REGARDING TECHNICAL MEASURES FOR THE SECOND STEP TO HANDLE VIOLATIONS OF THE LAW ON DYES IN THE YEN PHU-NHAT TAN DYKE SECTION (HA NOI) FOR TWO-STORY HOUSES AND LOWER (STAGE 1)
Pursuant to Decree No. 63/CP dated July 11, 1994 of the Government stipulating the functions, tasks, and organizational structure of the Ministry of Water Resources;
Pursuant to Decision No. 158/TTg dated March 16, 1995 of the Prime Minister on measures to handle violations of the Law on Dyes in Ha Noi;
Pursuant to Decision No. 274/TTg dated May 5, 1995 of the Prime Minister on measures for the second step to handle violations of the Law on Dyes in Ha Noi;
Pursuant to the calculation results of Company KSTKTL I and the Institute of Research and Technology in Water Resources;
Pursuant to the review results of the "National Science and Technology Council to Review the Technical Measures for the Second Step to Handle the Sông Hồng Dyke in the Ha Noi Area of the Ministry of Water Resources" at Document No. 1008/NCTK dated May 5, 1995 of the Ministry of Science, Technology, and Environment;
After consultation with the Minister of Construction;
After consulting the opinions of the Advisory Group of the Prime Minister;
At the proposal of the Director of the Flood Control and Dyke Management Department;
To ensure the safety and long-term stability of the dyke;
DECISION:
Article 1.
Within the range from 5 meters outside the flood protection zone to the entire adjacent area of the dyke protection zone in the Yen Phu - Nhât Tan section (Ha Noi) from K59 + 340 to K63 + 600, after considering the specific foundation conditions and technical aspects, the dyke foundation within this range can withstand the existing types of houses (including those partially demolished in the first step and those not yet processed) without affecting the safety of the dyke and the dyke protection zone as follows:
1- Four-story house.
2- One-story flat-roofed house with shallow foundation and simple foundation structure.
3- Two-story house with shallow foundation and simple foundation structure. In terms of legal handling, the Chairman of the People's Committee of Ha Noi City shall take the lead, based on the Land Law, the Law on Dyes, Decree No. 429-HĐBT dated December 15, 1990 of the Council of Ministers (now the Government), construction regulations, etc., coordinate with relevant sectors to handle violations and restore social order in the Yen Phu - Nhât Tan dyke section according to Clause 2, Article 1 of Decision No. 274-TTg dated May 5, 1995 of the Prime Minister.
Article 2.
For the houses mentioned in Article 1, the household owners must self-fund to reinforce the house foundation, the outer perimeter of the house, and the foundation of auxiliary facilities to prevent seepage for the dyke protection works according to the specific guidance of the Flood Control and Dyke Management Department. This must be completed before June 30, 1995.
Strictly prohibit families from arbitrarily digging holes, trenches, wells, taking soil, and planting long-term crops within the dyke protection zone. Householders must strictly comply with the management regulations for the dyke issued by the Flood Control and Dyke Management Department.
Article 3.
For one-story and two-story houses with deep foundations and complex foundation structures, and three-story houses and above, they must be inspected for stability in relation to the dyke-house combination according to the technical standards issued by the Ministry of Water Resources.
The householders of these houses must submit the following documents:
- Geological survey and testing materials.
- Design drawings including: calculation explanations and drawings for the foundation, foundation, and house.
- Completion records.
These documents must be prepared by units with legal person status and must be accepted by the competent authority of the People's Committee of Ha Noi City.
The Ministry of Water Resources will take the lead, coordinating with the Ministry of Construction, the Ministry of Science, Technology, and Environment, and the People's Committee of Ha Noi City to inspect and review to propose specific solutions and issue separate decisions.
Those cases that fail to submit documents as prescribed or submit them beyond the prescribed deadline, if allowed to exist legally, must reduce the number of floors to two. Households that provide false documents will be dealt with according to the law.
The submission deadline for documents is May 15, 1995.

Article 4.
The Chairman of the People's Committee of Ha Noi City shall base on this technical handling decision and coordinate with related legal handling decisions to organize implementation for each house.
Article 5.
The People's Committee of Ha Noi City, the Flood Control and Dyke Management Department, and related Departments and Bureaus shall be responsible for implementing this Decision.
