PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Considering the proposal of the Minister of Labor, Invalids, and Social Affairs,
DECISION:
Article 1. Scope of Regulation and Applicability
This Decision stipulates the monthly allowance, health insurance benefits, and funeral expenses subsidy for individuals who have ceased receiving disability allowances and do not fall under the category eligible to continue receiving such allowances according to Decision No. 60/HĐBT dated March 1, 1990 of the Council of Ministers (now the Government) and Decision No. 812/TTg dated December 12, 1995 of the Prime Minister, and who have at least 15 but less than 20 years of actual service.
Article 2. Conditions for Receiving Monthly Allowance
The subjects specified in Article 1 of this Decision shall be entitled to a monthly allowance upon reaching retirement age (60 years old for men, 55 years old for women).
Those individuals who have reached retirement age before the effective date of this Decision shall be entitled to the allowance from May 1, 2010.
Article 3. Amount of Monthly Allowance
1. The amount of the monthly allowance shall be equivalent to the allowance currently being received by the subjects specified in Decision No. 91/2000/QĐ-TTg dated August 4, 2000 of the Government.
2. Individuals receiving a monthly allowance pursuant to this Decision shall be entitled to health insurance; upon death, the person responsible for burial shall be entitled to funeral expenses in accordance with current social insurance laws.
Article 4. Implementation funds
The funding for the allowances stipulated in Article 3 of this Decision shall be guaranteed by the State Budget; specifically, in 2010, it will be allocated within the budget for salary reform.
Article 5. Effective Date
This Decision takes effect from July 1, 2010. The provisions of this Decision shall be implemented from May 1, 2010.
Article 6. Responsibilities for Guidance and Implementation
1. The Ministry of Labor, Invalids, and Social Affairs shall be responsible for guiding the implementation of this Decision.
2. The Vietnam Social Security shall be responsible for organizing the implementation and managing the funds for payment of allowances.
Article 7. Responsibility for Implementation
The Minister of Labor, Invalids, and Social Affairs, the Minister of Finance, the General Director of the Vietnam Social Security, and the Chairpersons of the People's Committees of provinces and centrally-administered cities are responsible for implementing this Decision./.
