Regarding the export of wood products and forest products

PRIME MINISTER

 

Pursuant to the Government Organization Law dated September 30, 1992;

Pursuant to Article 25 of the Forest Protection and Development Law dated August 19, 1991;

Considering the proposal of the Joint Ministries of Forestry, Trade, Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).Planning, and the General Department of Customs in the report No. 2587-LS/CN dated November 16, 1993,

 

DECISION:

Article 1.

1. To promulgate the list of wood products and forest products permitted for export attached to this Decision. To abolish Circular No. 09-TT/LB dated May 18, 1992 of the Joint Ministries of Forestry, Trade, Tourism, and the State Planning Committee concerning the list of wood products for export.

2. Wood products (including natural forest wood and planted forest wood) and forest products permitted for export are those finished products refined according to mandatory technology, with names, wood groups, sizes, and shapes specified in the list attached to this Decision.

3. Export contracts must accurately record the product name, quantity, unit of measurement, type of wood, size, quality, unit price; and must be accompanied by technical drawings (or samples). For complex-shaped products, color photographs may be used to illustrate. Export contracts and accompanying drawings must be original copies bearing the signature and seal of the seller, and the buyer's signature with seal (if applicable).

4. For wood and forest products exported outside the list attached to this Decision but deemed to have low raw material consumption and high economic export efficiency, the following measures shall apply:

If the product has the same name but changes in shape and size (not exceeding the maximum size specified in the list), and does not belong to rare wood groups as defined in Decree No. 18-HĐBT dated January 17, 1992 of the Council of Ministers (now the Government), then the Minister of Forestry shall consult the Ministry of Trade and the General Department of Customs to decide.

If it is a new product, large quantities, or uses rare wood group IIA as defined in Decree No. 18-HĐBT dated January 17, 1992 of the Council of Ministers (now the Government), the Minister of Forestry together with the Ministry of Trade and the General Department of Customs shall examine and submit to the Prime Minister for decision.

Article 2.

1. To implement quota management for wood allocated for processing and export. The Ministry of Forestry will coordinate with the State Planning Committee to establish and submit to the Government for approval the annual total quota of processed wood for export. Based on the approved total quota of wood, the Ministry of Forestry will directly allocate quotas to businesses engaged in trading and producing wood products that have been granted direct import/export licenses by the Ministry of Trade. The Ministry of Trade will issue export permits for wood and forest products to these enterprises based on the allocated quotas, in accordance with the provisions of this Decision. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).2. The Ministry of Forestry will work with the Ministry of Trade to determine the specific list of businesses authorized to directly export forest products. These businesses must meet the following conditions:

Have a decision and registration to re-establish the enterprise according to Decision No. 388-HĐBT dated November 20, 1991 of the Council of Ministers (now the Government).

Have been granted a permit for wood and forest product processing by the competent authority according to Decision No. 14-CT dated January 15, 1992 of the Council of Ministers (now the Government).

Have invested in building physical facilities and technical infrastructure, and have skilled workers sufficient to process export products according to prescribed technology.

3. The Government Price Board will cooperate with the Ministry of Finance, the Ministry of Trade, and the Ministry of Forestry to establish a minimum foreign currency price list for each unit of exported wood products consistent with domestic and international market prices. The Ministry of Finance will cooperate with the Ministry of Trade and the Ministry of Forestry to establish export tax rates for permitted export items in line with state policies on exploitation, processing, and export of wood products.

Joint ventures in wood and forest product processing with foreign investment capital that have been granted investment and processing permits before Directive No. 462-TTg dated September 11, 1993 of the Prime Minister can continue exporting wood and forest products, but must adjust their export product structure in accordance with the list of products attached to this Decision.

Article 3. To promptly detect and prevent improper actions by organizations and individuals during the implementation of this Decision, the Prime Minister assigns responsibilities to relevant ministries, sectors, and provincial People's Committees as follows:

Article 4. The Ministry of Forestry will regularly coordinate with relevant functional agencies to inspect the implementation of regulations on the allocation and use of wood processing quotas and production technology for exported wood and forest products as stipulated in this Decision.

The Ministry of Trade will ensure the issuance of export permits for wood and forest products to enterprises in accordance with the provisions of this Decision.

The General Department of Customs will be responsible for strictly inspecting exported wood and forest products in accordance with the regulations in the list attached to this Decision and completing customs procedures according to assigned functions and tasks.

When necessary, upon request from the Ministry of Forestry and the Ministry of Trade, the General Department of Customs will re-inspect consignments that have already been packed.

The Central Market Management Steering Committee will be responsible for regularly coordinating to monitor wood and forest product import and export activities nationwide to ensure strict compliance with the provisions of this Decision.

Provincial People's Committees under the central government will be responsible for organizing the implementation of this Decision in conjunction with the implementation of Directive No. 462-TTg dated September 11, 1993 at the local level, and regularly organizing inter-sector inspection teams (including forestry, trade, market management, customs, internal affairs, etc.) to promptly detect, prevent, and handle improper actions during the implementation of this Decision.

Ministers of Ministries, Heads of State Committees, Heads of government agencies, and Chairmen of provincial People's Committees under the central government are responsible for enforcing this Decision.

Article 5. This Decision takes effect from the date of signature.
