DECISION OF THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT

On issuing regulations on animal disease safety zones and facilities.

 

THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to Decree No. 101/ dated October 20, 2015 of dated November 1, 1995 of the Government stipulating functions, tasks, powers and organizational structure of the Ministry. Upon consideration of the proposal of the Director of the Ministry’s Office,

Pursuant to the Animal Health Ordinance on February 15, 1993, Decree No. 93/ dated October 20, 2015 of dated November 27, 1993 of the Government guiding the implementation of the Animal Health Ordinance,

At the proposal of the Director of the Animal Health Department,

 

DECISION:

Article 1This Decision annexes the Regulations on animal disease safety zones and facilities.

Article 2.This Decision shall take effect three months from the date of signature.

Article 3.The Head of the Ministry's Office, the Director of the Department of Animal Health, the Directors of Provincial Departments of Agriculture and Rural Development, Heads of units and individuals concerned are responsible for implementing this Decision./.

 

REGULATIONS ON ANIMAL DISEASE SAFETY ZONES AND FACILITIES

(Issued pursuant to Decision No. 62/2002/QD-BNN dated July 11, 2002

of the Minister of Agriculture and Rural Development).

PART I

GENERAL PROVISIONS

Article 1.Scope and applicability:

1. Disease safety zones and disease-safe breeding facilities (hereinafter referred to as disease-safe facilities) for supplying animals and animal products for domestic consumption or export include:

a) Disease safety zones and disease-safe facilities for one species of animal against one or more diseases.

b) Disease safety zones and disease-safe facilities for multiple species of animals against one or more diseases.

2. Animals and animal products under this Regulation are defined according to Article 2, Clause 1 and 2 of the Animal Health Ordinance, except aquatic animals.

3. Organizations and individuals involved in livestock and poultry breeding activities; production and trade of animal feed and veterinary drugs; purchase, sale, slaughter of animals; processing and trade of animal products within disease safety zones and disease-safe facilities must comply with this Regulation.

Article 2.In this Regulation, the following terms shall be understood as follows:

1. "Disease safety zone" is a territorial area where no cases of disease occur during the specified period for each disease and animal health activities ensure control over disease outbreaks, slaughter, trade, and transportation of animals and animal products. A disease safety zone includes a safe zone and a buffer zone. The buffer zone is adjacent to the safe zone.

2. "Disease-safe facility"

is within the scope of a breeding facility where no cases of disease occur during the specified period for each disease and breeding and animal health activities ensure control over disease outbreaks, import and export of animals and animal products. Epidemic focus

"is a communicable disease or parasite listed by the Ministryof Agriculture and Rural Development occurring in a commune or a facility involved in breeding, slaughtering animals, and processing animal products. 4. "Disease surveillance" involves monitoring, inspecting, and evaluating the nature, causes of appearance, modes of transmission of diseases throughout the breeding process, transportation, slaughter of animals, processing and trading of animal products, and proposing preventive measures, disease control, or eradication for specific diseases.

1. The Department of Agriculture and Rural Development shall submit to the provincial people's committee proposals for establishing disease safety zones and disease-safe facilities in

Article 3.Directing and managing the implementation of the Steering Committee's activity plans.

local areas, investment in animal health activities and other activities within disease safety zones and disease-safe facilities. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).2. The Department of Animal Health is responsible for guiding the establishment, reviewing disease safety zones and disease-safe facilities, directing provincial Animal Health Sub-departments in establishing and managing activities related to disease safety zones and disease-safe facilities. 3. Provincial Animal Health Sub-departments under the central government are responsible for assisting county people's committees and breeding facilities in establishing and managing disease safety zones and disease-safe facilities and implementing technical contents within their authority.

2. The Animal Health Department shall be responsible for guiding the construction, reviewing safe disease zones and safe disease premises, directing the Provincial Animal Health Sub-departments in the construction and management of activities related to safe disease zones and safe disease premises.

3. The Provincial Animal Health Sub-department under the central city shall be responsible for assisting the People's Committee at the district level and livestock farms in constructing, managing safe disease zones and safe disease premises, and implementing technical contents within their authority.

Chapter II

CONDITIONS FOR VETERINARY SANITATION IN DISEASE-FREE ZONES, SAFE DISEASE AREAS

Article 4.The conditions for veterinary sanitation in disease-free zones and safe disease areasfor exporting animals and animal products include:

1.There must be no Foot-and-Mouth Disease or Swine Fever from the date of the lastill animal, death, or slaughter until the date the zone or area is recognized as adisease-free zone or safe disease area according to the regulations of the Ministryof Agriculture and Rural Development. 2.There must not occur other diseases listed in the disease declaration list of theMinistry of Agriculture and Rural Development but they must not develop into epidemicsand diseased animals must be promptly destroyed and treated according to theregulations.Agriculture and Rural Development but not to become diseased and animals contracting diseases. 3.Comply fully with all veterinary requirements stipulated in this Regulation regardingvaccination, quarantine, veterinary hygiene inspection of slaughtering, processing,distribution of animals and animal products, feed, and disease reporting.

4.Ensure sufficient veterinary hygiene conditions at facilities involved in veterinaryactivities as specified in Article 1, Clause 3 of this Regulation according to theregulations of the Ministry

of Agriculture and Rural Development and specific guidance from the VeterinaryOffice. The conditions for veterinary sanitation in disease-free zones and safe disease areasfor supplying animals and animal products for domestic consumption include: 1.Maintain all conditions as prescribed in Article 4, Clauses 2, 3, and 4 of thisRegulation;

Article 5.2.No outbreaks of diseases being proposed for recognition as disease-free zonesmust occur during the time period specified for each zone, the nature of eachdisease, and each species of animal up to the date of recognition of the disease-freezone or safe disease area.

PROVISIONS ON DISEASE REPORTING: Livestock farms and animal slaughterhousesmust immediately report to the local veterinary authority or local government whenanimals show signs of illness or die, and may not sell, slaughter, or circulate on themarket.

When receiving reports, the veterinary office at the commune or district mustimmediately verify in cases suspected of Foot-and-Mouth Disease, Swine Fever, orother diseases registered as safe disease areas, and must report to the provincialVeterinary Office while taking samples for diagnosis and testing.

Article 6.PROVISIONS ON VACCINATION: Vaccination schedules for each disease, each speciesof livestock, and types of vaccines in disease-free zones and safe disease areas forexporting animals and animal products must be carried out according to DecisionNo. 1243-NN-TY/QĐ dated July 24, 1996 of the Ministry of Agriculture and RuralDevelopment. PROVISIONS ON QUARANTINE OF ANIMALS: In cases where it is necessary to preventthe spread of disease, the Ministry

of Agriculture and Rural Development shall submit to the People's Committee ofthe province for permission to establish quarantine stations on major roads inbuffer zones.

2.Strictly control the transportation of animals and animal products, especially thoseentering disease-free zones and safe disease areas. 3.Must have isolation quarantine facilities. Isolation quarantine periods varyaccording to each disease. .

Article 7.4.Issue quarantine certificates only for animals and animal products sourced fromdisease-free zones and safe disease areas.

Article 8 PROVISIONS ON VETERINARY HYGIENE INSPECTION AND SLAUGHTERING OFANIMALS: 1.Feed must meet quality standards and veterinary hygiene requirements.

2.Slaughtering of livestock for business purposes must be conducted at authorizedslaughterhouses. Livestock slaughtered must be inspected by the veterinaryauthority. 3.Slaughtering of poultry for business purposes must be strictly controlled by theveterinary authority.

PROVISIONS ON DIAGNOSIS AND TESTING: 1.When animals show signs of illnessor death suspected of dangerous diseases, the veterinary authority must conductdiagnosis and testing and provide a diagnostic result certificate along with the diseasereport.

2.Conduct serological surveys according to the regulations of the Ministry

PROVISIONS ON HANDLING INFECTIOUS DISEASED ANIMALS: 1.Immediatelycarry out the destruction of animals infected with Foot-and-Mouth Disease upondiscovery.

Article 9.2.Mandatory slaughtering of animals infected with Swine Fever.

8.Mandatory destruction and slaughtering of animals infected with other diseasesaccording to the guidance and supervision of the veterinary authority suitable foreach disease as prescribed by veterinary laws.

REGISTRATION PROCEDURES AND RECOGNITION OF DISEASE-FREE ZONESAND SAFE DISEASE AREAS: Localities and livestock farms applying to builddisease-free zones and safe disease areas must prepare registration files including:

1.A registration form for disease-free zones and safe disease areas (according to thetemplate provided by the Veterinary Office).

Article 10.2.A report on the conditions of the planned disease-free zones and safe diseaseareas, including:

a)A report describing the disease-free zones and safe disease areas regardinglocation, natural geography, and production characteristics.

b)Veterinary activities in disease-free zones and safe disease areas. Agriculture and Rural Development.

Article 11.Each disease-free zone and safe disease area must have its own report.

The location for registering disease-free zones and safe disease areas and the timelimit for processing:

1.The People's Committee of the district and livestock farms applying to builddisease-free zones and safe disease areas must submit their registration files to theProvincial Veterinary Office within the scope of Article 12 of this Regulation.

2.Within thirty days from the receipt of valid files, the Provincial Veterinary Office willestablish a project to build disease-free zones and safe disease areas.

Chapter III

Localities and livestock farms applying for recognition of disease-free zones andsafe disease areas must follow these procedures:, SAFE DISEASE AREAS

Article 12.1.Prepare a registration file including:

a)A request for review.

b)A report on the conditions of the built disease-free zones and safe disease areas. 2.Submit the registration file to the Veterinary Office.

Within thirty days from the receipt of valid files, the Veterinary Office will reviewthe conditions of the disease-free zones and safe disease areas and respond with theresults. If the conditions are met, competent authorities will issue a certificate forthe disease-free zones and safe disease areas for the locality according to Article 17of this Regulation.

In cases where the review finds that the conditions are not met for disease-freezones and safe disease areas, the locality or facility can reapply for review aftercorrecting and addressing the deficiencies identified in the previous review.

Each safe disease zone and safe disease premise shall have its own application.

Article 13.Place of registration for safe disease zones and safe disease premises and time limit for processing:

1. The People's Committee at the district level and livestock farms applying to construct safe disease zones and safe disease premises shall submit the registration dossier to the Provincial Animal Health Sub-department under the central city as stipulated in Article 12.

2. Within thirty days from receiving valid dossiers, the Provincial Animal Health Sub-department shall assist the People's Committee at the district level and livestock farms in establishing projects to construct safe disease zones and safe disease premises.

Article 14.The locality and livestock farms applying for recognition of safe disease zones and safe disease premises must complete the following procedures:

1. Prepare a registration dossier including:

a) A request for review;

b) An application regarding the conditions of the safe disease zone and safe disease premise that have been constructed.

2. Submit the registration dossier to the Animal Health Department.

Within thirty days from receiving valid dossiers, the Animal Health Department shall review the conditions of the safe disease zone and safe disease premise and provide the results. If the conditions are met, competent authorities shall issue certificates for safe disease zones and safe disease premises according to Article 17 of this Regulation.

In cases where the review finds that the conditions are not sufficient for a safe disease zone or safe disease premise, the locality and the entity may reapply for review after addressing the deficiencies identified in the previous review.

Article 15.Establishment of the disease safety zone assessment team and disease safety facility assessment team:

1.The Animal Health Department shall be responsible for deciding to establish theassessment team.

2.The members of the assessment team shall be determined by the Director of theAnimal Health Department and shall include technical veterinary staff fromrelevant units related to the content of the assessment.

Article 16.Duties of the assessment team:

1.Checking the conditions of the proposed disease safety zone and disease safefacility for recognition.

2.Evaluating the disease situation and livestock transportation within the zoneand imports and exports with other regions and countries.

3.Determining the capability of the responsible agencies for the disease safetyzone and disease safe facility.

4.Preparing the assessment report and recommendations at one of the following levels:

a)Level A: Meeting all standards for the disease safety zone and disease safefacility, recommending recognition of the disease safety zone and diseasesafe facility.

b)Level B: Meeting some but not all standards, requiring completion of certaincontents according to the assessment team's requirements for re-assessment.

c)Level C: Not meeting the standards, requiring continued activities to build adisease safety zone and disease safe facility.

Article 17.Authority to issue certificates recognizing disease safety zones and disease safefacilities:

The Animal Health Department shall issue certificates recognizing counties, districts, and breeding facilities as disease safety zones and disease safefacilities based on the proposal of the Provincial Animal Health Sub-departmentunder the direct central administration.

Article 18.Management of disease safety zones and disease safe facilities:

1.Recognition certificates for disease safety zones and disease safe facilitiesare valid for two years from the date of issuance and must be notified to allprovinces and cities nationwide. Three months before the expiration date, theunit must submit a request for reassessment to the Animal HealthDepartment. If during the validity period of the certificate, the disease safetyzone and disease safe facility fail to meet the required standards, thecompetent authority will revoke the certificate.

2.The Animal Health Department shall organize a reassessment of the diseasafety zone and disease safe facility within two months from the receipt of therequest for reassessment, covering the following contents:

a)Veterinary hygiene conditions of breeding facilities.

b)Serological testing for registered safe diseases and zoonotic diseases.

c)Inspection of vaccination, quarantine, and slaughterhouse control operations.

Article 19.Responsibilities of state management agencies for animal health regarding diseasafety zones and disease safe facilities:

1.The Animal Health Department shall be responsible for:

a)Guiding and directing provincial animal health sub-departments in buildingdisease safety zones and disease safe facilities.

b)Assessing disease safety zones and disease safe facilities.

c)Issuing decisions to recognize disease safety zones and disease safe facilities.

d)Supervising, inspecting, and auditing disease safety zones and disease safefacilities.

2.Provincial animal health sub-departments under the direct central administrationshall be responsible for:

a)Cooperating with relevant agencies at local level and breeding facilities to build disease safety zones and diseasafe facilities.

b)Proposing to the Animal Health Department for recognition of disease safetyzones and disease safe facilities.

c)Supervising, inspecting, and auditing animal health activities within diseasafety zones.

3.Units assigned by the Animal Health Department to assess, diagnose, and testdisease safety zones and disease safe facilities must bear legal responsibilityfor their conclusions.

Article 20.Responsibilities of organizations and individuals engaged in animal husbandryactivities in disease safety zones and disease safe facilities.

1.Breeding facilities, feed processing facilities, animal slaughterhouses, andanimal product traders in disease safety zones and disease safe facilities mustcomply with all legal

provisionsregarding animal health for disease safety zones and disease safe facilities.

2.Organizations and individuals inother areas engaging in activities related to disease safety zones and diseasafe facilities must comply with regulations applicable to disease safetyzones and disease safe facilities.

CChapter IV

IMPLEMENTING PROVISIONS

Article 21.Responsibilities for Implementation:

The Director of the Animal Health Department, within the scope of theirfunctions, duties, and powers, shall be responsible for guiding theimplementation of this Regulation.

During the implementation of this Regulation, if there are any difficulties,they should be reported to the Ministry of Agriculture and Rural Development(Animal Health Department) for consideration and resolution./.
