PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decision No. 198/1998/QĐ-TTg dated October 12, 1998 of the Prime Minister on the establishment of the Hoa Lac High-Tech Park; approving the Master Plan and Project Investment Step 1, Phase I of the Hoa Lac High-Tech Park;

Pursuant to Decision No. 10/2000/QĐ-TTg dated January 18, 2000 of the Prime Minister on the establishment of the Management Board of the Hoa Lac High-Tech Park;

To accelerate the construction progress of the Hoa Lac High-Tech Park, considering the proposal of the Minister of Science and Technology (document No. 1117/TTr-BKHCN dated December 16, 2002, document No. 52/BKHCN-CNC dated January 10, 2003); opinions of the Ministry of Planning and Investment (document No. 8154/BKH-KHGDMT dated December 23, 2002), the Ministry of Construction (document No. 433/BXD-KH-TK dated March 29, 2002), the General Department of Land Administration (document No. 1537/TCĐC-PC dated November 11, 2002).

DECISION:

Article 1. The Management Board of the Hoa Lac High-Tech Park is assigned to coordinate with relevant agencies to implement the following tasks in accordance with current regulations:

1. Pre-investment works outside Step 1, Phase I.

2. Select reputable foreign consulting organizations with experience to contract for planning consultancy and design consultancy for special projects of the Hoa Lac High-Tech Park.

3. Implement infrastructure construction projects of Step 1, Phase I of the Hoa Lac High-Tech Park according to the Turnkey Contract form specified in Article 62 of the Investment and Construction Management Regulations issued together with Decree No. 52/1999/NĐ-CP dated July 8, 1999 of the Government.

Article 2. Agreeing with the proposal of the Ministry of Science and Technology regarding the assignment of Vietnam National Construction Import-Export Corporation (VINACONEX) under the Ministry of Construction as the General Contractor to implement infrastructure construction projects of Step 1, Phase I of the Hoa Lac High-Tech Park (as stipulated in Clause 3, Article 1 of this Decision) according to the Turnkey Contract form. The Ministry of Science and Technology directs the Management Board of the Hoa Lac High-Tech Park to organize the implementation of this form in accordance with current regulations.

Article 3. Based on the approved master plan and land use plan, allowing the Management Board of the Hoa Lac High-Tech Park to pilot the transfer of land and lease of land to investors in accordance with the procedures prescribed by current laws. The Management Board is responsible for completing all required procedures and submitting applications to the People's Committee of Ha Tay Province for issuance of land use rights certificates to investors..

Article 4. Based on the annual budget estimates for project implementation proposed by the Management Board of the Hoa Lac High-Tech Park, the Ministry of Planning and Investment will cooperate with the Ministry of Finance to proactively allocate state budget funds to ensure that the Management Board of the Hoa Lac High-Tech Park can implement assigned tasks on schedule.

Article 5. THIS DECISION SHALL TAKE EFFECT 15 DAYS AFTER THE DATE OF SIGNATURE.

Article 6The Ministers of Science and Technology, Planning and Investment, Finance, Construction, Natural Resources and Environment, Defense, Governor of the State Bank of Vietnam, Chairman of the People's Committee of Ha Tay Province, General Director of Vietnam National Construction Import-Export Corporation, and Head of the Management Board of the Hoa Lac High-Tech Park are responsible for enforcing this Decision.
