CIRCULAR

REGULATIONS ON TECHNICAL SAFETY INSPECTION ACTIVITIES FOR LABOR EQUIPMENT UNDER THE MANAGEMENT AUTHORITY OF THE MINISTRY OF INDUSTRY AND TRADE

Circular No. 09/2017/TT-BCT dated July 13, 2017 issued by the Minister of Industry and Trade on technical safety inspection activities for labor equipment under the management authority of the Ministry of Industry and Trade, which took effect from August 31, 2017, has been amended and supplemented by:

1. Circular No. 37/2018/TT-BCT dated October 25, 2018 issued by the Minister of Industry and Trade to amend and supplement certain regulations on safety management and technical safety inspection activities for labor equipment under the management authority of the Ministry of Industry and Trade, which took effect from December 10, 2018;

2. Circular No. 42/2019/TT-BCT dated December 18, 2019 issued by the Minister of Industry and Trade to amend and supplement certain provisions on periodic reporting regimes in Circulars issued by the Minister of Industry and Trade or jointly issued, which took effect from February 5, 2020;

3. Circular No. 12/2020/TT-BCT dated June 18, 2020 issued by the Minister of Industry and Trade to amend and supplement certain articles of Circular No. 09/2017/TT-BCT dated July 13, 2017 issued by the Minister of Industry and Trade on technical safety inspection activities for labor equipment under the management authority of the Ministry of Industry and Trade and some inspection procedures issued together with Circular No. 10/2017/TT-BCT dated July 26, 2017 issued by the Minister of Industry and Trade on technical safety inspection procedures for machines, equipment, and materials with strict requirements for labor safety under the management authority of the Ministry of Industry and Trade, which took effect from August 2, 2020;

Pursuant to the Labor Safety Law dated June 25, 2015;

Pursuant to Decree No. 44/2016/NĐ-CP dated May 15, 2016 of the Government detailing certain provisions of the Labor Safety Law on technical safety inspection activities, occupational safety training, and labor environment monitoring;

Pursuant to Decree No. 95/2012/NĐ-CP dated November 12, 2012, of the Government, detailing the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

At the proposal of the Director of the Department of Safety Technology and Industrial Environment; [1]

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates technical safety inspection activities for machines, equipment, and materials with strict requirements for labor safety listed in the Catalogue of Machines, Equipment, and Materials with Strict Requirements for Labor Safety issued by the Ministry of Labor, Invalids and Social Affairs under the management authority of the Ministry of Industry and Trade as specified in Appendix Ib of Decree No. 44/2016/NĐ-CP dated May 15, 2016 of the Government detailing certain provisions of the Labor Safety Law on technical safety inspection activities, occupational safety training, and labor environment monitoring (Decree 44/2016/NĐ-CP).

Article 2. Applicability

1. Organizations and individuals related to technical safety inspection activities for machines, equipment, and materials with strict requirements for labor safety under the management authority of the Ministry of Industry and Trade.

2. Organizations and individuals related to management, ownership, and use of machines, equipment, and materials with strict requirements for labor safety under the management authority of the Ministry of Industry and Trade.

Article 3. Classification of Inspection Objects

The inspection objects are machines, equipment, and materials with strict requirements for labor safety under the management authority of the Ministry of Industry and Trade, including:

1. Group A inspection objects (Group A) are power plant boilers.

2. Group B inspection objects (Group B) are industrial boilers with pressure over 16 bar, pressure vessels, steam pipelines, and hot water pipelines.

3. Group C inspection objects (Group C) are systems for processing, loading, supplying, tanks, reservoirs containing oil and gas products, liquefied petroleum gas (LPG), liquefied natural gas (LNG), compressed natural gas (CNG), fixed metal pipelines for transporting and distributing oil and gas products on land, and technological pipelines in onshore oil and gas facilities.

4. Group D inspection objects (Group D) are LPG cylinders.

5.[2] Group E inspection objects (Group E) are single hydraulic props, mobile frames, and self-propelled scaffolds (single hydraulic props, single hydraulic supports, hydraulic frames, and hydraulic scaffolds) used in underground mining.

6. Group G inspection objects (Group G) are open hoists, load shafts.

5.[3] Group H inspection objects (Group H) are explosion-proof electrical equipment used in explosive environments.

8. Group I inspection objects (Group I) are electric blasting machines (excluding explosion-proof electric blasting machines).

Chapter II

REGULATIONS ON INSPECTION ACTIVITIES

Article 4. Equipment and tools for inspection

1. Equipment and tools for inspection must have technical specifications suitable for the objects to be inspected and must be calibrated, verified, and tested in accordance with the provisions of the law.

2. The minimum requirements for equipment and tools necessary for inspection activities, categorized by specific groups of inspection objects, are as follows:

a) For Group A, B, and C

- Hydraulic test pump;

- Pressure gauges for various types;

- Metal thickness measuring device;

- Weld quality testing device;

-[4] - Magnetic and penetrant testing device for detecting metal defects;

- Endoscopic testing device for detecting defects;

- Tools and means for geometric dimension checking;

- Surface defect measurement tools;

- Safety valve testing device;

- Temperature measuring device.

b) For Group D

- Device for recovering remaining LPG in cylinders;

- Metal thickness measuring device;

- Weld quality testing device;

- Surface defect measurement tools;

- Cylinder valve installation and removal device;

- Durability and tightness testing device;

- Cylinder drying device;

- Internal cylinder inspection device;

- Surface cleaning device;

- Cylinder valve testing device;

- Scale;

- Marking and labeling devices for inspection;

- Vacuum pump;

- Volume expansion testing device.

c)[5] For Group E

- System for generating test pressure for valves, hydraulic supports, and pressure pipelines;

- Device for maintaining test pressure on hydraulic supports;

- Device for testing beams, platforms, or hydraulic support structures;

- Weld quality testing device;

- Pressure gauges for various types.

d) For Group G

- Force gauge;

- Geometric dimension measuring devices and tools;

- Speed measuring device;

- Rail gauge measuring tool;

- Surveying instrument;

- Steel cable defect testing device;

- Device for testing shaft misalignment and eccentricity;

- Tensile testing device for steel cables using destructive methods;

- Weld quality testing device;

- Magnetic, eddy current, and penetrant testing device for metal defects;

- Braking impact time measuring device;

- Insulation resistance and earth resistance measuring device;

- Voltmeter, ammeter;

- Pressure gauges for various types.

đ) For Group H

- Cable pulling testing device within cable connectors;

- Torque testing device for pile bolts and cable heads;

- Insulation resistance measuring device;

- Electronic data recording device (Oscilloscope).

e) For Group I

- Insulation resistance measuring device;

- Multimeter;

- Electronic data recording device (Oscilloscope);

- Stop watch.

Article 7. Inspector

Inspectors must meet the standards specified in Article 9 of Decree 44/2016/NĐ-CP. The experience and relevant expertise of inspectors for each specific group of inspection objects are as follows:

1. For Group A

Graduated from a university majoring in thermal engineering, mechanical engineering, mechatronics, or equivalent, with at least two years of experience in inspecting, designing, manufacturing, installing, repairing, operating, and maintaining boilers in power plants.

2. For Groups B and C

Graduated from a university majoring in thermal engineering, mechanical engineering, mechatronics, or equivalent, with at least two years of experience in inspecting, designing, manufacturing, installing, repairing, operating, and maintaining equipment in Groups B and C.

3. For Group D

Graduated from a university majoring in thermal engineering, mechanical engineering, mechatronics, or equivalent, with at least two years of experience in inspecting, designing, and manufacturing equipment in Group D.

4. For Group E

Graduated from a university majoring in mechanical engineering, mechatronics, or equivalent, with at least two years of experience in inspecting, designing, manufacturing, installing, repairing, operating, and maintaining equipment in Group E.

5. For Group G

Graduated from a university majoring in mechanical engineering, mechatronics, construction machinery, automation, or equivalent, with at least two years of experience in inspecting, designing, manufacturing, installing, repairing, operating, and maintaining equipment in Group G.

6. For Group H

Graduated from a university majoring in electrical engineering, automation, mechanical engineering, mechatronics, or equivalent, with at least two years of experience in inspecting, designing, manufacturing, installing, repairing, operating, and maintaining equipment in Group H.

7. For Group I

Graduated from a university majoring in electrical engineering, automation, mechatronics, or equivalent, with at least two years of experience in inspecting, designing, and manufacturing equipment in Group I.

Article 8.

Article 9. Documents and procedures for issuing the Certificate of Eligibility for Occupational Safety and Health Technical Inspection Activities and Inspector Certificates

1.[13] Organizations and individuals requiring issuance, extension, reissuance of the Certificate of Eligibility for Occupational Safety and Health Technical Inspection Activities (Certificate of Eligibility) and Inspector Certificates (Certificates) shall prepare one set of documents in accordance with regulations and send them via postal service, submit directly to the Department of Safety and Industrial Environment, or through the Ministry of Industry and Trade's online portal under the form of public administrative services.

2.[14] The documents and procedures for issuing, extending, and reissuing the Certificate of Eligibility shall be carried out in accordance with the provisions of Article 5 of Decree No. 44/2016/ND-CP and Clause 2, Clause 3 of Article 1 of Decree No. 140/2018/ND-CP dated October 8, 2018, of the Government amending and supplementing related decrees on investment conditions and administrative procedures within the scope of management of the Ministry of Labor, Invalids and Social Affairs.

3. Documents, procedures, and process for issuing and reissuing Certificates shall comply with the provisions of Articles 11, 12, and 13 of Decree No. 44/2016/ND-CP.

4.[15] Equipment and tools serving inspection activities mentioned in Article 4 and Article 78 of this Circular shall only be used as conditions for issuing the Certificate of Eligibility for one Inspection Organization.

Chapter III

TRAINING, ENRICHMENT, AND INSPECTOR QUALIFICATION TESTING

Article 10. Forms of training, enrichment, and qualification testing

1. Initial training and qualification testing apply to individuals meeting the inspector standards stipulated in Article 7 of this Circular.

2. Retraining and requalification testing apply to inspectors whose certificates have expired or whose certificates have been revoked.

3. Enrichment applies to inspectors who have been issued certificates for thirty months from the date of issuance of the certificate.

Article 11. Content and duration of training and enrichment

1. Training Content

a) General theory

- System of legal normative documents related to occupational safety and health work and inspection activities;

- Overview of the National Technical Regulations system on safety and national standards relevant to inspection activities;

- Overview of the inspection procedure system;

- Overview of machines and equipment with strict safety requirements for labor, tools, and equipment serving inspection work;

- Risk assessment methods and safety measures related to inspection activities.

b) Specialized theory and practical inspection for equipment groups A, B, C, D, E, G, and I

- National technical regulations, applicable national standards;

- Classification, construction principles, basic characteristics;

- Requirements for measuring equipment and safety;

- Safety engineering requirements in design, manufacture, installation, testing, use, maintenance, and repair of inspected objects;

- Specific hazardous factors of inspected objects and common accidents with inspected objects;

- Calculations related to safety evaluation during machine and equipment inspection;

- Weld quality assessment techniques;

- Non-destructive testing techniques;

- Inspection procedures and organization of inspection work for inspected objects;

- Guidance on using inspection tools and equipment;

- Practical training related to specific inspection skills and expertise (on-site or on software, simulation models).

c) Specialized theory and practical inspection for equipment group H

As specified in point b, Clause 1 of this Article and:

- Flammable gas and dust explosion environment: Characteristics, hazardous area classification;

- Inspection, maintenance, repair, major overhaul, and installation of electrical equipment in explosive environments.

2. Content of enrichment

a) Updating regulations at National Technical Regulations, national standards, and new regulations related to the training content at point a, Clause 1 of this Article;

b) Guidance on using newly equipped inspection tools and equipment;

c) Inspection procedures and organization of inspection work for inspected objects.

3. Duration of training and enrichment

Based on the training and enrichment subjects, the vocational inspection training organization shall develop detailed content and training and enrichment duration but not less than six days for training and not less than two days for enrichment.

Article 12. Training and Refresher Courses Organizations

1. Training and refresher course organizations for technical safety inspection must meet the following requirements:

a) Having sufficient equipment and tools suitable for the inspected objects as stipulated in Article 4 of this Circular;

c) Having lecturers with relevant majors as stipulated in Article 7 of this Circular and at least five years of experience related to technical safety inspection activities.

2. Training and refresher course organizations are responsible for issuing certificates of completion of training and refresher courses for technical safety inspection to trainees according to the model specified in Appendix 4 and 5 of this Circular.

Article 13. Examination Organization

1. The examination board shall conduct examinations for technical safety inspection officers.

2. The examination board shall have at least five members and shall be responsible for the following:

a) Developing examination questions and answers on a scale of 100 points;

b) Organizing theoretical and practical examinations;

c) Scoring and evaluating examination results;

d) Summarizing examination results.

3. Examination Content

The examination content shall be appropriate to the inspected objects as stipulated in Clause 1, Article 11 of this Circular.

4. Examination Forms

a) Theoretical examination in written and oral forms;

b) Practical examination conducted directly on the inspected objects or through software or simulation models.

5. Examination Results Meeting Requirements

Examination results meet the requirements when the theoretical examination score reaches 80 points or higher and the practical examination score reaches 75 points or higher.

Chapter IV

IMPLEMENTATION

Article 14. Publishing Information on the Ministry of Industry and Trade's Electronic Information Website

1. The information published by organizations granted certificates of eligibility for inspection activities includes:

a) The name, address, and code of the Inspection Organization;

b) The list of inspected objects;

c) The validity period of the certificate of eligibility;

d) The list of inspectors;

đ) Administrative violations committed by the inspection organization (if any).

2. Information published upon request of training and refresher course organizations for inspection activities.

a) The name and address of the training and refresher course organization for inspection activities;

b) The inspected objects trained and refreshed.

Article 15. Responsibilities of the General Department of Safety and Environmental Protection

1. Guide the implementation of technical safety inspection activities under the management authority of the Ministry of Industry and Trade.

2.[17] (Repealed)

3. Decide on the establishment of the examination board and issue the examination regulations.

4. Issue, reissue, and revoke certificates in accordance with the provisions.

5. Conduct inspections, audits, and handle violations related to technical safety inspection activities under the management authority of the Ministry of Industry and Trade in accordance with the provisions.

6. Select training and refresher course organizations for inspection activities that comply with the provisions of Clause 1, Article 12 of this Circular based on the proposal of the training and refresher course organizations along with detailed contents and plans for organizing training and refresher courses.

7. Announce information related to technical safety inspection activities under the management authority of the Ministry of Industry and Trade on the Ministry of Industry and Trade's electronic information website in accordance with Article 14 of this Circular.

Article 16. Responsibilities of the Department of Industry and Trade

1. Coordinate with relevant agencies to guide and inspect the implementation of the provisions of this Circular.

2. Summarize and report on compliance with the provisions of this Circular within its jurisdiction according to the model in Appendix 1 of this Circular before January 15 each year.

Article 17. Responsibilities of Certification Organizations

1. Implement technical safety inspections for labor in accordance with the laws and this Circular.

2. Establish and maintain a quality management system to control inspection quality.

3. Be responsible under the law for the results of inspections.

4. Organize professional training for inspectors in accordance with regulations.

5.[18] Reports shall be sent directly or through postal services before January 15 each year or at any time when required regarding the situation of technical safety inspections for labor according to the model in Appendix 2 of this Circular.

6.[19] Notify in writing the General Department of Safety and Environmental Technology Industry no later than ten days from the date of change in inspectors or persons responsible for inspection activities used as conditions for issuing the Certificate of Eligibility for Inspection Organizations.

Article 18. Responsibilities of organizations and individuals managing, owning, and using machinery and equipment with strict requirements for labor safety

1. Conduct inspections at inspection organizations that have been issued a Certificate of Eligibility by the Ministry of Industry and Trade.

2. Maintain conditions for safe operation of machinery and equipment.

3.[20] Report on inspection implementation to the Department of Industry and Trade where the machinery and equipment are installed directly or through postal services before January 5 each year according to the model in Appendix 3 of this Circular.

Article 19. Implementation Provisions

[21]

This Circular takes effect from August 31, 2017 and revokes Circular No. 35/2009/TT-BCT dated December 9, 2009 of the Ministry of Industry and Trade on conditions for inspection organizations' operations.

2.[22] Inspection organizations may only conduct inspections of machinery and equipment with strict labor safety requirements under the authority of the Ministry of Industry and Trade after obtaining a Certificate of Eligibility for Technical Safety Inspections.

Inspection organizations that were granted a Certificate of Eligibility before July 1, 2016 may continue to use it until its expiration date.

3. In case there are changes to regulatory documents, national standards, or technical regulations, apply the new documents.

4. During implementation, if issues arise or difficulties occur, organizations and individuals should report to the Ministry of Industry and Trade for timely review and resolution./.
