Regulations on the functions, tasks, powers, and organization of the Department of Youth Affairs

THE MINISTER OF THE MINISTRY OF HOME AFFAIRS

Pursuant to Decree No. 36/2012/NĐ-CP dated April 18, 2012, of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 61/2012/NĐ-CP dated August 10, 2012, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

Considering the proposal of the Director of the Department of Youth Affairs and the Director of the Department of Civil Service Personnel

DECISION:

Article 1. Position and Functions

The Department of Youth Affairs is an organizational unit under the Ministry of Home Affairs, with the function of advising and assisting the Minister to implement state management over youth affairs.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. Assist the Minister in drafting and promulgating, within its authority, or submitting for approval by competent authorities, legal normative documents, programs, projects, and plans concerning youth, including:

a) Laws, Resolutions, Decrees, Decisions, Directives on youth and youth work;

b) Circulars and joint circulars guiding and implementing legal normative documents on youth and youth work;

c) Strategies for the development of Vietnamese youth in accordance with stages of national development;

d) Formulating policies and laws for youth;

đ) Projects and plans related to youth;

e) Programs, materials, and organizing training sessions on specialized knowledge and skills for cadres and civil servants responsible for state management over youth;

g) Summarizing and concluding the implementation of legal provisions, strategies, and national target programs on youth and youth work.

2. Serve as the focal point to assist the Minister in performing the following tasks:

a) Implementing programs, plans, projects, and plans related to youth and youth work according to the division of responsibilities by competent authorities;

b) Leading or coordinating with Ministries, ministerial-level agencies, government agencies, provincial People's Committees, and centrally-administered city People's Committees to implement legal normative documents on youth and youth work; integrating mechanisms and policies for youth and youth work when formulating and implementing strategies, programs, and plans for economic and social development within the scope of management of ministries, sectors, and localities;

c) Leading or coordinating with relevant agencies and organizations in resolving inter-sectoral issues concerning youth and youth work;

d) Leading or coordinating with the Communist Youth Union Central Committee Ho Chi Minh, the National Council for Youth Affairs, and political-social organizations in performing state management tasks over youth;

đ) Guiding, inspecting, and urging activities of state management over youth within the administrative system;

3. Leading or coordinating with agencies and organizations under the Ministry to carry out state diplomatic activities on youth; organizing international conferences and seminars related to youth and youth work according to the Minister's assignment.

4. Leading or preparing documents to respond to matters concerning youth and youth work according to assigned functions and tasks and the Minister's assignment; coordinating with agencies and organizations under the Ministry in examining the establishment of youth associations.

5. Coordinating with the Ministry's Inspectorate to conduct inspections, examinations, handle complaints and denunciations, and deal with violations in the implementation of youth policies and laws by ministries, sectors, and localities.

6. Leading or participating in scientific research, scientific topics, and special scientific studies on youth and youth work according to assigned functions and tasks and the Minister's assignment.

7. Compiling and reporting periodic statistical data from ministries, sectors, and localities on organizational and management work for youth and youth work; leading the summarization and conclusion of the implementation of youth policies and laws nationwide.

8. Examining and submitting for approval by competent authorities to consider rewarding outstanding collectives and individuals in state management over youth by ministries, sectors, and localities.

9. Performing other tasks assigned by the Minister.

Article 3. Organization and Working System

1. The Department shall have a Director, Deputy Directors, and civil servants.

2. The Director shall be responsible to the Minister for organizing and implementing the tasks specified in Article 2 and shall have the following specific duties and powers:

a) Organizing and directing the implementation of the Department's tasks and being accountable to the Minister for all aspects of the Department's work;

b) Assigning tasks, supervising, urging, and inspecting the implementation of tasks by Deputy Directors and civil servants within the Department;

c) Signing on behalf of the Minister to respond, provide guidance, and request information from relevant agencies, organizations, units, or individuals according to the Department's functions and tasks;

d) Cooperating with agencies and organizations under the Ministry and related agencies in resolving issues within the Department's functions, tasks, and powers;

đ) Implementing the information system for civil servants in the Department according to the Ministry's working regulations;

e) Deciding on the contents of reports, reviews, summaries, and recommendations to the Minister regarding policies and solutions in organizing the implementation of the Department's tasks;

g) Implementing the Ministry's working regulations; managing civil servants and assets according to the Ministry's classification.

3. Deputy Directors shall perform specialized tasks and assist the Director in overseeing one or more areas of work as assigned by the Director; they shall be accountable to the Director for the assigned tasks.

The Director shall assign a Deputy Director to oversee the Department's operations during the Director's absence.

4. Civil servants in the Department shall perform specialized tasks and be accountable to the Director for the assigned tasks.

5. The Department shall operate under a specialist system combined with a chief executive system; when Ministry leadership works directly with Deputy Directors or specialists, Deputy Directors and specialists shall be responsible for implementing the leadership's opinions and promptly reporting back to the Director.

Article 4. Effectiveness and Responsibility for Implementation

1. This Decision takes effect from the date of issuance.

Abolish Decision No. 1386/QD-BNV dated December 1, 2010, issued by the Minister of Home Affairs, stipulating the functions, tasks, powers, and organization of the Youth Work Department.

2. The Head of the Ministry's Office, the Director of the Cadre and Civil Servant Organization Department, the Director of the Youth Work Department, the Heads and civil servants of related agencies and organizations under the Ministry shall be responsible for enforcing this decision./.
