WHEREAS the Law on Organization At the proposal of August 25 the 2001;

WHEREAS the Law on Competition, Awards dated June 26 the 11 in 2003; the Law Amending and Supplementing Certain Provisions of the Law on Competition, Awards dated June 14, 2005 and the Law Amending, MANAGEMENT AND USE OF DEPOSITS AT THE ENVIRONMENT PROTECTION FUND Certain Provisions of the Law on Competition, Awards dated June 16 the Decision No. 64/2014/NĐ-CP

WHEREAS the Law on Cultural Heritage a written notice dated June 29, 2001 and the Law Amending and Supplementing Certain 1. NATIONAL UNIVERSITIES ARE PUBLIC HIGHER EDUCATION INSTITUTIONS MANAGED BY THE MINISTRY OF EDUCATION AND TRAINING, HAVE LEGAL PERSONALITY, SEPARATE ACCOUNTS, AND USE STAMPS WITH THE NATIONAL EMBLEM. Provisions of the Law on Cultural Heritage dated June 18, 2009;

At the proposal of the Minister of Culture, Sports and Tourism;

THE GOVERNMENT promulgates this Decree stipulating the awarding of the titles "People's Artist", "Meritorious Artist" in the field of intangible cultural non material,

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decree stipulates the subjects, criteria, procedures, and formalities for awarding the titles "People's Artist", "Meritorious Artist" in the field of intangible cultural heritage.

Article 2. Applicability

1. Vietnamese citizens who currently hold, teach, and promote the value of intangible cultural heritage in the following categories: Languages, scripts; Folk literature; Folk performing arts; Social customs and beliefs; Traditional festivals; Folk knowledge.

2. Organizations and individuals related to the activities of awarding the titles "People's Artist", "Meritorious Artist".

Article 3. Rights and obligations of People's Artists and Meritorious Artists

People's Artists and Meritorious Artists have the following rights and obligations:

1. To receive the Medal, Certificate from the President of the Socialist Republic of Vietnam and monetary awards accompanying the title "People's Artist" or "Meritorious Artist" as prescribed by laws on competition and awards;

2. For People's Artists and Meritorious Artists with low income and difficult living conditions, they shall be entitled to monthly subsistence allowances as prescribed by the Government;

3. Continuously improve their knowledge and skills;

4. Actively teach and disseminate knowledge and skills;

5. Other rights and obligations as prescribed by laws on competition and awards and laws on cultural heritage.

Article 4. Budget for Conferment Activities and Monetary Rewards

1. The budget for organizing the awarding of the titles "People's Artist", "Meritorious Artist" to implement the following activities:

a) Building and implementing the Plan of the Awarding Council for the titles "People's Artist", "Meritorious Artist";

b) Reviewing the application files for awarding;

c) Organizing public opinion collection from local communities or professional associations;

d) Organizing Council meetings;

đ) Announcing information about the Council's selection results through mass media to solicit public opinions;

e) Press conference announcing the decision of the President conferring the titles;

g) Organizing award ceremonies;

h) Handling complaints;

i) Other related activities as prescribed by law.

2. Responsibilities regarding the budget for organizing the awarding of the titles "People's Artist", "Meritorious Artist" and accompanying monetary awards are stipulated as follows:

a) The Ministry of Culture, Sports and Tourism is responsible for allocating funds for the activities organization of the specialized awarding council at the ministry level, the national-level awarding council, organization ceremony for presenting the titles and other related expenses as prescribed by law;

b) Chairmen of the National Assembly; of provincial people's committees directly under the central government (hereinafter referred to collectively as provincial people's committees) are responsible for allocating funds for the activities of the provincial awarding council, monetary awards accompanying the titles "People's Artist", "Meritorious Artist" and other related expenses as prescribed by law.

Chapter II

CRITERIA FOR AWARDING THE TITLES "PEOPLE'S ARTIST", "MERITORIOUS ARTIST"

Article 5. Criteria for awarding the title "People's Artist"

The title "People's Artist" is awarded to individuals meeting the following criteria:

1. Loyalty to the Socialist Republic of Vietnam; complying well with the policies and guidelines of the Party and the laws of the State, internal regulations, and rules of agencies, units, organizations, and localities;

2. Having good moral character, being exemplary in life; passionate and dedicated to their profession, respected and admired by colleagues and the public; having trained individuals who are currently involved in protecting and promoting the value of intangible cultural heritage;

3. Possessing extraordinary professional talent, making significant contributions, and being exemplary in the cause of protecting and promoting the value of intangible cultural heritage nationwide, demonstrated through mastery of skills and secrets of practicing intangible cultural heritage, achievements, awards, spiritual or material products of high historical, cultural, scientific, artistic, aesthetic, and technical value;

4. Having worked in the profession for 20 years or more and previously been conferred the title "Meritorious Artist" by the State.

Article 6. Criteria for awarding the title "Outstanding Artisan"

The title "Outstanding Artisan" shall be awarded to individuals meeting the following criteria:

1. The criteria stipulated in Clause 1 and Clause 2 of Article 5 of this Decree;

2. Possessing extraordinary professional talent, making significant contributions, and being exemplary in the cause of protecting and promoting the value of intangible cultural heritage at the local level, demonstrated through mastery of skills and secrets of practicing intangible cultural heritage, achievements, awards, spiritual or material products of historical, cultural, scientific, artistic, aesthetic, and technical value; quality of the document simultaneously poor quality of the document 3. Chapter III

BOARD FOR AWARDING THE TITLES "PEOPLE'S ARTISAN", "OUTSTANDING ARTISAN"

Article 7. Duties, principles of operation, and composition of the Board for awarding the titles "People's Artisan", "Outstanding Artisan"

1. The Board for awarding the titles "People's Artisan", "Outstanding Artisan" shall be established at three levels:

a) Provincial Council.

b) Sectoral Council at the Ministry level;

c) National-level Council.

2. The Board for awarding the titles "People's Artisan", "Outstanding Artisan" shall have the following duties:

a) Organizing the awarding process to ensure quality, timeframes, and compliance with legal regulations;

b) Selecting individuals who meet the criteria for awarding the titles "People's Artisan", "Outstanding Artisan" as prescribed in Articles 5 and 6 of this Decree;

c) Announcing the selection results on mass media to solicit public opinions;

d) Completing the awarding dossier and submitting it to the competent board;

đ) Considering and resolving any recommendations related to the awarding process;

3. The Board for awarding the titles "People's Artisan", "Outstanding Artisan" shall operate according to the following principles:

a) Established for each awarding session and dissolved upon completion of its tasks;

b) Operating under the principle of democracy, transparency, and in accordance with the legal provisions on commendation and reward; stipulating c) Meetings of the Board for awarding the titles "People's Artisan", "Outstanding Artisan" shall be organized when at least 75% of the members named in the decision to establish the Board attend, including the Chairman of the Board or the Deputy Chairman of the Board authorized to represent. The secretary has the responsibility to collect the opinions of absent members through Voting Forms (Model No. 5 and Model No. 6);

d) The national-level Board shall only consider dossiers submitted by the specialized provincial-level Board, and the provincial-level Board shall only consider dossiers submitted by the municipal-level Board according to the procedures stipulated in Articles 12, 13, 14, and 15 of this Decree; it shall not consider dossiers that do not comply with legal regulations on commendation and reward; issues to the Head of the General Staff, Commander of the Military Region, Naval Zone Command, Director of the Enforcement Bureau đ) The provincial-level Board shall only submit to the specialized central-level Board, the specialized central-level Board shall only submit to the national-level Board, and the national-level Board shall only submit to the Prime Minister a list of individuals receiving 90% or more of the votes from the total number of Board members;

e) Members of the Board for awarding the titles "People's Artisan", "Outstanding Artisan" shall not be candidates for the titles "People's Artisan", "Outstanding Artisan";

g) In one awarding period, a member of the provincial-level Board shall not simultaneously be a member of the specialized central-level Board or the national-level Board.

4. The composition of the Board for awarding the titles "People's Artisan", "Outstanding Artisan" includes the Chairman of the Board, Deputy Chairmen of the Board, and Board members representing state management agencies on commendation and reward at the same level; political organizations, political-social organizations, social organizations, occupational social organizations; some People's Artisans, Outstanding Artisans, and reputable scientists with deep expertise in related intangible cultural heritage.

5. The Chairman of the Board for awarding the titles "People's Artisan", "Outstanding Artisan" decides to establish the Secretariat to assist the Board.

1. The provincial-level Board shall be established by the Provincial People's Committee Chairman based on the proposal of the Department of Culture, Sports and Tourism, consisting of nine to twelve members. The composition of the provincial-level Board includes:

a) The Chairman of the Board is a Leader of the Provincial People's Committee;

Article 8. Provincial Council

b) The Deputy Chairman of the Board is the Director of the Department of Culture, Sports and Tourism; of the National Assembly; 2. The permanent office of the provincial-level Board is the Department of Culture, Sports and Tourism. The provincial-level Board uses the seal of the Department of Culture, Sports and Tourism.

1. The specialized central-level Board shall be established by the Minister of Culture, Sports and Tourism based on the proposal of the Director of the Department of Commendation and Reward, Ministry of Culture, Sports and Tourism, consisting of twelve to fifteen members. The composition of the specialized central-level Board includes: of the National Assembly; l) Guide and implement laws on thrift and anti-waste in the use of the budget and public finance according to the law.

a) The Chairman of the Board is a Leader of the Ministry of Culture, Sports and Tourism;

c) Other members of the Council.

b) The Deputy Chairman of the Board is the Director of the Department of Commendation and Reward, the Director of the Heritage Management Agency, Ministry of Culture, Sports and Tourism; of the National Assembly; e) The portion of land rented by the state with annual rent payments.

Article 9. Ministry-level Professional Council

2. The permanent office of the specialized central-level Board is the Department of Commendation and Reward, Ministry of Culture, Sports and Tourism. The specialized central-level Board uses the seal of the Ministry of Culture, Sports and Tourism.

a) The Chairman of the Council is the Head of the Ministry of Culture, Sports and Tourism; Culture, culture, Sports and Tourism;

b) The Vice-Chairman of the Council is the Director of the Department of Awards and Commendations, the Director of the Heritage Management Department, Ministry of Culture, Sports and Tourism; Culture, culture, Sports and Tourism;

c) Other members of the Council.

2. The permanent office of the specialized council at the ministerial level is the Department of Awards and Commendations, Ministry of Culture, Sports and Tourism. Article 10. National Council

b) Deputy Chairmen of the Council are the Heads of the Central Board for Commendation and Reward, the Ministry of Home Affairs; the Heads of the Ministry of Culture, Sports and Tourism;

c) Other members of the Council.

2. The permanent office of the National Council is the Ministry of Culture, Sports and Tourism. The National Council uses the seal of the Ministry of Culture, Sports and Tourism.

Chapter IV

APPLICATION FILE, PROCEDURE AND PROCEDURES FOR PROPOSING TO AWARDS THE TITLES "PEOPLE'S ARTIST", "OUTSTANDING ARTIST"

Article 11. Documents for Proposal to Awards

1. The documents for proposing to award for individuals include:

a) A form of achievements application for awarding the title "People's Artist" (Form No. 1), "Outstanding Artist" (Form No. 2);

b) Documents proving knowledge, skills, and contributions to the cause of preserving intangible cultural heritage including: tapes, discs, images describing knowledge and skills currently possessed; certified copies of certificates or decisions on awarding medals, orders, prizes, commendations, and other related documents. a written notice intangible cultural heritage includes: tapes, discs, images depicting knowledge and skills currently held; certified copies or authenticated certificates of awarding orders, decisions granting medals, awards, commendations and other related documents.

2. The file of the provincial council sent to the specialized council at the ministry level includes:

a) The report of the Chairman of the provincial council (Form No. 4);

b) The list of proposals for awarding the titles "People's Artist", "Outstanding Artist" (Form No. 7) along with individual files as stipulated in Clause 1 of this Article;

c) Minutes of meetings of the provincial council (Form No. 8); Voting slips of council members (Forms No. 5 and No. 6); Minutes of meetings to seek opinions of the local community or professional associations (Form No. 3);

d) Summary of individual achievements according to the list submitted under Point b, Clause 2 of this Article (Form No. 9);

đ) Decision establishing the Provincial Council.

3. The file of the specialized council at the ministry level sent to the National Council includes:

a) The report of the Chairman of the specialized council at the ministry level (Form No. 4);

b) The list of proposals for awarding the titles "People's Artist", "Outstanding Artist" (Form No. 7) along with individual files as stipulated in Clause 1 of this Article;

c) Minutes of meetings of the specialized council at the ministry level (Form No. 8); Voting slips of council members (Forms No. 5 and No. 6);

d) Summary of individual achievements according to the list submitted under Point b, Clause 3 of this Article (Form No. 9);

đ) Decision establishing the Ministry-level Professional Council.

4. The documents of the National Council submitted to the Prime Minister include:

a) The report of the Chairman of the National Council (Form No. 4);

b) The list of proposals for awarding the titles "People's Artist", "Outstanding Artist" (Form No. 7) along with individual files as stipulated in Clause 1 of this Article;

c) Minutes of meetings of the National Council (Form No. 8); Voting slips of council members (Forms No. 5 and No. 6);

d) Summary of individual achievements according to the list submitted under Point b, Clause 4 of this Article (Form No. 9);

đ) Decision on establishing the National Council.

Article 12. Submission and Acceptance of Application Files

1. Individuals proposing to be awarded may themselves or authorize (in writing) another individual or organization to prepare the application file and submit directly or through postal service six (6) sets of files to the Department of Culture, Sports and Tourism where the individual resides.

2. The application file includes the documents and materials specified in Clause 1, Article 11 of this Decree and must be submitted to the receiving agency as stipulated in Clause 1 of this Article within the time limit prescribed for awarding the titles "People's Artist", "Outstanding Artist". 3. The agency receiving the application file for awarding the titles "People's Artist", "Outstanding Artist" shall be responsible for checking the validity and completeness of the documents and materials in the file according to regulations and reply in writing within ten working days from the date of receipt of the file. In case additional or corrected materials are required in the file, the receiving agency will guide the individual to complete the file or the authorized individual or organization to complete and resubmit the file no later than twenty working days from the date of receipt of the supplementary and corrective guidance document.

Article 13. Procedures and formalities for awarding at the provincial council

1. The permanent office of the provincial council has the responsibility to assist the council in performing the following tasks:

the provincial people's council; draft guiding documents on pricing and valuation laws applicable within the province in accordance with the law; stipulate procedures and processes for valuing pricing plans and determining prices for goods and services within the provincial people's council's decision-making authority; of the National Assembly; The provincial People's Committee decides on the establishment of the provincial council for conferring the titles "People's Artist" and "Artist of Merit";

b) Organize to seek opinions of the local community (village, ward, town) where the individual proposing to be awarded resides or the professional association where the individual proposing to be awarded operates to include in the application file (Form No. 3);

c) Announce the list of individuals proposing to be awarded on the mass media of the province, centrally governed city; post the list and achievement forms of individuals proposing to be awarded on the online portal of the Provincial People's Committee for public opinion collection during fifteen working days;

d) Send the application dossier and related documents to the members of the provincial council and organize a meeting of the council to select candidates;

2. The provincial council shall organize the examination of application files and proceed with selection as follows:

a) Review the composition and accuracy, validity of the documents in the file; the compliance of individuals with the standards for each title as stipulated in Articles 5 and 6 of this Decree; Industry and the application dossier; the individual's compliance with the criteria for each title as stipulated in Article 5 and Article 6 of this Decree;

b) Receive and process complaints from organizations and individuals (if any) and conduct secret voting to select individuals meeting the criteria for awarding the titles "People's Artist", "Outstanding Artist" to be reported to the specialized council at the ministry level;

c) Publicly announce the results of selection on the online portal of the Provincial People's Committee and the mass media of the province, centrally governed city; of the National Assembly; during fifteen working days; Industry and within fifteen working days;

d) Send a report on the results of selection by the Chairman of the provincial council together with five (5) sets of files as stipulated in Clause 2, Article 11 of this Decree to the specialized council at the ministry level within the time limit prescribed for awarding the titles "People's Artist", "Outstanding Artist"; Plan for conferring the titles "People's Artist" and "Artist of Merit";

đ) Notify the selection results in writing to the individual who has submitted the application dossier;

Article 14. Procedures and formalities for awarding at the Ministry-level specialized council

1. The permanent office of the specialized council at the ministry level has the responsibility to coordinate with the Heritage Management Department, Ministry of Culture, Sports and Tourism to assist the Council in performing the following tasks: a written notice The Ministry of Culture, Sports and Tourism assists the Council in performing the following tasks:

a) Propose the Minister of Culture, Sports and Tourism to decide on establishing the specialized council at the ministry level;

b) Receive and check the validity and completeness of the documents and materials in the file sent by the provincial council; in case additional or corrected materials are needed in the file, guide the provincial council to complete and resubmit the file no later than fifteen working days from the date of receipt of the guidance document, a written notice guidelines MANAGEMENT AND USE OF DEPOSITS AT THE ENVIRONMENT PROTECTION FUND, editing;

c) Post the list of individuals proposed for awarding by the provincial council on the online portal of the Ministry of Culture, Sports and Tourism for public opinion collection during fifteen working days;

d) Send the application dossier and related documents to the members of the Ministry-level specialized council and organize a meeting of the council to select candidates;

2. The Ministry-level specialized council organizes the review of the dossiers and conducts the selection as follows:

a) Review the composition and accuracy, validity of the documents in the file; the compliance of individuals with the standards for each title as stipulated in Articles 5 and 6 of this Decree;

b) Receive and process complaints from organizations and individuals (if any) and conduct a secret ballot to select individuals who meet the criteria for conferring the titles of "People's Artist" and "Outstanding Artist" to be submitted to the State Council;

c) Publish the results of the selection on the Ministry of Culture, Sports and Tourism’s electronic portal for a period of 15 working days;

d) Send a written notice the report on the selection results by the Chairman of the specialized council at the ministry together with four sets of files as stipulated in Clause 3, Article 11 of this Decree to the State Council within the time specified in the plan for conferring the titles of "People's Artist" and "Outstanding Artist";

đ) Notify the selection results in writing to the provincial council that has submitted the dossier.

Article 15. Procedures for awarding at the State Council

1. The permanent office of the State Council shall have the duty to assist the Council in performing the following tasks:

a) Submitting to the Prime Minister for decision on establishing the State Council;

b) Receive and verify the validity and completeness of the documents and materials in the file sent by the specialized council at the ministry; in cases where additional or amended materials are required, provide guidance to the specialized council at the ministry to complete and resubmit the file within no more than 10 working days from the date of receipt of the supplementary and amendment guidance document;

c) Publish the list of individuals proposed for awarding by the specialized council at the ministry on the Government’s electronic portal and mass media under the Ministry of Culture, Sports and Tourism for public opinion collection for a period of 15 working days;

d) Sending the award proposal documents and dossier to members of the Council and organizing a meeting of the Council to select candidates;

2. The State Council shall organize the examination of dossiers and selection as follows:

a) Review the composition and accuracy, validity of the documents in the file; the compliance of individuals with the standards for each title as stipulated in Articles 5 and 6 of this Decree;

b) Receive and process complaints from organizations and individuals (if any) and conduct a secret ballot to select individuals who meet the criteria for conferring the titles of "People's Artist", "Outstanding Artist";

c) Publish the results of the selection on the Government’s electronic portal and mass media under the Ministry of Culture, Sports and Tourism for a period of 15 working days;

d) Complete the dossier, submit it to the Prime Minister for consideration, and present it to the President for decision to confer the titles of "People's Artist" and "Outstanding Artist";

e) Send a written notice the report on the selection results by the Chairman of the State Council together with three sets of files as stipulated in Clause 4, Article 11 of this Decree to the Central Board of Awards and Honors within the time specified in Plan for conferring the titles "People's Artist" and "Artist of Merit";

f) Announce a written notice the results of the selection to the specialized council at the ministry.

Article 16. Announcement of the Decision to Confer and Present the Titles of "People's Artist" and "Outstanding Artist" by the State President

AND Culture, The Ministry of Culture, Sports and Tourism shall organize the ceremony to announce the Decision to Confer and Present the Titles of "People's Artist" and "Outstanding Artist" by the State President.

Chapter V

IMPLEMENTING PROVISIONS

Article 17. Effective Date

This Decree takes effect from August 7, 2014.

Article 18. Responsibility for Implementation

1. The Ministry of Culture, Sports and Tourism promulgates Plan for conferring the titles "People's Artist" and "Artist of Merit".

2. The Ministry of Labor, Invalids and Social Affairs shall submit to the Government for the establishment of a monthly living allowance system for People's Artists and Outstanding Artists with low income and difficult circumstances.

3. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairmen of the National Assembly; provincial and centrally governed city people's committees, relevant organizations and individuals are responsible for implementing this Decree./.
