and presentation of the original for verification (in case of direct submission); a copy from the original book or a certified copy (in case of submission through postal service or on an electronic environment) of the decisions awarding prizes as specified in Clause 4 of Article 7 or Clause 4 of Article 8 of this Decree;

c) A confirmation by the Head of the unit regarding the individual's participation in artistic works that won Gold or Silver awards at professional art contests, festivals, or performances, which can be converted when calculating achievements for individuals participating as specified in Clause 4 of Article 7 or Clause 4 of Article 8 of this Decree (if applicable);

d) A copy from the original book or a certified copy or a copy and presentation of the original for verification (in case of direct submission); a copy from the original book or a certified copy (in case of submission through postal service or on an electronic environment) of the decisions on commendation titles and forms of reward (if applicable).

2. Individuals specified in point a and point c of Clause 1 of Article 2 of this Decree shall submit directly or through postal service or on an electronic environment one set of files as prescribed in Clause 1 of this Article to the unit where they work.

3. Individuals specified in points b, d, and đ of Clause 1 of Article 2 of this Decree shall submit directly or through postal service or on an electronic environment one set of files as prescribed in Clause 1 of this Article to the Department of Culture, Sports and Tourism or the Department of Culture and Sports where they reside.

4. Individuals specified in point a and point c of Clause 1 of Article 2 of this Decree who have retired shall submit directly or through postal service or on an electronic environment one set of files as prescribed in Clause 1 of this Article to the unit where they worked before retirement or to the Department of Culture, Sports and Tourism or the Department of Culture and Sports where they reside.

5. In cases where the individual's file is not valid, requires supplementation, or correction: The agency receiving the file shall guide the individual to complete the file. Within seven days from the date of receiving the returned file, the individual must resubmit the completed file to the receiving agency.

Article 14. Procedures and formalities for considering the bestowal of the titles "People's Artist" and "Outstanding Artist" at the grassroots-level Council

1. Publicize the list of individuals requesting consideration for the bestowal of the titles "People's Artist" and "Outstanding Artist" by posting publicly or publishing on the unit's website for ten days starting from the end date of the deadline for individuals to submit their files as prescribed.

2. Receive and process public comments within fifteen days from the end date of the public announcement of the list of individuals requesting consideration for the bestowal of the titles "People's Artist" and "Outstanding Artist" by posting publicly or publishing on the unit's website.

3. Examine and evaluate each file for requesting consideration for the bestowal of the titles "People's Artist" and "Outstanding Artist" as prescribed in Article 7 or Article 8 of this Decree within ten days from the date the permanent body of the Council reports to the Council members for their opinions on the files.

4. Within seven days from the end of the meeting, the Council is responsible for notifying in writing the results of the consideration to the individuals whose files requested the bestowal of the titles "People's Artist" or "Outstanding Artist".

5. Receive and process public comments within twenty days from the date of the Council's notification of the results of the consideration.

6. Within seven days from the end of the comment receipt and processing period, complete the file for requesting the bestowal of the titles "People's Artist" or "Outstanding Artist" that received at least eighty percent approval votes from the total number of Council members present at the meeting, and submit it to the permanent body of the provincial or central-level Council. The file (one set) includes:

a) A proposal report for the bestowal of the title "People's Artist" or "Outstanding Artist" according to Form No. 2a or Form No. 2b attached as Appendix I to this Decree;

b) A summary of achievements for the bestowal of the title "People's Artist" or "Outstanding Artist" according to Form No. 3a or Form No. 3b attached as Appendix I to this Decree;

c) Minutes of the Council meeting for considering the bestowal of the title "People's Artist" or "Outstanding Artist" according to Form No. 4a or Form No. 4b attached as Appendix I to this Decree;

d) Minutes of the vote tally for the bestowal of the title "People's Artist" or "Outstanding Artist" according to Form No. 5a or Form No. 5b attached as Appendix I to this Decree;

đ) A report on the process of considering the bestowal of the title "People's Artist" or "Outstanding Artist" according to Form No. 6a or Form No. 6b attached as Appendix I to this Decree;

e) An evaluation by the Council of each individual considered and evaluated according to point d of Clause 4 of Article 7 or point đ of Clause 4 of Article 8 of this Decree: Form No. 8a or Form No. 8b attached as Appendix I to this Decree;

g) Decision establishing the grassroots-level Council;

h) Individual files as prescribed in Clause 1 of Article 13 of this Decree.

7. The time for organizing activities for considering the bestowal of the titles "People's Artist" and "Outstanding Artist" at the grassroots-level Council shall not exceed seventy days.

Article 15. Procedures for awarding the titles "People's Artist" and "Artist of Merit" at the Ministry-level Council and Provincial-level Council

1. Publicize the list of individuals proposed for the awarding of the titles "People's Artist" and "Artist of Merit" on communication means under their management authority: the portal website of the ministry, sector, or locality, or the newspaper of the ministry, sector, or locality for a period of 10 days from the date the Council's base level ends its receipt of files.

2. Receive and process public opinions within 15 days from the end date of the publicizing of the list of individuals proposed for the awarding of the titles "People's Artist" and "Artist of Merit" on communication means under their management authority: the portal website of the ministry, sector, or locality, or the newspaper of the ministry, sector, or locality.

3. Examine and evaluate each file for requesting consideration for the bestowal of the titles "People's Artist" and "Outstanding Artist" as prescribed in Article 7 or Article 8 of this Decree within ten days from the date the permanent body of the Council reports to the Council members for their opinions on the files.

4. Within 10 days from the end date of the meeting of the Council, the permanent office shall be responsible for notifying in writing the results of the awarding of the titles "People's Artist" and "Artist of Merit" of the Ministry-level Council or Provincial-level Council to the Council's base level.

Within 5 days from the date the Council's base level receives the notification result document of the Ministry-level Council or Provincial-level Council, the permanent office of the Council's base level shall be responsible for notifying in writing to the individuals with the application files for the awarding of the titles "People's Artist" or "Artist of Merit".

5. Receive and process public comments within twenty days from the date of the Council's notification of the results of the consideration.

6. Within 10 days from the end date of the receipt and processing of public opinions, complete the application file for the awarding of the titles "People's Artist" or "Artist of Merit" achieving at least 80% of the total number of votes in agreement from the members present at the meeting, and submit it to the permanent office of the State-level Council. The file (one set) includes:

a) The document prescribed in points a, b, c, d, đ, e, and h Clause 6 Article 14 of this Decree;

b) The assessment of the Ministry-level Council or Provincial-level Council for each individual being considered and evaluated according to the provisions in point d Clause 4 Article 7 or point đ Clause 4 Article 8 of this Decree: Model No. 8a or Model No. 8b attached in Appendix I to this Decree;

c) Decision on establishing the Ministry-level Council or Provincial-level Council.

7. The time for organizing the awarding of the titles "People's Artist" and "Artist of Merit" at the Ministry-level Council and Provincial-level Council shall not exceed 85 days.

Article 16. Procedures for awarding the titles "People's Artist" and "Artist of Merit" at the State-level Council

The procedures for awarding the titles "People's Artist" and "Artist of Merit" at the State-level Council are carried out through two steps as follows:

1. Step 1 at the State-level Professional Council:

a) Publicize the list of individuals proposed for the awarding of the titles "People's Artist" and "Artist of Merit" on the portal website of the Ministry of Culture, Sports and Tourism for a period of 15 days from the end date of the receipt of files by the Ministry-level Council or Provincial-level Council to solicit public opinion;

b) Receive and process public opinions within 15 days from the end date of the publicizing of the list of individuals proposed for the awarding of the titles "People's Artist" and "Artist of Merit" on the portal website of the Ministry of Culture, Sports and Tourism;

c) Review and evaluate each application file for the awarding of the titles "People's Artist" and "Artist of Merit" according to the provisions in Article 7 or Article 8 of this Decree within 25 days from the date the permanent office of the Council reports to seek the opinions of the Council members on the files;

d) Within 20 days from the end date of the meetings of the Councils, the permanent office shall be responsible for notifying in writing the results of the awarding of the titles "People's Artist" and "Artist of Merit" of the State-level Professional Councils to the Ministry-level Council or Provincial-level Council.

Within 5 days from the date the Ministry-level Council or Provincial-level Council receives the notification result document of the State-level Professional Council, the permanent office of the Ministry-level Council or Provincial-level Council shall be responsible for notifying in writing to the individuals with the application files for the awarding of the titles "People's Artist" or "Artist of Merit".

đ) Receive and process public opinions within 20 days from the date of notification of the results of the awarding of the titles by the Councils.

e) Within 15 days from the end date of the receipt and processing of public opinions, complete the application file for the awarding of the titles "People's Artist" or "Artist of Merit" achieving at least 80% of the total number of votes in agreement from the members present at the meeting, and submit it to the permanent office of the State-level Council. The file (one set) includes:

The document prescribed in points a, b, c, d, đ, e, and h Clause 6 Article 14 of this Decree;

The assessment of the State-level Professional Council for each individual being considered and evaluated according to the provisions in point d Clause 4 Article 7 or point đ Clause 4 Article 8 of this Decree: Model No. 8a or Model No. 8b attached in Appendix I to this Decree;

Decision on establishing the State-level Professional Council.

g) The time for organizing the awarding of the titles "People's Artist" and "Artist of Merit" at the State-level Professional Council shall not exceed 115 days.

2. Step 2 at the State-level Council:

a) Publicize the list of individuals proposed for the awarding of the titles "People's Artist" and "Artist of Merit" on the Government Portal Website and the portal website of the Ministry of Culture, Sports and Tourism for a period of 15 days to solicit public opinion, from the end date of the receipt of files by the State-level Professional Council;

b) Receive and process public opinions within 15 days from the end date of the publicizing of the list of individuals proposed for the awarding of the titles "People's Artist" and "Artist of Merit" on the Government Portal Website and the portal website of the Ministry of Culture, Sports and Tourism;

c) Review and evaluate each application file for the awarding of the titles "People's Artist" and "Artist of Merit" according to the provisions in Article 7 or Article 8 of this Decree within 15 days from the date the permanent office of the Council reports to seek the opinions of the Council members on the files;

d) Within fifteen days from the date of conclusion of the meeting of the Council, the permanent agency shall be responsible for notifying in writing the results of the examination and awarding the titles of "People's Artist" and "Artist of Merit" of the State-level Council to the Ministry-level Council or the Provincial-level Council.

Within five days from the date the Ministry-level Council or the Provincial-level Council receives the notification of the results of the State-level Council, the permanent agency of the Ministry-level Council or the Provincial-level Council shall be responsible for notifying in writing the individuals with application files for the examination and awarding the titles of "People's Artist" or "Artist of Merit".

Receive and process complaints within twenty days from the date of notification of the examination results.

e) Within fifteen days from the date of completion of the period for receiving and processing complaints, complete the application file for the examination and awarding the title of "People's Artist" or "Artist of Merit" that has received at least eighty percent of the votes in agreement from the total number of members present at the meeting, and submit it to the Ministry of Home Affairs for consolidation and submission to the Prime Minister. The file (one set) includes:

The document prescribed in points a, b, c, d, and đ of Clause 6, Article 14 of this Decree;

The assessment of the State-level Council for each individual under consideration and evaluation according to point d of Clause 4, Article 7 or point đ of Clause 4, Article 8 of this Decree: Model No. 8a or Model No. 8b attached as Appendix I to this Decree;

Decision on the establishment of the State-level Council.

g) The time for organizing the examination and awarding the titles of "People's Artist", "Artist of Merit" at the State-level Council shall not exceed one hundred days.

Article 17. Transitional Provisions

Individuals who meet the criteria for the examination and awarding of the titles of "People's Artist", "Artist of Merit" and have been awarded these titles by the State-level Council for the tenth time through and up to the effective date of this Decree without having a Decision of the President of the State granting the titles of "People's Artist", "Artist of Merit" shall continue to be examined and awarded according to Decree No. 89/2014/NĐ-CP dated September 29, 2014 of the Government on the examination and awarding of the titles of "People's Artist", "Artist of Merit" and Decree No. 40/2021/NĐ-CP dated March 30, 2021 of the Government amending and supplementing some articles of Decree No. 89/2014/NĐ-CP dated September 29, 2014 of the Government on the examination and awarding of the titles of "People's Artist", "Artist of Merit".

Chapter V

IMPLEMENTING PROVISIONS

Article 18. Effective Date

1. This Decree takes effect from July 22, 2024.

2. Decree No. 89/2014/NĐ-CP dated September 29, 2014 of the Government on the examination and awarding of the titles of "People's Artist", "Artist of Merit" and Decree No. 40/2021/NĐ-CP dated March 30, 2021 of the Government amending and supplementing some articles of Decree No. 89/2014/NĐ-CP dated September 29, 2014 of the Government on the examination and awarding of the titles of "People's Artist", "Artist of Merit" shall cease to be effective from the date this Decree takes effect.

Article 19. Responsibility for Implementation

1. The Ministry of Culture, Sports and Tourism shall be responsible for organizing the implementation of this Decree.

2. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial people's committees directly under the central government, relevant agencies, organizations, and individuals shall be responsible for implementing this Decree.
