THE MINISTER OF HEALTH

Pursuant to Decree No. 68/CP dated October 11, 1993 of the Government stipulating tasks, powers, and organizational structure of the Ministry of Health;

Pursuant to Decree No. 58/1998/NĐ-CP dated August 13, 1998 of the Government promulgating the Health Insurance Charter;

Pursuant to Circular No. 25/TCCP-TCBC dated January 21, 1999 of the Minister, Head of the Organizational and Cadre Affairs Council of the Government regarding agreement on issuing the "Regulation on Organization and Operation of the Vietnam Health Insurance";

At the proposal of the Director of the Department of Organization and Cadres of the Ministry of Health,

DECISION:

Article 1: Issued together with this Decision is the "Regulation on Organization and Operation of the Vietnam Health Insurance".

Article 2: This Decision takes effect from January 1, 1999.

Article 3: The following officials are responsible for implementing this Decision: Chief of the Office, Directors of the Departments: Department of Organization and Cadres, Legal Department, Treatment Department, Finance and Accounting Department, Planning Department of the Ministry of Health, General Director of the Vietnam Health Insurance.

Organization and operation of the Vietnam Health Insurance

Chapter 1:

GENERAL PROVISIONS

Article 1. The Vietnam Health Insurance was established pursuant to Decree No. 58/1998/NĐ-CP dated August 13, 1998 of the Government to manage and implement health insurance policies as prescribed by the State.

Article 2. The Vietnam Health Insurance is under the Ministry of Health, has legal personality, its own bank account and seal, operates independently from the state budget and is protected by the State, with its headquarters located in Hanoi City.

Article 3. The Vietnam Health Insurance is organized and managed according to a centralized and unified system from central to local levels.

Article 4Regular operating funds of the Vietnam Health Insurance are allocated from health insurance revenue as stipulated in the Health Insurance Charter and guiding documents issued by competent state agencies.

Chapter 2:

TASKS AND POWERS OF THE VIETNAM HEALTH INSURANCE

Article 5. The Vietnam Health Insurance shall perform the following tasks and powers:

1. Implementing the Health Insurance Charter issued pursuant to Decree No. 58/1998/NĐ-CP dated August 13, 1998 of the Government throughout the country;

2. Managing health insurance fund revenues and expenditures nationwide; proposing measures to preserve and increase the health insurance fund and organizing their implementation upon approval; printing, issuing, and managing health insurance cards;

3. Managing organizations, cadres, staff, and technical facilities within the entire health insurance system as prescribed by the State;

4. Organizing training, retraining, and professional development for cadres; researching and applying scientific and technological advancements in the field of health insurance; implementing international cooperation in the field of health insurance under the authority of the Minister of Health;

5. Examining and resolving complaints and denunciations of health insurance participants within its jurisdiction;

6. Organizing information dissemination, propaganda, and explanation of health insurance systems and policies.

Chapter 3:

THE GENERAL DIRECTOR AND ASSISTANT ORGANIZATION

Article 6. The Vietnam Health Insurance is managed and directed by the General Director under the head-of-department system. Deputy General Directors assist the General Director.

The General Director of the Vietnam Health Insurance is appointed and relieved of duty by the Minister of Health at the recommendation of the Management Board of the Vietnam Health Insurance and the agreement of the Minister, Head of the Organizational and Cadre Affairs Council of the Government. Deputy General Directors of the Vietnam Health Insurance are appointed and relieved of duty by the Minister of Health at the recommendation of the General Director of the Vietnam Health Insurance;

The organizational structure assisting the General Director of the Vietnam Health Insurance includes:

1. Office

2. Business Development Division

3. Audit Division

4. Planning and Finance Division

5. Organization and Cadre Division

6. Internal Audit Division

7. International Cooperation Division

8. Information and Propaganda Division

9. Computer Center

10. Training Center

11. Representative Office of the Vietnam Health Insurance in Ho Chi Minh City

The General Director of the Vietnam Health Insurance specifies the functions, tasks, powers, and working relationships of the above organizations.

Article 7. Tasks and powers of the General Director of the Vietnam Health Insurance:

1. Utilizing resources effectively to develop the health insurance industry;

2. Developing strategic plans and operational plans, submitting them to the Management Board of the Vietnam Health Insurance and organizing their implementation after approval;

3. Formulating and submitting proposals on labor, salary, and special health insurance policies to relevant state management agencies that comply with state regulations;

4. Appointing, relieving, and specifying the functions, tasks, and powers of positions such as Office Director, Deputy Office Director, Division Director, Deputy Division Director, Center Director, and Deputy Center Director within the Vietnam Health Insurance organization, subject to the approval of the Minister of Health;

5. Appointing, relieving, and transferring Provincial Health Insurance Directors, Municipal Health Insurance Directors, and Industry Health Insurance Directors after obtaining opinions from the People's Committees of provinces and centrally-administered municipalities, industry leaders, and the approval of the Minister of Health. In case of differing opinions, the General Director of the Vietnam Health Insurance appoints and relieves based on the directive of the Minister of Health;

Appointing, relieving, and transferring Deputy Directors, Chief Accountants, Heads of Departments, and equivalent positions in Provincial Health Insurance, Municipal Health Insurance, and Industry Health Insurance;

6. Establishing and specifying the functions, tasks, powers, and working relationships of District Health Insurance Branches, County Health Insurance Branches, City Health Insurance Branches under provinces (collectively referred to as county-level Health Insurance Branches), and functional divisions of Provincial Health Insurance, Municipal Health Insurance, and Industry Health Insurance;

7. Formulating standards for cadre positions in the Vietnam Health Insurance system and submitting them to the Minister of Health for approval;

8. Determining staffing levels and allocating labor quotas in the Vietnam Health Insurance system based on work tasks, salary funds, and development needs of the Vietnam Health Insurance;

9. Recruiting, transferring cadres and staff, and issuing and directing the implementation of recruitment procedures for cadres, staff, and workers in the Vietnam Health Insurance system;

10. Deciding on annual salary increases for cadres, staff, and equivalent workers from assistant level downwards in accordance with current regulations.

Chapter 4:

PROVINCIAL AND MUNICIPAL HEALTH INSURANCE UNDER THE CENTRAL GOVERNMENT AND INDUSTRY HEALTH INSURANCE

Article 8Health Insurance of provinces, centrally governed cities, and Health Insurance of sectors are units under the Vietnam Health Insurance, having legal personality, with their own offices, bank accounts, and seals. (see attached list).

Article 9. Health Insurance of provinces, centrally governed cities, and Health Insurance of sectors are managed and directed by the Director under the head system. The Directors are assisted by Deputy Directors.

The structure and organizational apparatus assisting the Director of Health Insurance of provinces, centrally governed cities, and Health Insurance of sectors include:

Administrative and General Affairs Department

Exploitation Department

Inspection Department

Accounting Department

Specifically, Health Insurance of Hanoi City and Ho Chi Minh City establish an Organization and Cadre Department.

Article 10. Duties and powers of the Director of Health Insurance of provinces, centrally governed cities, and Health Insurance of sectors:

1. Organize and implement health insurance policies within the assigned management scope according to the directives and management of the General Director of Vietnam Health Insurance; develop voluntary health insurance proposals submitted to the General Director of Vietnam Health Insurance and implement them after approval.

2. Manage and utilize the health insurance fund, settle medical examination and treatment costs for insured persons in accordance with current state regulations to ensure the rights of those holding health insurance cards.

3. Develop proposals for establishing Health Insurance Branches at districts submitted to the General Director of Vietnam Health Insurance for decision.

4. Appoint and relieve from office the positions of Deputy Heads of Departments of Health Insurance of provinces, centrally governed cities, and Health Insurance of sectors, Heads and Deputy Heads of Health Insurance Branches at districts after obtaining the consent of the General Director of Vietnam Health Insurance.

5. Sign labor contracts with fixed terms for employees after obtaining the consent of the General Director of Vietnam Health Insurance.

6. Perform other tasks delegated by the General Director of Vietnam Health Insurance.

Article 11Health Insurance Branches at districts under Health Insurance of provinces, centrally governed cities have their own offices and seals for transactions. Specific duties and powers of Health Insurance Branches at districts are defined by the General Director of Vietnam Health Insurance./.
