DECREE
Provisions on medical examination and treatment for officers' relatives while on active duty
THE GOVERNMENT
Pursuant to the Government Organization Law dated December 25, 2001
Pursuant to the Law on Officers of the Vietnam People's Army No. 10/1999/QH dated December 21, 1999;
Based on the proposal of the Minister of National Defense.
DECREE
Chapter 1:
GENERAL PROVISIONS
Article 1.
This Decree stipulates the provision of free or discounted medical examination and treatment under the health insurance scheme at military and civilian healthcare facilities for officers' relatives (hereinafter referred to as officers' relatives) who do not have health insurance coverage.
Article 2.
1. Officers' relatives while on active duty entitled to free or discounted medical examination and treatment under the health insurance scheme include: biological parents; biological parents of the officer’s spouse; foster parents or legally recognized guardians of the officer’s spouse; the officer’s spouse; biological or adopted children under 18 years old; children aged 18 or older but disabled and unable to work.
2. Officers' relatives not eligible for the medical examination and treatment provisions set forth in Clause 1, Article 1 of this Decree include: those with health insurance; children of officers aged 18 or older who are not disabled and unable to work.
Article 3. Healthcare facilities providing medical examination and treatment for officers' relatives while on active duty include: civilian and military healthcare facilities and other healthcare facilities that have signed contracts for medical examination and treatment with the health insurance agency under the Vietnam Social Security.
Article 4. Medical examination and treatment for officers' relatives while on active duty must be conducted accurately according to the target group, policy, and convenience.
Chapter 2:
MANAGEMENT AND REGISTRATION FOR MEDICAL EXAMINATION AND TREATMENT OF OFFICERS' RELATIVES WHILE ON ACTIVE DUTY
Article 5.
1. Officers eligible for health insurance benefits include those serving in the regular forces within the military or on temporary assignment.
2. If officers specified in Clause 1 of this Article cease active service for retirement, transfer, discharge, or if they lose their officer status or die, their relatives will no longer be entitled to health insurance benefits as stipulated in this Decree.
Article 6.
The management of officers and their relatives to implement the health insurance scheme is the responsibility of the unit directly managing the officers. Every six months, the unit managing the officers is responsible for registering and compiling lists of officers and their relatives, tracking changes, and adjusting health insurance cards for officers' relatives according to this Decree.
Article 7.
Officers are responsible for registering with the local unit where their relatives reside or receive medical examination and treatment. When a relative no longer meets the criteria for medical examination and treatment under this Decree, the officer must promptly report to the directly managing unit to stop issuing health insurance cards for such relatives according to this Decree.
Article 8.
The Health Insurance Agency of Vietnam bases its issuance of health insurance cards, registration of healthcare facilities, and distribution of health insurance cards for each person on the list of officers' relatives provided by the Ministry of National Defense, in accordance with the regulations set forth in this Decree.
Chapter 3:
RESPONSIBILITY FOR ENSURING MEDICAL EXAMINATION AND TREATMENT FOR OFFICERS' RELATIVES WHILE ON ACTIVE DUTY
Article 9.
The annual health insurance contribution rate for individuals falling under Clause 1, Article 2 of this Decree is 3% of the minimum wage as prescribed by the Government.
Article 10.
Officers' relatives receiving medical examination and treatment benefits under this Decree shall have their expenses reimbursed according to current laws on health insurance.
Article 11.
1. Annually, the Ministry of National Defense is responsible for preparing the budget to purchase health insurance and issue health insurance cards for officers' relatives while on active duty in accordance with the law.
2. Local military agencies at the district level and above are responsible for coordinating with local health insurance agencies to monitor, inspect, and resolve issues related to the issuance of health insurance cards, registration of healthcare facilities, and implementation of medical examination and treatment for officers' relatives within their jurisdiction.
Article 12. The annual funding for purchasing health insurance for officers' relatives while on active duty is allocated in the Ministry of National Defense's budget according to the law.
The Ministry of National Defense is responsible for managing and using the budget for purchasing health insurance cards for officers' relatives while on active duty in accordance with the law.
The Ministry of Finance is responsible for ensuring timely and adequate funding from the state budget for this activity in accordance with the law.
Article 13.
The Ministry of Labor, Invalids, and Social Affairs is responsible for directing the social security agency to implement health insurance benefits for officers' relatives in accordance with the law on health insurance.
The Ministry of Health is responsible for directing the implementation of medical examination and treatment for officers' relatives at both public and non-public healthcare facilities.
Article 14.
Officers' relatives receiving medical examination and treatment at registered healthcare facilities enjoy all rights and are responsible for complying with the laws on health insurance.
Chapter 4:
IMPLEMENTING PROVISIONS
Article 15.
This Decree shall take effect fifteen days from the date of signature.
Article 16.
1. The medical examination and treatment benefits for officers' relatives stipulated in this Decree will be revoked if fraudulent documents are discovered.
2. Any entity, organization, unit, or individual violating the provisions of this Decree will be subject to disciplinary action, administrative penalties, reimbursement of medical examination and treatment costs, or criminal liability depending on the nature and severity of the violation.
Article 17.
The Minister of National Defense, in coordination with the Ministers of Health, Finance, Labor, Invalids, and Social Affairs, shall guide the implementation of this Decree.
Article 18.
The Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, and Chairpersons of provincial and municipal People's Committees directly under the central government are responsible for enforcing this Decree.
