DECISION OF THE PRIME MINISTER

Regarding the renaming and supplementing the tasks of the National Committee for Search and Rescue

 

PRIME MINISTER

Pursuant to the Government Organization Law dated September 30, 1992;

Pursuant to the Civil Aviation Law of Vietnam dated December 26, 1991; the Law Amending and Supplementing Certain Provisions of the Civil Aviation Law of Vietnam dated April 20, 1995; the Maritime Code of Vietnam dated June 30, 1990; Decree No. 40/CP dated July 5, 1996 on Ensuring Order and Safety in Inland Waterway Traffic;

Pursuant to the Ordinance on the Vietnam Coast Guard Force dated March 25, 1998;

Pursuant to the Water Resources Law dated May 20, 1998; the Ordinance on Flood and Storm Prevention and Control dated March 8, 1993;

To enhance the effectiveness of search and rescue operations,

 

DECISION:

Article 1. The name of the "National Committee for Air and Sea Search and Rescue" established pursuant to the Prime Minister's Decision No. 780/TTg dated October 23, 1996 shall be changed to "National Committee for Search and Rescue". Additional members and tasks will be added to the National Committee for Search and Rescue.

Article 2. The National Committee for Search and Rescue has the following duties and powers:

1. Direct and organize the implementation of search and rescue operations for persons and transportation means (aircraft, ships, inland waterway vessels, oil equipment) in distress within the airspace, territorial waters, and territories under the management of the Socialist Republic of Vietnam; persons and property of the people and the State in cases of natural disasters, catastrophes, floods, and storms; oil spill response;

2. Mobilize and coordinate various forces and types of equipment from ministries, sectors, localities, organizations, and individuals to promptly carry out search and rescue operations and bear responsibility for their decisions. Coordinate with countries in the region to conduct search and rescue operations;

3. Develop plans for search and rescue operations for persons and transportation means in various situations, ensuring promptness and effectiveness;

4. Direct investigations and verifications of major accidents assigned by the Prime Minister, and make recommendations to the Prime Minister and relevant state agencies on measures to prevent and minimize losses caused by accidents;

5. Guide, urge, and inspect ministries, sectors, and localities in implementing state regulations and the National Committee for Search and Rescue's provisions regarding search and rescue operations and handling aftermaths of accidents;

6. Annually, based on assigned tasks, the National Committee for Search and Rescue prepares a budget estimate to send to the Ministry of Finance and the Ministry of Planning and Investment for inclusion in the annual state budget for government approval;

7. Recommend timely rewards to organizations and individuals with outstanding achievements in search and rescue operations; propose measures to address organizations and individuals who have committed serious violations causing severe consequences during search and rescue operations;

8. Organize search and rescue drills annually, provide specialized training and instruction for search and rescue forces;

9. Cooperate with countries in the region and international organizations on search and rescue operations.

Article 3. The National Committee for Search and Rescue has a seal bearing the national emblem and maintains an account at the State Treasury. The permanent office of the National Committee for Search and Rescue is the Office of the National Committee for Search and Rescue (referred to as the Office of the Committee), located at the Ministry of National Defense.

The staffing of the Office of the Committee is included in the staffing of the Ministry of National Defense.

Article 4. Funding for search and rescue activities is provided by the state budget (from central and provincial budgets), including:

1. Funding for regular operational activities of the National Committee for Search and Rescue (including funding for the Office of the Committee), specialized search and rescue headquarters, and localities;

2. Funding for purchasing equipment, goods, materials for search and rescue operations and national reserves for search and rescue work;

3. Funding for emergency search and rescue operations for persons and transportation means.

The National Committee for Search and Rescue, in collaboration with the Ministry of Finance, the Ministry of Planning and Investment, and related agencies, shall develop a financial mechanism for search and rescue activities. For now, it will be implemented according to the Prime Minister's Decision on the Interim Financial Management Regulations for Search and Rescue Operations No. 215/1999/QĐ-TTg dated November 3, 1999.

Article 5. Members of the National Committee for Search and Rescue include:

1 Deputy Prime Minister, Chairman of the Committee;

1 Deputy Minister of National Defense, Vice-Chairman in charge;

1 Deputy Minister of Agriculture and Rural Development, Vice-Chairman;

1 Deputy Director of the Government Office, Vice-Chairman;

1 Deputy Minister of Transport, Vice-Chairman;

1 Deputy Minister of Fisheries, Vice-Chairman;

Director of the Civil Aviation Administration of Vietnam, Vice-Chairman;

Director of the Vietnam Maritime Administration, member;

Commander of the Air Force, member;

Commander of the Navy, member;

Commander of the Border Guard Forces, member;

Director of the Flood and Storm Prevention and Control Bureau, member;

Director of the Coast Guard Bureau, member;

Director of the Inland Waterways Bureau, member;

General Director of Vietnam Oil and Gas Corporation, member;

The Chairman and Vice-Chairman in charge of the National Committee for Search and Rescue are decided by the Prime Minister; heads of ministries and the Director of the Government Office decide on other Vice-Chairmen, report to the Prime Minister, and notify relevant agencies.

Members of the National Committee for Search and Rescue serve in兼任职务。

Article 6. The specialized permanent offices of the National Committee for Search and Rescue are the specialized search and rescue headquarters under relevant ministries and sectors. Currently, they include:

The Search and Rescue Command Board of the Ministry of National Defense and the Search and Rescue Command Boards of Military Regions, Corps, Services, Arms, and Border Guard Forces;

The Standing Committee for Civil Aviation Search and Rescue and Regional Coordination Centers;

The Vietnam Maritime Search and Rescue Coordination Center and Regional Coordination Centers;

The Flood and Storm Prevention and Control Command Board (Ministry of Fisheries);

The Flood and Storm Prevention and Control Bureau and Reservoir Management Bureau (Ministry of Agriculture and Rural Development);

The Maritime Environmental Protection and Rescue Office (Coast Guard Bureau);

The Flood and Storm Control Council (Vietnam Inland Waterways Administration);

The Emergency Oil and Gas Situation Steering Committee (Vietnam Oil and Gas Corporation);

The Provincial and Central City Flood and Storm Control and Search and Rescue Committees;

The aforementioned agencies are the permanent bodies responsible for specialized and local search and rescue operations in their respective fields, and serve as coordination points with other specialized and local entities;

Article 7. The Chairman of the National Search and Rescue Commission is responsible for promulgating the Regulations on:

1. The organization, staffing, and operation of the National Search and Rescue Commission, including the functions and responsibilities of the Commission's Office;

2. The working relationship between the Commission's Office and the agencies under the Ministry of National Defense, other search and rescue agencies under various ministries and sectors, and localities;

3. The principles for coordinating activities among specialized search and rescue agencies and with localities;

Article 8. This Decision shall take effect fifteen days from the date of signature and replace Decision No. 780/TTg dated October 23, 1996;

Article 9. The Minister, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairmen of People's Committees of provinces and centrally governed cities, and members of the National Search and Rescue Commission are responsible for implementing this Decision./.
