Amending and supplementing some articles of Decree No. 07/2014/NĐ-CP January 27, 2014, stipulating the organization, tasks, powers and coordination relations of the Counter-Terrorism Steering Committee at all levels

Pursuant to the Law on Organization of Local Administration dated June 19, 2015;

Pursuant to the Law Amending and Supplementing Several Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Law on Prevention and Combating Terrorism dated June 12, 2013;

The Government promulgates this Decree on regulations regarding entry, exit, and residence policies for foreigners at the International Financial Center in Vietnam.

THE GOVERNMENT ISSUES THE DECREE AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF DECREE NO. 07/2014/NĐ-CP January 27, 2014, stipulating the organization, tasks, powers and coordination relations of the Counter-Terrorism Steering Committee at all levels.

Article 1. Amending and supplementing certain provisions of the Governmental Decree No. 07/2014/NĐ-CP January 27, 2014, issued by the Government stipulating the organization, tasks, powers and coordination relations of the Counter-Terrorism Steering Committee at all levels

1. Article 5 shall be amended and supplemented as follows:

"Article 5. The Counter-Terrorism Steering Committee of the province and centrally governed city

1. The Counter-Terrorism Steering Committee of the province and centrally governed city is the advisory body assisting the People's Committee, Chairman of the People's Committee of the province and centrally governed city in organizing and directing counter-terrorism activities in the province and centrally governed city.

The provincial police force is the permanent office of the Counter-Terrorism Steering Committee of the province and centrally governed city; it has a unit for advisory and support services called the Permanent Office of the Counter-Terrorism Steering Committee of the province and centrally governed city.

2. The members of the Counter-Terrorism Steering Committee of the province and centrally governed city include:

a) The Chairman of the Provincial People's Committee, the Chairperson;

b) The Director of the Provincial Police Force, the Vice-Chairperson in charge of permanent duties;

c) The Commander of the Hanoi Capital Military Command (for the Counter-Terrorism Steering Committee of Hanoi City), the Commander of the Ho Chi Minh City Military Command (for the Counter-Terrorism Steering Committee of Ho Chi Minh City), the Commander of the Provincial Military Command (for other Counter-Terrorism Steering Committees of provinces and centrally governed cities), the Vice-Chairperson;

d) The Deputy Director of the Provincial Police Force responsible for security, a standing member;

đ) The Commander of the Border Guard Command (if applicable), a member;

e) The Director of the Department of Foreign Affairs (if applicable), a member;

g) The Director of the Department of Transport, a member;

h) The Director of the Department of Information and Communications, a member;

i) The Director of the Department of Health, a member;

k) The Director of the Department of Finance, a member;

l) The Director of the Department of Industry and Trade, a member;

m) The Director of the Department of Agriculture and Rural Development, a member;

n) The Director of the Department of Science and Technology, a member;

o) The Governor of the State Bank of Vietnam Branch in the province and centrally governed city, a member;

p) The Head of the Civil Aviation Port Authority (if applicable), a member;

q) The Director of the Civil Aviation Airport (if applicable), a member;

r) The Controller of the Air Traffic Control Station (if applicable), a member;

s) The Chairman of the District People's Committee where there is an airport or civil aviation facilities and equipment, a member;

t) Other members as proposed by the Chairperson of the Steering Committee."

2. Article 9 shall be amended and supplemented as follows:

"Article 9. Tasks and Powers of the Counter-Terrorism Steering Committee of Ministries and Sectors

1. Implement the tasks and powers prescribed in Clause 3, Article 13 of the Law on Counter-Terrorism.

2. Coordinate with the Counter-Terrorism Steering Committee of the Ministry of Public Security, the Ministry of National Defense, and the Counter-Terrorism Steering Committee of the province and centrally governed city to advise and assist the Minister and the head of the equivalent agency in organizing and directing counter-terrorism activities.

2a. Advise and assist the Minister and the head of the equivalent agency in organizing and directing activities to prevent the proliferation of weapons of mass destruction in accordance with Decree No. 81/2019/NĐ-CP dated November 11, 2019 of the Government on preventing the proliferation of weapons of mass destruction.

3. Perform other tasks and powers as prescribed by law and assigned by the Minister and the head of the equivalent agency."

3. Article 10 shall be amended and supplemented as follows:

"Article 10. Tasks and Powers of the Counter-Terrorism Steering Committee of the Province and Centrally Governed City

1. Implement the tasks and powers prescribed in Clause 2, Article 13 of the Law on Counter-Terrorism.

2. Advise the People's Committee and the Chairman of the People's Committee of the province and centrally governed city to direct the handling of terrorist incidents occurring locally, except those incidents that fall under the advisory direction handling responsibility of the National Counter-Terrorism Steering Committee, the Counter-Terrorism Steering Committee of the Ministry of Public Security, and the Ministry of National Defense.

2a. Advise and assist the People's Committee and the Chairman of the People's Committee of the province and centrally governed city in organizing and directing activities to prevent the proliferation of weapons of mass destruction in accordance with Decree No. 81/2019/NĐ-CP dated November 11, 2019 of the Government on preventing the proliferation of weapons of mass destruction.

2b. Assist the People's Committee and the Chairman of the People's Committee of the province and centrally governed city in performing the task of commanding and responding to illegal interference in civil aviation operations at places with airports and civil aviation facilities and equipment in accordance with Decree No. 92/2015/NĐ-CP dated October 13, 2015 of the Government on civil aviation security.

3. Perform other tasks and powers assigned by the People's Committee and the Chairman of the People's Committee of the province and centrally governed city."

4. Clause 1a following Clause 1 of Article 11 shall be supplemented as follows:

"1a. Members of the Counter-Terrorism Steering Committee at all levels work on a part-time basis, perform their tasks and powers according to the Rules of Operation of the Steering Committee, and use the seal of their place of work. In case the Chairperson of the Steering Committee is absent or delegates authority, the Vice-Chairperson performs the tasks and powers of the Chairperson and bears legal responsibility for their decisions."

Article 2. Implementation clause

1. This Decree takes effect from October 5, 2023.

2. The Minister of Public Security is responsible for chairing and coordinating with relevant ministries and sectors to guide, inspect, and urge the implementation of this Decree.

3. The Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees under central cities are responsible for implementing this Decree./.
