DECISION OF THE MINISTER OF FINANCE
Regarding the issuance of Accounting Regulations for Securities Investment Funds
THE MINISTER OF FINANCE
Pursuant to the Accounting Law No. 03/2003/QH11 dated June 17, 2003, and the Government Decree No. 129/2004/NĐ-CP dated May 31, 2004 detailing and guiding the implementation of certain provisions of the Accounting Law in business operations;
Pursuant to the Government Decree No. 77/2003/NĐ-CP dated July 1, 2003 stipulating the functions, tasks, authorities, and organizational structure of the Ministry of Finance;
Pursuant to the Government Decree No. 144/2003/NĐ-CP dated November 28, 2003 on Securities and the Securities Market;
At the proposal of the Director of the Accounting System and Audit Department, the Chairman of the State Securities Commission, and the Head of the Ministry of Finance's Office,
DECISION:
Article 1. Issuing the "Accounting Regulations for Securities Investment Funds" applicable to the accounting work of Securities Investment Funds. The Accounting Regulations for Securities Investment Funds consist of four parts:
Part One: Accounting Documents System;
Part Two: Accounting Account System;
Part Three: Accounting Books System and Forms of Accounting Application;
Part Four: Financial Reporting System.
Article 2. The Accounting Regulations for Securities Investment Funds issued pursuant to this Decision shall apply to all Securities Investment Funds nationwide and replace the Accounting Regulations for Securities Investment Funds approved by Circular No. 2913/TC-CĐKT dated November 8, 2004 of the Ministry of Finance.
Securities Investment Fund Management Companies shall close their accounting books for each Securities Investment Fund at the end of December 31, 2005 to transfer the balances of old accounting accounts to new accounting accounts from January 1, 2006 according to the Accounting Regulations issued under this Decision. Other accounting regulations not specified in this Decision shall be implemented in accordance with the Accounting Law and the Government Decree No. 129/2004/NĐ-CP dated May 31, 2004 detailing and guiding the implementation of certain provisions of the Accounting Law in business operations.
Article 3. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.
Article 4. The General Directors of Securities Investment Fund Management Companies are responsible for directing and organizing the implementation of separate accounting work for each fund managed by the Company in accordance with the provisions of this Decision and the Accounting Law and the Government Decree No. 129/2004/NĐ-CP.
The Management Company of the Fund must ensure that the accounting work of the Securities Investment Fund is separated from the accounting work of the Management Company itself.
Article 5. The Director of the Accounting System and Audit Department, the Chairman of the State Securities Commission, the Head of the Ministry of Finance's Office, the Director of the Financial Banking Department, financial organizations, and heads of related units are responsible for guiding and inspecting the implementation of this Decision./.
