Decree No. 62/2008/ND-CP stipulates the functions, tasks, powers, and organizational structure of the Vietnam Academy of Science and Technology (VAST). VAST is a public institution under the Government, conducting research in natural sciences and technology according to the priorities set by the State. This Decree replaces Decree No. 27/2004/ND-CP.

DECREE

Specifies the functions, tasks, powers, and organizational structure of the Vietnam Academy of Science and Technology.

THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Considering the proposal of the President of the Vietnam Academy of Science and Technology,

 

DECREE:

Article 1. Position and Functions

1. The Vietnam Academy of Science and Technology is a public institution under the Government, performing the function of basic research in natural sciences and developing technology according to the priorities set by the State to provide scientific grounds for science and technology management work, policy-making, strategy-formulation, planning, and economic and social development plans, and training high-level human resources in science and technology in accordance with the provisions of the law.

2. The Vietnam Academy of Science and Technology has the international trade name in English as: Vietnam Academy of Science and Technology, abbreviated as VAST.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

The Vietnam Academy of Science and Technology (hereinafter referred to as the Institute) shall perform the specific tasks and powers as follows:

1. Submit to the Government draft decrees prescribing, amending, and supplementing the functions, tasks, powers, and organizational structure of the Institute; submit to the Prime Minister for decision on establishing new organizations, changing names, restructuring, or dissolving units under the authority of the Prime Minister.

2. Regarding strategies, plans, programs, and their implementation:

a) Submit to the Government and the Prime Minister the strategies, plans, long-term, five-year, and annual programs, important projects, and proposals of the Institute; organize the implementation of these strategies, plans, and programs after approval;

b) Participate in building the development strategy for natural sciences and technology; participate in formulating policies for the development of science, technology, education, and training, contributing to the protection of natural resources and the environment;

c) Study and synthesize natural resources, natural conditions, and the environment to provide scientific bases for the formulation and issuance of policies, strategies, plans, and economic and social development plans for regions and the country;

d) Organize research activities in natural sciences and technological development in key areas such as information technology; biotechnology; materials science; marine and island research and construction; ecology and the environment; biological resources and natural compounds; electronic engineering; scientific equipment and automation; disaster prediction, prevention, and mitigation; space technology;

đ) Propose and lead the implementation of national key science and technology programs according to the division of labor by the Government and the Prime Minister;

e) Implement, apply, and transfer new research results in science and technology; organize production, business, and consulting services in specialized fields into practical production and daily life, contributing to the development of high-tech industries in line with the country's economic and social development plan and in accordance with the law;

g) Provide earthquake and tsunami warnings;

h) Inform, promote, and disseminate knowledge and research results in science and technology to meet the requirements of the science and technology market;

i) Appraise or participate in appraising the technological level and review economic and technical feasibility studies of major state and local projects at the request of the Government, the Prime Minister, and competent state agencies;

k) Train high-level human resources in science and technology; organize postgraduate training in natural sciences and technology in accordance with the law;

l) Decide on investment projects of the Institute in accordance with the law.

3. Regarding international cooperation:

a) International cooperation in science and technology in accordance with the law;

b) Organize and monitor the implementation of international cooperation programs and projects that have been signed;

c) Participate in international conferences, seminars, and cooperation programs and decide to organize international conferences and seminars in accordance with the law; manage conferences, seminars, and international cooperation plans of subordinate units.

4. Decide and direct the implementation of the administrative reform program according to the goals and content of the state administrative reform program after approval by the Prime Minister.

5. Regarding staffing, cadres, and civil servants:

a) Develop the staffing plan of the Institute to be sent to the Ministry of Home Affairs for consolidation and submission to the Prime Minister for approval; decide on the allocation and management of the staffing quota for subordinate agencies and units; guide, inspect, and supervise subordinate units in implementing staffing management;

b) Decide and implement specific measures to strengthen discipline and administrative conduct among cadres and civil servants within its authority; prevent corruption, practice thrift, combat waste, and all manifestations of bureaucracy, arrogance, and arbitrary power in the Institute's activities;

c) Inspect compliance with policies, laws, and assigned tasks by cadres, civil servants, and workers under its management; resolve complaints and denunciations related to cadres and civil servants under its authority in accordance with the law.

6. Regarding financial and asset management:

a) Prepare the annual budget estimate of the Institute to be submitted to the competent state agency for approval in accordance with the law on the state budget;

b) Decide on the allocation of quotas and plans; check expenditures; be responsible for final accounts and have the right to adjust within the approved total revenue and expenditure ceiling to fulfill assigned tasks without changing the approved objectives and plans;

c) Manage finances and assets; use state-owned assets and other sources of assets effectively; carry out accounting and statistical work in accordance with the law.

7. Regarding state-owned enterprise management:

a) Direct the reorganization and modernization of enterprises under the Institute's management in accordance with the Government's regulations; organize implementation after approval by the Prime Minister;

b) Perform certain specific tasks and powers regarding representing the state's ownership interest in enterprises under the Institute's management. in accordance with the law.

8. Report to the Government, the Prime Minister, or the Minister managing the sector or field as prescribed by law.

9. Perform other tasks and exercise other powers assigned by the Government or the Prime Minister and as prescribed by law.

22. Information Technology Institute.

27. Applied Mechanics and Informatics Institute.

28. Tropical Biology Institute.

29. Tropical Engineering Institute.

30. Applied Materials Science Institute.

31. Nha Trang Institute for Research and Application of Science and Technology.

32. Information and Documentation Center.

33. Vietnam National Museum of Nature.

34. Science and Technology Publishing House.

In this Article, units from Clause 1 to Clause 7 are units assisting the President of the Institute; units from Clause 8 to Clause 31 are research institutes; units from Clause 32 to Clause 34 are public service units.

Based on development needs, the President of the Vietnam Academy of Science and Technology decides to establish, rename, reorganize, merge, dissolve other public service units under the Academy, and decides to establish, rename, reorganize, merge, dissolve self-financing units and science and technology enterprises according to the provisions of law.

Article 4. Leadership

1. Leadership:

a) The Vietnam Academy of Science and Technology has a President and four Vice Presidents. The President of the Vietnam Academy of Science and Technology is appointed and relieved of duty by the Prime Minister, accountable to the Government and the Prime Minister for all activities of the Vietnam Academy of Science and Technology;

b) The Vice Presidents are appointed and relieved of duty by the Prime Minister at the recommendation of the President, accountable to the President for the tasks assigned by the President.

2. Powers of the President of the Institute:

a) Enact regulations governing the operations of the Vietnam Academy of Science and Technology;

b) Define functions, tasks, powers, organizational structure, and working relationships of subordinate units;

c) Appoint, reappoint, relieve of duty, discipline heads and deputy heads of subordinate units according to the provisions of law; define the powers and responsibilities of heads of subordinate units;

d) Decide and delegate management authority regarding organization and personnel; grant autonomy and responsibility for tasks, finance, assets, organizational structure, and staffing to subordinate units according to the provisions of law;

đ) Plan, train, develop, recruit, utilize, transfer, retire, extend working time, reward, discipline, and other policies and benefits for cadres, civil servants, and employees under his/her management according to the provisions of law;

e) Decide to establish scientific councils to advise the President on strategic directions, orientations, and development plans for science and technology of the Institute;

g) Exercise other powers as prescribed by law.

Article 5. Effectiveness and Responsibility for Implementation

1. This Decree takes effect fifteen days after its publication in the Official Gazette and replaces Decree No. 27/2004/NĐ-CP dated January 16, 2004 of the Government on the functions, tasks, powers, and organizational structure of the Vietnam Academy of Science and Technology.

Article 2. Abolish previous provisions that conflict with this Decree.

3. The President of the Vietnam Academy of Science and Technology, Ministers, Heads of ministerial-level agencies, Heads of central government agencies, Chairpersons of provincial People's Committees directly under the Central Government shall be responsible for implementing this Decree./.
