Amending and supplementing certain Articles of Decision No.

417/2003/NQ-UBTVQH11 on functions, tasks, authorities, and organizational structure of the National Assembly Office

On the basis of the Report No. 319/TTr-VPQH dated February 22, 2013, from the Director of the National Assembly Office on the Project to renew the National Assembly Office to improve the quality and effectiveness of its operations and the opinions of the members of the Standing Committee of the National Assembly;

Pursuant to the Law on the Organization of the National Assembly No. 30/2001/QH10, as amended and supplemented by Law No. 83/2007/QH11;

Amending and supplementing certain Articles of Decision No. 417/2003/NQ-UBTVQH11 on functions, tasks, authorities, and organizational structure of the National Assembly Office as follows:

RESOLUTION:

Article 1.

1. Clause 8 of Article 2 shall be amended and supplemented as follows:

"8. Research and serve the Standing Committee of the National Assembly in directing, coordinating, and cooperating in the activities of the National Ethnic Councils, Committees of the National Assembly; assist the Chairman of the National Assembly in maintaining contact with National Assembly deputies; ensure conditions for the operation of National Assembly deputies and Delegations of National Assembly deputies; provide necessary financial and material conditions for National Assembly deputies in submitting draft laws and ordinances and proposals regarding laws and ordinances.”

2. Clause 15 of Article 2 shall be amended and supplemented as follows:

"15. Organize and manage information, press, publishing, library, museum, and information technology application work to serve the activities of the National Assembly, the Standing Committee of the National Assembly, the National Ethnic Councils, Committees of the National Assembly, Committees under the Standing Committee of the National Assembly, and National Assembly deputies."

3. Add Clauses 18, 19, and 20 to Article 2 as follows:

"18. Issue documents within its authority; consolidate legislative regulations, codify laws, and other regulatory provisions according to the law; advise and support National Assembly deputies in preparing and perfecting files according to the Law on Legislative Regulatory Documents to submit to the Standing Committee of the National Assembly and the National Assembly for consideration to include in the Law and Ordinance Construction Program at the request of National Assembly deputies.

19. Implement recruitment, utilization, and management of staff, civil servants, officials, and other employees of the National Assembly Office; conduct inspections, investigations, handle complaints and denunciations, deal with violations, prevent corruption, promote thrift, and combat waste according to the law; international cooperation.

20. Perform other tasks as prescribed by law or assigned by the National Assembly, the Standing Committee of the National Assembly, or the Chairman of the National Assembly.”

4. Article 3 shall be amended and supplemented as follows:

"Article 3. Establishment and abolition of departments and units

1. The National Assembly Office shall be organized into departments and units equivalent to department level, the People's Representative Newspaper, and other public service units. Departments and units equivalent to department level that have multiple areas of work or multiple blocks of tasks shall establish divisions.

2. The authority to decide on establishing new departments, restructuring, or dissolving departments, units, and divisions is defined as follows:

a) The Standing Committee of the National Assembly decides on establishing new departments, restructuring, or dissolving departments and units equivalent to department level and public service units equivalent to those under ministries;

b) The Director of the National Assembly Office decides on establishing new departments, restructuring, or dissolving division-level units under departments and common service units and public service units not covered by point a of this clause;

c) The Permanent Delegation of the National Ethnic Council, the Permanent Delegation of the Committees of the National Assembly, or the leadership of Committees under the Standing Committee of the National Assembly, in coordination with the Director of the National Assembly Office, decides on establishing new departments, restructuring, or dissolving divisions under departments directly assisting the National Ethnic Council, Committees of the National Assembly, or Committees under the Standing Committee of the National Assembly; the Director of the National Assembly Office issues the decision.”

5. Article 4 shall be amended and supplemented as follows:

"Article 4. Organizational structure of the National Assembly Office

1. Departments directly assisting the National Ethnic Councils and Committees of the National Assembly include:

a) Department of Ethnic Affairs;

b) Department of Legal Affairs;

c) Department of Judicial Affairs;

d) Department of Economy;

đ) Department of Finance and Budget;

e) Department of Defense and Security;

g) Department of Culture, Education, Youth, Children, and Adolescents;

h) Department of Social Issues;

i) Department of Science, Technology, and Environment;

k) Department of Foreign Relations.

2. Departments and units equivalent to department level directly assisting Committees under the Standing Committee of the National Assembly include:

a) Department of Public Petitions;

b) Department of Deputy Work;

c) Center for Training Elected Representatives.

3. Departments and units equivalent to department level providing common services include:

a) General Department;

b) Department of Supervision Services;

c) Administrative Department;

d) Organization and Cadre Department;

đ) Planning and Finance Department;

e) Information Department;

g) National Assembly Library;

h) Computing Center;

i) Reception Department;

k) Management Bureau;

l) Southern Region Work Department;

m) Central and West Highlands Work Department.

a) The People's Representative Newspaper;

4. Public service units include:

b) National Assembly Guest House in Hanoi City;

c) National Assembly Guest House in Ho Chi Minh City;

d) Other public service units established according to point a and point b of Clause 2 of Article 3 of this Decision.”

6. Add Clause 4 to Article 8 as follows:

"4. Appointment, dismissal, and removal of the Editor-in-Chief and Deputy Editors-in-Chief of the People's Representative Newspaper shall be decided by the Director of the National Assembly Office after consulting with the competent state agency for press.

Appointment, dismissal, and removal of heads and deputy heads of other public service units shall be decided by the Director of the National Assembly Office.”

1. Transfer the Research Legislation Journal, a public service unit under the National Assembly Office, to become a public service unit under the Institute for Legislative Research.

Article 2.

The Director of the Institute for Legislative Research shall specify the functions, tasks, and organizational structure of the Research Legislation Journal.

2. The Director of the National Assembly Office shall amend, supplement, or issue new regulations on the functions and tasks of departments and units under the National Assembly Office.

1. This Decision takes effect from September 1, 2013.

Article 3.

2. The Permanent Delegation of the National Ethnic Council, the Permanent Delegation of the Committees of the National Assembly, the Heads of Committees under the Standing Committee of the National Assembly, the Director of the Institute for Legislative Research under the Standing Committee of the National Assembly, and the Director of the National Assembly Office are responsible for implementing this Decision./.

2. The Standing Committee of the National Assembly, the Standing Committees of the National Assembly's Committees, the Heads of the National Assembly's Committees, the President of the Legislative Research Institute under the National Assembly's Standing Committee, and the Director of the National Assembly's Office shall be responsible for implementing this Resolution./.
