Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 77/2003/NĐ-CP dated July 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

At the proposal of the Director of the Department of Banking and Financial Organization Finance,

DECISION:

Article 1: The amendment and supplementation of certain articles of the Lottery Issuance Regulation for Traditional Lotteries issued together with Decision No. 143/2003/QĐ-BTC dated September 9, 2003 of the Minister of Finance are as follows:

1. Article 7 - Issuing organizations shall be amended and supplemented as follows:

a. The lottery issuance company may simultaneously issue traditional lotteries alongside other types of lotteries on the basis of ensuring the completion of assigned tasks and maintaining the development of traditional lottery types.

b. Traditional lotteries shall be issued through a network of lottery agents and cooperators which are organizations and agencies related to target programs. The lottery issuance company shall organize a network of agents to develop widely within the defined market range, actively participating in combating illegal lottery activities. The issuance of tickets from the lottery issuance company to agents and organizations shall be carried out according to the Agent Ticket Sales Regulation and relevant regulations.

c. The issuance of lottery tickets must ensure sufficient quantities as announced in each issuance period and must be meticulously planned based on demand surveys to avoid waste; at the same time, it must be widely publicized to the people for monitoring and supervising lottery activities.

d. In the region, the lottery issuance company may establish representative offices to issue tickets outside the province. Representative offices issuing tickets outside the province are subordinate units of the company, having the function of coordinating ticket distribution, recovering unsold tickets, awarding prizes to customers, and urging agents to recover debts. Representative offices issuing tickets outside the province are not allowed to engage in business operations.

2. Article 8 - The consumption market for traditional lottery tickets shall be amended as follows:

The consumption market for traditional lottery tickets is the common market of provinces and cities in the region as specified below:

a. Northern Region: including provinces and cities from Ha Tinh Province northward.

b. Central Region: including provinces and cities from Quang Binh Province to Ninh Thuan Province, Dak Nong Province.

c. Southern Region: including provinces and cities from Binh Thuan Province, Lam Dong Province, Binh Phuoc Province southward.

3. Article 11 - Recovery of unsold tickets (unsold tickets) shall be amended and supplemented as follows:

a. When recovering and counting unsold tickets, including those returned by authorized agents and unsold tickets retained by the lottery company of the same issuance period, there must be the presence of the Lottery Supervisory Board.

b. The recovery of unsold tickets must be completed 30 minutes before the start of the number drawing.

c. Before submitting unsold tickets for recovery, the agent must cut the corner of the tickets according to the regulations and submit the cut tickets along with the list to the company's staff for verification and recovery. If the submitted tickets meet the invalidation requirements, the number of recovered tickets will be confirmed. If the agent submits tickets late compared to the specified time, the lottery company will refuse to accept unsold tickets from that agent.

The cutting of corners for unsold tickets still managed by the lottery company (if any) must also be carried out according to the above regulations. The company must arrange staff to carry out this work.

d. For the recovery of unsold tickets (unsold tickets) sold outside the main office of the company:

- Before submitting unsold tickets, the agent must personally cut the corner (invalidating the ticket) according to the regulations and submit the cut tickets along with the list to the company's staff (or the authorized company). If the submitted tickets meet the invalidation requirements, the initial counting of bundles and the number of recovered tickets will be conducted 30 minutes before the start of the number drawing, then sealed and handed over to the receiving department to transfer to the main office for the final counting.

- During the recovery, counting, handover, and transportation of unsold tickets back to the company, there must be supervision by representatives of the Lottery Supervisory Board.

- The lottery company must establish procedures, specific steps, and responsibilities for each participating department in the recovery of unsold tickets.

e. The lottery company must register the location for destroying unsold tickets with the Department of Finance.

4. Article 16 - Commission for agents shall be amended as follows:

The commission for agents shall be determined by the lottery company but shall not exceed 13% of sales revenue.

Article 2: This Decision takes effect 15 days from the date of publication in the Official Gazette.

Article 3: The Director of the Department of Banking and Financial Organization Finance, the Head of the Ministry of Finance’s Office, and the Heads of related units under and directly under the Ministry of Finance are responsible for implementing this Decision.
