THE MINISTER OF THE MINISTRY OF HOME AFFAIRS

Pursuant to Decree No. 36/2012/NĐ-CP dated April 18, 2012, of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 61/2012/NĐ-CP dated August 10, 2012, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

At the proposal of the Director of the Cadre and Civil Servant Organization Department and the Director of the Administrative Reform Department,The Administrative Reform Department is an organizational unit under the Ministry of Home Affairs, with the function of advising and assisting the Minister in state management of administrative reform work and performing the standing tasks of administrative reform for the Government.

DECISION:

Article 1. Position and Functions

1. To assist the Minister in implementing the following tasks:

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

a. Drafting normative legal documents on the field of administrative reform according to the division of labor assigned by the Government and the Prime Minister, and submitting them to the competent authority for promulgation.

b. Drafting programs, plans, and general projects on state administrative reform in each phase, and submitting them to the Government according to the division of labor assigned by the Government.

c. Studying and proposing policies and solutions to promote state administrative reform, and submitting them to the Government and the Prime Minister for decision.

d. Reviewing pilot projects on administrative reform developed by Ministries, ministerial-level agencies, government agencies, and provincial and municipal People's Committees directly under the Central Government, and submitting them to the Prime Minister.

đ. Directing, guiding, inspecting the implementation of normative legal documents, projects, programs, and plans on administrative reform issued by the Government.

e. Preparing quarterly, semi-annual, and annual reports on administrative reform for submission to the Government meetings.

g. Summarizing, reviewing, and concluding the implementation of administrative reform tasks by Ministries, ministerial-level agencies, government agencies, and provincial and municipal People's Committees directly under the Central Government.

h. Guiding, monitoring, urging, and inspecting Ministries, ministerial-level agencies, government agencies, and provincial and municipal People's Committees directly under the Central Government in developing and implementing administrative reform plans.

2. To guide and take the lead in implementing the annual Administrative Reform Index for Ministries, ministerial-level agencies, and provincial and municipal People's Committees directly under the Central Government.

3. To guide and take the lead in implementing the process of determining the Satisfaction Index of citizens and organizations with public administration services.

4. To monitor the implementation of the single-window mechanism and the interlinked single-window mechanism at local public administration agencies.

5. To provide professional guidance in the field of administrative reform for specialized civil servants responsible for administrative reform work in Ministries, ministerial-level agencies, government agencies, and provincial and municipal People's Committees directly under the Central Government.

6. To coordinate with relevant agencies and organizations to disseminate information about administrative reform.

7. To coordinate with units within the Ministry in drafting, providing comments on projects, normative legal documents, and resolving issues related to the functions and tasks of the Department.

8. To take the lead or coordinate in resolving recommendations and complaints related to administrative reform work according to the directives of the Minister.

9. To coordinate with relevant units to organize the implementation of research and surveys domestically and internationally on administrative reform.

10. To implement statistical and summarizing work on administrative reform and to coordinate with the Application Information Technology Center to manage, exploit, and utilize information technology to serve leadership and management of the Ministry regarding administrative reform work.

11. To take the lead or participate in researching scientific topics in the field of administrative reform.

12. To coordinate with units within the Ministry to implement reform contents related to the functions and tasks of the Ministry.

13. To perform other tasks assigned by the Minister.

Article 3. Organization and working regime of the Department

1. The Department consists of a Director, Deputy Directors, and civil servants.

2. The Director is responsible to the Minister for organizing and implementing the tasks specified in Article 2 and the specific duties and powers as follows:

- Organizing and directing the implementation of the Department's tasks and being accountable to the Minister for all aspects of the Department's work;

- Assigning tasks, supervising, urging, and inspecting the implementation of tasks by Deputy Directors and civil servants within the Department;

- Signing on behalf of the Minister to respond, provide guidance, and request information from organizations with functions and responsibilities for managing administrative reform in state administrative agencies or individuals regarding issues related to administrative reform;

- Coordinating with organizations within the Ministry and relevant agencies in resolving issues related to the Department's functions, duties, and powers;

- Implementing information work for civil servants in the Department according to the Ministry's Working Regulations;

- Deciding on the contents of reports, summaries, conclusions, and recommendations to the Minister on policies and solutions in implementing the Department's tasks;

- Implementing the Ministry's regulations, managing civil servants and assets assigned according to the Ministry's classification;

3. Deputy Directors perform specialized tasks and assist the Director in overseeing one or more aspects of work as assigned by the Director; they are accountable to the Director for the tasks assigned to them.

4. Civil servants carry out specialized tasks assigned by the Director and are accountable to the Director for performing those tasks.

5. The Department operates under a specialist system combined with a chief executive system; in cases where the Ministry leadership works directly with Deputy Directors or specialists, Deputy Directors and specialists are responsible for implementing the leadership's opinions and promptly reporting back to the Director thereafter.

Article 4. Effectiveness and Responsibility for Implementation

1. This Decision takes effect fifteen days from the date of signing.

2. The Head of the Ministry's Office, the Director of the Department of Organization and Cadres, the Director of the Department of Administrative Reform, heads of units and civil servants related to the Ministry are responsible for implementing this Decision./.
